1 INDIAN HILL TOWNHOMES ASSOCIATION SAFETY AND PARKING IMPROVEMENT PLAN PARKING RULES AND REGULATIONS (Reviewed 10/1/2014) All Indian Hill Townhomes Association (IHTA) residences have a 2-car garage. The CC&Rs clearly state that each owner/resident shall ensure the garage is being utilized to its maximum designed capacity for the parking of vehicles. Therefore, two (2) vehicles must be parked in the garage unless an exception has been made due to oversized vehicle or other outstanding issue in which the IHTA Board of Directors has given special permission. All common area parking is designated as permit parking ONLY. Vehicles MAY NOT park in the common area parking spaces unless they have a PROPERLY authorized and displayed Parking Permit or are placed on the Safe List. The Board of Directors has established this Safety and Parking Improvement Plan (SPIP) to address the parking issues. An element of the SPIP is a Parking Permit program designed to regulate and monitor vehicle parking within the community and to obtain compliance of the parking rules. As stated in the IHTA Bylaws, the Board of Directors have the obligation to administer and enforce the CC&Rs and Parking Rules and in doing so, the following procedures are established to implement the Parking Permit program: 1. All Owners/Residents will receive one Parking Permit per household after completing and returning an Application for Parking Permit. 2. After the first permit is issued, additional permits will only be issued after two cars are parked in the garage. If due to oversized vehicles, two cars will not fit in the garage, an inspection of the garage and the vehicles must occur before an additional permit is issued. 3. Each application must include a copy of all vehicles registration certificates showing that the vehicles are registered to that residence. For example, if a resident has 4 registered vehicles and is seeking two parking permits, the resident must submit registration certificates for all 4 vehicles. 4. A resident shall have 5 days from whenever a change in one or more vehicles occurs for whatever reason, including new resident or change of ownership, to resubmit the entire form with all the applicable unit s vehicles listed as of the change date
2 5. An annual update of the form shall be required from those residents who have not made a change within 45-days prior to the scheduled renewal date. 6. Owners of oversized vehicles, those with special handicap issues, or other special parking requests should submit their special requirements to the contracted Security Patrol Company. 7. All vehicle Parking Permits will be issued by the contracted Security Patrol Company. 8. Parking Permits will be monitored by the association s contracted Security Patrol Company. 9. Additional permits will be issued ONLY IF QUALIFIED. The IHTA Board of Directors will determine qualification requirements. 10. Parking enforcement will be conducted on all weekends, defined as 6:00 p.m. Friday to 6:00 a.m. Monday, and overnight on weekdays, defined as 6:00 p.m. to 6:00 a.m. Monday through Friday. 11. Safe listing of overnight visitors or temporary needs of owners/residents will be allowed. 12. Other street parking violations will be enforced including, but not limited to: wrong way parking, blocking fire hydrants, parking in fire lanes, parking outside of designated parking stalls (along curbs, in front of homeowner garage or driveway), straddling sidewalks, blocking sidewalk ramps, and storing of vehicles on the street (96-hour rule). 13. A citation will be placed on any owner/resident vehicle parked in common area parking spaces without a valid Parking Permit. In the event the same vehicle is parked in common area parking without a proper Parking Permit at any time within 90 days following issuance of a citation, the vehicle may be towed at the vehicle owner s expense without further warning or notice
3 PERMITS: 1. Indian Hill Townhomes Association and the Board of Directors reserves the right to suspend and/or revoke a Parking Permit and Safe List access following notice and an opportunity for a hearing before the Board in situations including but not limited to: a. Dishonesty in vehicle reporting or Safe Listing (e.g. Safe Listing a vehicle under another homeowner s address.) b. Repeated parking violations c. Abuse of the Safe List procedure (e.g. multiple requests for extensions or multiple vehicles being Safe Listed by the same resident at the same time.) d. Failure to submit required documentation e. Failure to pay required fees 2. Receiving a Parking Permit does NOT guarantee you a space. Common courtesy and neighborly consideration must be used when parking. 3. Vehicles parked in garages DO NOT require a Parking Permit. 4. All Parking Permits will be serialized and generic in nature (no logos, etc.). 5. Permits are issued at no cost; replacement permits are issued for a predetermined fee. A Parking Permit may be issued to a properly registered and authorized vehicle. 6. Parking Permits will only be issued when the resident has provided information (found on Application for Parking Permit) which indicates he/she has used all garage space appropriately. If any vehicle in a household requires a Parking Permit, IHTA requires the following information to be included with the Application for Parking Permit: a. A copy of all vehicle registrations with an address located within the IHTA b. Completed IHTA Application for Parking Permit c. Proof of residence in the Indian Hills community (using one item below) 1. Current vehicle registrations showing resident name and address on site 2. Valid California Driver s License showing on site address 3. Lease agreement showing the name of resident and on site address 7. In determining whether or not permits will be issued, the following vehicle types are not acceptable as legitimately garaged vehicles: a. Vehicles out of current registration b. Vehicles with current registration but registered as non-operating c. Vehicles, which are registered but not street legal (off road vehicles) d. Commercial vehicles (definition below) e. Recreational vehicles (definition below) - 3 -
4 GARAGE INSPECTIONS: 1. Complete Application for Parking Permit with all required supporting documentation. 2. Schedule an appointment through the contracted Security Patrol Company for a garage inspection to be performed by the contracted Security Patrol Company. 3. Permits for oversized vehicles are allowed only with an annual garage inspection, for a predetermined fee, to verify that garages have not been modified to prevent parking of the vehicle within the garage. 4. Two qualifying vehicles must be parked in the garage and the additional vehicle(s) for which an additional pass is being requested for must be present. 5. All vehicles must be registered to the address of the garage being inspected. 6. The garage may not be modified so as to preclude the accommodation of a standard passenger car(s) or truck(s). This means cabinets or shelves may not interfere with the parking of a vehicle. 7. Miscellaneous items or storage boxes cannot interfere with the parking of a vehicle. 8. Every effort must be made to fit the vehicles, including oversized vehicles, into the garage. If the vehicle in question can safely be parked in the garage it cannot be issued an additional permit. The key word is safely, not comfortably
5 GUEST PARKING: A guest vehicle parked in the community on weekends (6:00 p.m. on Friday to 6:00 a.m. on Monday) and overnight on weekdays (6:00 p.m. to 6:00 a.m. Monday through Friday) must be Safe Listed by the resident host or must display a Parking Permit assigned to the unit of the resident host. Each vehicle is allowed 10 Safe List days in a 180 day rolling window. For example, a vehicle Safe Listed for Monday evening through Wednesday morning would use two Safe List days. A vehicle placed on the Safe List for the weekend (Friday, Saturday, and Sunday) would use three Safe List days. If you have a guest staying more than the allowable days, please contact the Property Management Company for consideration of an extension by the Board. Keep in mind that the Board of Directors only meets once a month and the request may not be considered until the next scheduled meeting. Residents with temporary need for additional parking may place themselves on the Safe List. To Safe List your guest s vehicles please follow the Safe List procedures established by the contracted Security Patrol Company
6 ADDITIONAL PARKING RULES: 1. VEHICULAR REPAIR AND/OR MAINTENANCE: Personal vehicle repair, maintenance, or restoration is not permitted except wholly within the unit s garage. However, such activity shall at no time be permitted if it is deemed to be for compensation or such activity results in hazardous waste and/or constitutes a fire hazard. 2. VEHICLE SALES: Resale of personal vehicles is permitted for occasional sale of private vehicles. At no time is such resale activity permitted if deemed to be for commercial gain or results in unsafe practices or visits by those considered a risk to the security of the complex. 3. VEHICLE WASHING AND MAINTENANCE INSPECTION: Washing of personal vehicles is permitted if kept to a reasonable frequency and is not for commercial gain. Vehicles should be parked in front of the unit s garage and only for the duration of the washing and maintenance inspection. 4. STORAGE PARKING: Vehicles left in any common area or designated parking space(s) for more than 96 hours following issuance of a citation placed on the vehicle will be considered as stored or abandoned and will be subject to tow at the vehicle owner s expense. Vehicles must be moved at least one mile or to the public streets. 5. PARKING FOR LOADING AND UNLOADING: Vehicles may be parked in front of a garage or on the private streets for the purpose of loading, unloading, or washing of the vehicle and only for a period not to exceed 40 minutes. Such parking at night should include use of the vehicle s flashing hazard signals. 6. ENFORCEMENT: Each owner is encouraged to assist in the enforcement of all speed limits and vehicle rules by notifying the Property Management Company, the contracted Security Patrol Company, and/or local law enforcement of actions which violate same, or which constitute unacceptable or unsafe conduct by residents, guests, or intruders. 7. SPEED LIMIT: The confined nature of the IHTA complex requires safety at all times for the safety of children, animals, and property with a recommended speed not to exceed 10 MPH. 8. RECKLESS DRIVING: Any act of reckless driving, such as speeding, driving on the left side, driving in reverse at high speed, burning rubber, or any other driving conduct that creates a safety hazard or risk is prohibited and will be reported to the local law enforcement immediately
7 9. MOTORIZED SCOOTERS, SKATEBOARDS, AND OTHER OFF-STREET/OFF-ROAD VEHICLES: Any use of such vehicles on IHTA property shall be considered as unsafe and shall be reported immediately to the Property Management Company, the contracted Security Patrol Company, and/or local law enforcement
8 VEHICLE TYPES: Commercial vehicles will not be issued Parking Permits and will be towed after 96 hours on the property, even with a Parking Permit displayed. Parking Permits issued to residents may not be used for commercial vehicles. These vehicles are allowed only in your own enclosed garage. Commercial vehicles are defined as but not limited to vehicles having any of the following attributes: 1. Racks 2. Ladders 3. Tool boxes on the sides 4. Over 2 tons gross weight 5. More than two axles 6. Vans or buses designed to carry more than 10 persons 7. Vehicles wearing the commercial logo or advertising for a business Recreational vehicles will not be issued Parking Permits. For the purposes of this policy, recreational vehicles do not satisfy the requirements of qualifying vehicles in the garage for additional Parking Permit requests. Recreational vehicles are defined as but not limited to vehicles like the following: 1. Motor homes 2. Personal watercraft 3. Trailers (all types) 4. Unlicensed vehicles 5. Boats 6. Aircraft 7. Cab-over campers - 8 -
9 TOWING: Please note that the following violations will result in a fine and/or towing at the vehicle s owner s expense: 1. VEHICLES PARKED IN A FIRE LANE. Including but not limited to any of the following: a. Fire lanes or alleys b. Within 15 feet of a fire hydrant 2. VEHICLES PARKED OUTSIDE OF DESIGNATED PARKING STALLS: Including but not limited to any of the following: a. Along any curbs or sidewalks b. In front of homeowner driveways c. In front of homeowner garages (except as noted above) 3. VEHICLES PARKED IN COMMON AREA PARKING SPACE WITHOUT A SAFELIST OR PARKING PERMIT a. Recreational vehicles (definition above) b. Commercial vehicles (definition above) 4. STORED OR UNMOVED for 96 hours with or without a permit 5. VEHICLES PARKED FACING THE WRONG DIRECTION 6. VEHICLES STRADDLING OR BLOCKING SIDEWALKS While a Notice or Citation will be placed on vehicles in violation of the association rules, these notices are provided as a courtesy only. The Association or the contracted Security Patrol Company will not be responsible should any vehicle be towed for violation of this Policy, whether or not a notice or citation was received on the vehicle
