2 Interim Policy 1. Commitment Canterbury College Policy for Placing Students on Work Experience / Work Placements. Canterbury College is committed to improving the work and life prospects for all learners. The College provides a range of opportunities for learners to study and experience working life and job opportunities, supported by the College s Enterprise Strategy. Work experience for learners is one element of this strategy. Policy Statement a) Scope: This Policy applies to all work experience and work placement organisation for learners at Canterbury College. It operates in tandem or conjunction with specific policies relating to; compulsory placements in childcare or the health sector; Apprenticeships or those in work place learning; and those undertaking Traineeships and supported internships (students with a Learning Difficulty Assessment (LDA) or Education, Health and Care Plan (EHC Plan) and College H&S Work Placement Policies. b) Canterbury College recognises that learners gain valuable experience of the world of work, by engaging in work experience still in full time education. The College also accepts that these placements assist in the promotion of the College and students, to prospective employers. c) The College plays host to children and vulnerable adults who come onto its premises to study and to visit. The College also undertakes academic activities which involve staff and students spending time in both internal and external environments within which they have contact with children and/or vulnerable adults. For further guidance refer to the College s Safeguarding and specific Sector Placement Policies. d) Certain legislation, particularly in respect of Regulation 19 of the Management of Health & Safety at Work Regulations 1999 and the associated guidance HSG 199 "Managing health and safety on Work Experience A guide for Organisers", specifically require risk assessments to be undertaken by a competent person, prior to the commencement of work by a young person. e) The onus is placed upon the organiser of the work experience to identify the competent person best able to undertake the risk assessment and to make suitable arrangements for this to be completed. It is clear that the necessary expertise to meet this obligation is within the individual Curriculum Sections, with guidance from the Estates Team. f) Section Managers and their curriculum teams must ensure the provision of appropriate and meaningful work experience for all under 19 learners, not only to fulfil the obligations of Study Programmes, but to also meet our mission to: inspire everyone to meet their full potential. 2. Work Experience at Canterbury College The College is committed to developing meaningful work experience which is ultimately beneficial to each student that undertakes it, especially as part of a Study Programme. The College does not advocate work experience in Study Programmes based purely on funded work experience as part of a qualification in a Study Programme, but seeks to ensure that learners access a variety of enrichment and appropriate work experience to individuals requirements as follows: 2

3 Planned and tailored based on the individual s prior attainment, progression plan and career aspiration. Provides purposeful, relevant and challenging work which enables a young person to think about their career goals and abilities. Gives students the valuable experience of a real job in a real working environment, with all the commercial pressure that occur in that environment. Develops wider employability skills and provides an opportunity to experience the students chosen vocation. Provides the student with an opportunity to demonstrate their practical skills and attitudes to employers. Involves the student and employer in the planning, review and evaluation of the work experience. Provides valuable feedback to the student on their performance and how it can be improved or developed. 3. Definition of Funded Work Experience The following definitions of Work Experience applicable to Study Programmes are based on the Education Funding Agency Delivery and recording of work experience in EFA funded study programmes from the 2014 to 2015 academic year (May 2014). 1) The student s core aim is work experience: i. External work experience - required to meet programme requirements ii. Internal work experience - as a precursor to external only iii. Example a programme entirely based at an employment setting iv. Funding - To be recorded in on the ILR under one of 6 work experience aims (as qualification hours) v. Hours minimum as defined by programme for external experience vi. Ofsted will look to see if the WE is appropriately planned in the programme to maximise benefit to the student and effectiveness of preparation for employment 2) Learning in a workplace environment as an essential element of a student s vocational qualification: i. Internal work experience acceptable as an essential part of the vocational qualification ii. External work experience may also be added as beneficial but counts as nonqualification hours if not required as part of the qualification. However, if required it is counted as qualification hours iii. Example internal salon, college retail points, catering outlets iv. Funding Recorded on ILR as appropriate to qualification work experience requirement vii. Hours This should aspire to be a minimum of 30 planned hours but in any event should be proportionate and realistic to the learner s progression aims. viii. Ofsted will look for progression intention effectiveness / relevance. Apprenticeship progression routes recommended to have external WE but HE progression routes no external expectation 3) Work experience as an enrichment activity: i. External can be offered ii. Internal at least must be offered iii. Example Curating the Art Gallery here or participating in the Canterbury Festival as volunteers iv. Funding This is recorded as non-qualification hours v. Hours Not defined but we should relate to any allocated hours under study programmes in planning and be appropriate to the learner s progression aims. 3

4 vi. Oftsed will look for evidence that experience has been purposeful and at what value the student has gained from it. 4

Legislative Considerations Under the Health and Safety (Training for Employment) Regulations 1990, students on work experience (including those on Work-related Learning Programmes) have the same protection under health and safety law as employees. Under the Management of Health and Safety at Work Regulations 1992 as amended by the Health and Safety (Young Persons) Regulations 1997 placement providers are required to: 1) Assess the risks to their young workers (under 18 years of age), including students on work experience, before they start work; 2) Make a risk assessment addressing specific factors (the outcome of the assessment will determine whether the work is prohibited (under Regulation 13d(2)); and 3) Before the student takes up the placement, let the parents of any student below compulsory school leaving age know the key findings of the risk assessment (and the control measures introduced to eliminate or minimise risks). (effectively under 18s). Successful management of health and safety at work experience placements relies on close cooperation between all players, particularly between the College, work experience students and employers. The College will undertake its Health and Safety obligations in compliance with existing law and in accordance with the DFE guidance Post-16 work experience as a part of study programmes advice for post-16 education and training providers (October 2013). This guidance is reflected in the rest of this section of the Policy. Employers have specific obligations and responsibilities as required under Health & Safety legislation as recently revised and set out in the HSE s health and safety guidance. Key points to note are: Employers who already employ young people do not need to repeat risk assessments if they offer work experience placements Repeat assessments are not required for each successive work experience student where an employer regularly takes them on. It remains the case however, that employers are responsible for the health and safety of students on a work experience placement. The College as an education provider must satisfy itself that an employer has assessed the associated risks to workers under 18 on their premises and has put in place measures to mitigate these risks. The nature of the risk assessment will depend on the type of work environment. Assurance can be gained through a conversation with the employer rather than a physical inspection or requiring the employer to complete lengthy forms. There is no requirement for a separate risk assessment for work experience students where an employer already employs young workers under 18, as the risks should already have been considered. Where work experience students are the first young workers an employer takes on (or the first for some years) the employer should review the existing assessment. Employers Liability Compulsory Insurance Work experience students are covered by existing Employers Liability Compulsory Insurance policies. If an employer already has this cover they do not need to buy additional cover. Voluntary organisations are also covered if they have this cover, but are not if they only have Public Liability Insurance. Disclosure and Barring Service (DBS) 5

6 From July 2012 providers are no longer required to carry out enhanced Disclosure and Barring Service checks on employers / staff supervising young people aged on work experience. Nonetheless, the College reserves the right to undertake any assessment or disclosure checks to a level which provides it appropriate assurance or which are compliant with specific industry requirements. Standard required documentation is provided an Annex to this Policy. 5.
