1 AIRPORTS AUTHORITY OF INDIA NOTICE INVITING e TENDER (3 BOT 3 Envelope Open Tender) 1. Lump Sum/Turn Key (Design and Build) e tenders are invited through the e tendering portal by Asst. G. M. Engg (C), 'A' Block, IIIrd Floor, Airports Authority of India, Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi on behalf of Chairman, AAI, from eligible contractors for the composite work of Construction of Terminal Building, Ceremonial Lounge and Associated works at Vijayawada Airport Design & Build at an estimated cost of Rs Crores with period of completion of 15 (Fifteen) months. The tendering process is online at e portal URL address or Aspiring bidders may go through the tender document by Guest User login. Prospective Tenderers are advised to get themselves acquainted for e tendering participation requirements at Guidelines for bidders, register themselves at AAI e tendering portal, obtain User ID & Password and go through the Self Help Files available in the Home Page after log in to the portal or They should also obtain Digital Signature Certificate (DSC) in parallel which is essentially required for submission of their application. The process normally takes 03 days time. The tenderer may also take guidance from AAI Help Desk Support. Tender fee of Rs /- (inclusive of taxes) will be required to be paid by way of online payment through HDFC Bank gateway provided at the portal itself. Last date and time of sale of tender document is upto Hours. 2. Following 3 envelopes shall be submitted through online at e portal by the bidder. Last date & time of submission of bids (Envelope I, II & III) is upto 17:00 Hours. (I) Envelope I: Containing qualifying requirements of Contractor/ Firm: A. The tenderer shall submit their application by downloading the PQ Proforma as per Annexure A from the e tendering portal, fill up the required information and upload the digitally signed file of scanned documents and firm s bio data in support of their meeting each criteria mentioned below in the PQQ folder in Technical Bid/ Attachments Section in the portal. Uploading of application in location other than specified above shall not be considered. Hard copy of application shall not be entertained. NIT 1

2 B. Qualifying requirements of contractors/firms i) Agency should have Permanent Account Number (PAN). ii) Should have satisfactorily completed (#Phase/Part completion of the scope of work in a contract shall not be considered, however predetermined phasing of the work will be accepted) three works, each of Rs Crores or two works, each of Rs Crores or one work, of Rs Crores in a single contract of similar nature of work on Design and Build basis (Construction of Airport Terminal building or Fully Air conditioned large shopping malls or IT Parks or Multi Storeyed Large Office Complexes, of minimum area 10,000 sqm or underground metro stations or 5 star hotels only, during last seven years ending on 31 st July Client certificate for experience should show the nature of work done, the value of work, date of start, date of completion as per agreement, actual date of completion and satisfactory completion of work. Certificate from the owner need to be produced as proof. Firms showing work experience certificate from non government/non PSU organizations should submit copy of tax deduction at source certificate in support of their claim for having experience of stipulated value of work. Firm based in other countries (Indian firms showing experience in abroad) should have their turnover and work experience certificates authenticated by Indian Embassy based in that country. iii) Should have annualized average financial turnover of Rs Crores against works executed during last three financial years ending 31st of March of previous financial year. As a proof, copy of abridged balance sheet along with profit & loss account statement of the firm should be submitted along with the application. Firms showing continuous losses during the last three years in the balance sheet shall be summarily rejected. iv) The applicant should have a minimum solvency of 60% of estimated value certified by his bankers. v) The applicant should not be blacklisted by any State/Central Government Department or PSU or Autonomous bodies in last 5 years. The applicant must submit a duly notarized affidavit to this effect. Applications received without this declaration in original shall stand automatically rejected. vi) The bidding capacity of the contractor should be equal to or more than the estimated cost of the work put to tender. The bidding capacity shall be worked out by the following formula: Bidding capacity = {[AxNx2] B} Where, A= Maximum turnover in construction works executed in any one year during the last five years taking into account the completed as well as works in progress. The value of completed work shall be brought to current costing level by enhancing at a simple rate of 7% per annum. NIT 2

3 N = Number of years prescribed for completion of work for which bids has been invited. B = Value of existing commitments and ongoing works to be completed during the period of completion of work for which bids have been invited. vii) AAI shall give tentative layout plans, design intent, broad specifications with schedule of finishes. Contract agency has to carry out detailed design as per design scope of work for execution of all packages by engaging specialized consultants. Towards the above, Contract agency should possess in house design department or should submit three design consultant details to be appointed for the design scope of the work. (II) Envelope II: Technical Bid containing scanned copy of Unconditional Acceptance of AAI s Tender conditions, scanned copy of BG, Letter of Undertaking to Bank(in case of EMD is BG ), signed Integrity pact and Authorization/Power of attorney. Scanned copy of Earnest Money Deposit (EMD) of value Rs / (Rupees One Crore Forty One Lacs Fifty Eight Thousand only) in the form of Bank Guarantee as stipulated in the Notice Inviting Tender (as per Performa given in Annexure 4 on page 139 of tender document) from nationalized or any scheduled bank but not from any cooperative or Gramin Bank with letter of undertaking from the depositor to bank (as per the proforma given in Annexure 5 on page 140) may be submitted in Tech Bid Folder in Technical Bid/Attachments section of e tendering portal along with duly signed Unconditional Acceptance of AAI s Tender Conditions (Performa given in Annexure 1 on page 131 of tender document), duly signed Integrity Pact (Performa given in Annexure 6 on page 142 of tender document). (III) Envelope III: The Financial e Bid shall be submitted in Items section of e tendering portal. Unconditional rebate i.e. header discount (%) if any is to be put in Bid Invitation Information Price Component section only. 3. Original EMD, hard copy of Original under taking letter from depositor to bank (in case of BG), hard copy of signed Original Unconditional Acceptance of AAI s Tender Conditions as well as signed original Integrity Pact and Authorization letter / Power of attorney to be sent to the Asst. G. M. Engg (C), 'A' Block, IIIrd Floor, Airports Authority of India, Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi and should reach to Bid Manager within 48 hours (2 workng days) of opening of the bid (First Envelope i.e. PQ envelope of the bid). Tender of the tenderer whose Original EMD, Original Letter of Undertaking to Bank (in case of BG), signed Original Integrity Pact and signed Original unconditional acceptance of AAI s tender conditions are not received within 48 hours (2 workng days) of opening of the bid (First Envelope i.e. PQ envelope of the bid) then their tenders will be summarily rejected. Any postal delay will not be entertained. 4. MODE OF SUBMISSION OF EMD: EMD of the value of Rs. 1,41,58,000/ (Rupees One Crore Forty One Lacs Fifty Eight Thousand only) shall be accepted online, only through E tender portal via bank transfer in the form of RTGS/NEFT or through Bank Guarantee from nationalized or any scheduled bank but not from any co operative or Gramin Bank. Vendors shall use the payment gateway of IndusInd Bank /HDFC bank integrated for the purpose with NIT 3

4 the AAI E Tender portal for online submission of EMD in the form of RTGS/NEFT. For the earnest money deposit (EMD) submitted through Bank Guarantee (BG) of value as stipulated in the Notice Inviting Tenders a scanned copy shall be submitted in Tech Bid Folder on the e tendering portal. In this scenario the original BG is required to be submitted to the Bid Manager (Address : Asst. G. M. Engg (C), 'A' Block, IIIrd Floor, Airports Authority of India, Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi ) within 48 hours (2 working days) of opening of the bid (First Envelope i.e. PQ envelope of the bid). Note: EMD in the form of Cash/Demand Draft or any other form shall not be accepted. Vendors shall also note that they are not required to contact any AAI employee or submit any documentary evidence of submission of EMD via Bank Transfer in the form of RTGS/NEFT to any AAI employee during the process of the tender. In no scenario the vendors are required to submit / contact any AAI employee for physical submission of any documents before opening of the Bids. The tenders of the bidders who fail to submit the original BG towards EMD within 48 hours (2 workng days) of opening of the bid (First Envelope i.e. PQ envelope of the bid) shall be rejected outright. Any postal delay will not be entertained. Refund of EMD EMD of unsuccessful bidders received through bank transfer mode (RTGS/NEFT) shall be refunded online through the same mode (BT) only and it shall be refunded in the Bank Account whose details are provided on the portal at the time of submission of the tender. The refund of EMD to bidders who fail to qualify the eligibility /technical stage shall be initiated automatically within 7 days of their rejection. For all bidders who qualify and their financial bids are opened, the refund of EMD of all vendors except L1 shall be processed within 7 days of opening of the financial bid. 5. Bids opening process is as below: Envelope I: Containing documents for pre qualification bid (uploaded by the contractors/firms) shall be opened on at 15:00 Hours. The intimation regarding acceptance/rejection of their bids will be intimated to the contractors/firms through e tendering portal. Envelope II: Technical bid opening (Depending on pre qualification, the date shall be intimated through Notification to Bidder section). If any clarification is needed from the bidder about the deficiency in his uploaded document in Envelope I and Envelope II, he will be asked to provide it through collaboration folder in e tendering portal. The bidder shall upload the requisite clarification/documents within time specified by AAI, failing which tender will be liable for rejection. Envelope III: Depending on Technical Bid evaluation, date of opening of financial bids of the contractors/firms found to be meeting qualifying requirements and technical criteria shall be intimated through Notification to Bidder section. 6. AAI reserves the right to accept or reject any or all applications without assigning any reasons. AAI also reserves the right to call off tender process at any stage without assigning any reason. 5 7. AAI reserves the right to disallow issue of tender document to working agencies whose performance at ongoing project(s) is below par and usually poor and has been issued letter of restrain/temporary/ Permanent debar by any department of AAI. AAI reserves the right to verify the credential submitted by the agency at any stage (before or after the award of work). If at any stage, any information/documents submitted by the applicant is found to be incorrect/false or have some discrepancy which disqualifies the firm then AAI shall take following action: a) Forfeit the entire amount of EMD submitted by the firm. b) The agency shall be liable for debarment from tendering in AAI, apart from any other appropriate contractual/legal action. 8. Implementation of Integrity Pact. 8.i) ii) iii) iv) Signing of Integrity Pact is mandatory for every bidder participating in this tender and the contractor who is awarded the work. The Pact signed on each page by the person authorized by bidder/sub contractor/associate to sign the bid for submission or the person authorized to sign the contract on behalf of successful bidder shall be submitted by the bidder in Envelope II and be enclosed with the agreement by the contractee. IP shall be signed on plain papers, which is pre signed by tender issuing authority/contract signing authority. All sub contractors/associates whose contribution in the project is Rs.0.50 crores (Rupees zero point Five crores) or above shall sign Integrity Pact with the Authority after the work is awarded to the successful bidder. All bidders shall inform their subcontractors/associates accordingly. Purchase preference to Central Public Sector Undertaking shall be applicable as per the directive of Govt. of India prevalent on the date of acceptance. 10. If the entity participating in any of the tenders is a private /public limited company, partnership firm or proprietary firm and any of the Directors/Partners/Proprietor of such company is also a director of any other company or partner of a concern or a sole proprietor having established business with AAI and has outstanding dues payable to the Authority, then the said entity shall not be allowed to participate in AAI tenders. 11. Service Tax / Sales Tax/purchase tax/vat/turnover tax /contract tax/octroi/ royalty/ Building and other construction workers Welfare Cess/ Excise or any other duty levied by Custom Authorities in respect of import of any materials or any other tax on material, labour, services or contract in respect of this work contract including payment to NIT 5

6 local/govt./statutory authorities shall be payable by the contractor and Airports Authority of India will not entertain any claim whatsoever in this respect. Building and other construction workers Welfare Cess will be deducted at the time of making payment of running account bill as per prevailing rates of the respective states. Nothing extra will be paid by AAI in this respect. 12. Queries, if any, may be sent through AAI e tendering portal in Queries & Replies section only upto Any queries raised after this date shall not be entertained. 13. Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their Tenders as to the nature of the site, the means of access to the site, the accommodation they may require, working conditions including space for stacking of materials, installation of T&P, rates of various materials to be incorporated in works, conditions affecting accommodation and movement of labours etc., and in general shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or effect their Tender. A Tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent of any misunderstanding or otherwise shall be allowed. 14. Submission of a Tender by a Tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the works to be done and of conditions and rates at which stores, tools and plants, etc., will be issued to him by Airports Authority of India, local conditions, local material rates and other factors bearing on the execution of the works. 15. a) All tendered rates shall be inclusive of all taxes and levies payable under respective statutes. However, pursuant to the Constitution (46 th Amendment A c t. 1982, if any further tax or levy is imposed by Statute, after the last stipulated date for the receipt of tender including extensions if any and the contractor there upon necessarily and properly pays such taxes/levies, the contractor shall be reimbursed the amount so paid, provided such payments, if any, is not, in the opinion of the Engineer In Charge (whose decision shall be final and binding on the contractor) attributable to delay in execution of work within the control of the contractor. b) The contractor shall keep necessary books of accounts and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorized representative of Airports Authority of India and / or Engineer in charge and further shall furnish such other information/document as the Engineer In Charge may require from time to time. c) The contractor shall, within a period of 30 days of the imposition of any such further tax or levy, pursuant to the Constitution (46th amendment) Act 1982, give a written notice thereof to the Engineer in Charge that the same is given pursuant to this condition, together with all necessary information relating thereto. 16. The site for the work is available. 17. The tenders shall be in the prescribed Form. 18. All rates shall be quoted in the AAI E tendering portal. 19. Notification of Award of contract will be made in writing to the successful Bidder by the NIT 6

7 Accepting Authority or his representative. The contract will normally be awarded to the qualified and responsive Bidder offering lowest evaluated bid in conformity with the requirements of the specifications and contract documents and the Accepting Authority shall be the sole judge in this regard. The Accepting Authority does not bind himself to accept the lowest or, any tender or to give any reason for his decision A responsive bidder is one who submits priced tender and accepts all terms and conditions of the specifications and contract documents A major modification is one which affects in any way the quality, quantity and period of completion of the work or which limits in any way the responsibilities or liabilities of the Bidder or any right of AAI, as required in the specifications and contract documents. Any modification in the terms and conditions of the Tender which are not acceptable to AAI shall also be treated as a major modification A Tenderer shall submit a responsive bid, failing which his tender will be liable to be rejected The Accepting Authority reserves to himself the right of accepting the whole or any part of the Tender and tenderer shall be bound to perform the same at his quoted rates. 20. On acceptance of Tender earnest money will be treated as part of the security deposit. 21. Airports authority of India will return the earnest money where applicable to every unsuccessful tenderer except as provided in the tender documents. 22. Canvassing in connection with tenders is strictly prohibited and the Tenders submitted by the Tenderers who resort to canvassing will be liable to rejection. 23. The Tenderer shall not be permitted to tender for works in Airports Authority of India Engineering Department, responsible for award and execution of contracts, in which his near relative is posted as Manager Finance & Accounts or Sr. Officer or as an engineer in any capacity. He shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relatives to any officer in Airports Authority of India. Any breach of these conditions by the contractor would render him liable to be debarred from tendering for next 2 years. 24. The contractors shall give a list of AAI employees related to him. 25. No Engineer of Gazetted rank or other Gazetted Officer employed in Engineering or Administrative duties in an Engineering Department of Airports Authority of India/Govt. of India is allowed to work as a contractor for a period of two years of his retirement from Airports Authority of India/Govt. service, without the prior permission of Airports Authority of India/Govt. of India. The contract is liable to be cancelled if either the contractor or any of his employees is found at any time to be such a person who had not obtained the permission of Airports Authority of India/Govt. of India as aforesaid before submission of the Tender or engagement in the contractor s service. 8 26. The Tender for works shall remain open for acceptance for a Period of ninety days from the date of opening of Tenders. If any Tenderer withdraws his Tender before the said period or makes any modifications in the terms and conditions of the Tender which are not acceptable to the Department, then Airports Authority of India shall without prejudice to any other right or remedy, be at liberty to forfeit the full said earnest money absolutely. 27. On acceptance of the Tender, the name of the accredited representative(s) of the contractor who would be responsible for taking instructions from the Engineer in Charge, shall be communicated to the Engineer in Charge. 28. This notice of Tender shall form part of the contract documents. The s u c c e s s f u l Tenderer/ contractor, on acceptance of his Tender by the Accepting Authority, shall within 15 days from the date of award of work sign the contract consisting of Notice Inviting Tenders, General conditions of contract, special/additional conditions, General and particular specifications, Tender conditions as issued at the time of invitation of Tender and acceptance thereof with any correspondence leading there to. 29. SUBMISSION OF BANK GUARANTEE. The agency shall advice the branch of the bank issuing bank guarantee to send the original Bank guarantee directly to the Airports Authority of India(AAI) under Registered Post(A.D). However, in exceptional cases as in case of EMD, where the guarantee is to be handed over directly to the AAI for any genuine reasons, the branch shall immediately send by Registered post(a.d) an unstamped duplicate copy of the guarantee directly to the AAI with a covering letter with request to compare the same with the original received from their NIT customer and confirm that it is in order. The agency shall also advise the issuing bank branch to incorporate the address etc, of the Regional/Controlling Branch of the issuing Branch in a suitable space in the Bank Guarantee. The A.D card shall be kept with the loan papers of the relevant guarantee. The agency shall also advise the issuing bank branch that whenever any letter is issued by AAI to the concerned Bank Branch, for confirmation of having issued the guarantee, Branches must send the confirmation letter to the concerned authorities promptly without fail. 30. No two or more concerns in which an individual is interested, as proprietor and/or partner shall tender for the execution of the same works. If they do so, all such tenders shall be liable to rejected. 31. Tenders shall be received through AAI E tendering portal upto the date and time as mentioned at Pageno.2 of GCC and shall be opened on the date and time as mentioned at Page no:2 of GCC in the presence of tenderers who may be present. 32. Sufficiency of Tender Although the details presented in the Tender Documents have been compiled with all reasonable care, it is the Tenderer's responsibility to ensure that the information provided is adequate and clearly understood. The Tenderer shall be responsible for obtaining and verifying all necessary data and information. The Tenderer shall make its own interpretation of any and all information provided in the Tender. AAI shall not be NIT 8

9 responsible for the accuracy or completeness of such information and/or interpretation. Any failure or neglect to carry out these verifications and investigations shall not absolve the Tenderer from any of its obligations under the requirements of the Tender or any Contract subsequently executed. The Tenderer is responsible for informing itself with respect to all conditions which might in any way affect the cost or the performance of the Works. Any failure to do so will be at the sole risk of the Tenderer. No relief or consideration will be given for errors and omissions contained within the Tender Documents. 33. Tender documents consisting of plans, requirement, scope, specifications of work to be done, the conditions of contract and other necessary document will be available in e portal in downloadable form and will be open for inspection in the office of the Asst. G. M. Engg (C), 'A' Block, IIIrd Floor, Airports Authority of India, Rajiv Gandhi Bhawan, Safdarjung Airport, New Delhi , between hours of am & 4.00 pm every day except Saturday, Sunday and public holidays. 34. Rates to be quoted in the Items Section of e portal, upto two decimal places only. In case no rate has been quoted for any item/items it will be presumed that the contractor has included the cost of this /these items(s) in other item(s) and rate for such item(s) will be considered as zero and work will be required to be executed accordingly. 35. Once the contractor has uploaded the digitally signed files of tender related documents along with unconditional acceptance as an attachment, he is not permitted to upload any additional file or put any remarks(s) / conditions(s) in /along with the Tender documents,except unconditional rebate on quoted rates if any as per the Clause no 2(III) of NIT. 36.
