1 Lindsay USD: Exhibit Employee Use of Technology E 4040 Employees will confirm their assent to the AUP electronically when they activate their district account and/or change passwords. The Lindsay Unified School District (district) and the Tulare County Office of Education (TCOE) offers students, staff, parents and community members access to the Internet and other computer technology. To participate in this opportunity, you must understand and practice proper and ethical use of district equipment, software and the Internet. The purpose of this Agreement is to clarify the conditions under which you, the user, will be allowed to use the district's technology. Your use of district technology is a privilege, not a right, and with the privilege comes significant responsibilities. These responsibilities are described in this Agreement. The district may revoke your permission to use its technology services at any time, with or without cause. The district's Acceptable Use Policy ("AUP") is to prevent unauthorized access and other unlawful activities by users online, prevent unauthorized disclosure of or access to sensitive information, and to comply with the Children's Internet Protection Act ("CIPA"). As used in this policy, "user" includes anyone using the computers, Internet, , chat rooms and other forms of direct electronic communications or equipment provided by the district (the "network."). Only current students or employees are authorized to use the network. The district will use technology protection measures to block or filter, to the extent practicable, access of visual depictions that are obscene, pornographic, and harmful to minors over the network. The district reserves the right to monitor users' online activities and to access, review, copy, and store or delete any electronic communication or files and disclose them to others as it deems necessary. Users should have no expectation of privacy regarding their use of district property, network and/or Internet access or files, including . Acceptable Uses of the LUSD Computer Network or the Internet Schools must verify each year students using the computer network and Internet access for that school year have a signed page acknowledging this policy. Students who are under 18 must have their parents or guardians sign this page and schools must keep it on file. Once signed that permission/acknowledgement page remains in effect until revoked by the parent, or the student loses the privilege of using the district's network due to violation of this policy or is no longer a LUSD student. Employees and other users are required to follow this policy. Even without signature, all users must follow this policy and report any misuse of the network or Internet to a teacher, supervisor or other appropriate district personnel. Access is provided primarily for education and district business. Staff may use the Internet for incidental personal use during duty-free time. By using the network, users have agreed to this policy. If a user is uncertain about whether a particular use is acceptable or appropriate, he or she should consult a teacher, supervisor or other appropriate district personnel. Page 1 of 8

2 Educational Purpose 1. The district network has been established for a limited educational purpose. The term "educational purpose" includes classroom activities, continuing education, professional or career development, and high-quality, educationally enriching personal research. 2. The district network has not been established as a public access service or a public forum. The district has the right to place reasonable restrictions on the material that students access or post through the system. Students are also expected to follow the rules set forth in this policy, the student disciplinary code, and the law in their use of the district network. 3. Students may not use the district network for commercial purposes. They may not offer, provide, or purchase products or services through the district network. 4. Students may not use the district network for political lobbying. They may use the system to communicate with elected representatives and to express their opinions on political issues. Unacceptable Uses of the Computer Network or Internet These are examples of inappropriate activity on the district web site, but the district reserves the right to take immediate action regarding activities (1) that create security and/or safety issues for the district, students, employees, schools, network or computer resources, or (2) that expend district resources on content the district in its sole discretion determines lacks legitimate educational content/purpose, or (3) other activities as determined by district as inappropriate. 1. Violating any state or federal law or municipal ordinance, such as: Accessing or transmitting pornography of any kind, obscene depictions, harmful materials, materials that encourage others to violate the law, confidential information or copyrighted materials; 2. Criminal activities that can be punished under law; 3. Selling or purchasing illegal items or substances; 4. Obtaining and/or using anonymous sites; spamming; spreading viruses; 5. Causing harm to others or damage to their property, such as: a. Using profane, abusive, or impolite language; threatening, harassing, or making damaging or false statements about others or accessing, transmitting, or downloading offensive, harassing, or disparaging materials; b. Deleting, copying, modifying, or forging other users' names, s, files, or data; disguising one's identity, impersonating other users, or sending anonymous ; c. Damaging computer equipment, files, data or the network in any way, including intentionally accessing, transmitting or downloading computer viruses or other Page 2 of 8

3 harmful files or programs, or disrupting any computer system performance; d. Using any district computer to pursue "hacking," internal or external to the district, or attempting to access information protected by privacy laws; e. Accessing, transmitting or downloading large files, including "chain letters" or any type of "pyramid schemes". 6. Engaging in uses that jeopardize access or lead to unauthorized access into others' accounts or other computer networks, including but not limited to: a. Using another's account password(s) or identifier(s); b. Interfering with other users' ability to access their account(s); c. Disclosing anyone's password to others or allowing them to use another's account(s). 7. Using the network or Internet for Commercial purposes: a. Using the Internet for personal financial gain; b. Using the Internet for personal advertising, promotion, or financial gain; c. Conducting for-profit business activities and/or engaging in non-government related fundraising or public relations activities such as solicitation for religious purposes, lobbying for personal political purposes. If a student mistakenly accesses inappropriate information, he/she should immediately disclose this access in the manner specified by their school. This will protect them against a claim that they have intentionally violated this Policy. Student Internet Safety Students under the age of eighteen should only access LUSD network accounts outside of school if a parent or legal guardian supervises their usage at all times. The student's parent or guardian is responsible for monitoring the minor's use. Personal contact information includes a student's name together with other information that would allow an individual to locate them, including, but not limited to, their parent's name, their home address or location, their work address or location, or their phone number. Students shall not reveal on the Internet, personal information about themselves or other persons. Students shall not reveal their name, home address, telephone number, or display photographs of themselves or others; Students shall not meet in person anyone they have met only on the Internet; Page 3 of 8

4 Students must abide by all laws, this Acceptable Use Policy and all district security policies. Students will promptly disclose to their teacher or an administrator any message they receive that is inappropriate or makes them feel uncomfortable. They should not delete such messages until instructed to do so by an administrator. Illegal, Unauthorized, and Inappropriate Uses and Activities Illegal Activities Students will not attempt to gain unauthorized access to the district network or to any other computer system through the district network or go beyond their authorized access. This includes attempting to log in through another person's account or access another person's files. Students will not make deliberate attempts to disrupt the district network or any other computer system or destroy data by spreading computer viruses or by any other means. Students will not use the district network to engage in any other illegal act, such as arranging for a drug sale or the purchase of alcohol, engaging in criminal gang activity, or threatening the safety of a person. Trespass is defined as the unauthorized access to confidential files or the unauthorized access, use, or distribution of, or allowing another person without valid authorization access to, confidential information contained in electronic files. Inappropriate Language Restrictions against Inappropriate Language apply to all speech communicated through the district network, including but not limited to public messages, private messages, and material posted on web pages. Students will not use obscene, profane, lewd, vulgar, rude, inflammatory, threatening, or disrespectful language. Students will not post information that could cause damage or a danger of disruption. Students will not engage in personal attacks, including prejudicial or discriminatory attacks. Students will not harass another person. Harassment is persistently acting in a manner that distresses or annoys another person. When a student is told by a person to stop sending him or her messages, they must stop. Students will not knowingly or recklessly post false or defamatory information about a person or organization. Plagiarism and Copyright Infringement Page 4 of 8

5 Students will not plagiarize works they find on the Internet. Plagiarism is taking the ideas or writings of others and presenting them as if they were theirs. Students will respect the rights of copyright owners in their use of materials found on, disseminated through, or posted to the Internet. Copyright infringement occurs when a person inappropriately reproduces a work that is protected by a copyright. Copyright law can be very confusing. If a student is uncertain whether it is appropriate to copy or use material, they should ask a teacher. Vandalism and Harassment Vandalism and harassment will result in cancellation of your privileges. Vandalism is defined as any malicious attempt to harm, modify, and/or destroy computer equipment, configuration of the operating system or software installed on a computer or the network, or the data of another user. This includes, but is not limited to, the uploading or creating of computer viruses. Harassment is defined as the persistent annoyance of another user, or interference in another user's work. Harassment includes, but is not limited to, the sending of unwanted mail. Procedures for Use You must always get permission from a teacher or the person who is supervising the equipment you intend to use before you log on. You must always follow the verbal instructions of the person(s) who are supervising the facility at which you are using the district's technology resources. You must also follow any posted rules, regulations, or instructions. You must sign-in and log on using the appropriate procedures each time on the appropriate log or register in the classroom each time they use the network. In general, it is not appropriate to use the computers to play games during instructional time or times when others may be awaiting access to computers for educational purposes. You are not allowed to install software of any type on any district computer. Doing so will cause you to lose your privileges. If you have software that you would like to install, ask your teacher of the person who is supervising the facility you are using to help you follow the appropriate procedures. System Security and Resource Limits System Security Security on any computer system is a high priority, especially when the system involves many users. You must never allow others to use your password. You should also protect your passwords to ensure system security and your own privileges and ability to continue use of the system. If someone else learns and uses your password and violates any of the terms and conditions of this agreement, you will be held responsible. Therefore, guard your password very carefully. Do not share it even with your best friend. If Page 5 of 8

6 you think someone else may have learned your password, immediately contact the system administrator to have a new password issued. Students will immediately notify a teacher or the system administrator if they have identified a possible security problem. They are not to go looking for security problems, because this may be construed as an illegal attempt to gain access. Students will avoid the inadvertent spread of computer viruses by following the district virus protection procedures. Resource Limits Students will use the district data network only for educational and career development activities and limited, high-quality, personal research. Students will not download large files unless absolutely necessary. If necessary, download the file at a time when the system is not being heavily used and immediately remove the file from the system computer to a personal computer. Students will not misuse district, school, or personal distribution lists or discussion groups for sending irrelevant messages. Students will check their frequently and delete unwanted messages promptly. Students will subscribe only to approved discussion groups that are relevant to school related tasks or career development. Your Rights and Expectations Free Speech A student's right to free speech and access to information applies to his or her use of the Internet. The district may restrict access to materials for valid educational reasons. The district will not restrict access to information and ideas based on viewpoint discrimination. The district network is considered a limited public forum. The district may restrict student speech for valid educational reasons. The district will not restrict speech on the basis of a disagreement with the opinions expressed by a student. Copyright Students own the copyright to works that they have created in school or for a class assignment. If the work is created jointly, each student will have joint ownership of the copyright. Students and their parent/guardian must agree to post student work on the school or district web site. Student work will be posted with the student's copyright notice. Privacy Page 6 of 8

7 Students should expect no privacy in the contents of personal files or while using the district Internet. All student use of the Internet may be supervised and monitored. The district's monitoring of Internet usage can reveal all activities engaged in while using the district network. Routine maintenance and monitoring of the district network may lead to discovery that a student has violated this policy, the student disciplinary code, or the law. An individual search will be conducted if there is reasonable suspicion that a student has violated this policy, the student disciplinary code, or the law. The investigation will be reasonable and related to the suspected violation. Parents or guardians have the right to request to see the contents of their student's personal computer and files at any time. Due Process The district will cooperate fully with local, state, or federal officials in any investigation related to any illegal activities conducted through the district network. In the event there is a claim that a student has violated this policy or student discipline code in their use of the district network, the student will be provided with notice and an opportunity to be heard in the manner set forth in the student discipline code. If the violation also involves a violation of other provisions of the student discipline code, it will be handled in a manner described in the code. Additional restrictions may be placed on the student's use of the district network. Any user violating these rules, applicable state and federal laws, or posted classroom and district rules is subject to loss of Internet privileges and any other district discipline options. In addition, pursuant to State of California law, any unauthorized Internet access, attempted access, or use of any state computing and/or network system is a violation of section 502 of the California Penal Code and/or other applicable federal laws, and is subject to criminal prosecution. Limitation of Liability The district will not guarantee that the functions or services provided through the district network will be without error. The district will not be responsible for any damage a student may suffer, including but not limited to, loss of data, interruption of service, or exposure to inappropriate material or people. The district is not responsible for the accuracy or quality of the information obtained through the system. The district will not be responsible for financial obligations arising through the unauthorized use of the system. Parents or guardians can be held financially responsible for any harm that may result from their intentional misuse of the system. A student may only use the system if his or her parent or guardian has signed a disclaimer of claims for damages against the district. It is not possible for the district to monitor and enforce a wide range of social values in student use of the Internet. Parents/guardians are encouraged to specify to their children what material is and is not acceptable in accord with their family values for their children to access through the district system. I understand that if I violate this agreement, disciplinary action will be taken, including revoking my user account and appropriate legal action.
