1 Vive Sion Gala Auction Car Raffle Rules sponsored by Notre Dame de Sion School Please read these Official Rules before entering the Vive Sion Gala Auction Car Raffle at Notre Dame de Sion (Sion). By purchasing a ticket you represent that you meet all of the stated requirements and agree to be bound by these Official Rules and by the decisions of Sion (the Sponsor), a 501(c)(3) nonprofit corporation under the laws of the State of Missouri. THE RAFFLE: Purchase one or more raffle tickets during the Vive Sion Gala Auction Car Raffle and you will be entered to win a car from Molle Toyota. The Vive Sion Gala Auction Car Raffle (Raffle) is conducted for the purpose of generating operating funds for Sion. Raffle tickets are $25 each (or $20 each if you purchase 5 tickets or more at the same time). Ticket purchases are not tax deductible. The winner is based on a random drawing. RAFFLE PERIOD: The Raffle begins November 30 th at 12:01am CST and continues until Saturday, March 4, 2017 at 9:00pm CST. Sion reserves the right to shorten or extend the Raffle Period. RAFFLE ENTRY: All entries must be accompanied with a cash, check, or credit card to the Notre Dame de Sion School. One entry per $25.00 donation (or 5 entries per $100.00). No photocopied or mechanically reproduced entries will be accepted. Each entry of $25.00 (check, cash, credit card or money order) must be mailed or returned to Notre Dame de Sion School to be valid. Checks must be made out to: Notre Dame de Sion School, and mailed to Notre Dame de Sion School, Advancement Office Attn: Bridget Rutledge, Wornall Road, Kansas City, MO Entries and donations received after the Raffle Period will not be eligible and will be returned to the sender if a valid return address is included with the entry. One winner will be selected by random drawing from among all entries received on Saturday, March 4, 2017 around 9:30pm CST. The Sponsor and any related entities are not liable for any lost, late, misdirected, incomplete, illegible, undelivered or destroyed tickets regardless of cause or person responsible, including any problem or technical malfunction of any computer, online system, server or the Internet. Entries received that are mutilated, tampered with, illegible, from ineligible entrants do not contain a 1

2 minimum of $25.00 or are incomplete will be void. All entries become the property of Sion and will not be returned. All entries subject to verification by Sion, whose decisions on all matters related to this drawing are final and binding. Incomplete entries will be disqualified. There are five ways to enter. 1. Go to and complete the online entry form and pay entry fee with your credit card. (Online entry begins at 12:01a.m. m on January 1, 2017 and ends at Noon on Friday, March 3, 2017.) 2. Call Notre Dame de Sion School at (816) extension 1184 during regular business hours, M-F. Provide your entry information (name, address, telephone, ) over the phone along with credit card information. (Phone entry begins at 12:01 a.m. on January 1, 2017 and ends at Noon on Friday, March 3, 2017.) 3. Mail completed entry form to Notre Dame de Sion School, Wornall Road, Kansas City, MO with your payment for $25 per ticket or $20 per ticket if purchasing 5 tickets or more at the same time. Entry forms may be obtained by students, faculty, and staff at the Notre Dame de Sion School or by downloading and printing the Notre Dame de Sion School Car Raffle Entry Form at (Mailed entries must be received by Notre Dame de Sion School no later than noon on March 3, 2017.) 4. Fill out an entry form and give to any employee or student at Notre Dame de Sion School. (Entries must be received by Notre Dame de Sion School no later than 9:00pm on March 3, 2017.) 5. BidPal. (Entries must be received by Notre Dame de Sion School no later than 9:00pm on March 6, 2017.) ELIGIBILITY: The Raffle is only open to legal residents of the 50 states and District of Columbia, who are 18 years of age or older as of the date of purchase. Immediate family members residing with Sion students and employees may participate. Contest void where prohibited. GRAND PRIZE: One Grand Prize winner will be randomly selected. The Grand Prize winner will receive a 2017 Toyota Corolla Sport 50 th Anniversary Special Edition. The approximate value of the grand prize is $22, (Costs of transportation, insurance, licenses, fees (including registration), taxes, and any other expenses are the sole responsibility of the winner.) Molle Toyota will select Grand Prize vehicle exchanges for the price of the vehicle by Molle Toyota to purchase a vehicle at a greater value may be made by winner. Winner of vehicle cannot redeem for cash or receive any rebates from Molle Toyota. Vehicle displayed is the winning vehicle. The winner must personally retrieve the vehicle and present acceptable personal identification, a valid driver s license 2

3 and evidence of any legally required insurance. The actual vehicle may have acquired a limited number of miles due to transportation of the vehicle. Delivery of the Grand Prize vehicle will occur on or around March 9, 2015 at Molle Toyota West 103 rd Street, Kansas City, MO (date and location subject to change). WINNER NOTIFICATIONS: Finalists will be notified by phone, in-person or . An alternate finalist(s) will be selected and contacted if a finalist cannot be positively contacted by phone or within 24 hours of the drawing or a finalist is disqualified. Winners must have valid contact information where they can be notified, or Sponsors reserve the right to award the prize to another winner. GRAND PRIZE ACCEPTANCE AND RESTRICTIONS: Winner is subject to verification by Sion and must provide Sion with valid identification (including winner s name, age, address, phone number and a valid taxpayer identification number or Social Security number). The winner will be required to sign an Affidavit of Eligibility and Release of Liability and Publicity within 24 hours (one day) of notification without further compensation. Failure to do so will disqualify the winner and the prize will be awarded to an alternate finalist. If a winner is disqualified, Sion reserves the right to determine an alternate winner or to not award that winner s prize at all. Prizes cannot be redeemed for cash. Prizes are non-assignable and non-transferrable. Sion may substitute a comparable prize of like or greater value, excluding cash, for any prize, for any reason. Winner of vehicle cannot redeem for cash or receive any rebates from Molle Toyota. PUBLICITY RELEASE: Each entrant acknowledges that entry in the Raffle constitutes that entrant s consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television, or offline promotions), the winner s name, voice, likeness, and any portion thereof, without time or geographic limit without further compensation, credit or right of review or approval, except where prohibited by law. TELEPHONE AND DELIVERY DISCLAIMER: Sion disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond Sion s control, or otherwise. Sion disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Sion is not responsible for mechanical, technical, computer, hardware or software errors, malfunctions, or failures of any kind, including failed, incomplete, garbled, or delayed transmission of entries, traffic congestion on telephone lines, the 3

4 Internet or at any website or lost or unavailable network connections, which may limit an entrant s ability to participate in the Raffle, and any injury or damage to entrant s or any other person s computer related to or resulting from participating in or downloading any information necessary to participate in the Raffle. Sion reserves the right to cancel the Raffle if it becomes technically corrupted. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS RAFFLE, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY ANY SUCH INDIVIDUAL FROM PARTICIPATION IN THE RAFFLE OR ANY OTHER RAFFLE. TAXES: Any valuation of the prize(s) stated above is based on available information provided to Sion, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state, and local taxes, are the sole responsibility of the winner. Winner will receive a 1099 form from Molle Toyota at the end of the calendar year and a copy of such form should be filed with the IRS. Conditions: Sion may, in its sole discretion, modify this Raffle or any portion hereof, or disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, interruption in wireless calling devices or wireless service, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in Sion s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Raffle, (b) the Raffle or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Rules, (c) the Raffle becomes corrupted due to wireless calling service interruption for any reason, or (d) the Raffle is otherwise not capable of running as planned. By entering, entrants represent that they are eligible and agree to be bound by and comply with the Rules and the decisions of any judges. Any entrant who attempts to tamper with this Raffle in any way or use fraudulent means to participate in and/or win the Raffle shall be disqualified. Sion may disqualify any entrant at any time, for any reason, including, without limitation, language, activities or behavior deemed inappropriate. Sion (and its agents) are not responsible for cancellations, postponements, or delays. Other than the prizes received by the winner, no entrant shall be entitled to receive any wages, benefits, fees or other compensation whatsoever by participating in the Raffle. Sion has the sole discretion to administer the Raffle and interpret and apply the Official Rules. 4

5 INDEMNIFICATION AND HOLD HARMLESS: Entrants agree: (a) to the Official Rules and decisions of Sion which shall be final in all respects; (b) to release, discharge, and hold harmless Sion and Molle Toyota and their respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents (the Released Parties ) from all liability, injuries, losses or damages of any kind to persons, including but not limited to death or property damage resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of a prize, or from participation in and/or entry into the Raffle or any Raffle-related activity and for acceptance, delivery, or use of any prize; (c) that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. In consideration for his or her participation in the Raffle, each entrant agrees to hold harmless and indemnify the Released Parties from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the entrant s participation in the Raffle, including attorneys fees. Harm, injury or damage includes but is not limited to occurrences beyond the control of Sion such as death, bodily injury, property damage, or theft, or for failure of any automobile manufacturer s or dealership s warranties. LIMITATIONS OF LIABILITY: The Released Parties are not responsible or liable for any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the Raffle or in the announcement of the prize(s) and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (ii) failure of any entry to be received by Sion due to technical problems, telephone service problems, human error, or wireless calling service, (iii) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (iv) damage to any computer (software or hardware) resulting from participation in the Raffle, or damage to mobile phone or other PDA device, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof). Any expenses incurred by the entrant during the application process, including but not limited to, postage are the sole responsibility of each entrant and Sion will not issue reimbursement for any expenses. UNDER NO CIRCUMSTANCES SHALL THE RELEASED PARTIES BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY 5

6 DAMAGES, ATTORNEYS FEES, OR ANY OTHER DAMAGES. CHOICE OF LAW AND FORUM: All entrants agree, by participation in the Raffle, to submit to the personal jurisdiction of the courts of Missouri. Missouri law shall govern this Raffle, without regard Missouri s choice of law rules. The courts of Missouri shall be the exclusive forum for any dispute regarding any Rule or activity associated with the Raffle. OFFICIAL RULES: Complete contest rules are available Monday through Friday during normal business hours at Notre Dame de Sion School, Wornall Road, Kansas City, MO or at NAMES OF WINNERS: For a list of prize winners, send a separate, self-addressed, stamped envelope by March 3, 2017 to Notre Dame de Sion School, Attn: Molly Fisher, Wornall Road, Kansas City, MO 64114, or appear in person at that location between normal business hours. COMPLIANCE WITH LAW: The conduct of the Raffle is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Sion will follow the applicable laws for conducting Raffle. 6
