1 PowerPoint Presentation Preventive Detention Instructional objectives Students will be able to: articulate the issues raised by the use of preventive detention in the war on terror put the use of preventive detention in historical perspective evaluate the arguments for and against the use of preventive detention articulate and defend their own opinion Overview Students will develop a series of PowerPoint presentations to provide an overview of the issues surrounding the use of preventive detention in the war on terror. Materials needed Securing Liberty Notes on the readings PowerPoint Presentation: Preventive Detention Computers loaded with PowerPoint or similar software Preparation Ascertain the level of computer literacy of the class and make group assignments with these skill levels in mind. Groups should have a good mix of skills, but a student well versed in PowerPoint should be in each group if possible. As homework: Have students actively read Part 4: Preventive Detention in Securing Liberty, looking for each author s point of view and the arguments the author uses to support it. Securing Liberty Preventive Detention 1

2 Remind students to read the introduction to Part 4, which presents an overview of the issue and the articles. Distribute the glossary for those who might need help with the readings. You will need the use of the computer lab for this activity. Before the lesson begins, resolve any questions about the readings. Procedure 1. Explain that the class will work in groups to develop PowerPoint presentations on the issue of preventive detention that they can then show to other students. 2. Divide the class into five groups. Distribute the activity sheet and review. Assign each group a different portion of the presentation for development. One group will research the background, another the history. The other three groups will analyze the articles from Securing Liberty. The class will work together to develop the introduction and their opinion on the use of preventive detention. The students are to use graphics to enhance their presentation. 3. Facilitate the development of the PowerPoint s general introduction, setting out the parameters of the issue. All groups will use this as the first slide in their presentation. 4. Have the groups work on their presentations. Depending on the class s facility with PowerPoint, either have students familiar with the program create the slides or create the slides yourself for the organizing and editing phase of the activity. 5. Facilitate the development of the final opinion slides. 6. Once the segments are organized and polished, combine and show the presentation. Summary If practicable, have the class merge their work to develop a presentation for other students, teachers, and community groups or to put on the class website. Homework Have your students write an essay on one of the questions at the end of the worksheet. Securing Liberty Preventive Detention 2

3 powerpoint presentation Preventive Detention Introduction: Your class has been asked to make a PowerPoint presentation on the controversy involving the use of preventive detention in the war on terror. Your presentation will help other students get a variety of perspectives on the issue. You have an important job to do because the issue involves the fundamental constitutional right of due process. What your generation thinks about preventive detention can have an impact on the interpretation and implementation of these rights for years to come. Good luck! Background After the attacks of September 11, the Bush administration undertook a rapid military response against known al Qaeda camps and bases in Afghanistan and elsewhere. In the course of these operations, the United States detained thousands of individuals whom the Bush administration called enemy combatants. Some were captured on the battlefield, but others were taken thousands of miles away. For some, there was little objective evidence that they had fought against the United States. Nearly eight hundred persons were remanded to the U.S. naval base at Guantánamo Bay, Cuba. Some have remained there for nearly ten years without criminal charges or a criminal trial. Guantánamo became one of the most controversial aspects of U.S. counterterrorism policy because, initially, the detainees had no access to U.S. courts to challenge the legality of their detention. The Bush administration defended the use of preventive detention on the grounds that it was undertaken to help forestall another terrorist attack. For those concerned about civil liberties, preventive detention is deeply troubling. Some argue that terrorists should either be tried on criminal charges in civilian courts or released. But what should we do with those detainees who the United States considers dangerous but for whom we have insufficient evidence to convict in a criminal trial? In a country where one is presumed innocent until proven guilty, does preventive detention have a role to play in fighting terrorism? Task You will meet in groups to develop a PowerPoint presentation on the issue of the use of preventive detention in the war on terror. Each group will prepare a different portion of the presentation. Securing Liberty Preventive Detention 3

4 Process 1. The presentation will include these topics: Introduction Background on the use of preventive detention after September 11. This should include a discussion of Guantánamo. History of preventive detention including civilian detention Viewpoint and arguments/evidence in support of the three authors in the preventive detention chapter of Securing Liberty Group opinion on the use of preventive detention 2. Work with other members of your class to develop the introductory slide. 3. Use the articles in Securing Liberty and information you find on the Internet to develop your group s assigned portion of the presentation. You may use the worksheets below to help you organize your information. You are to use graphics, such as photos, cartoons, or images you create, to illustrate your presentation. Your segment must include at least two slides. 4. Work with other members of the class to develop the last segment the class s opinion on the use of preventive detention. Remember to address these questions in your opinion slides: What role does preventive detention play in fighting terrorism generally? In the fight against al Qaeda or the Taliban more specifically? Should terrorists either be tried on criminal charges or released or does preventive detention have a role even where a criminal conviction is not possible? Clearly mark the slides in this segment opinion. Homework Write an essay on one of the following questions: 1. Should the United States engage in preventive detention of suspected terrorists or should it limit detention to those whom it can convict of crimes in civilian courts? What should be done with individuals we consider dangerous but for whom we have insufficient evidence to convict in a criminal trial? 2. In a traditional war between nations, it has long been permissible to detain members of the opposition s armed forces as prisoners of war. Should that authority be applicable to the ongoing conflict with al Qaeda and the Taliban, neither of which is a state, or is the conflict sufficiently different that traditional military detention authority is inapplicable? 5 3. Should Guantánamo remain open or should it be closed? If it is to be closed, what should be done with the individuals detained there? 4. 6 Background Worksheet Instructions: The background segment is designed to put the issue of preventive detention into context by summarizing how the Bush administration used preventive detention post-9/11. Using the readings from the preventive detention and profiling chapters in Securing Liberty and information you may find during your research, cover at least the following topics: 1. Preventive detention in the immediate aftermath of 9/11 2. Establishment of Guantánamo 3. Bush administration justification for preventive detention 4. Controversy over policy 5. 7 History Worksheet Instructions: You are to develop the history segment of the presentation. This segment is designed to put the post-9/11 use of preventive detention in historical context. Using the readings in Securing Liberty and information you may find during your research, cover at least the following topics: 1. Traditional use of preventive detention in wartime. How was it used and what restrictions were placed on its use? 2. U.S. use of preventive detention of civilians in wartime.
