12 Securing a Property THE PROCESS Securing a property is made as simple as possible. EXPRESSION OF INTEREST FORM Once a person has expressed an interest in a particular property within the development, they are asked to fill out an Expression of Interest Form accompanied with a $1000 holding deposit (via electronic transfer or direct deposit) which is held in a trust account. The Expression of Interest Form is not a binding commitment. The information given in the Expression of Interest Form will only be used to prepare the necessary documentation to proceed with the proposed purchase. Once the form has been received Contract documentation is prepared. The developer will hold your designated property for a maximum of 10 days from the date of the Expression of interest (when accompanied by a holding deposit) to allow contract preparation and signing by the purchaser/entity. Once documents have been signed they are executed by the seller. At this point the Purchaser s Lawyers will receive the documents and you have 5 working days (cooling off period) to gain independent advice from your Lawyer. Should the purchaser wish not to proceed within the cooling off period then the initial deposit is refunded and the property is released back into the open market. Once a purchaser is 100% happy with their contract and ready to proceed with the purchase of the property, a 10% deposit is required to secure the property. This equates to 10% of the purchase price (less the initial holding deposit of $1000 which will now act as deposit against the property).
