3 NOTES ON THE IMPLEMENTATION OF FEMAS FOR BUSINESSES PROCESSING MILK & PRODUCING DAIRY PRODUCTS & BY-PRODUCTS Sector Notes are provided to assist FEMAS participants and assessors in establishing some background knowledge of specific feed industry supply sectors where issues may exist that are uncommon, or of less relevance, in other sectors. These Notes are not necessarily exhaustive. These Sector Notes are relevant to businesses involved in the processing of milk or production of dairy products and by-products in both liquid and powder form for use in animal feed. They apply equally to products in any of the following three categories: 1. Products produced specifically for animal feed 2. Products downgraded from human food status and offered as animal feed 3. By-products of processing milk for other purposes and which are offered as animal feed With reference to Commission Regulation (EU) No 68/2013 of 16 January 2013 Catalogue of Feed Materials, these Sector Notes cover feed materials in the category: Milk products and products derived thereof. These Notes are laid out in the same format as the FEMAS International Core Standard. Where additional comment is necessary, the clause reference is to the appropriate section of the FEMAS International Core Standard. It is emphasised that the comments included in this document are intended to assist in the application of the corresponding requirements of the FEMAS International Core Standard and are not to be considered in isolation. For clauses where no additional comments are provided in this document, the original requirements of the FEMAS International Core Standard continue to apply without any additions or exclusions. In subsequent issues, additions and amendments to these Notes will be shown in blue italics, for ease of reference. The expert knowledge and assistance of members of the UK Dairy Industry is gratefully acknowledged in preparing these Sector Notes. Page 3 of 8

4 1.10 Definitions By-product (Co-product): Product produced as the result of a process primarily intended to produce a different product. Dairy Products and By-Products: Milk products and products derived from milk produced specifically for animal feed, milk products and products derived from milk downgraded from human food status and offered as animal feed, milk by-products and by-products derived from processing milk for other purposes and which are offered as animal feed. For additional definitions refer to FEMAS International Core Standard Page 4 of 8

5 SECTION 3 RESOURCES AND GOOD HYGIENIC PRACTICES 3.4 Storage Facilities Due to the nature of the products concerned, particular attention must be given to the avoidance of fermentation and the formation of biogenic amines, caused by the degradation of proteins during storage. To prevent nesting and other pest access, breather pipes on bulk tanks must be suitably protected. Breather pipes must also be downward facing to prevent ingress from rainwater and other potential contaminants. 3.8 Cross Contamination Participants must prevent products that have not been heat-treated (e.g. raw milk, raw milk washings) from coming in contact with heat-treated products. Wherever heat-treated products and products that have not been heat-treated do come into contact with each other, all affected product must be managed as raw Pest Control To prevent rodent access, all detachable hoses must be capped when not in use Process Water & Water Used For Cleaning Purposes Participants must prevent process or cleaning water containing potential microbiological contaminants or unsafe levels of residual cleaning agents from coming into contact with Dairy Products. When Cleaning in Place (CIP) systems are in operation, applicants must be able to demonstrate that residual cleaning agents are not present in Dairy Products at levels that may be detrimental to livestock. Participants must implement testing regimes of any water held in tanks on site in addition to any other routine testing of water supplies. Risk assessment must be undertaken to determine the appropriate type and frequency of tests undertaken Melamine has been identified as an intentional contaminant of Dairy Products from certain origins, with the intention that the Nitrogen contained in the Melamine will indicate enhanced protein during testing of the Dairy Products. Melamine contamination is harmful to livestock species (as well as humans) and its inclusion in products certified by FEMAS is prohibited. Page 5 of 8

6 SECTION 4 TRANSPORT REQUIREMENTS Inspections of Land Transport Prior to Loading Where the health and safety of quality personnel would be put at risk by climbing onto road tankers to carry out internal inspections, participants must comply with one of the following: Allow safe access by provision of safety platforms from which inspections may be done Nominate and train drivers to undertake inspections (in which case records of training must be held) Utilise risk assessment methodology to put in place alternative controls that will ensure issues of cross-contamination can be avoided (e.g. by use of dedicated tankers). In any such assessment, consideration must be given to the potential effects of inadvertently mixing different grades of the same product. Page 6 of 8

7 SECTION 5 PRODUCT SAFETY MANAGEMENT Feed Ingredient Specifications Where products offered for feed use contain added ingredients (for example salt, trace elements, colours, flavours or other additives), this must be stated in the specification Hazard Analysis / Identification (CODEX Principle 1) Wherever dairy products rejected for food use are designated for animal feed use, participants must demonstrate that no potential hazards are being introduced into feed products as a result of this practice. Specific consideration must be given within the risk assessment to the appropriate management of liquid milk and other dairy products returned from stores outside the control of the participant, where unknown hazards may have been introduced. Specific consideration must be given to the appropriate control of any food additives used on site and the effect on any feed products of food products containing colours or flavours. 5.2 Raw Materials Participants must demonstrate controls with regard to potential contamination with antibiotics and other veterinary medicines. Where their presence is detected in products intended for feed use, potential purchasers must be informed of this in writing. 5.6 Process Control Under normal conditions, participants must demonstrate that a sufficient temperature and time is used during processing of feed ingredients to achieve effective pasteurisation and no products may be dispatched for livestock consumption without first being pasteurised or otherwise effectively heat-treated to destroy potential pathogens. The exception to this is where there is regulatory provision for raw milk to be sent direct to farm and all requirements relating to this are met in full by the participant. Page 7 of 8

This section of the Sector Notes is intended to assist participants and assessors in identifying specific regulations that should be considered with regard to this sector. It is not necessarily exhaustive nor does it reduce the obligation of both participants and assessors to ensure they are familiar with any regulations relevant to this sector. In addition to those regulations that apply to all feed ingredients, suppliers of Dairy Products & By-Products based in, or supplying to, the EU must be aware of the following specific regulations: 1. Regulation (EC) No 1069/2009 Laying down health rules concerning animal byproducts not intended for human consumption 2. TSE Regulations 2006 (UK only) 3. Regulation (EC) No 79/2005 Covering the use of milk, milk-based products and milkderived products, defined as Category 3 4. Regulation (EC) No 1292/2005 Amending Annex IV to Regulation (EC) No 999/2001 of the European Parliament and of the Council as regards animal nutrition 5.
