2 Current Status On April 1, 2014, City Council approved Chapter 740, Street Vending and amended Chapter 545, Licensing to improve opportunities for vendors. Changes took effect on May 15, Highlights included: Mobile Food Vending Permit for food trucks to operate at pay and display parking spaces on major and minor arterial roads, for 3 hours at a time, 50 metres from a restaurant that is open and operating. Ice Cream Vending Permit for ice cream trucks to operate for up to 30 minutes at one space on local roads. Sidewalk Vending Permit holders may apply for up to 50% extra space to sell an expanded menu. Moratorium remains on issuance of new Sidewalk Vending Permits in Wards 20, 27 and 28. Vendors may operate in commercial parking lots.

3 Current Status Since Council s decision, ML&S has issued: 17 Mobile Food Vending Permits 39 Ice Cream Vending Permits 0 Sidewalk Vending Permits (119 existing) Concerns from businesses and the public: Ice cream trucks operating in prohibited areas Waste and clutter around food truck cluster sites Promotional vendors operating from the roadway or sidewalk Cost of Mobile Food Vending Permit

4 Council Direction 1. Review the impacts of the new regulations and report back in one year. 2. Study the feasibility of establishing a new permit fee for a licensed restaurant wishing to operate a non-motorized refreshment vehicle on the sidewalk outside of the restaurant and to exempt them from any proximity requirements. 3. Study possible waste reduction and collection policies that could be included as conditions of street food vending permits. 4. Study the impact of the new regulations, such as noise, idling and environmental impacts of using generators and recommendations for reducing the impact of discharges to the City's sanitary sewer system.

5 Council Direction 5. Study how Queen Street south of Nathan Phillips Square can be designated as a special vending area in order to showcase the best of street vending in the City. 6. Study the demand for enforcement and any additional resources necessary to implement this program effectively. 7. Study the viability of directing a portion of new permit revenues to City programs in support of BIAs.

6 Further Considerations Street Food Working Group 8. Study the regulation that vendors must operate a minimum distance from restaurants. 9. Study the feasibility of increasing the amount of time that food trucks are allowed to park on the street. 10. Consider lifting the moratorium. 11. Consider whether non-food vendors should be allowed to apply for permits outside the downtown core. 12. Consider removing the limits on the number of food trucks per block. 13. Consider amending street vending permits to make them seasonal.

7 Further Considerations Street Food Working Group 14. Consider increasing the number of streets on which food trucks may operate. 15. Consider a model of designated spaces for food trucks. 16. Consider a model of designated spaces for food trucks only downtown, with roaming permitted outside the downtown core. 17. Consider a pilot project for larger hot dog carts on the sidewalk. 18. Consider allowing the Toronto Food Truck Association to become a self-regulated trade association to govern where food trucks can operate. 19. Address the issue of sampling trucks/guerilla marketers.

8 Proposed Considerations Re-instate $200 application fee that was inadvertently removed when creating by-law Introduce new 6-month & 9-month Mobile Food Vending Permit, based on cost of annual permit Introduce new 6-month & 9-month Ice Cream Vending Permit, based on cost of annual permit Define school to mean elementary and high schools Permit Mobile Food Vendors to park for five (5) hours on any one block Add all pay and display parking spaces on Collector Roads to Mobile Vending Zones

9 Proposed Considerations Strengthen language in the by-law to ensure food trucks provide waste containers, clean their litter from around their food truck Prohibit third party advertising on food trucks and distribution of free products Prohibit A-frame signs on sidewalk next to food truck Strengthen enforcement article to provide for seizure of merchandise Ban all guerilla marketing; prohibit distribution of products or services on public property (City right-of-way, sidewalks, curbside) until such time as the City comes up with new regulations
