3 1 Introduction The Regulation (EU) 913/2010 of the European Parliament and the Council of 22 September 2010 lays down rules for the establishment and organisation of international rail corridors for competitive rail freight with a view to the development of a European rail network for competitive freight and it sets out rules for the selection, organisation, management and the indicative investment planning of freight corridors. The Corridor Information Document provides all information in one document in relation with Rail Freight Corridor 9, CS-Corridor (hereinafter RFC 9 among Railway Infrastructure Managers and Allocation Bodies of the Czech Republic and Slovak Republic) from the national network statements. This document ensures the existence of the Corridor and gives the overall basic structure of the applicable rules, procedures and available data of RFC 9. The creation of the Corridor contributes to the development of the international freight market. Competitiveness of the railway sector is essential for comparison with other modes of transport; therefore a proper railway infrastructure and good quality regarding freight transport services should be applied and generated along the Corridor. According to the fulfilment of the Regulation (EU) 913/2010, cooperation of infrastructure Managers and Allocation Bodies is indispensable at the international level. 2 Structure of the Corridor Information Document Based on the Rail Net Europe (RNE) structure, the Corridor Information Document as a single document consists of 5 different Books. There are proposed structures available for each book; the Network Statement Excerpts follows in part the structure of national Network Statements. The Corridor Information Document is built up as follows: Book 1 Generalities Book 2 Network Statement Excerpts Book 3 Terminal Description Book 4 Procedures for Capacity and Traffic Management Book 5 Implementation Plan 3
4 All Books can be implemented under different processes but the Network Statement Excerpts part should be drawn up in accordance with the procedure set out in Directive 2012/34/EU. The Corridor Information Document should contain: all the information in relation with the freight corridor from the national network statements information on terminals information on capacity allocation (OSS operation) and traffic management, also in the event of disturbance the implementation plan that contains: o the characteristics of the freight corridor o the essential elements of the transport market study that should be carried out on a regular basis o the objectives for the freight corridor o the investment plan described in the regulation o measures to implement the provisions for coordination of works, capacity allocation (OSS), traffic management etc. The Corridor Information Document is an international document, therefore it is written in English. 4
5 3 Corridor Description The initial network established by the Rail Freight Corridors was drafted as follows: The RFC 9 runs in the following two countries: the Czech Republic and the Slovak Republic, between the cities of Praha Žilina Čierna nad Tisou border SK/UA. 5

11 RFC 9 has currently the following connections with other RFCs: from Prague to Česká Třebová with Corridor Orient/East-Med (RFC 7), from Ústí nad Orlicí to Česká Třebová and from Prosenice to Mosty u Jablunkova (CZ/SK border) with Baltic-Adriatic Corridor (RFC 5). 11

13 Two countries participating in the corridor RFC 9 the Czech Republic and Slovakia in the year 2012 have signed a Memorandum of Understanding between both Infrastructure Managers on creating the Management Board. The Management Board of the corridor designed to carry out tasks under Regulation No. 913/2010 establishes: Advisory Group Terminals operators and owners (TAG), Advisory Group Railway undertakings (RAG). Managers and owners of terminals and railway undertakings may enter the Advisory Group (AG) or leave it in its sole discretion. Written notice of entering the Advisory Group with contact information (postal address, telephone number, address) or leaving it shall be sent to one of the designated contact points. The Management Board sends documents to which it intends to obtain opinions of the Advisory Groups to each member of both Advisory Groups. Members of the Advisory Group may submit opinions to the Management Board concerning proposals of the Management Board that could have an impact on their activities. Members of the Advisory Groups may also submit proposals concerning activities of the rail freight corridor on their own initiative. Members of the Advisory Group can appoint their common representative who draws up a summary opinion of the Advisory Group based on the opinions and suggestions of the Advisory Group members. The Advisory Group informs the Management Board about the appointment of the representative and his contact details (postal address, telephone number, address). The Management Board establishes the following Working Groups (WG) corresponding to their focus: Management and coordination, Marketing and OSS, Infrastructure and ERTMS deployment, Information exchange and traffic management, Coordination of Temporary Capacity Restrictions (from 12 November 2015), Activities of each Working Group are managed by its leader in accordance with instructions of the Management Board. Infrastructure Managers (SŽDC or ŽSR) may propose any changes concerning working groups. 13

Miroslav Zuber Legal Framework The main international regulations relating to Rail Freight Corridors are: Regulation 913/2010/EU of the European Parliament and of the Council of 22 September 2010 concerning a European Rail Network for Competitive Freight Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 Establishing a Single European Railway Area (recast). The framework for infrastructure capacity allocation on the corridor has to be defined by the Executive Board of each Rail Freight Corridor according to Article 14 (1) of the Regulation (EU) 913/2010. For RFC 9 it is available on its website. Further applicable legislation and regulations can be found in Book 2 of this Corridor Information Document. 7 Legal Status The Management Board has designated a joint body for applicants to request and to receive answers, in a single place and a single operation, regarding infrastructure capacity for freight trains crossing at least one border along the freight corridor. The Management Board has decided to apply the rotating model of the C-OSS representative office with annual periodicity. The state organization Správa železniční dopravní cesty (SŽDC) fulfils the role of C-OSS in the first period from November 2013 and for the whole period of the Timetable 2014, 2016, 2018 with the C-OSS seat in Prague. Železnice Slovenskej republiky (ŽSR) fulfils the role of C-OSS seated in Bratislava for the whole period of the Timetable 2015, 2017,
15 8 Validity and Updating process The Regulation (EU) 913/2010 states that the Corridor Information Document should be drawn up, published and regularly updated by the MB. 9 Publishing All 5 books of the Corridor Information Document are independent with various forms of updates. The Corridor Information Document is published by each corridor on its website. 10 IT-Tools 10.1 RNE PCS RNE PCS is the only tool for publishing the offer of PaPs and Reserve Capacity and for placing international path requests on the corridor. The advantage of this solution is that the displayed data for a PaP or RC may be used for creating a path request dossier without any manual copying. Furthermore, this method simplifies the presentation and management of the paths, which remain in the catalogue for allocation as ad-hoc paths during the running timetable period. More information and access to the tool can be found RNE CIS CIS is an online tool which allows the rapid estimation of infrastructure charges for international train paths. It combines the various national rail charging systems to calculate the price for using of international train paths. More information and access to the tool can be found at RNE TIS The main purpose of TIS is real-time monitoring of international trains via a web-based interface. The tool can be used by IMs, RUs, and more recently, by Terminals. In order for RUs to see trains from other companies, mutual agreements have to be signed. A similar document has to be signed between terminals and RUs. 15
16 The IMs send data to TIS where all information from the different IMs is combined into one train run from departure or origin to the final destination. In this manner, a train can be monitored from start to end across borders. More information and access to the tool can be found at 16
