1 L AT VIAN PRESIDEN CY OF T HE PERMANEN T C OMMITTEE ON CADASTRE IN T HE EU Digital Europa Towards Cadastre 2034 CONFERENCE AND PLENARY MEETING MAY 2015, RIGA CURRENT ESSENTIAL EVENTS IN CADASTRE AREA Most of the essential events mentioned by the country representatives are legal changes and successful attempts to make the cadastral information digital e.g. in Austria the change of Surveying law requires scanning about 5 million surveying documents of the archives in Cadastral offices, as well as the homogenisation of control points in order to shift to ETRS89 and UNTM fully electronic surveying documents. Estonia is developing the new e- Cadastre software; Greece is about to complete the Hellenic Cadastre including the forest maps and to establish a permanent structure of the operational cadastre. In Poland there is an ongoing first stage establishment of the integrated system of Real estate information covering establishment of a Central Repository of copies of cadastral data maintained in form of local databases as well as adjustment of cadastral data to the requirements of integrated system of real estate information in 58 counties. Portugal is about to define a new Cadastral model and a supporting legislation to regulate the activity of Real Property Cadastral Professional. Slovakia and Slovenia are working on information systems. In Slovakia there are two main projects under development ESKN and CSKN (electronic services for real estate cadastre) and a few little projects for ensuring of progressive development of the system (concerning the development of application programs for creating and updating of digital data, but in Slovenia there is an reengineering of cadastral information system (database and applications) happening, improving the positional accuracy of graphical data. Also in Sweden there is an ongoing development of the existing National Cadastre to a continuously updated Cadastre, including rights & restrictions and physical plans together with a nationwide Cadastral map (index map). Project is expected to be finished in Meanwhile there is an ongoing development of the geometrical quality of the property boundaries in the National Cadastre and an investigation of the possibilities to use the coordinates in the National Cadastre as the legally binding property boundaries. Also in the Netherlands the use of preliminary boundaries is topical together with the aim to increase the quality of the cadastral maps and the new environmental protection act which deals with public rights and restrictions affecting the complete legal situation of a property. UK is on the move to deliver Land Registration services through digital channels, and release open data in a sustainable manner. Cyprus has recently completed the General revaluation of Cyprus in y.2013 prices and currently is developing e-applications and DLS Portal following the INSPIRE directive. In Cyprus there is also a current upgrading of the Cyprus Integrated Land Information System. Czech Republic is working on the Registry of territorial identification, addresses and real estate and dealing with some quality improvements what refer to the Information system of the cadastre of real property. In Denmark there is a plan that registration of condominiums and buildings which have different owner from the parcel will be moved from the Land Registry to the Cadastre. Hungary meanwhile is improving land office procedures according to the user requirements. 1

2 Latvia has launched significant project to ensure simplification of real property registration procedures. According changes in legislation which came into effect on 1 st of January, 2015, the services of Cadastre and Land Register have been integrated (one-stop agency principle) and level of data synchronization in both systems is increased. To provide more effective public administration and wider use of e-services, Latvia has developed and implemented a Digital archive - document repository that provides access to digital documents and their use. Latvia is working on e-service Cadastral data for state institutions and municipalities distribution on the single state and local government portal latvija.lv as well as. Also Lithuania is working on electronic services introducing integrated tools that have been developed in order to enable signing electronic files of land parcel cadastral data with electronic signature. France, Romania and Spain have indicated their ongoing and implemented projects in a very detailed manner i.e. in France, in 2014, the DGFiP and the IGN decided to make converge their mapping by producing a new French cadastral map named RPCU that will be managed by the DGFiP. Furthermore, this new cadastral map will be continuous. So, it will answer better to the needs of the users (especially the municipalities) and geographic information stakeholders in France. Concerning the tax system, the French cadastre leads two projects aiming at updating the assessments of the real estate for the purpose of a fair tax collection (developed property tax). The National Agency for Cadastre and Land Registration of Romania (ANCPI) has started the National Programme for Cadastre and Land Book for the period , which seeks to extend the systematic registration of property in 2337 administrative-territorial units from the 3181 existing in Romania. Currently it has 8 contracts that are under development for systematic registration of property in 44 administrative-territorial units in the rural areas of the country. The contracts have been concluded within the Project on Complementing EU Support for Agricultural Restructuring CESAR. The project aims at free registration of properties covering approximately 375,000 ha and involving approximately 200,000 people. Within the Regional Operational Programme there has been included the Priority Axis 11 Cadastre, which aims at systematic registration of proprieties from 793 administrative-territorial units in the rural areas of Romania. Romania is also implementing the project for updating the integrated information system for cadastre and land book eterra3, financed through EU funds. ANCPI has currently under development a project financed through EU funds Achievement of an online payment system for the services provided by ANCPI Code SMIS It actually provides online submission of applications through a 100% functional procedure for notaries (47% of them use this facility) and for licensed surveyors (35% of them use this facility), and has implemented a procedure to view the data for the National Agency for Fiscal Administration and the National Anticorruption Directorate. In Spain the cadastral regularization procedure has been made to combat real estate tax fraud and to boost local finance together with the implementation, management and exchange of electronic documents and files of Cadastre. There has also been a change in the culture of work of the Spanish Cadastral organization. In Finland there is a preparation for introduction of 3D properties in 2017, the simplification of cadastral survey procedure is also an ongoing event together with introduction of digital customer process. There is also a plan to abolish the restrictions concerning the mandate of the cadastral surveyors depending on their level of education. What refers to Ireland, there is an ongoing development of a national real-world object based topographic reference framework, known as Prime2. This framework is based in industry standards, IS system & vendor agnostic and is has 3-Dimensional object management capability. In 2014 the Italian Parliament approved a legislative decree charging the Government with the task to issue rules aimed at a revision of the cadastral valuation system related to buildings. The main purpose of this revision is a significant improvement of the quality of the tax basis resulting from the economic data registered in 2

3 cadastre, making them more consistent with the actual market data, but Luxembourg currently is working on establishment of a coordinate cadastral map. FUTURE BUSINESS CHALLENGES IN CADASTRE AREA Most of the countries have mentioned the need of integration of the current information systems what refer to the cadastral information. Hungary is dealing with the centralization of the IT system. Ireland has the challenge of implementing the government decision to integrate the three existing organizations responsible for Survey, Registration & Valuation into a single organization with the associated activities of data and workflow integration. The impact of the development of an e-conveyancing service for Ireland has also been noted. Poland is dealing with further development of integration of cadastre within the land register and modernization of cadastral data in terms of form, scope and quality. In Slovakia there is an ongoing centralization of the cadastral database to interconnect the cadastral information system with other public administration information systems, while in Slovenia there is a wish to offer cadastral data as an interoperable dataset in the future including services for spatial planning and real estate taxation processes, but in the Netherlands professionals are seeking for a sustainable business model for the use and development of the Cadastre as a key register within the scope of e-government and public savings, including the part of the cadastral data as open data. In Sweden there is a challenge changing the existing main frame environment and cadastral handling systems to a modern technical environment as well as modernizing the legal framework for Cadastre and other register relevant to the geodata field. In Italy the main challenge is a full implementation of an integrated management system for the different real estate information data bases through the most recent technological tools currently available. Towards real estate information Lithuanians are planning to revise the Law on the Real Property Cadastre and the Law on the Real Property Register and to prepare new wordings of the mentioned laws. A working group was established for this purpose and was assigned to revise the existing legislation by July, 2015 and to prepare draft laws regulating real property cadastre and register. These draft laws are intended to differentiate the provisions of legal procedures related to real property formation, determination of real property cadastral data, regulation of surveyors activities and real property registration into separate laws. In Portugal a Legal reform of the actual model to implement a national cadastral coverage is planned, including implementation of Simple Operations promoted by the real estate owner, promotion of training courses for the new Real Estate Cadastral Technician profession, legal regulation and implementation of the cadastral actualization processes and promotion and distribution of Information of Cadastral nature. Meanwhile Spain has indicated the improvement of the procedure of adaptation of the values of the real estate to the market and mentioned the need of a new law to achieve the necessary coordination between the Land Registry and the Cadastre, but in Greece the most important challenge is the fulfillment of the organizational, financial, legal and institutional conditions for the completion of the Hellenic Cadastre in time, in scope and in quality. 3

4 Estonia is planning principal changes in the cadastral legislative basis implementing an all new Land Cadastre Act. Also Latvia is working on the development of new State Cadastre Law and new object-oriented Cadastre Information System as well as has begun work of data collection for new Information System of Restricted Territories. Romania s future business challenges in cadastre area are aims to achieve an uniform and comprehensive database of the real estate throughout the country, to enact a new law for the integrated system for cadastre and land book replacing the current law of cadastre and land registration, to extend the procedure for online submission of applications towards other categories of users: banks, bailiff and to extend the online access to data regarding properties and owner. Currently the procedure is available for the National Agency for Fiscal Administration and the National Anticorruption Directorate. Romania is also eager to implement projects financed through EU funds for instance what refer to the implementation of online payment system, setting up a technical framework needed for achievement of Romanian NSDI (INSPIRE substantiated decisions and coherent policies at national level to fit in an unitary European frame) and achieving a national electronic register of street names (RENNS). Czech Republic is dealing with the simplification of the payment for data including credit cards and online payments. A serious challenge for most of the countries is a limited funding e.g. Cyprus has to deal with reduction of funding and resources meanwhile with handling large scale simultaneous projects and opening up data. In Finland cadastral activities are self-financed with no government subsidies involved dealing with a fact that there are no licensed or private surveyors and the demand on cadastral surveys depends on the general economic situation. In Austria there is a public discussion about free access to cadastral information renewal of web portal. Also UK is dealing with lots of challenges and the main ones are around identity management i.e. there are no official identity cards in the UK, but there must be a process to identify an individual in order to tenable high value online services. Alongside the Land Registry is working to move IT infrastructure from the long surveying systems to a more modular approach that can better supported to deliver the digital services, including a restructuring of data holdings to be more granular The move to digital service provision brings challenges around the organizational structure of Land Registry and there is an ongoing hard work to understand and implement a strategy to facilitate this change. INNOVATIVE SOURCES TO UPDATE CADASTRAL DATA Greece, Hungary, Sweden, and the UK have not indicated any innovative sources this time. In Estonia there is a plan to dynamically link the cadastral data to topographic database for taking over changes, while address data are already linked with the e-cadastre software. Cyprus has indicated data capture on field, aerial photography and remote sensing as innovative sources used in their country including crowd sourcing as a future option, while in Czech Republic the crowd sourcing is used to correct the insufficiencies for address points of parcels and buildings. In Slovenia the crowd sourcing is used only at level of registries, but not at level of Cadastre. Luxembourg has indicated that there is no need of crowd sourcing in their country. Many countries are using photogrammetry e.g. in Poland photogrammetry is used for modernisation of cadastre, especially cadastral measurements. In Ireland the digital photogrammetry is used in combination with field surveying to update the topographic reference data. System links to the Local authority planning systems 4

5 are being developed to automatically identify building changes as means of change detection for the survey updating of the reference topographic mapping. Also in France the photogrammetry is used as well as the collaboration with the IGN and the chartered surveyors in order to improve the graphic representation of the parcels on the cadastral map in the framework of the RPCU project. Austria, Italy and Romania have indicated the importance of ortophoto maps to update the cadastral data. In Italy procedures based on the integration of high-resolution digital ortophotos, digital landscape and surface models, and cadastral cartography in vector format are used for the identification of buildings that although existing are not registered in cadastre. Austria is using remote sensing digital ortophotos, but Romania has also noted that ANCPI has developed the Romanian Position Determination System ROMPOS, which provides accurate positioning in the European coordinate reference system ETRS89 through the National Network of Permanent GNSS Stations. Also Finland is using the modern methods like laser scanning for updating the topographic database which is used as a background material in the cadastral work. In Denmark there are private licensed land surveyors, who report changes of boundaries to the Danish Geodata Agency, therefore innovative sources to update cadastral data are not used due to the fact that in Denmark there is a 100% registration of the entire country already, sometimes reports of errors in the cadastral maps are received. Also in Lithuania the cadastral data are determined by traditional methods and the principles of updating the cadastral data will be discussed by drafting new specific laws. In the Netherlands there is a trend to let professional partners to do the part of the work, in the long run expecting for end users to take up this role for instance in the cadastral surveying. In the Netherlands the investigation of the use of drones to capture cadastral boundaries in areas that are difficult to access has been done. In Spain there is a specific usage of Lidar i.e. within the Cadastral regularization procedure to combat real estate tax fraud and to boost local finance Lidar and other technics are used. Slovakia has indicated the planned interconnection with other public administration registers e.g. population register, register of individuals, address register etc. by which the cadastral data will be updated. In Latvia in cooperation with two universities, there is started research project of the using LiDAR for building and land use identification. In Portugal there is used ortophoto imagery with 10 cm geometric resolution. ONGOING OR PLANNED INSTITUTIONAL OR FUNCIONAL CHANGES IN THE CADASTRE INSTITUTIONS Denmark, Estonia, Hungary, Slovenia, Sweden, Spain and Portugal have indicated that there are not any ongoing or planned institutional or functional changes in their countries, including cadastral organizations. There are countries that are planning following changes: in Cyprus the government has plans for restructioning the public service, Czech Republic expects the implementation of the Civil Service Act which does not include changes in the cadastral administration system, but refers to the job positions of single employees. The Netherlands is increasingly moving into a networked society adapting their workings to this new environment. The changes firstly will be functional and in the end they may lead to institutional changes. Latvia (State Land Service) is entrusted with two new functions in accordance with Land Management Law: development and implementation of land consolidation project and development of marine cadastre. 5

6 In Lithuania the institutional-functional system that was established on July, 2010 is currently in operation and changes within this system are possible when several legal acts will be drafted and enacted. In France there is an ongoing survey related to the organization of the cadastral offices on the national territory (a better organization with a refocusing on the technical mission to give priority to update the cadastral map and to the RPCU project). There is an important ongoing reorganization of structure of cadastral offices in Austria. Also in Slovakia (October, 2013), there have been changes in local cadastral registries which were incorporated under the district offices, cadastral departments which are managed by the Ministry of Interior of the Slovak Republic. In Finland (January, 2010) the Land Registry activities were moved from local courts to the National Land Survey (NLS) including more than 200 employees, while in January, 2014 the NLS was reorganized and the regional unit structure was changed to national unit structure, but in January, 2015 the NLS, the Finnish Geodetic Institute and a part of the ICT activities in the Ministry of Agriculture and Forestry were merged. In Romania operational departments for systematic registration of property will be established within ANCPI and the subordinate territorial units in order to implement the National Programme for Cadastre and Land Book within ANCPI and the subordinate territorial units, it is planned that these departments will oversee the coordination and achievement of systematic registration services at national and regional level. Also in Greece there have been institutional changes i.e. the National Cadastre and Mapping Agency has incorporated all the competencies of the Hellenic Mapping Organization (which doesn't exist any longer from July 2013) and Greeks are in the middle of establishing the sector of Geospatial Data and Cartography. In Ireland, in accordance with Government Policy, the Property Registration Authority (Land Registry), the Ordnance Survey and the Valuation Office are going to be merged into a new state body. Draft legislation named Tailte Éireann for the establishment of this new body, states that the new body will also be responsible for the management of National Spatial Data Infrastructure (NSDI). Meanwhile in the UK, the national mapping agency Ordnance Survey has recently moved from being a trading fund to a government owned company. At the end of 2012, an important organizational change was approved in Italy, as a part of a set of measures aimed at a public spending review. As a result, from the December, 2012 the Italian Cadastre and Land registry organization (Agenzia del Territorio) was incorporated into the Tax agency (Agenzia delle Entrate), already charged with the management, verification and collection of taxes. Following the incorporation of Agenzia del Territorio, Agenzia delle Entrate was assigned with all the related activities, that is: the cadastral, geocartographic and appraisal services, the management of the Land registry and the real estate market monitoring system. The implementing decree provided the integration of «no core» processes by 2013 and of «core» processes by the end of The aggregation of the two agencies is to be placed in a process of continuous evolution aimed at further improving the performances of organizations with a high level of efficiency. Thus, it is a complex operation and its realization in the middle term is going to involve a reorganization of the central and local branches, and then the re-engineering of work processes. In Poland the governmental programme for development of Integrated System of Real Estate Information is prepared. 6
