1 How to use these resources This set of ten lesson plans has been designed to guide you through the process of preparing for the Bar National Mock Trial Competition. Whether you are new to the competition this year, or have competed in the past, you may find these useful in guiding your rehearsal time to get the best out of your lessons and your students. In each lesson plan a particular area of the competition is covered, whether it be background information on the law and court system, through to preparing for each individual role and finally running through the whole mock trial. Each lesson plan will refer to certain resource sheets which can be downloaded from our website, and you may recognise some from the schools guide. Some lesson plans will also refer to wider resources which you may like to use, and also whether there are any connections to the Key Stage 4 National Curriculum for Citizenship. 2 Lesson Plan 1 Lesson No: 1 Reference to Lesson Plan Summary: Introduction to the Law : To understand why we have laws. To understand different types of laws, including the difference between Civil and Criminal. To know the role of Crown Courts and about the people who work in them. Key Words: Law, Civil, Criminal, Prosecution, Defence, Jury, Barrister, Witness, Defendant, Court Clerk, Usher. 1) Brainstorm rules at home and school on the board and match to similar laws in society (e.g. no fighting and assault, no taking other peoples things and theft). 2) Define what a law is: Rules that everyone in the country has to follow. 3) Students discuss why we have the laws in resource 1 either in groups or as a whole team. 4) Students complete the sorting task using resource 2. 5) Feedback and ensure students know the difference between civil and criminal law either before or after the task. Criminal law- when someone breaks a law, Civil law- when there is a dispute between 2 people. 6) Read resource 3 as a group and discuss the following questions: In your opinion, what are the advantages and disadvantages of the different ways cases are decided? (i.e. magistrates, juries, judges). Which do you think is the best way? Why? 3 Lesson Plan 2 Lesson No: 2 Reference to Lesson Plan Summary: The Competition To know what the competition is and how it works. To know the rules of the competition. To understand the scoring system. To begin looking at (Case 1). Key Words: Scoring, Analysis 1) Briefly outline what the competition is and how it works. You may like to show the Mock Trial Video which is provided as an introduction, depending on the length of the lesson. 2) Explain to students that before they can begin preparing, they need to understand the rules of the competition. 3) Read resource 5 as a whole group. Ensure students understand: The 3 rules that apply to everyone. The assessment criteria for the 10 marks that are given to the team as a whole. That they are given 10 marks for their role except the lawyers who get 10 marks for each thing they do. That the verdict of bears no relation to who wins and loses the round THIS IS REALLY IMPORTANT! 5 Lesson Plan 4 Lesson No: 4 Reference to Lesson Plan Summary: Role To begin preparing for your role To start to understand more about how your role fits into the team Key Words:, Opening Speech, Closing Speech, Statement Summary, Law Summary, Verdict. 1) Divide the class into 5 groups: prosecution lawyers, defence lawyers, witnesses, court staff and magistrates. 2) Prosecution Lawyers: Write the opening speeches for both cases uses the guidance (resource 14) and the example (resources 13 and 15). 3) Defence Lawyers: Write the closing speeches for both cases using the guidance (resource 16) and the example (resources 13 and 17). 4) Witnesses: Write a summary of their statement for both cases using the example (resources 13 and 18). 5) Court Clerk/Usher: Fill in their identification slips (resource 19), and start to go through the order of procedure (resource 20). Practice reading the section 9 statement in each case. 6) Jury: complete the practise case as a group using resources 21 and 22. Decide whether they want to use resource 22 to help them come to a verdict on the day of the competition. Key Words:, Examination in Chief, Order of Procedure, Verdict. 1) Divide group as follows: each lawyer with the witness they will do an examination in chief of, legal adviser and usher, magistrates. 2) Lawyers and Witnesses: Write their examination in chief using the instructions (resource 23) and the example (resources 13 and 24). 3) Court Clerk/Usher: Practise running through the order of procedure using resource 20. If they finish this they can help the lawyers and witnesses. 4) Jury: help the lawyers and witnesses in their discussions. NB: You may need another lesson to finish this e.g. use one lesson per case. 7 Lesson Plan 6 Lesson No: 6 Reference to Lesson Plan Summary: Role To complete preparations for the competition ready for the first run through. Key Words:, Cross Examination. 1) Divide students so that lawyers are working separately and the rest of the team are spread relatively evenly between them. The rest of the team will help the lawyers in this Lesson. 2) Lawyers write their cross examinations using the instructions (resource 25) and example (resources 13 and 26) with the help of other students in the team. NB: You may need another lesson to finish this e.g. use one lesson per case. 8 Lesson Plans 7-10 Lesson No: 7-10 Reference to Lesson Plan Summary: Run Through To make sure you know the order of procedure. To run through. To consider any improvements you might make before the competition. Key Words: Order of procedure, Trial, Verdict 1) Set up the classroom like a court (use resource 4 to help if needed). 2) Students stand/sit in the correct places. 3) All students need an order of procedure (resource 20). 4) Students can complete a run through without doing questions/speeches the first time to get them used to the order of procedure. 5) Full run through of.
