U)O. 8:( 1('-4 OF ;O/ 8:( A"1,;:84 )'(0,/(.8 OF '()U+",- OF,./O.(0,A Considering: a. that one of the substantial evidence in a court proceeding is in the form of testimony given by Witnesses and/or Victims who hear, see, or experience an offence in order to find and seek for clarity of an offence committed by an accused offender; b. that law enforcers in finding and seeking for clarity of an offence perpetrated by an accused offender often find difficulties because they are unable to present Witnesses and/or Victims due to threats, whether physical or psychological from certain parties; c. in relation to the above matter, the presence of protection for Witnesses and/or Victims is important in court proceedings; d. that based on consideration stated on point a, point b, and point c, it is necessary to enact Law on Witnesses and Victims Protection; In the view of: 1. Article 1 clause (3) Article 20, Article 21, Article 28G, Article 28I, and Article 28J, in Republic Indonesia s 1945 Constitution. 2. 17 REPUBLIC OF INDONESIA S HOUSE OF REPRESENTATIVES and PRESIDENT OF REPUBLIC OF INDONESIA DECIDE: To stipulate: LAW ON WITNESSES AND VICTIMS PROTECTION -:A)8(' 2 ;(.('A" )'O9,0,O.0 Article 2 In this Law, what is meant by: 1. Witnesses means people who can provide information for the purpose of investigation, litigation, prosecution, and examination in court proceeding on an offence, which they hear, see, and/or experience themselves. 2. Victims means people who have suffered from physical and mental harm, and/or economic loss due to a violation of criminal laws. 3. Witnesses and Victims Protection Agency (LPSK) means an agency whose task and authority is to provide protection and other rights to Witnesses and/or Victims as regulated in this Law. 4. Threats means any form of conduct which causes an impact, directly or indirectly, and which causes Witnesses and/or Victims to feel fear and/or feel forced to perform or not to perform something which is related to their testimony in a criminal court proceeding. 5. Families means people who are blood-related to Witnesses and/or Victims in a direct line upward or downward and sideward up to the third degree of generations, or due to marriage, and/or dependants of Witnesses and/or Victims. 17

Protection means any form of action to fulfill the rights and assistance to provide a sense of safety to Witnesses and or/victims, which are the obligations of Witnesses and Victims Protection Agency or other agencies as stipulated in this Law. Article 2 This Law provides protection for Witnesses and Victims in all stages of court proceedings in court jurisdiction. Article 3 Witnesses and Victims Protection is based on: a. respect for inherent dignity and worth of a human person; b. sense of safety; c. justice d. no discrimination; and e. legal assurance. Article 4 Witnesses and Victims Protection is aimed at providing a sense of safety to Witnesses and/or Victims in presenting their testimony in a court proceeding. 18

A./ 8:( ',;:80 OF $,8.(00(0 A./ 9,-8,10 Article C (1) Witnesses and victims are entitled to: a. the right to obtain protection of their personal, family and property safety, against any threat which is related to the testimony which they will give, are giving, or have given; b. the right to participate in selecting and determining the form of protection and security assistance; c. the right to give information without any pressure; d. the right to obtain a translator; e. the right to be free from any misleading questions; f. the right to be informed about the development of court proceedings; g. the right to be informed about court s verdict; h. the right to be informed about the release of the offender; i. the right to obtain a new identity; j. the right to obtain relocation; k. the right to obtain reimbursement for transport expenses as necessary; l. the right to obtain legal advice; and/or m. the right to obtain living expenses temporarily until the protection is terminated. (2) The rights as stipulated in clause (1) are provided for Witnesses and/or Victims in certain cases in accordance with the decision made by Witnesses and Victims Protection. Article
20 Victims of serious human rights violations, asides from being entitled to the rights as stipulated in Article 5, are also entitled to obtain: a. medical services; and b. psycho-social rehabilitation services. Article 7 (1) Victims through Witnesses and Victims Protection are entitled to request to the court: a. the right to compensate in a case of serious human rights violations; b. the right to restitution or compensation which is born by the offender. (2) Decision on compensation and restitution is given by court. (3) Provisions regarding the distribution of compensation and restitution are governed further through a Government Regulation. Article 8 Protection and the rights of Witnesses and Victims are given since the investigation stage starts and ends in accordance with the provisions stipulated in this law. Article E (1) Witnesses and/or Victims who feel they are in a serious threat, upon the judge s approval, can give their testimony without being present in the court where the offence is being tried. (2) The Witnesses and/or Victims as stipulated in clause (1) can give their testimony in writing which is presented in front of an authorized official and sign their signature in a dossier containing that testimony. (3) Witnesses and/or victims as stipulated in clause (1) accompanied by an authorized official can also give their testimony which can be heard directly through an electronic means. Article
21 (1) Witnesses, victims and people who report an offence should not be prosecuted on criminal or civil code on the report or testimony which they will give, are giving, or have given. (2) A Witness who is also an offender in the same case cannot be released from any legal charges if he/she is proven legally and convincingly guilty; nevertheless, his/her testimony can be used by the judge as a consideration to lessen the sentence. (3) Provision as stipulated in clause (1) are not applicable to Witnesses, Victims, and people who provide information without a good intention. -:A)8(',,, $,8.(00(0 A./ 9,-8,10 )'O8(-8,O. A;(.-4 )art One ;eneral Article 22 (1) Witnesses and Victims Protection Agency is an independent agency. (2) Witnesses and Victims Protection Agency is based in the Capital City of Republic Indonesia. (3) Witnesses and Victims Protection Agency must be established at local areas when necessary. Article 22 Witnesses and Victims Protection Agency is responsible for providing protection and assistance to Witnesses and Victims in accordance with its tasks and authorities as stipulated in this Law. Article 23 (1) Witnesses and Victims Protection Agency is accountable to the President. (2) Witnesses and Victims Protection Agency prepares periodically a report on its tasks implementation to the House of Representatives minimum once in 1 (one) year. 21
22 )art 8wo,nstitution Article 24 Witnesses and Victims Protection Agency consists of 7 (seven) people who are professionals with experiences in the field of legal and human rights advancement, fulfilling, and protection, law enforcement, police, state attorney, Department of Justice and Human Rights, academia, lawyers, or nongovernmental organization. Article 2C 1. The serving term of members of Witnesses and Victims Protection Agency is 5 (five) years. 2. When the serving term as stipulated in clause (1) ends, members of Witnesses and Victims Protection Agency can be reelected for the same position for one more term of 5 (five) years. Article 27 (1) Witnesses and Victims Protection Agency consists of Heads and Members. (2) Heads of Witnesses and Victims Protection Agency consists of Head and Vice Head who are concurrently members. (3) Heads of Witnesses and Victims Protection Agency are elected from and by its members. (4) Provisions regarding the procedures of the election of the Heads are governed further by Witnesses and Victims Protection Agency Regulation. Article
23 The serving term of the Head and the Vice Head of Witnesses and Victims Protection Agency is 5 (five) years and upon its completion, they can be reelected for the same position for one more term of 5 (five) years. Article 28 (1) In administering its duties, Witnesses and Victims Protections Agency is assisted by a secretariat whose duty is to give administrative services for the activities of the Agency. (2) The Secretariat of Witnesses and Victims Protections Agency is headed by a Secretary who is from the Civil Service. (3) The Secretary is appointed and terminated by the Secretary of State. (4) Provisions regarding position, structure, organization, duties, and responsibilities of the secretary as stipulated in clause (1) are governed further by a Government Regulation. (5) A Government Regulation as stipulated in clause (4) is established in within 3 (three) months since Witnesses and Victims Protections Agency is established. Article 2E (1) The first members of Witnesses and Victims Protections Agency are selected and elected by the President. (2) In conducting the selection and election as stipulated in clause (1), the President forms a selection committee. (3) The selection committee as stipulated in clause (2) consists of 5 (five) persons, with the following structure: a. 2 (two) persons are people from the government; and b. 3 (three) persons are people from the community. 23
24 (4) Members of the selection committee are not eligible for becoming candidates of members of Witnesses and Victims Protections Agency. (5) Provisions regarding the structure of the selection-committee, the procedures of the election committee, the election of members of Witnesses and Victims Protections Agency are governed further by a President Regulation. Article 20 (1) The selection committee puts forward 21 (twenty one) candidates who meet the requirements. (2) The President selects 14 (fourteen) persons out of a number of candidates as stipulated in clause (1) to be proposed to the House of Representatives. (3) The House of Representatives selects and approves 7 (seven) from the candidates as stipulated in clause (2). Article 22 (1) The House of Representatives provides the decision in within 30 (thirty) days since the day the proposal on the candidates of Witnesses and Victims Protections Agency members is accepted. (2) Should The House of Representatives not provide approval to one or more candidates proposed by the President within 30 (thirty) days since the day the proposal on the candidates of Witnesses and Victims Protections Agency members is accepted, the House of Representatives must notify the President and explain the reason. (3) In a matter of the House of Representatives does not provide approval as stipulated in clause (2), the President proposes twice as many as the number of candidates who are not approved. (4) The House of Representatives is required to provide approval to substitute candidates as stipulated in clause (3), within 30 (thirty) days since the day the proposal on the substitute candidates is accepted. 25 The President agrees on members of Witnesses and Victims Protection Agency who are endorsed by the House of Representatives, within 30 (thirty) days since the day the approval is received by the President. )art 8hree Appointment and 8ermination Article 23 (1) Members of Witnesses and Victims Protection Agency are appointed by the President with the approval of the House of Representatives. (2) To be eligible for appointment, the requirements are: a. citizen of Republic of Indonesia; b. healthy both physically and mentally; c. never been sentenced for a criminal case the penal charge of which is at the minimum of 5 (five) years; d. between 40 (forty) and 65 (sixty five) years of age during the selection process; e. holds a minimum of an undergraduate degree; f. experienced in the field of law and humans rights for at least 10 (ten) years; g. has good integrity and personality. h. has a tax payer s number. Article 24 Members of Witnesses and Victims Protection Agency are terminated due to: a. passed away; b. their serving term ends; c. by personal request; 25
26 d. physically or mentally ill which leads to inability to perform their duties for 30 days consecutively; e. engage in a misconduct and/or other actions which are based on the Decision of Witnesses and/or Victims Protection Agency, they must be terminated as they have disgraced the worth and reputation of, and/or reduce the independence and credibility of the Agency f. convicted or found guilty for committing a crime with charges at the minimum of 5 (five) years. Article 2C Provisions regarding the procedures of the appointment and termination of members of Witnesses and Victims Protection Agency are governed further by a President Regulation. )art Four /ecision 1akinR and FinancinR Article 27 (1) Decisions of Witnesses and Victims Protection Agency are made based on deliberation for a consensus. (2) In a matter when decisions as stipulated in clause (1) are not reached, decisions are made by voting. Article 27 All expenses necessary for the implementation of the duties of Witnesses and Victims Protection Agency shall be taken by the State Budget. -:A)8(',9 -O./,8,O.0 A./ )'O-(/U'(0 OF )'O8(-8,O. 27 Article 28 -onditions os )rotection and Assistance Protection agreement from Witnesses and Victims Protection Agency for Witnesses and/or Victims as stipulated in Article 5 clause (2) is given by considering the following conditions: a. the importance of information from Witnesses and/or Victims; b. the level of threat which may endanger Witnesses and/or Victims; c. the result of medical team s or psychologist s analysis on Witnesses and/or Victims; d. the criminal record on offences which have been committed by Witnesses and/or Victims. )art 8wo )rocedures os the )rovision os )rotection Procedures to obtain protection as stipulated in Article 5 are as follow: a. The Witnesses and/or Victims, either by their own initiative or by request from an authorized official, can request for protection in writing to Witnesses and Victims Protection Agency; b. Witnesses and Victims Protection Agency will conduct an assessment on the request as stipulated in point a; c. The decision made by Witnesses and Victims Protection Agency will be given in writing within 7 (seven) days since the request is proposed. Article 30 (1) In a matter when Witnesses and Victims Protection Agency receives the request from Witnesses and/or Victims as stipulated in Article 29, Witnesses and/or Victims sign a statement containing their willingness to obey terms and conditions of Witnesses and Victims protection. (2) A statement containing willingness to obey terms and conditions of Witnesses and Victims as stipulated in clause (1) encompasses: a. Witnesses and/or Victims willingness to provide testimony in a court proceeding; 27
28 b. Witnesses and/or Victims willingness to uphold regulation regarding their safety; c. Witnesses and/or Victims willingness not to communicate in any way with other people except with the approval from Witnesses and Victims Protection Agency during the time they are under the protection of the Agency; d. Obligations of Witnesses and/or Victims not to tell anyone regarding their whereabouts under the protection of the Agency; and e. Other matters which are considered necessary by Witnesses and Victims Protection Agency. Article 32 Witnesses and Victims Protection Agency is under the obligation to provide full protection to Witnesses and/or Victims, including their family, since the protection agreement as stipulated in Article 30 is signed. Article 32 (1) Protection for the safety of Witnesses and/or Victims can only be terminated based on the following reasons: a. Witnesses and/or Victims request by their own initiative that the protection be terminated; b. An authorized official requests that the protection be terminated in matter where the request for protection is made by an authorized official; c. Witnesses and/or Victims violate the provisions as written in the agreement; or d. Witnesses and Victims Protection Agency is under the opinion that Witnesses and/or Victims no longer require protection based on convincing evidence. (2) Termination of protection on the safety Witnesses and/or Victims has to be made in writing. )art 8hree )rocedures os the )rovision os Assistance 28
29 Article 33 Assistance as stipulated in Article 6 is given to Witnesses and/or Victims based on their own request or the request from someone who represents them to Witnesses and Victims Protection Agency in writing. Article 34 (1) Witnesses and Victims Protection Agency determines the feasibility of the provision of assistance to Witnesses and/or Victims. (2) In a matter where Witnesses and/or Victims are given the assistance, Witnesses and Victims Protection Agency decides the length of time and the amount of expenses required. (3) Provisions regarding the feasibility as stipulated in clause (1) as well as the length of time and the amount of expenses as stipulated in clause (2) are governed further by a Government Regulation. Article 3C Decisions made by Witnesses and Victims Protection Agency regarding the provision of assistance to Witnesses and/or Victims must be notified in writing to the recipient within 7 (seven) days since the request of assistance is accepted. Article 37 (1) In providing protection and assistance, Witnesses and Victims Protection Agency may cooperate with other relevant, authorized institutions. (2) In providing protection and assistance as stipulated in clause (1) relevant institutions in accordance with their authority are under the obligation to carry out decisions made by Witnesses and Victims Protection Agency in line with the provisions stipulated in this law. -:A)8('
30 )(.A" -O/( Article 37 (1) Any person who imposes their will with the use of violence or certain methods, which causes Witnesses and/or Victims not to obtain protection as stipulated in Article 5 clause (1) point a to point d, so that the Witnesses and/or Victims do not present their testimony in any stage of a court proceeding, is punishable by imprisonment not less than 1 (one) year and not more than 5 (five) years and by a fine not less than Rp ,00 (forty million rupiahs) and not more than Rp ,00 ( two hundred million rupiahs). (2) Any person who impose their will as stipulated in clause (1) so that causes severe injury to Witnesses and/or Victims, is punishable by imprisonment not less than 2 (two) years and not more than 7 (seven) years and by a fine not less than Rp ,00 (eighty million rupiahs) and not more than Rp ,00 ( five hundred million rupiahs). (3) Any person who impose their will as stipulated in clause (1) so that causes the death of Witnesses and/or Victims, is punishable by imprisonment not less than 2 (two) years and not more than their lifetime and by a fine not less than Rp ,00 (eighty million rupiahs) and not more than Rp ,00 ( five hundred million rupiahs). Article 38 Any person who obstructs in any way, so that Witnesses and/or Victims do not obtain the protection or assistance, as stipulated in Article 5 clause (1) point a and point d, Article 6, or Article 7 clause (1), is punishable by imprisonment not less than 2 (two) years and not more than 7 (seven) years and by a fine not less than Rp ,00 (eighty million rupiahs) and not more than Rp ,00 (five hundred million rupiahs). 31 Any person who causes Witnesses and/or Victims or their family to lose their job because Witnesses and/or Victims present an honest testimony in a court proceeding, is punishable by imprisonment not less than 2 (two) years and not more than 7 (seven) years and by a fine not less than Rp ,00 (eighty million rupiahs) and not more than Rp ,00 (five hundred million rupiahs). Article 40 Any person who causes Witnesses and/or Victims to be deprived of or receive fewer their rights as stipulated in Article 5, Article 6, or Article 7 clause (1) because Witnesses and/or Victims present an honest testimony in a court proceeding, is punishable by imprisonment not less than 1 (one) year and not more than 3 (three) years and by a fine not less than Rp ,00 (thirty million rupiahs) and not more than Rp ,00 (a hundred million rupiahs). Article 42 Any person who informs the whereabouts of Witnesses and/or Victims who are under protection in a special place secretly arranged by Witnesses and/or Victims Protection Agency as stipulated in Article 5 clause (1) point j, is punishable by imprisonment not less than 3 (three) years and not more than 7 (seven) years and by a fine not less than Rp ,00 (eighty million rupiahs) and not more than Rp ,00 (five hundred million rupiahs). Article 42 In a matter of an action as stipulated in Article 37, Article 38, Article 39, Article 40, and Article 41 is committed by a public official, the punishment is increased by 1/3 (a third). Article 43 (1) In a matter where the offender cannot afford to pay a fine as stipulated in Article 37, Article 38, Article 39, Article 40, Article 41, and Article 42, the fine is replaced with imprisonment not less than 1 (one) year and not more than 3 (three) years. 31
