2 S.I.OF 2012 ANIMAL AND PLANT BIOSECURITY ACT, 2012 Animal and Plant Biosecurity (Plant) Regulations, 2012 In exercise of the powers conferred by section 146 of the Animal and Plant Biosecurity Act, 2012, the Minister for Investment, Natural Resources and Industry makes the following Regulations 1. These Regulations may be cited as the Animal and Plant Biosecurity (Plant) Regulations, In these Regulations Citation Interpretation agency responsible for biosecurity means the agency designated as such under section 10 of the Act; Chief Plant Protection Officer means a person appointed as such under section 23(1)(a) of the Act; international reporting requirements means the obligations of the national plant protection organisation to report on the status of pests and diseases to competent international authorities and national authorities of trading partners under the provisions (a) for transparency in the Agreement on the Application of Sanitary and Phytosanitary Measures; (b) of the International Plant Protection Convention; and (c) of other international and regional agreements and treaties to which Seychelles is signatory; IPPC means the International Plant Protection Convention; national plant protection organisation means - Page: - 2 -

3 (a) in relation to Seychelles, the entity designated as such under regulation 3; (b) in relation to any country other than Seychelles, the competent authority in that country responsible for issuing any phytosanitary certificate or other authorization for the export of any plant, plant material or plant product, or for specifying the requirements for such materials to be imported into that country. 3. For the purposes the fulfillment of Seychelles obligations under any international and regional agreements and treaties to which it is signatory and in particular the IPPC, the agency responsible for plant health and life is the national plant protection organisation for Seychelles. 4. The Chief Plant Protection Officer is the official contact point for the purposes of the fulfillment of Seychelles obligations under the IPPC. 5. (1) For the fulfillment of Seychelles obligations under any international and regional agreements and treaties, the national plant protection organisation for Seychelles must comply with all International Reporting Requirements under these agreements and treaties in accordance with this regulation. National Plant Protection Organisation Chief Plant Protection Officer to be official contact point International Reporting Requirements (2) Pursuant to Seychelles obligations under the IPPC, the national plant protection organisation of Seychelles must provide the following information to the IPPC Secretariat and other contracting parties to the IPPC (a) (b) (c) the contact point for Seychelles for the exchange of information connected with the implementation of the IPPC; official pest reports on plant pests in particular on the occurrence, outbreak or spread of pests that may be of immediate or potential danger; a description of the national plant protection organisation of Seychelles and changes in such organization; Page: - 3 -

4 (d) legislation in Seychelles establishing phytosanitary requirements, restrictions and prohibitions; (e) (f) (g) points of entry in Seychelles through which particular plants or plant products are required to be imported; a list of regulated pests; and emergency actions taken on the detection of a pest posing a potential threat to Seychelles or the report of such a detection. (3) The national plant protection organisation of Seychelles may, on request, provide information on the following (a) (b) (c) (d) any significant instances of non-compliance with phytosanitary certification; a description of its organizational arrangements for plant protection; pest status; the rationale for phytosanitary requirements, restrictions and prohibitions adopted by Seychelles. 6.
