Long School of Pharmacy and Health Sciences at the University of the Pacific, a chapter of the American Pharmacists Association - Academy of Student Pharmacists, a student branch of the California Pharmacists Association, and the Student Body Government, established in November Page 4 of 25
5 ARTICLE 1. NAME The name of this organization shall be the American Pharmacists Association - Academy of Student Pharmacists (APhA-ASP) of the at the University of the Pacific (the School ), which is also a student branch of the California Pharmacists Association (CPhA), and shall be referred to as APhA-ASP, or Chapter in this constitution. APhA-ASP also serves as the official body of student government for the School s campus. Page 5 of 25
6 ARTICLE 2. MISSION STATEMENT The mission of APhA-ASP is to be the collective voice of student pharmacists, to provide opportunities for professional growth, to improve patient care, and to envision and advance the future of pharmacy. APhA-ASP also emulates the goals and visions of the administration of the at the University of the Pacific. Page 6 of 25
7 ARTICLE 3. CHAPTER GOALS AND OBJECTIVES SECTION 3.01 GOALS GOAL 1: TO ADVANCE AND EXPAND THE PROFESSIONAL ASPECTS OF PHARMACY PRACTICE. Objective 1: Encourage student involvement in innovative programs. Objective 2: Increase public awareness of the changing role of the pharmacist as a health care provider through community outreach events. GOAL 2: TO PROMOTE THE PROFESSION OF PHARMACY THROUGH STUDENT INVOLVEMENT WITH POLITICAL AND LEGISLATIVE ACTIVITIES. Objective 1: Keep student membership informed and involved in legislative issues. Objective 2: Empower and motivate student membership to submit and evaluate policies at APhA-ASP Midyear Regional and Annual meetings. Objective 3: Increase the number of active student members attending and participating in all APhA and CPhA conference meetings. GOAL 3: TO DEVELOP COLLABORATIVE EFFORTS AMONG PHARMACY STUDENTS, EDUCATORS, PHARMACISTS, AND OTHER HEALTH CARE PROVIDERS TO BETTER SERVE OUR COMMUNITY. Objective 1: Work within an integrated student government that collaborates with the various programs at the at the University of the Pacific. Objective 2: Provide and promote the opportunities for the exchange of information between healthcare providers by means of symposiums, outreach events, and health fairs. Page 7 of 25
8 ARTICLE 4. MEMBERSHIP All student pharmacists and the students in the Pre-Pharmacy program at the Thomas J. Long School of Pharmacy and Health Sciences at the University of the Pacific shall be members of APhA-ASP upon payment of dues set by APhA. SECTION 4.01 ELIGIBILITY Any student enrolled in the school of pharmacy shall be eligible for active membership in the Chapter upon submission of the proper membership enrollment form and payment of dues set by APhA. SECTION 4.02 DUES Dues shall consist of national, state, and local chapter fees and shall be paid upon submission of a completed membership form to the APhA-ASP Vice President of Membership and Finance. SECTION 4.03 CONFERENCE REIMBURSEMENTS (a) Students, student delegates, and the APhA-ASP Executive Board (the Board ) attending conferences will forfeit all reimbursements if they are excessively tardy or absent from required events as set by the Board. (b) Reimbursement requests must conform to current business practices of the School, as managed by the Office of Student Affairs and Organizations. Page 8 of 25
9 ARTICLE 5. CHAPTER FUNDS Any activity recommended by the Chapter may serve as a source of income for the Chapter, upon approval of the Board. Additionally any chapter dues shall be funds of the Chapter. An approved budget and appropriations shall require the consent of the Board. Page 9 of 25
10 ARTICLE 6. EXECUTIVE OFFICERS The Board consists of a President, Vice President of Student Affairs, Vice President of Professional Affairs, Vice President of Membership and Finance, Vice President of Legislative Affairs, Vice President of Communications, and ASP-ASuop Senator. These officers comprise the Board, either partially or entirely, and each executive officer serves as a voting member of the Board. The Board abides by the duties and responsibilities set forth in the School s APhA-ASP Policy and Procedures manual. SECTION 6.01 TERMS OF OFFICE (a) The Board will serve until the installation of newly elected officers is held customarily in the summer semester. (b) The Board may not hold a leadership or co-chair position for any organization, PFC, or fraternity while serving on the Board unless there is compelling reason with the approval of the APhA-ASP faculty adviser and the respective committee or organization faculty adviser. (c) The past Board will serve as advisors to the current executive board while enrolled as students at the school of pharmacy. (d) The elected Board will serve until installed as the official Board. (e) The elected Board will shadow and perform tasks as assigned by the current executive officers until the installation of the newly elected officers is held. Page 10 of 25
11 ARTICLE 7. FACULTY REPRESENTATION There shall be a chapter advisor for the Chapter sitting as an ex-officio member of the executive board and all committees involving the student body. The advisor may be present at all Chapter meetings unless two-thirds of the Boards votes to exclude the advisor s attendance. The chapter advisor must hold membership in APhA and CPhA. Page 11 of 25
12 ARTICLE 8. APHA-ASP ASSOCIATE OFFICERS The APhA-ASP Associate Officers will consist of a 1 st Year Class Representative, Social Chair, and 2nd Year Class Representative. The APhA-ASP President may appoint officers, with the approval of the Board, if vacancies arise in any APhA-ASP Associate Officers. (a) The APhA-ASP Vice President of Student Affairs will oversee all activities of the APhA-ASP Associate Officers, including, but not limited to, elections. (b) The APhA-ASP Associate Officers will serve a term of office commencing at their election and terminating at the next election of their office. Page 12 of 25
13 ARTICLE 9. APPOINTED OFFICES The APhA-ASP Vice President of Communications shall appoint student pharmacists to the positions of News Capsule Editors and Yearbook Editors, and the APhA-ASP Vice President of Legislative Affairs shall appoint students to the positions of delegates. SECTION 9.01 YEARBOOK EDITORS (a) The Board will determine whether a yearbook will be created each year. (b) There shall be up to four Yearbook Editors consisting of two Business Managers and two Production Managers and each editor will serve a term of one full academic year. These editors are appointed by the APhA-ASP Vice President of Communications and confirmed by a majority vote of the Board. (c) The goal of the Yearbook Editors will be to organize and prepare for publication the collective experiences of the student body for their particular term of office. (d) Yearbook editors must be members of APhA and CPhA. SECTION 9.02 NEWS CAPSULE & NEWS CAPSULE EDITORS (a) The News Capsule is to be the official newsletter of the Chapter of the School. (b) The intent of the News Capsule is to assist Chapter members in their professional development by furnishing them with legislative and/or socioeconomic and/or networking opportunity news and information relevant to student pharmacists. (c) One or more editors of the News Capsule may be appointed by the APhA-ASP Vice Presidents of Communications, with confirmation by a majority vote of the Board. (d) News Capsule editors must be a member of APhA and CPhA. Page 13 of 25
14 SECTION 9.03 DELEGATES (a) Appointed delegates shall attend state or national conferences. (b) Delegates shall abide by the duties and responsibilities set forth by the APhA-ASP Vice President of Legislative Affairs. (c) Delegates must be a member of APhA and CPhA. Page 14 of 25
15 ARTICLE 10. ELECTIONS Elections for the Board are to be planned and executed in accordance with the criteria stated in this section. SECTION CANDIDATE QUALIFICATIONS (a) Must be an active member of the Chapter at the School; (b) Must be in good academic standing in the Doctor of Pharmacy program to run for an office of the Board; (c) And, must be enrolled full-time in the School when he/she receives the oath of office. SECTION ELECTION ELIGIBILITY Upon the announcement of elections by the Board, the following will be required of each candidate before being eligible to run for office: (a) Submit a petition containing 25 signatures from active Chapter members specifying the specific office for which he or she desires candidacy. The petition must be submitted to the APhA-ASP Vice President of Student Affairs no later than 48 hours before the elections are scheduled to be held; (b) Complete a platform for the desired office. The platform shall be due to the APhA-ASP Vice President of Student Affairs no later than 48 hours before the elections are held, and shall be posted for the student body to view; (c) Present a 5-minute speech at the election forum held prior to elections; (d) And, after the election forum, videos of the candidates speeches will be available for viewing for all Chapter members. 16 SECTION ELECTION PROCEDURES (a) All students enrolled in the Doctor of Pharmacy program who have paid ASP-ASuop student fees are eligible to vote. (b) Elections will be scheduled to be convenient for all eligible to vote. Elections are customarily held during the first 4 weeks of classes of the spring semester. (c) Voting shall be done by electronic secret ballot, or an alternative mechanism determined by the Board. (d) A candidate must receive greater than 50% of the votes cast to be elected to office. (e) Write-in candidates are considered valid candidates and are entitled to all rights and privileges equally with all other candidates, providing they meet the candidate qualifications in Article 10 Section 1 (10.01). (f) Results shall be announced as soon as possible after the ballots have been tabulated and verified by the Board and the Office of Student Affairs and Organizations. (g) Terms of office are as outlined in the in Article 6 Section 1 (6.01). (h) In the event of a tie or failure to receive a majority of the votes cast, a run-off election will be held as soon as possible. (i) In the event that there are no eligible candidates, the current APhA-ASP President may appoint an officer for a vacant position. Appointees are to be confirmed with a majority vote of the Board. (j) All forms of campaigning from candidates is prohibited. Page 16 of 25
17 ARTICLE 11. FILLING OF VACATED OFFICES SECTION REMOVAL OF AN OFFICER/DISCIPLINARY ACTION (a) An officer or officer-elect may be removed from their elected position for any of these causes: willful neglect of duties; failure to maintain good academic standing (is on academic probation); found guilty of mishandling of chapter funds; found guilty of academic misconduct; excessive absence or tardiness for meetings or events; and willful neglect to uphold chapter bylaws. (b) An officer or officer-elect will not be removed from office before the charges are discussed by the remaining Board members and grounds for removal are established by a majority vote of the remaining Board members. (c) An officer removed from office will be ineligible for candidacy for any future office in the chapter. SECTION REPLACEMENT OF VACANCIES (a) Upon vacancy of office, the APhA-ASP President appoints a replacement, with confirmation of the replacement of the remaining Board members Section b applies if the vacancy is the office of the president. (b) Upon vacancy of the APhA-ASP President from his/her position, the APhA-ASP Vice President of Student Affairs will assume the president s position and responsibilities for the remainder of the term. The new president will appoint a replacement APhA-ASP Vice President of Student Affairs with confirmation by the remaining Board members. (c) If a vacancy exists for an officer-elect, the current president will appoint a replacement, to be confirmed by the current Board. Page 17 of 25
18 ARTICLE 12. COMMITTEES AND APPOINTMENT OF COMMITTEE CHAIRPERSONS AND PROJECT MANAGERS SECTION COMMITTEE CO-CHAIRS AND PROJECT MANAGERS (a) An announcement of the availability of co-chair positions for professional affairs committees for the upcoming academic year shall be made by the current APhA-ASP Vice President of Professional Affairs. (b) Interested students will be instructed to submit applications to the current APhA-ASP Vice President of Professional Affairs. (c) Two students per committee will be selected by the respective current co-chairs pending final approval by the APhA-ASP Vice President of Professional Affairs. Committee cochairs will submit their recommendations to the APhA-ASP Vice President of Professional Affairs for approval. (d) Every committee co-chair will be subjected to an evaluation by their fellow co-chairs each semester. These evaluations will be anonymous and used exclusively by the APhA-ASP Vice President of Professional Affairs to determine if the Board will need to intervene within committee affairs. Any decisions rendered by the Board will require final approval by the chapter advisor and the Associate Dean of Student Affairs and Organizations. (e) The Board requests that at least one co-chair or project manager from each Chapter s sponsored committee should be present at each Chapter s general meeting. (f) Membership drives must be approved in advance by the Board. (g) Membership drives will not be held until after APhA/CPhA membership drives are completed Page 18 of 25
19 ARTICLE 13. NEW ORGANIZATIONS, COMMITTEES, AND CLUBS (a) New organizations, committees, or clubs must petition the Board for approval of charter before they can interact with pharmacy students. (b) New organizations, committees or clubs must demonstrate a value to the student body that does not compete with existing student groups (organizations, committees, or clubs) on campus. The competition includes group activities, group audience, and fundraising plans. (c) Executive officer elections for student groups shall not be held until after the APhA-ASP (Student Body Government) executive officer elections are held and officers have been announced. The exceptions to the timing of elections are ASP-ASuop and run-off elections. (d) All new student groups will be considered part of APhA-ASP (Student Body Government), unless otherwise stated and approved by the Associate Dean of Student Affairs and Organizations. All new groups are subject to Chapter bylaws and policies and procedures. (e) The process for the recognition of new student groups (organizations, committees, and clubs) is as follows: a. The group must petition the Board for formal recognition. The petition must include the following: i. Official name; ii. Mission statement; iii. Statement describing the unique contribution of the group that is not served by any current student group; iv. Proposed bylaws; v. Budget that includes plans for sources of funding (IPPE, ASP, and external) and dues, anticipated costs of activities; vi. Statement of affiliations with any external organizations; Page 19 of 25
20 vii. Proposed activities and outreach viii. Fundraising Plans b. The APhA-ASP President reviews the petition and makes a recommendation to the Board for consideration. c. The Board votes to grant probationary approval, requiring a majority of the Board. The approval is based primarily, but not exclusively, on how the proposed activities differ from existing opportunities, and the feasibility to perform the proposed activities based on the budget provided. d. Provisional approval is granted for a calendar year, and allows the group to operate under the Chapter s rules. e. Final approval is granted if all of the following conditions are met i. The group has operated as proposed for an entire calendar year under provisional approval; ii. The group receives approval for formal recognition by the Board; iii. The group receives approval from the Associate Dean of Student Affairs and Organizations (ADSAO); and iv. The group receives approval by at least 50% of the full-time tenure-track faculty in the School. The ADSAO presents the group for approval at a faculty meeting. Page 20 of 25
21 ARTICLE 14. MEETINGS SECTION APHA-ASP GENERAL MEETINGS (a) There shall be at least eight general meetings per academic school year where membership can transact business at that time. (b) The APhA-ASP President or a majority of the executive board may call general meetings. (c) Meetings may also be called by the general membership on petition signed by no less than one-tenth of the current eligible members and upon the approval of a majority of the remaining Board members. (d) The Board shall determine the time and place for general meetings. The APhA-ASP President shall reserve the appropriate room for that meeting. (e) The membership shall be notified at least one week in advance of the time and place for of the general meeting. SECTION APHA-ASP EXECUTIVE BOARD MEETINGS (a) There shall be at least 10 executive board meetings per academic year. (b) The APhA-ASP President or two Board members may call a meeting. Page 21 of 25
22 ARTICLE 15. QUORUM SECTION APHA-ASP GENERAL MEETINGS (a) For a general meeting, a quorum shall consist of at least 10% of the current APhA-ASP student pharmacist membership. SECTION APHA-ASP EXECUTIVE BOARD MEETINGS (a) For a Board meeting, a quorum shall exist of at least 50% of Board members. Page 22 of 25
23 ARTICLE 16. RULES OF ORDER The rules of order and procedures at all APhA-ASP general and executive board meetings could be those set out in Roberts Rules of Order, when they are not in conflict with the bylaws of the American Pharmacists Association or the University of the Pacific APhA-ASP bylaws. In the event of a conflict, the APhA-ASP President, who has the final decision, shall resolve it. Page 23 of 25
24 ARTICLE 17. AMENDMENTS These chapter bylaws may be amended at any time following the procedures outlined below. SECTION PROCEDURES (a) Amendments of the Chapter bylaws must be submitted in writing to the Board. (b) Changes to the bylaws shall be posted for a minimum of 2 weeks to allow for membership commentary or objection. Members will be notified of bylaw changes by the appropriate mechanism determined by the Board. (c) Adoption of the proposed amendment(s) will require an affirmative 2/3 vote of the Board. (d) The adopted amendment(s) shall become effective immediately. Page 24 of 25
25 ARTICLE 18. SANCTIONS Failure to adhere to the Chapter bylaws and Policies and Procedures, may result in a sanctions, including but not limited to warnings, fines, removal of privileges, loss of recruitment weeks, etc., being levied at the discretion of the Board. SECTION WARNINGS (a) Warnings will be issued at the discretion of any member of the Board. (b) In the event that a warning is issued to a student group, a member of the student group, the student group s advisor, the Board, and the Chapter Advisor will be notified. (c) Any warning issued will remain on record for 1 academic year during which any following infractions may warrant more severe sanctions. Page 25 of 25
