1 #KrakowToRome Photo & Video Contest Official Rules No Purchase Required to Enter or Win 1. Eligibility: The #KrakowToRome Photo & Video Contest (the Promotion ) is open to every person at least eighteen (18) years of age as of the Entry Period (defined below) or have reached the age of majority in their jurisdiction of residence, whichever is older, ALETEIA shall have the right to ask a documentary proof at anytime. Employees of Aleteia (Sponsor) and each of its subsidiaries, affiliates, officers, directors, employees and agents, and the immediate family (defined as parents, children, siblings and husband or wife) of each such employee, together with those with whom such employees are domiciled, are not eligible to participate. 2. Agreement to Official Rules: Participation in the Promotion constitutes entrant s full and unconditional agreement to and acceptance of these Official Rules, which are final and binding. 3. Entry Period: The Promotion begins at 12:00 Krakow time on July 15th and ends at 11:59 Krakow time on August 10th. Entries that are submitted before or after the Entry Period will be disqualified. 4. Create and Submit an Entry: To enter the Promotion, you must submit one or more photographs or videos chronicling the events of the World Youth Day in Poland from July 26 th 2016 to July 31 st Your Entry must meet each of the following requirements: a. You must have the right to submit the Entry to Aleteia. b. The Entry may not be obscene or indecent, it must not contain defamatory statements, it must not include threats to any person, place, business, or group, it must not invade privacy rights or any other rights of any person, business, or group, and it must not name or depict any third party without his/her permission. c. The Entry must be submitted to any of the following social media networks: Facebook: by adding to the photo or video the tag or mention AleteiaPL Twitter: by publishing the photo or video with the hashtag #KrakowToRome Instagram: by publishing the photo with the hashtag #KrakowToRome
2 Youtube: by inserting KrakowToRome into the video title. d. The Entry must comply with the terms of service of each social media website. 5. Entrant s Warranties and Representations: By submitting an Entry, each entrant warrants and represents: a. The Entry (i) is original to the entrant, (ii) does not infringe the intellectual property, privacy, publicity, or any other rights of any third party, (iii) does not violate any law or regulation, (iv) has not previously been entered in any other promotion, and (v) has not been previously published in any medium. b. To the extent the Entry depicts any individual, the entrant is the individual pictured in the submission, or, alternatively, that the entrant has obtained permission from each person appearing in the entry or, if that person is a minor, permission from that person s parent or legal guardian, to grant the rights to the Sponsor (Aleteia) described in the Sponsor s Rights to Entries section below, and can make written copies of such permissions available to the Sponsor upon request. 6. Sponsor s Rights to Entries: By submitting an Entry, each entrant: a. Grants to Sponsor (Aleteia) and each of its designees, licensees, and assigns ( Authorized Parties ), a perpetual, non-exclusive, worldwide, royalty-free license to reproduce, distribute, display, and post the Entry in any media for the purposes of promoting and administering the Promotion. The Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use. The Authorized Parties may not sublicense or sell any of the foregoing rights to any third party. b. Grants to Sponsor (Aleteia) licenses for the publication of a social movie and a photo album on the World Youth Day c. Agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor (Aleteia) on the grounds that use of the Entry pursuant to Section 7a infringes any of the entrant s rights as creator of the Entry including, without limitation, copyrights, trademark rights, and moral rights. 7. Selection of Potential Winners: on August 1 st 2016 among all the Entries that meet all the requirements in Section 6, a panel of judges selected by the Sponsor will
3 evaluate the 5 most shared videos and the 5 most shared photos based on the following criteria (the Judging Criteria ): - how creative the Entry is, - how original the Entry is, - the degree to which the Entry exudes personality, - and what overall impact the Entry has. The Entries with the top three (3) scores will each be deemed a finalist. Each finalist s Entry will be evaluated by a guest judge chosen by Sponsor using the Judging Criteria. The guest judge will choose the two winning Entries (the picture and the video) and such entrants shall be deemed to be the two winners (hereinafter the Winner ). 8. Notification and Requirements of the Winner: the Winner will be notified by social media and after the date of selection. Except where prohibited, the potential member may be required to sign and return an affidavit (or declaration) of eligibility and liability/publicity release and a background check. In addition, the Winner will be required to sign a release in which he/she irrevocably assigns and transfers to the Sponsor any and all rights, title and interest in the Entry, including, without limitation, all copyrights and trademark rights (if applicable), and waives all moral rights in the Entry. Documents must be signed and returned to the Sponsor within five (5) days of being notified. If the Winner fails to sign and return the required documents within the required time period or is otherwise ineligible to receive the prize, an alternate entrant may be selected in his/her place according to the selection procedures set forth above. The looser at the Promotion will not be notified. 9. Prizes: Each two Winners will receive a six-day, five-night trip for one (1) adult to Rome, Italy. The prize package includes: (i) round-trip coach airfare from Winner s home city - (up to a maximum of $1,500 USD round trip), (ii) hotel or other accommodations, ground transportation to and from the Winner s accommodations, all meals (breakfast, lunch, dinner, snacks) and non-alcoholic beverages - (up to a maximum of $120 USD per day) and expert tours of the Vatican Art Museum. The following charges are not included in the prize package and are the sole responsibility of the Winner: transportation to and from Winner s nearest airport, alcoholic beverages, gratuities, insurance, luggage fees, cell phone/data usage fees, passport processing fees, long distance phone charges, spa treatments, hotel upgrades, excursions, souvenirs, incidentals, applicable local, state, and federal taxes and any reporting, or tariffs on prizes.
4 The six-day, five-night trip should be used within the year, i.e. before July 31 st, Dates of the travel will be determined at the discretion of the Sponsor based on dates proposed by the Winner. The prize package is non-transferable, holds no cash value, and cannot be extended. Once the travel dates have been selected, Sponsor will book travel for the Winner. The Winner may be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel s sole discretion upon hotel check-in and all in-room charges, telephone calls, gratuities, hotel upgrades, amenities, personal incidentals and any other expenses charged to Winner s hotel room will be charged to that major valid credit card or deducted from the deposit provided. Winner will be solely responsible for obtaining all required government documents in order to travel. Sponsor is not responsible for failure to obtain any required travel documents (e.g., government issued identification, etc.). The prize is not redeemable for cash and no other substitution may be made, except by the Sponsor, who reserves the right to substitute the prize package with another prize of equal or greater value if the prize package is not available for any reason as determined by the Sponsor in its sole discretion. Winner will be responsible for payment and reporting of any applicable taxes associated with the receipt of the prize package. Sponsor may report the receipt of any prize to the appropriate federal, state, or local taxing agency(ies). 10. Publicity: Except where prohibited, participation in the Promotion constitutes an entrant s consent to the Sponsor s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration. 11. General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules or (b) award the prize according to the Judging Criteria from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages
5 from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the social media or address used to enter will be deemed to be the participant. The authorized account holder is the natural person who is assigned to an address by an Internet access provider, online service provider, or other organization responsible for assigning addresses for the domain associated with the submitted address. The Promotion is subject to French and European laws and regulations and is void where prohibited. 12. Compliance with Laws; Indemnification: By entering, entrants agree that their Entry shall comply with any and all laws, statutes, regulations, rules, or the like applicable to the posting of photos, videos, or other media on public websites (including all rules of any Web host to which such content is posted). By entering, entrants agree to defend, indemnify and otherwise hold Sponsor, Aleteia SAS, and each of its agents, officers, directors, and employees (the Released Parties ) harmless from and against any and all liability of any nature whatsoever arising out of or relating to (a) the content in entrant s Entry; (b) any technical errors that may prevent an entrant from submitting an Entry; (c) unauthorized human intervention in the Promotion; (d) errors in the administration of the Promotion or the processing of Entries; (e) the receipt, transfer, use, handling, transportation, storage, hosting, posting, or display in any manner of the Entries, (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant s participation in the Promotion or receipt or use of any prize, including any such claim by Sponsor s employees or any third parties. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. In addition, Sponsor reserves the right to report inappropriate Entries to any applicable law enforcement authorities. 13. Disputes: Any and all rights and obligations arising hereunder are subject to the laws of France. Any and all the disputes should be arisen by the Parties on the Promotion or any prize awarded will be submitted to the exclusive jurisdiction of the Court of Paris. 14. Promotion Results; Posting of Official Rules: The list of Winners and the winning Entry will be posted on all of Sponsor s (Aleteia.org) official social media websites and for four weeks following the close of the Promotion.
