1 TrustAssured Service Policy (PKI) Disclosure Statement Version 1.1

Contact Information Enquiries or other communications about this statement should be addressed to: The Royal Bank of Scotland TrustAssured Product & Digital Commercial & Private Banking Floor 1, 280 Bishopsgate, London, EC2M 4RB Community, Usage, Certificate Profiles and Validation Authority. The TrustAssured Service supports the IdenTrust Identity Validation Service in addition to standard Public Key Infrastructure (PKI) functions. The structure is based on the Internet X.509 Public Key Infrastructure Certificate policy and the Internet Engineering Task Force s (IETF) Certification Practices Framework discussion document ([RFC 3647). The following Certificate Policies are supported: TrustAssured Identity Certificate Policy; TrustAssured Utility Certificate Policy.

3 Only contracted parties within the IdenTrust Scheme may use and rely upon a TrustAssured Service Identity or Utility Certificate. The TrustAssured Service supports a large, diverse and widespread community of Business Customers who require PKI certificate services in support of: Authenticating themselves; Signing transactions; Time-stamping; Non-repudiation; Securing communication channels; Data integrity. Currently a Validation Authority (OCSP) is employed to check the status of TrustAssured issued certificates. The Validation Authority (On-line Certificate Status Protocol - OCSP) will provide the following services: Provide Relying Customers with the Certificate status of RBS TrustAssured Subscribing Customers Certificates; Provide RBS Relying Customers with access to the Certificate status of RBS TrustAssured Subscribing Customers certificates; Logging of audit information. All messages to and from the OCSP are digitally signed to ensure authentication and integrity 3. Obligation of Subscribing Customers Providing their Registration Authority (RA) with true and correct information at all times; Providing sufficient proof of material Certificate information to meet the Business Customer Agreement Terms and Conditions Know Your Customer and the End User or IdenTrust Enabled Application registration, and to meet the Certificate renewal requirements; Signing a Business Customer Agreement Terms and Conditions. Immediately notifying their RA of any error or defect in their Certificates, or of any subsequent changes in the Certificate information; Using their key pairs and other End User s public keys only in accordance with the Business Customer Agreement Terms and Conditions and the relevant Certificate Profile (CP); Ensuring the safety and integrity of their private keys, including:

4 controlling access to the Smartcard or HSM containing their private keys protecting the access control mechanism used to access their private keys Immediately notifying their RA of any instance in which a key pair is compromised or in which they have reason to believe a key pair may have become compromised; Ensure they comply with all relevant laws and regulations. 4. Obligations of Relying Customer In addition to the obligations in section 4, where Business Customers act as a Relying Customer they fulfil their obligations by: Securely obtaining the Certificate of the Certificate Authority (CA) they trust in the trust hierarchy, which may include verification of the CA's public key hash (thumbprint); Complying with the Business Customer Agreement Terms and Conditions. Exercising due diligence and reasonable judgement before deciding to rely on a certificate based service, and in addition, for Identity Certificates, obtaining Certificate Status of the Subscribing Customer from RBS; Only trusting and relying on a Certificate that has not expired, been revoked or suspended, and ensuring a valid chain of trust exists to the IdenTrust root. 5. Liability, Warranty and Disclaimer RBS has a number of measures to reduce or limit its liabilities in the event that the safeguards in place to protect the RBS TrustAssured Service fail to: Inhibit misuse of those resources by authorised personnel; Prohibit access to those resources by unauthorised individuals. These measures include but are not limited to identifying contingency events and appropriate recovery actions in a Business Continuity Plan. Liability for each Certificate type issued by the RBS TrustAssured Service is documented in the appropriate Business Customer Agreement Terms and Conditions. We expressly disclaim any warranty that data or communications sent or received through the Service meet local legal requirements to effect a binding transaction or produce material that will be admissible as evidence in legal proceedings. RBS assumes no liability, including Financial Responsibility for certificates improperly accepted by Relying Parties.

5 Issuance of certificates does not make any CA or any RA within the RBS TrustAssured Service an agent, fiduciary, trustee, or other representative of Subscribing or Relying Customers. 6. Related agreements, Certification Practice Statement and Certificate Policies Hardware and software documentation; Application manuals; Policy documents, including relevant Certificate Policies; Relevant Business Customer Agreement Terms and Conditions; Operational practice and procedural documents, including the CPS; IdenTrust Scheme Documentation. 7. Confidentiality RBS will comply with current UK Data Protection legislation and any other relevant legislation. All registration records are considered to be confidential information, including: Certificate applications, whether approved or rejected; Proof of Identity documentation and details; Certificate information collected as part of the registration process, but not published in an End-User Certificate; Details of certificate revocation or suspension; Business Customer Agreements. Types of Information Not Considered Confidential The information contained in Certificates issued by the RBS TrustAssured Service to Business Customers is not considered to be confidential. Customer Certificate Status Information provided by the RBS Validation Authority, where the following status response is provided - Good, Revoked or Unknown Release to Law Enforcement Officials but only where there is: A properly constituted warrant is produced; and The law enforcement official is properly identified.

6 8. Dispute Resolution Any dispute arising out of or in connection with the Service, shall be settled in accordance with our Dispute Resolution Procedure for the TrustAssured Service 9. Governing Law The provisions of all Business Customer related contractual documents will be governed by and construed in accordance with the definitions detailed in the relevant Business Customer Agreement - Terms and Conditions. 10. Rules, Audits and Licenses. The Royal Bank of Scotland Bank has joined the IdenTrust Scheme and has established an infrastructure to register Business Customers and provide IdenTrust Services to them - The TrustAssured Service. The IdenTrust community and therefore the community served by the RBS TrustAssured Service are contracted members of the IdenTrust Scheme and therefore meet IdenTrust system specifications. The Royal Bank of Scotland Bank will carry out audits of the RBS TrustAssured Service. These will be comprehensive audits of the practices documented in the Certification Practice Statement: All auditing is carried out in accordance with the RBS auditing procedures and in compliance with IdenTrust requirements. Subordinate agreements will include a stipulation that RBS has the right to, and will, audit the subordinate IdenTrust PKI.
