1 USGBC TRADEMARK POLICY (Previously entitled "USGBC Logo Guidelines") Last Updated: September 16, 2010

2 WHY ARE TRADEMARK POLICIES IMPORTANT? The USGBC Trademark Policy is designed to give guidance on the authorized use and depiction of USGBC trademarks and service marks by our members. This document highlights common uses and misuses of USGBC marks and language. Through consistent application of these guidelines and repetition of these messages, USGBC s image and credibility will be reinforced, there by increasing the value of USGBC, its products, and its services and enhancing your standing as a proponent of buildings and communities that are responsible, healthy, and prosperous places to live and work. These guidelines are not all-inclusive. If you have questions regarding logo use and language, please contact the USGBC Marketing Department: marketing@usgbc.org APPLYING GUIDELINES USGBC expects all users of its trademarks and service marks to adhere to these guidelines. If you have questions regarding the appropriate use of USGBC trademarks or service marks, please contact the USGBC Marketing Department. USE OF USGBC PROPRIETARY MARKS The following terms and conditions govern the use of ALL proprietary marks owned by the U.S. Green Building Council (referenced below as "a mark" or "the mark"): USGBC will provide logo artwork files. Only artwork files provided by USGBC may be used. Images captured from Web sites, publications, and other sources may not be used. All uses must include the appropriate trademark symbol. The appropriate symbol will be part of the artwork provided by USGBC. Below are general rules regarding these symbols. Use of a mark that has been officially registered must be followed by the registration symbol "." Use of a mark owned but which has not yet been registered by USGBC must be followed by the trademark symbol " TM." These symbols are necessary for the first and most prominent appearance of the mark; they do not need to appear after every use of the mark within a single publication. If use on short promotional materials is permitted, the symbol should appear at least once. If the material is longer, the symbol should be repeated in each section. If Web site use is permitted, the symbol should be used with the first and most prominent use on each page within the Web site. The mark must be accompanied by an acknowledgement of USGBC ownership. This acknowledgement should appear as a footnote with the user s copyright notice, at the end of a printed document, or at the bottom of a webpage. For example, use of the LEED Logo must be accompanied by the statement: "LEED and the related logo is a trademark owned by the U.S. Green Building Council and is used with permission." Page 2

3 The mark may be used only to refer to the USGBC program or USGBC products. The mark (or any word or design that is confusingly similar to the mark) may not be used as part of a company s name, logo, domain name, or brand name for a product or service. The mark may not be the most prominent visual element on the materials. The user s name and logo must be significantly larger than the mark. (This does not apply to use of the USGBC Chapter logo by Chapters.) The mark may not be used on any type of product packaging under any circumstances. The mark may not be used to indicate any kind of endorsement by USGBC of any product or service, to indicate that any official status for any product or service has been conferred by or is otherwise associated with USGBC, or to show any kind of relationship with USGBC aside from those permitted by the terms and conditions specified for each proprietary mark. The mark may not be used on official documents provided to potential or actual clients that include any sales contracts or official disclosure documents provided to potential or actual clients of purchases of an organization s services or products. The mark may not be used in connection with any disparaging statements about USGBC or its products, or statements that otherwise reflect poorly on USGBC. The mark may not be altered in any way, including proportion, color (outside of logo specifications), element, type, etc. It may not be animated, morphed, or distorted in any other way. The mark, including its associated words, may not have additional text wrapped around it. See page 5 for examples of unacceptable uses. The mark may not be reduced to more than 20% of its original print size and may not be enlarged to more than 380% of its original print size. Original print size is set in the EPS file. On Web pages, the mark may not be reduced to less than a 50-pixel height, and may not be enlarged to more than a 200-pixel height. The height and width of the mark must be constrained to its original proportions. The mark is intended to stand alone and should not be integrated into other logos. For printing purposes, the mark supplied by USGBC only should be used in EPS or high-resolution JPEG file format. In instances where the mark is printed at a larger size, an EPS file must be used to ensure that the image retains clarity. Lower-resolution, Web-optimized JPEG or GIF files should be used when placing the mark on Web sites. USGBC reserves the right to approve or disapprove the use of any USGBC proprietary mark on non-usgbc printed materials or Web sites. ANY UNAUTHORIZED USE OF A USGBC PROPRIETARY MARK MAY RESULT IN LEGAL ACTION. Page 3

6 USGBC IN TEXT The official organization name is the U.S. Green Building Council. "USGBC" is the official acronym. Use the complete name on any first reference. Subsequent references in copy may use USGBC. Acceptable U.S. Green Building Council USGBC NOTE: When using "USGBC" as a noun, do not precede with "the." For example, "the USGBC offers LEED certification" should be changed to "USGBC offers..." When using USGBC as an adjective, however, articles such as "the" or "a" may be used as appropriate. 7 USGBC LOGO The USGBC Logo is a powerful marketing tool and a valuable asset of the USGBC community. Use of the USGBC Logo is governed by federal law. USGBC requires strict adherence to these guidelines. 8 USGBC CHAPTERS IN TEXT Chapters should be identified as USGBC Chapters in all communications including but not limited to written, electronic, and verbal communications. If a chapter has a unique chapter name (other than a geographical description), affiliation with USGBC must be represented in the communication. For example, "USGBC Arizona, a chapter of the U.S. Green Building Council" or "Urban Green, the New York chapter of USGBC." USGBC CHAPTER LOGO The USGBC Chapter Logo is meant to be used as a stand-alone logo to represent an approved chapter's affiliation with the USGBC community. It identifies an entity as a fully chartered chapter of USGBC. The Chapter logo, in conjunction with the approved chapter name, creates the unique identifier for each chapter. If a chapter has an additonal, unique name and/or logo used to denote the chapter in the marketplace, the USGBC Chapter logo must appear as the primary and foremost logo in any graphical representation of that chapter. All USGBC Chapter logos should be created in accordance with the USGBC Chapter Design Template shared with chapters when creating their identity. Design Guidelines for Using the Chapter Logo 1. The USGBC Chapter logo should look clean (i.e. ample white space for visibility). 2. The chapter s name should appear to the side of the Chapterw logo or neatly stacked underneath. 3. A sans serif font is required (e.g. Trade Gothic, Arial, Interstate). 4. Use of the Chapter logo in gray (60% black or Pantone 424U) is recommended. 5. Chapter name can appear in color chosen by chapter for consistency with other marketing materials. 6. Incorporation of geographic-related graphical indicator is acceptable (see example on following page). 7. All other requirements or stipulations of USGBC proprietary marks apply to Chapter logo use. Only recognized provisional and full chapters may use the Chapter logo. The logo must always be used in conjunction with the name of the chapter for all marketing and communications efforts, including but not limited to Web presence, e-communications, print collateral, print & electronic advertising, publicity, news items, tradeshow exhibit materials and fundraising literature. Chapters are encouraged to seek USGBC national review and input prior to committing significant resources to design development and production. Placement Web The Chapter logo should be present in a prominent and noticeable position on the main landing page of the standard usage (black) chapter's Web site to identify the organization as an official USGBC chapter. The Chapter logo, along with the descriptive Chapter name text, should be oriented near the top, or otherwise primary location of the Web page for immediate recognition of the Chapter's affiliation with USGBC. The logo may not be used to link to other pages on Web sites belonging to the chapter or any other third party. Placement e-communications The Chapter logo should be placed in a prominent and noticeable position on any recurring e-communications sent. The Chapter logo, along with the descriptive chapter name text, should be oriented near the top, or an otherwise primary location of the e-communication for immediate recognition of the Chapter's affiliation with USGBC. 10 USGBC STUDENTS LOGO The USGBC Students Logo is meant to be used as a stand-alone logo to represent an approved student group's affiliation with USGBC. The students logo, in conjunction with the college or university name, creates the unique identifier for each group. If a student group has an additonal, unique name and/or logo used to denote the student group in the marketplace, the USGBC Students Logo should appear as the primary and foremost logo in any graphical representation of that group. All USGBC Students logos should be created in accordance with the design examples below that are shared with groups when creating their identities. In addition, USGBC Student Groups should obtain permission rights to use the name of the college/university. Terms of Use Use of the USGBC Students logo is authorized by permission of the USGBC Students Group Manager. Should a conflict occur between college/university trademark policies and USGBC trademark policies, contact: studentgroups@usgbc.org Default Use The logo may be used in its default colors, customized collegiate colors, gray or reverse in white only (no color). When printing in B&W, either the Pantone color PMS 424U or 60% black may be used. 11 Design Guidelines for USGBC Students Logo Identity 1. The USGBC Students Logo should look clean (i.e., ample white space for visibility). 2. The logo colors can be manipulated to match collegiate colors for consistency with other marketing materials. 3. The groups's name should appear neatly beneath (or above) the logo with a 0.25" margin. 4. A sans serif font is preferred (e.g., Trade Gothic, Arial, Interstate). 5. If printing in B&W, use of the logo in gray (60% black or Pantone 424) is recommended. 6. 12 USGBC MEMBER LOGO The USGBC Member Logo is available for use by members with active standing to promote their membership with USGBC. Members may download the logo from their user account on the USGBC Web site or obtain the mark by contacting the USGBC Membership Department: The Member Logo is distinguished from the USGBC Logo by the replacement of USGBC at the bottom of the mark's circular band with Member. Use USGBC Members Only USGBC member organizations in good standing may use the logo. The privilege to use the Member Logo is immediately terminated upon the lapse or termination of an organization s membership. The USGBC Member logo may be used in connection with the member s business and marketing materials including, but not limited to: stationery, letterhead, business cards, print ads, brochures, flyers, tradeshow exhibit materials, and signage. The logo may be placed on the member s Web site as a link to and to identify the company as a USGBC member. 13 MEMBER LOGO ON PRODUCT PACKAGING USGBC does not review, certify, or endorse products. As such, the Member Logo may not be used to indicate any kind of endorsement by USGBC of any product or service, to indicate that any official status for any product or service has been conferred by, or is otherwise associated with USGBC, or to show any kind of relationship with USGBC other than to signify the company is a USGBC member. New Product Packaging Policy for 2010 The Member Logo may NOT be placed on product packaging under any circumstances. Product packaging that was previously approved with USGBC Member Logo placement can remain and continue to be used until the originally printed packaging inventory is depleted. 14 LEED LOGO The LEED Logo is a powerful marketing tool and a valuable asset of the USGBC community. Use of the LEED Logo is governed by strict legal guidelines designed to safeguard USGBC s rights to this valuable mark. USGBC requires strict adherence to these guidelines. This logo combines the USGBC Logo with a distinctive banner with the word LEED across its face. Use Use of the LEED Logo is authorized by the USGBC Marketing Department on a case-by-case basis and only upon written request. 15 LEED CERTIFICATION MARK The LEED Certification Mark combines the LEED Logo with a distinctive banner that designates a level of LEED certification across its face. Once a project has been certified, the LEED Certification Mark appropriate to the level of certification (see below: Platinum, Gold, Silver, Certified) may be used in collateral and other marketing materials to promote the associated LEED project. Use LEED Certified Projects Use of the LEED Certification Mark is authorized by the USGBC LEED Department only after a project is LEED certified. Contact: leed@usgbc.org Use of the LEED Certification Mark on anything other than promoting a LEED-certified project is prohibited. The mark may be used on business and marketing materials associated with a particular LEED-certified project. Additional uses must be approved by the USGBC Marketing Department. Contact: marketing@usgbc.org The mark may be printed in black, gray, any uniform color, and reverse in white. When printing in gray, either the Pantone color PMS 424U or 60% black can be used. The mark may appear embossed, with a slight gradient, or with other lighting or shadow effects to add dimension to the graphic. The logo may only appear in reverse white on a dark background. NOTE: USGBC only provides the mark in black. Literature in which the LEED Certification Mark appears must contain the following acknowledgement: " The 'LEED Certification Mark' is a registered trademark owned by the U.S. Green Building Council and is used with permission." 16 LEED IN TEXT LEED an acronym for the phrase Leadership in Energy and Environmental Design is a registered trademark of the U.S. Green Building Council. While it is acceptable to use the full phrase in communications, the registered LEED acronym has become the primary source identifier for USGBC s green building certification programs and will likely create more of an impression on recipients of such communications than the full phrase. "LEED " with the registered trademark superscript is only necessary for the first use in a short document, or the first use in each section of a longer document. Following the first mention, use "LEED." When a project achieves certification it should be referred to as a LEED-certified project (not: LEED for New Construction certified or LEED for Commercial Interiors v2.0 certified). If appropriate, supporting text may be written that gives additional detail about the specific rating system under which the project was certified. "LEED certification" with lowercase "c" is used to describe the certification process. "LEED certified" with lowercase "c" is used to describe a project that has been certified. "LEED Certified" with capital "C" (and no hyphen) is used to describe a project that has been certified to the base level: Certified. When a project is certified, the correct wording is "project A is LEED Silver" or "project A is LEED certified to the Silver level" or "project A is LEED Silver certified." Due to repetition, the wording "project A is LEED Certified certified" is not recommended. "Certified" to reference both certification and level is sufficient. "LEED green building certification program" is used for the first mention of the full title. If the LEED acronym is also being used for the first time, then the is used. Describing LEED "The LEED green building certification program is the nationally accepted benchmark for the design, construction, and operation of green buildings." 17 LEED Rating Systems When referring to the entire suite of LEED rating systems, use the phrase "LEED green building certification program." Individually, each rating system can be referred to with the lowercase phrase "rating system" (i.e., "LEED for New Construction rating system"). The complete and official names of the LEED 2009 rating systems are: LEED for New Construction & Major Renovations (acceptable: LEED for New Construction) LEED for Core & Shell LEED for Commercial Interiors LEED for Existing Buildings: Operations & Maintenance LEED for Schools LEED for Homes LEED for Retail: New Construction LEED for Retail: Commercial Interiors LEED for Neighborhood Development Rating system names should not be abbreviated on second reference (i.e., LEED-NC). However, on second reference, LEED for Existing Buildings: Operations & Maintenance in particular, may be referred to as LEED for Existing Buildings: O&M. LEED Credit Categories The four LEED rating systems that address green building design and construction LEED for New Construction, LEED for Core & Shell, LEED for Schools, and LEED for Retail: New Construction as well as the two interior design and construction rating systems LEED for Commercial Interiors and LEED for Retail: Commercial Interiors have six credit categories, which are named as follows: Sustainable Sites (SS) Water Efficiency (WE) Energy & Atmosphere (EA) Materials & Resources (MR) Indoor Environmental Quality (IEQ) Innovation in Design (ID) LEED for Existing Buildings: Operations & Maintenance has six credit categories, which are named as follows: Sustainable Sites (SS) Water Efficiency (WE) Energy & Atmosphere (EA) Materials & Resources (MR) Indoor Environmental Quality (IEQ) Innovation in Operations (IO) *continued on Page 18 Page 17

18 LEED for Homes has eight credit categories, which are named as follows: Location & Linkages (LL) Sustainable Sites (SS) Water Efficiency (WE) Energy & Atmosphere (EA) Materials & Resources (MR) Indoor Environmental Quality (IEQ) Awareness & Education (AE) Innovation in Design (ID) LEED for Neighborhood Development has four credit categories, which are named as follows: Smart Location & Linkage (SLL) Neighborhood Pattern & Design (NPD) Green Infrastructure & Buildings (GIB) Innovation & Design Process (IDP) LEED Professional Credentials The LEED Professional Credentials (LEED AP and LEED Green Associate ) are owned by USGBC and administered by the Green Building Certification Institute (GBCI ). The phrase LEED Professional Credentials refers to the LEED AP credential, all LEED AP specialty credentials, and the LEED Green Associate credential. LEED Professionals refers to any LEED Professional Credential holder. LEED Professional Credentials are earned through passing a LEED Professional Exam. The correct way to refer to LEED Professional Credentials: LEED Green Associate (not LEED GA) LEED AP (not LEED Accredited Professional) LEEP AP with specialty LEED AP without specialty LEED AP Building Design + Construction or LEED AP BD+C LEED AP Interior Design + Construction or LEED AP ID+C LEED AP Operations + Maintenance or LEED AP O+M LEED AP Homes (not LEED AP H) LEED AP Neighborhood Development or LEED AP ND *continued on page 19 Page 18

19 Note that while USGBC typically uses the ampersand (&) in names of rating systems and other programs, GBCI uses the plus sign (+) in the names of its credentials. Also, it's important to note that the LEED AP with specialty credentials reference a professional's knowledge of and expertise in a grouping of LEED rating systems based on building type and/or lifecycle phase, not individual rating systems. For example, it would be inappropriate to refer to "the BD+C rating system" rather, LEED for New Construction, LEED for Core & Shell, LEED for Schools, and LEED for Retail: New Construction are all rating systems encompassed by the Building Design + Construction credential grouping. These groupings are used both by GBCI for purposes of the LEED Professional Credentials and also by USGBC for purposes of naming the LEED reference guides, though the reference guides use the word "and" as opposed to the plus sign. 20 REFERENCING LEED IN PRODUCT LITERATURE The LEED green building certification program does not certify individual products. Manufacturers may reference LEED in their product literature providing that the language neither states nor implies endorsement by USGBC or the LEED program. Furthermore, the language must clearly acknowledge that LEED credit requirements cover the performance of materials, not the performance of individual products or brands. Therefore, products that meet the LEED performance criteria can only contribute toward earning points needed for LEED certification; they cannot be said to earn points toward LEED certification on their own. Acceptable "Product A contributes toward satisfying Credit X under LEED." "Product A complies with X requirements of Credit X under LEED." NOTE: Short statements claiming that a product meets certain LEED performance criteria may be used if the statement does not suggest endorsement by USGBC or product certification and the following statement is included in connection with the claim: Products are not reviewed or certified under LEED. LEED credit requirements cover the performance of materials in aggregate, not the performance of individual products or brands. 21 REFERENCING LEED REGISTERED PROJECTS "LEED registered-project" is the approved language to be used only in the event that the project is officially registered with LEED (to verify a project's status as registered, contact A project that is registered may also be referred to as "LEED -registered," a "LEED candidate project," or a "LEED certification candidate." USGBC does not have a LEED Registered Logo. Use of the LEED Logo to reference or indicate a LEED-registered project is prohibited. However, permission may be obtained from the USGBC Marketing Department to use the LEED Logo to reference the LEED green building certification program in general. In this case, the LEED Logo may be placed on signage that states "This project is registered under the LEED green building certification program." 22 LEED FOR HOMES LOGO The LEED for Homes Logo is a mark developed for project team members to signify newly constructed homes (or major rehab projects) that are being designed and built with the intention of being certified under the LEED for Homes green building rating system. Use Use of the LEED for Homes Logo is authorized by USGBC Residential Market Development staff. The LEED for Homes Logo may be used only by project team members to promote a registered project that is actively seeking LEED certification under the LEED for Homes program. Contact: homes@usgbc.org The logo may be printed in its default color, another color with gray type, its default color in grayscale (for no color printing), and reverse in white on a dark background. The default color is green (Pantone color PMS 390U) with gray type (Pantone color PMS Warm Gray 9 U). The logo can also be other colors as long as type remains gray on a light background. Reverse white must be used when the logo is applied to a dark background. From left to right: logo with default colors, logo in grayscale, logo reverse white on a dark background. There are 3 primary ways that the LEED for Homes Logo may be used: 1. The logo may be used on on-site signage and marketing materials specific to a LEED for Homes registered project that is actively seeking LEED certification. The mark must be positioned near/adjacent to text that provides context for use. Examples of acceptable text: Project "registered under LEED for Homes " Project "[designed/built] to qualify for LEED certification" "LEED for Homes project under construction" Page 22

23 2. The logo may be used on marketing and collateral materials by builders to signify their commitment to building LEED-certified homes. In this context, the mark must be positioned near/adjacent to text that describes the builder's commitment to the program. Accepted: "committed to building LEED -certified homes" "has XX units registered with the LEED for Homes green building rating system" Prohibited: "Builder of LEED homes" "LEED for Homes builder" 3. The logo may be used on marketing and collateral materials by licensed LEED for Homes Providers and their associated LEED for Homes Green Raters. The logo must be used in context with referencing the LEED for Homes certification program, and not used to identify a LEED for Homes Provider. To avoid confusion, the logo must be placed near/adjacent to text referencing the program. Accepted: "providing LEED for Homes verification support services to builders" "verifying that homes are built to meet the requirements of LEED for Homes " or "the LEED for Homes green building rating system" Prohibited: "LEED for Homes Provider" as the only text placed near/adjacent to the logo. Logo placement in this context risks creating the perception that the LEED for Homes logo is a certification for Providers. Following the above terms, the logo may be placed on a project team member or Provider's Web site as a link to USGBC's Green Home Guide: LEED for Homes Web page: http: It may not be used to link to other pages on the Web site or to link to any other third party Web sites. Additional Usage Terms The logo may not be used or associated with homes or developments that are not seeking LEED certification, or have not registered with the LEED for Homes certification program. After a registered project is completed and has been certified, the project team must cease using the LEED for Homes logo in association with the newly certified project and begin using the appropriate LEED Certification Mark. 24 The logo may not be used in any way that creates the perception that an individual or organization is an official builder, contractor, designer, etc. of LEED homes. Literature in which this logo appears must contain the following acknowledgement: "The 'LEED for Homes Logo' is a registered trademark owned by the U.S. Green Building Council and is used with permission. The logo signifies only that [COMPANY NAME] is actively participating in USGBC 's LEED for Homes certification program; USGBC does not guarantee the products or services offered by its participants." 25 LEED FOR HOMES AFFILIATE LOGO The LEED for Homes Affiliate Logo is a brand extension of the LEED for Homes brand. It was developed to allow authorized home builders' associations, building industry associations, and green residential programs to communicate alignment of their green residential efforts with those of USGBC. Use Use of the LEED for Homes Affiliate Logo is authorized by USGBC Residential Market Development staff. The LEED for Homes Affiliate Logo may only be used by organizations with which USGBC has a formal binding agreement that specifically permits its usage pursuant to the guidelines herein.
