Article 1-2 (Definitions) (1) The term "ship" used in this Act means a ship which is used or is able to be used for navigation on or in waters, and its classification shall be as follows: 1. Motor vessel: a ship propelled by engine [including any ship mainly using engines from among such ships as using both engines and sails] and a Wing- In-Ground-Effect Vehicle (a ship that attains level flight near the surface of water by ground effect); 2. Sailing ship: a ship propelled by sail (including any ship mainly using sails

2 from among such ships as using both engines and sails); and 3. Barge: a ship, not self-propelled and need to be towed or pushed by other ships. (2) The term small-type ship used in this Act means a ship falling under any of the following subparagraphs: 1. motor vessel or sailing ship of less than 20 gross tonnage; 2. barge of less tan 100 gross tonnage. Article 2 (Korean Ship) A ship falling under any of the following subparagraphs shall be a ship of the Republic of Korea (hereinafter referred to as a "Korean ship"): 1. A national or public ship; 2. A ship owned by a citizen of the Republic of Korea; 3. A ship owned by a commercial corporation established under any Act of the Republic of Korea; and 4. A ship owned by a corporation, other than that under subparagraph 3, whose main office is located in the Republic of Korea and whose representative (in case of joint representatives, all of them) is a citizen of the Republic of Korea. Article 3 (Tonnage of Ship) (1) The classification of the tonnage of a ship as used in this Act shall be as follows: 1. International Gross Tonnage shall refer to an index used to indicate the capacity of a ship serving generally to international voyages in accordance with the International Convention on Tonnage Measurement of Ships, 1969 (hereinafter referred to as the "Convention") and an annex thereto; 2. Gross Tonnage shall refer to an index used to indicate the capacity of a ship in applying Acts and subordinate statutes concerning maritime affairs of the Republic of Korea; 3. Net Tonnage shall refer to an index used to indicate the capacity of any place within a ship provided for the transportation of passengers or cargoes in accordance with the Convention and an annex thereto; and 4. Deadweight Tonnage shall refer to an index used to indicate a ship's maximum capacity of carrying passengers and cargoes to the extent of ensuring the security of navigation. (2) The standards for the tonnage measurement of a ship under any subparagraph of

3 paragraph (1) shall be prescribed by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. Article 4 (Relation with Other Acts) This Act shall apply to the standards for the tonnage measurement of a ship, except as otherwise prescribed by other Acts. Article 5 (Hoist of National Flag) Non-Korean ships shall not hoist the national flag of the Republic of Korea. Article 6 (Prohibition of Call at Non-Open Ports and Transportation between Domestic Ports) Non-Korean ships shall not be permitted to enter non-open ports of the Republic of Korea or to transport passengers and cargoes between domestic ports: Provided, That this shall not apply in any such case as otherwise prescribed by an Act or treaty, in any such case as escaping from a maritime accident or seizure, or in any such case as permitted by the Minister of Land, Transport and Maritime Affairs. Article 7 (Application for Tonnage Measurement of Ship) (1) The owner of a Korean ship shall designate its registry port in the Republic of Korea and make an application for its gross tonnage measurement to the head of a regional maritime affairs and fisheries office (including the head of a branch office of a regional maritime affairs and port office; hereinafter referred to as the "head of the regional maritime affairs and port office") having jurisdiction over its registry port or location. > (2) The head of the regional maritime affairs and port office having jurisdiction over a ship's registry port may have the head of any other regional maritime affairs and port office having jurisdiction over its location measure its gross tonnage. (3) Where a ship acquired in a foreign country cruises between ports of foreign countries, its owner may make an application for its tonnage measurement to a consul of the Republic of Korea. (4) Necessary matters concerning an application for a ship's tonnage measurement

4 shall be prescribed by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. Article 8 (Registry and Record) (1) After the owner of a Korean ship has registered his ship, he shall apply for its record to the head of the regional office having jurisdiction over the registry port. (2) When the head of the regional maritime affairs and port office receives an application for record under paragraph (1), he shall make a record thereof in a ship's register and issue a certificate of its nationality to the applicant. (3) Matters necessary for the issuance of a certificate of a ship's nationality shall be prescribed by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. (4) The registry of a ship shall be separately prescribed by an Act. Article 8-2 (Validity of Change in the Ownership of Small Type Ship) The change in the ownership of small type ships shall be valid after being registered. Article 8-3 (Registration of Seizure) Where a small ship registration authority is entrusted with the registration of seizure from the court under the Civil Enforcement Act or from an administrative authority under the National Tax Collection Act or the Local Tax Act, the small ship registration authority shall record it in the register of the ship concerned and notify to the ship s owner. Article 9 (Application for Issuance of Provisional Certificate of Ship's Nationality) (1) In case that a person who has acquired a ship in the Republic of Korea does not decide its registry port within any jurisdiction of the head of the competent regional maritime affairs and port office of a place of such acquisition, he may apply for the issuance of a provisional certificate of a ship's nationality to the said head. (2) A person who has acquired a ship in a foreign country may, at a place of such acquisition, apply for the issuance of a provisional certificate of a ship's nationality

5 to the consul of the Republic of Korea. (3) In case that it is impossible to apply for the issuance of a provisional certificate of a ship's nationality at a place of acquisition thereof in accordance with paragraph (2), such application may be made at the initial arrival place thereafter. (4) Matters necessary for the issuance of a provisional certificate of a ship's nationality shall be provided by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. Article 10 (Hoist of National Flag and Sailing) No Korean ship shall be permitted to hoist the national flag of the Republic of Korea or to sail without keeping a certificate of its nationality or provisional certificate thereof in itself: Provided, That this shall not apply in any such case as prescribed by the Presidential Decree. Article 11 (Hoist of National Flag and Indication) A Korean ship shall, in accordance with the Ordinance of the Ministry of Land, Transport and Maritime Affairs, hoist the national flag of the Republic of Korea and indicate its name, registry port, draft height, and other necessary matters as provided by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. Article 12 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 13 (International Tonnage Certificate, etc.) (1) The owner [a ship's manager in case of co-ownership of the ship, or a ship's lessee in case of the lease of the ship; hereafter the same shall apply in this Article] of a Korean ship not less than 24 meters in length shall not have it on an international voyage without keeping therein an international tonnage certificate (meaning a certificate in which international gross tonnage and net tonnage are entered; hereinafter the same shall apply) after being issued by the Minister of Land, Transport and Maritime Affairs. (2) In case that the Minister of Land, Transport and Maritime Affairs receives an application for the issuance of an international tonnage certificate under paragraph (1), he shall issue such certificate to the applicant after he measures the

6 international gross tonnage and net tonnage of the ship concerned. (3) Deleted <by Act No. 5972, Apr. 15, 1999> (4) In case that a Korean ship falls under any of the following subparagraphs, its owner shall, within 30 days after the facts thereof come to his knowledge, make report to the head of the regional maritime affairs and port office having jurisdiction over its registry port: 1. Where it falls under any of subparagraphs of Article 22 (1); 2. Where it fails to serve international voyages; or 3. Where it becomes less than 24 meters in length. (5) In case that the owner of a Korean ship less than 24 meters in length intends to have it on an international voyage, the Minister of Land, Transport and Maritime Affairs may issue a written confirmation of international tonnage (meaning a document in which international gross tonnage and net tonnage are entered; hereinafter the same shall apply) to him. (6) The provisions of paragraphs (2) through (4) shall apply mutatis mutandis to a written confirmation of international tonnage. In this case, a "certificate of international tonnage" and "less than 24 meters in length" shall be deemed to be a "written confirmation of international tonnage" and "not less than 24 meters in length" respectively. (7) Matters necessary for the issuance of a certificate of international tonnage and a written confirmation thereof shall be provided by the Ordinance of the Ministry of Land, Transport and Maritime Affairs. Articles 14 through 17 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 18 (Modification of Recorded Matters) If there occurs any modification of matters already recorded in a ship's register, the owner of a ship shall apply for the record thereof within 30 days after such modification comes to his knowledge. Articles 19 through 21 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 22 (Cancellation Record) (1) In case that a Korean ship falls under any of the following subparagraphs, its

7 owner shall, within 30 days after the facts thereof come to his knowledge, apply for the cancellation record to the head of the regional maritime affairs and port office having jurisdiction over its registry port: 1. Where it is destroyed or lost, sunk or dismantled; 2. Where it loses the nationality of the Republic of Korea; 3. Where it becomes that ship which is provided in Article 26; and 4. Where its existence is not obvious for 90 days. (2) If the owner of a ship fails to apply for the cancellation record in case of paragraph (1), the head of regional office having jurisdiction over its registry port shall urgently notify him of an application for its cancellation record within the period not exceeding one month as fixed by the said head, and shall ex officio make its cancellation record failing such application within the said period. Articles 23 through 25 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 26 (Ship Excluded from Application) The provisions of Articles 7, 8, 8-2, 8-3, 9 through 11, 13, 18 and 22 shall not apply to a ship falling under any of the following subparagraphs: Provided, That Articles 8, 18 and 22 shall not apply to a ship falling under subparagraph A warship and a police ship; 2. A sail ship of less than 5 gross tonnage which doesn t have an engine installed; 3. A barge of less than 20 gross tonnage; 4. A barge of not less than 20 gross tonnage fixed on the waters for the purpose of mooring ships and storing ship supplies. Provided, That floating structures such as floating hotels, restaurants or theaters which are permitted to be occupied or used under Article 5 of the Public Waters Management Act or permitted to be occupied under Article 33 of the River Act. 5. A ship run on oars or poles; 6. A fishing vessel falling under any item of Article 2, 1 of the Fishing Vessel Act; 7. A dredging vessel registered under Article 3 of the Construction Equipment Management Act; 8. Water Sports Equipments such as motor boats, personal water crafts, rubber boats and motor scooters registered under Article 30 of the Water Sports Safety Act out of such Equipments under Article 2, 4 of the same Act.

8 [Enforcement Date: Jun. 30, 2010] Proviso of Article 26, 4 Article 26-2 Deleted <by Act No. 8621, Aug. 3, 2007> Article 27 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 28 (Performance of Duties in Foreign Countries) The duties of the Minister of Land, Transport and Maritime Affairs and the head of the regional maritime affairs and port office shall, in foreign countries, be performed by a consul of the Republic of Korea. Article 29 (Mutatis Mutandis Application of Commercial Act) The provisions concerning maritime commerce of Chapter 5 of the Commercial Act shall apply mutatis mutandis to ships used for sailing even if they are not used for the purpose of commercial transactions: Provided, That this shall not apply to national or public ships. Article 29-2 (Performance of Measurement of Ship's Tonnage, etc. by Agent) (1) The Minister of Land, Transport and Maritime Affairs or the head of the regional maritime affairs and port office may have the Korea Ship Safety Technology Authority (hereinafter referred to as the "Authority") established under Article 45 of the Ship Safety Act or the Ship's Classification Corporation (hereinafter referred to as the "Classification Corporation") established under Article 60-2 of the same Act perform the duties falling under any of the following subparagraphs on his behalf: 1. Measurement of a ship's tonnage under Article 7 of this Act; 2. Measurement of international gross tonnage and net tonnage and issuance of a certificate of international tonnage or a written confirmation thereof under Article 13 of this Act; or (2) The classification of ships with respect to which the Minister of Land, Transport and Maritime Affairs has the Authority or the Classification Corporation (the both shall be referred to as the "agency" hereinafter) perform his duties on his behalf under paragraph (1) shall be as follows:

9 1. The Authority: any ship other than those ships with respect to which he has the Classification Corporation perform his duties on his behalf; and 2. The Classification Corporation: any ship whose owner has recorded or intends to record its classification to the Classification Corporation. (3) The agency shall report the duties which it performs under paragraph (1) to the Minister of Land, Transport and Maritime Affairs in accordance with the Ordinance of the Ministry of Land, Transport and Maritime Affairs. (4) The Minister of Land, Transport and Maritime Affairs shall confirm the details of such duties as performed and reported by the agency under paragraph (3), and shall take any necessary measure if he finds that it violates this Act or any order issued under this Act. (5) Necessary matters concerning such duties as performed by the agency under paragraph (1) shall be prescribed by the Presidential Decree. Article 30 (Fees) (1) A person who intends to obtain any permission or authorization, to make any record or tonnage measurement, or to be given any certificate pursuant to this Act shall pay fees in accordance with the Ordinance of the Ministry of Land, Transport and Maritime Affairs: Provided, That if the duties are performed by the agency under Article 29-2, he shall pay such fees as determined by the agency to it. (2) If the agency determines fees under the proviso of paragraph (1), it shall determine the standards therefor and obtain an approval of the Minister of Land, Transport and Maritime Affairs. The same shall apply to any modification of the approved matters. (3) If fees are collected by the agency under the proviso of paragraph (1), such fees shall be its revenue. Article 31 (Delegation of Authority) The Minister of Land, Transport and Maritime Affairs may delegate part of his authority under this Act to the head of a regional maritime affairs and port office in accordance with the Presidential Decree. Article 31-2 (Legal Fiction as Public Official in Applying Penal Provisions)

10 The officers and employees of the agency performing the duties of the Minister of Land, Transport and Maritime Affairs on his behalf under Article 29-2, shall be deemed to be public officials in applying Articles 129 through 132 of the Criminal Act. Article 32 (Penal Provisions) (1) A captain of a foreign ship, which has, for the purpose of falsely assuming Korea's nationality, hoisted the national flag of the Republic of Korea, or sailed by bearing a certificate of Korean ship's nationality or a provisional certificate of Korean ship's nationality shall be punished by imprisonment for not more than five years or by a fine not exceeding 10,000,000 won: Provided, That this shall not apply in case a ship concerned has hoisted the national flag of the Republic of Korea in order to escape capture. (2) The provisions of paragraph (1) shall apply in case any flag other than the national flag of the Republic of Korea is hoisted on a Korean ship for the purpose of falsely assuming any other country's nationality. (3) If the nature of violations of paragraphs (1) and (2) is grave, the ship concerned may be confiscated. Article 33 (Penal Provisions) A captain of a ship violating Article 6 or 10 shall be punished by imprisonment for not more than five years or by a fine not exceeding 10,000,000 won. Provided, That the same shall not apply to small-type ships. Article 34 (Penal Provisions) (1) Any person who has had false matters registered in the original ship's register by deceiving public officials shall be punished by imprisonment for not more than five years or by a fine not exceeding 10,000,000 won. (2) An attempt to commit a crime under paragraph (1) shall be subject to a punishment. Article 35 (Fine for Negligence) (1) Any captain who has failed to hoist the national flag of the Republic of Korea in violation of the provisions of Article 11 shall be punished by a fine for negligence

11 not exceeding 2,000,000 won. Provided, That the same shall not apply to the captains of small-type ships. (2) The owner of a ship, who falls under any of the following subparagraphs, shall be punished by a fine for negligence not exceeding 2,000,000 won: 1. When he has failed to keep his ship's nationality certificate, etc. in violation of Article 10(only referring to small-type ships); 2. When he has failed to indicate such matters as prescribed in Article 11 in his ship; 3. When he has had his ship on an international voyage without keeping a certificate of international tonnage in violation of Article 13 (1); 4. When he has failed to report the destruction, etc. of his ship in violation of Article 13 (4) (including where Article 13 (4) apply mutatis mutandis under paragraph (6) of the same Article); 5. When he has failed to make an application for the modification record in violation of Article 18; 6. When he has failed to make an application for the deletion record of his ship within any prescribed period after receiving an urge notice under Article 22 (2); (3) A fine for negligence under paragraphs (1) and (2) shall be imposed and collected by the Minister of Land, Transport and Maritime Affairs or the head of the regional maritime affairs and port office in accordance with the Presidential Decree. Articles 36 and 37 Deleted. <by Act No. 5972, Apr. 15, 1999> Article 38 (Applicable Provisions) (1) The provisions of Articles 32, 33 and 35 (1) shall apply to those persons who perform the duties of a captain on his behalf. <Amended by Act No. 9870, Dec. 29, 2009> (2) Deleted. <by Act No. 5972, Apr. 15, 1999> (3) The provisions of Article 35 (2) shall also apply to a ship's manager, or a representative or a liquidator of a commercial company or other juridical persons. <Amended by Act No. 9870, Dec. 29, 2009> [The Subject Amended by Act No. 9870, Dec. 29, 2009] Article 39 (Exclusion of Application of Provisions on Complicity in Criminal Act)

12 The provisions of Articles 30 through 32 of the Criminal Act shall not apply to such crimes as provided in Articles 32 and 33 of this Act. ADDENDA <Act No. 3641, Dec. 31, 1982> Article 1 (Enforcement Date) This Act shall enter into force on the date of its promulgation. Article 2 (Repeal of Act) The Act on Tonnage Measurement of Ship shall be hereby repealed. Article 3 (Transitional Measures for Tonnage of Ships of Existing Ships) (1) Notwithstanding the amended provisions of Article 3 (2), standards for measurement of tonnage of this Act (hereinafter referred to as the "existing ship") shall be those under the previous provisions: Provided, That with regard to an existing ship which made a repair as prescribed in the Ordinance of the Ministry of Maritime Affairs and Fisheries (hereafter referred to as the "specific repair") after enforcement of this Act, the same shall not apply after the date (hereinafter referred to as the "first remeasurement date") when it first underwent re-measurement or measurement (including dispositions equivalent thereto) due to the specific repair. (2) Notwithstanding the amended provisions of Article 3 (2), the standards for measurement of net tonnage shall be those under previous provisions: Provided, That with regard to the existing ship under the following, the same shall not apply after the date as prescribed in the following respectively: 1. The first re-measurement date in case of an existing ship (excluding one which became an existing ship under subparagraph 2 or 3 before the specific repair concerned was made) which made the specific repair after enforcement of this Act; 2. The date when measurement pursuant to Article 13 (2) was made in case of an existing ship to which the certificate of international tonnage was issued; and

The date when measurement pursuant to Article 13 (6) to which paragraph (2) of the same Article applies mutatis mutandis was made in the case of an existing ship to which the confirmation of international tonnage was issued. (3) With regard to an existing ship not less than 24 meters in length which serves to international voyages, the amended provisions of to Article 13 (1) shall not apply during the period (hereinafter referred to as the "grace period") which commences on the effective date of the treaty and ends on the date (the first re-measurement date in case of a ship which made the specific repair prior thereto) 12 years thereafter. (4) Notwithstanding the provisions of paragraph (3), the certificate of international tonnage may be issued to the owner of a ship under the same paragraph even during the grace period. Article 4 (Transitional Measures for Previous Disposition) Dispositions or other activities taken before the enforcement of this Act in accordance with previous provisions other than those under Article 3 of the Addenda shall be deemed to have been taken in accordance with this Act. Article 5 (Transitional Measures for Penal Provisions) Application of penal provisions to the activities committed before the enforcement of this Act shall be made in accordance with previous provisions. Article 6 Omitted. ADDENDUM <Act No. 5454, Dec. 13, 1997> This Act shall enter into force on January 1, (Proviso Omitted.) ADDENDA <Act No. 5809, Feb. 5, 1999> Article 1 (Enforcement Date) This Act shall enter into force six months after the date of its promulgation.

ADDENDA <Act No. 5972, Apr. 15, 1999> Article 1 (Enforcement Date) This Act shall enter into force six months after the date of its promulgation: Provided, That the amended provisions of Article 1-2 (limited to an application for the record of a ship subject to new record and the issuance of the ship's nationality certificate under the amended provisions of the same Article), the amended provisions of subparagraph 3 of Article 2 and Article 26-2 (limited to an application for the issuance of a nationality certificate of a ship subject to the issuance thereof and the subsequent issuance of the ship's nationality certificate under the amended provisions of the same Article) and the amended provisions of Article 4 of the Addenda shall enter into force on the date of the promulgation of this Act. Article 2 (Special Case for Application of Penal Provisions to Ships Subject to New Record) The provisions of Article 33, subparagraphs 3 and 4 of Article 36 and Article 38 shall not apply to the owner and captain of any ship which is subject to new record and the issuance of the ship's nationality certificate under the amended provisions of Articles 1-2 and 26-2 within six months after the date of the promulgation of this Act. Article 3 (Transitional Measures concerning Penal Provisions) The application of penal provisions to any act prior to the enforcement of this Act shall be dealt with according to previous provisions. Article 4 Omitted. ADDENDA <Act No. 8221, Jan. 3, 2007> Article 1 (Enforcement Date) This Act shall take effect 10 months after its promulgation.

15 <proviso omitted> Article 2 through 15 Omitted Article 16 (Revision in Other Acts) (1) and (2) Omitted (3) Part of the Ship Act shall be revised as follows: The Korea Ship Inspection Technology Association (hereinafter referred to as the inspection authority established under Article 7 of the Ship Safety Act in Article 29-2 (1) shall be revised as the Ship Safety Technology Authority (hereinafter referred to as the authority ) under Article 45 of the Ship Safety Act, Article 8 of the Act as Article 60 (2) of the Act and the inspection association in Article 60 (2) as the authority. (4) through (8) Omitted ADDENA <Act No. 8621, Aug. 3, 2007> Article 1 (Enforcement Date) This Act shall take effect 6 months after its promulgation. Provided, That revised provisions of Articles 8-2 and 8-3 shall take effect from 1 July 2008 and revised Articles 13 (4), 18 and 22 (1) shall take effect on the promulgation date. Article 2 (Interim Measures on Certificate of a Ship Nationality) Any certificate of a ship s nationality issued under Article 26-2 (2) of the Act prior to the enforcement of this Act shall be deemed to have been issued under Article 8 (2) of this Act. Article 3 (Revision of other Acts) (1) The Seamen Act shall be revised as follows: Article 1-2, 3 stipulated in Article 2 (1), 1 of the Act shall be revised as Article 1-2 (1), 3. (2) The Framework Act on Fire Services shall be revised as follows: Article 1-2 stipulated in Article 2, 1 of the Act shall be revised as Article 1-2 (1). (3) The Dangerous Object Safety Management Act shall be revised as follows: Article 1-2 stipulated in Article 3 of the Act shall be revised as Article 1-2 (1). (4) The Sea Traffic Safety Act shall be revised as follows: Article 1-2, 3 stipulated in Article 10 (1), 2 of the Act shall be revised as Article 1-2 (1), 3. (5) The Local Tax Act shall be revised as follows: Article 26-2 (1) stipulated in Article 125, 2 shall be revised Article 8 (1) and small-type ships under the provisions of article 26-2 (1) stipulated in Article 134 of

16 the Act shall be revised as small-type ships under Article 8 (1). (6) The Water Sports Safety Act shall be revised as follows: Articles 26 and 26-2 stipulated in Article 30 (1) shall be revised as Article 8. Article 4 (Relation with other Acts) The provisions of the Ship Act prior to the enforcement of this Act stipulated in other Acts shall be deemed to have been stipulated under this Act. ADDENDA <Act No. 8852, Feb. 29, 2008> Article 1 (Enforcement Date) This Act shall take effect on its promulgation date. Provided,...Omitted, Among the Acts to be revised under ADDENDA Article 6, the provisions to be revised of the Acts which were promulgated before the enforcement date of this Act but whose enforcement date hasn t arrived shall take effect on the enforcement date of each corresponding Act.
