2 New Coastal Study and Floodplain Maps All coastal floodplains in Delaware are receiving updated floodplain maps later this year or early next year. Higher Base Flood Elevations in some areas Lower Base Flood Elevations in others Communities may opt to require or encourage compliance with the higher flood heights for projects currently under design. Insurance grandfathering is being phased out. Houses built this year that are below the flood level on next year s map will be expensive to insure forever.

3 2014 Delaware Ordinance Workshops and assistance All communities in Delaware will be required to adopt updated floodplain regulations by the following FEMA imposed deadlines: Kent County July 7, 2014 New Castle County February 5, 2015 Sussex County March 2, 2015 For many communities first time revising floodplain regulations in years Unique opportunity to consider higher standards. Escalating flood insurance premiums are a driving factor as much as flood loss reduction.

4 Higher Standards identified by Delaware Senate Bill 64 Legislation formed a committee to identify higher Floodplain and drainage standards. 16 floodplain standards and 6 drainage standards were adopted by vote. Standards are non mandatory but are being promoted to communities as they prepare FEMA mandated floodplain ordinance updates

5 Biggert Waters National Flood Insurance Program Reform act of 2012 First significant attempt by U.S. Congress to phase out flood insurance subsidies which have resulted in the NFIP $30 billion deficit. Eliminate the pre FIRM subsidy and begins moving classes of pre FIRM properties to actuarial rate over a four year phase in period. Map grandfathering eliminated. If you build to today s map and tomorrow s map has a higher BFE, houses will be rated using the new map. Significant Flood Insurance cost increases for structures built to a lower flood standard than depicted on current flood risk map. Often 2x 4x higher than subsidized rates.

14 Today s Flood Damage Code Requirements will determine whether the project is safe or the project is damaged over its lifetime. There is a tremendous amount of uncertainty in flood risk. Designing a project to exactly the base flood level will often lead to unacceptable risk Flood heights are increasing and flood insurance rates are increasing. Are codes adequate for the lifetime of the building? Are codes designed to protect the building, or to make communities more resilient to storms and long term change No Adverse Impacts to adjacent community Safety and long term sustainability Future flood risks considered, not just past
