1 Town of North Greenbush Planning Board 2 Douglas Street, Wynantskill, NY at 6:30 pm Attendance: Mary Jude Foley, William Madsen, Mark Lacivita (Chairman), David Wilson, Leanne Hanlon (Secretary), Mark Ahern, Justin Law (Legal Counsel), Michael Miner (Building Department-acting town engineer). Public Hearings: Application of Sangeeta Raizada for Site Plan Approval for construction of a new gas station/convenience store at 132 Main Ave in a General Business (BG) Zoning District- Parcel ID # Deepak Raizada explained he would like to build a building behind the current structure with a drive through and tear down the old building when the new one is complete. Propane and kerosene will be sold as well. The building department requested some changes so they will be design guidelines. The BD also asked why he wanted to use filled tanks instead of exchange. He said he has been doing that for years; filling empty propane tanks instead of exchanging empty tanks for filled ones. He said customers prefer to use their own tanks. The propane tank will be in the back and they need a designated area to park to get tanks filled. Mr. Miner stated the public entrance and side entrance has to have a roof canopy over them. Three employees at any given time. Design guidelines issues: roof pitch, stone trim. Mr. Miner stated he doesn t feel the façade meets the design guidelines yet. His architect will look at the issues and re-design some items. Ms. Foley asked what he is surrounding the dumpster with. Mr. Raizada stated a vinyl fence. She asked if he would put arborvitae around the dumpster and Mr. Raizada agreed. Ms. Foley asked about the kerosene being too close to the stream. Mr. Miner stated that has been rectified. Code may require bollards around the propane tank. Mr. Raizada is aware. Public Hearing opened: No one wishing to speak. Public hearing closed. Application of Elizabeth Knauer for a two lot Minor Subdivision of a Acre parcel at Woodridge Road in an Agriculture- Residence (AR) Zoning District, parcel ID #

2 Page 2 Elizabeth Knauer spoke about her application. She would like to build a home on the parcel given to her by her father. She also showed a new plan showing where the town road ends. She will need an easement for the other Knauer property where she would cross to get to her property. She has an from her Aunt and Uncle stating they will give her access. She will have to go before ZB to get a variance because she is not on the front of the town road. Mr. Law reviewed the map with Ms. Knauer. Public hearing opened: No one wishing to speak. Public hearing closed. Presentations: Referral from the North Greenbush Town Board for proposed PDD application of Tech Valley Development, LLC Glenmore Road (Planned Development District) Mike Tucker Engineer reviewed a map for the board. 72 acres, 152 townhouse units (2 units in each). Access Glenmore only. They have been working with RPI tech park to find out some information on design. 60% of the site will remain in its current condition. Recreational field, community center, etc. to be built. Extend 12 inch water main though the site into the tech park. Increase dater available on Glenmore. Open space, walking trails, natural space. They are working with the tech park to get an easement or the possibility of purchasing that piece. Chairman Lacivita asked for Mr. Tucker to get something from RPI. Jim Kerr also spoke. He said they have had three meetings with RPI but do not have anything in writing. He also explained what they have been discussing with RPI. Justin Law is recusing himself on this project due to prior conflict. Mr. Kerr stated they will have another meeting with RPI. He also asked if this could be moved to a public hearing while getting the easement from RPI. Mr. Madsen asked if they have spoken to the county highway department and they have not per Mr. Tucker Because it will have a big impact on the roadway. He said if Glenmore needs to be widened they will. Mr. Madsen said there is no place to widen that road. Chairman Lacivita stated there are other issues with that road especially given there is slated 42 townhouses scheduled to be built in the front along with the Stewarts and a proposed restaurant in the front.

3 Page 3 Chairman Lacivita stated the Little Red School house district is a concern. Impact on fire, police, and ems services as well. This board will ask the town board to get comments from the fire district and PD. Mr. Wilson asked about Glenwood road. Mr. Tucker showed a potential park off that road and given the comments at the town board they have taken that offer off. It will be relocated but not known where yet. 44 acres will be undeveloped. There are 72 acres total. 44 acres will remain natural. The infrastructure will be town owner with no homeowners association. Local law questions? Chairman Lacivita stated it looks as if they have enough information to issue a recommendation to the town board. He also stated his main concern is density. Can the infrastructure and public services handle to density? Chairman Lacivita also asked if all units would be tax based. Jim? stated yes 152 all taxpayers. Extension of the water district 4? And the sewer district per Miner. AR district per Mr. Miner. Business Meeting Approval of March 2016 Planning Board meeting minutes Motion made to approve March meeting minutes by Mr. Madsen and seconded by Wilson with two changes. MS. Foley abstained. (changed Justin law from being absent on the minutes, he was present) Action to be considered: Application of Sangeeta Raizada for Site Plan Approval for construction of a new gas station/convenience store at 132 Main Ave in a General Business (BG) Zoning District- Parcel ID # conditions: construction will need to meet the main avenue design guidelines. Stone, color toning. Designation of drive thru lane as to where the propane fill lane is.

4 Page 4 Planting schedule on the site plan. Motion made for a neg dec by Mr. Madsen and seconded by Ms. Foley. All in favor, motion carried. Motion made to accept site plan with above conditions by Mr. Wilson and seconded by Mr. Madsen. All in favor, motion carried. Action to be considered: Application of Elizabeth Knauer for a two lot Minor Subdivision of a Acre parcel at Woodridge Road in an Agriculture Residence (AR) Zoning District, parcel ID # conditions; provisions of final map with property lines and easements defined and ZBA variance to approve the lot without direct frontage. Mr. Law will review and approve that. Motion made for neg dec by Mr. Madsen and seconded by Ms. Foley. All in favor, motion carried. Motion made to approve site plan for sub division with above conditions by Mr. Madsen and seconded by Ms. Foley. All in favor motion carried. Town board recommendation for approval with modifications: Chairman Lacivita stated density of the project and how it relates to access n the Glenmore road side is a major question. Improvement of Glenmore road needs to be defined. Clarification on easement and transportation overlay district. Public Benefits with the provisions of water and sewer. Two local laws will need modification. Local law 5 (1990). Recommend to the town board the comment from the school district and fire district and police chief and ambulance association and highway department. Clarification from RPI on the easement access. And their transportation network (Glenmore). Glenwood road: JR Casale explained the roadway on the map for the board on Glenwood. More taxpayers to add to the town tax base. There are legal questions from this board that the planning board attorney could not comment and the town attorney will need to review. Recommendation will be made to the town board with the above information discussed.

5 Page 5 Motion made to prepare a letter to the town board for referral by Mr. Wilson and seconded by Mr. Madsen. All in favor. Motion to Adjourn at 8:10pm by Mr. Madsen and seconded by Mr. Wilson.
