1 Environmental Public Health ORDER OF AN EXECUTIVE OFFICER CLOSED FOR TENANT ACCOMMODATION PURPOSES ORDER TO VACATE To: And To: Todd Eugene Hummelle the Owner All Occupant(s) of the following Housing premises: RE: Those housing premises located in Ponoka, Alberta and municipally described as: The converted garage unit, Oasis Motel, Avenue Crescent Lot 2B, Block 47, Plan WHEREAS I, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended; AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder in any manner the prevention or suppression of disease, namely: a. Lack of operational smoke alarm; b. Exterior door is in disrepair; c. Washroom is not properly ventilated and building materials are not conducive to high humidity conditions or suitable to sustain moist environments; and d. Bedroom door does not open from the inside. AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Housing Regulation, Alberta Regulation 173/99, and the Minimum Housing and Health Standards exist in and about the above noted premises, namely: a. Unit does not have an operational smoke alarm. This condition is in contravention of Section 12(a) of the Minimum Housing and Health Standards, which states: Smoke alarms within dwellings shall be installed between each sleeping area and the remainder of the suite and, where hallways serve the sleeping areas; the smoke alarms shall be installed within the hallway. Smoke alarms shall be operational and in good repair at all times. b. Exterior door is damaged and no longer in good repair or weatherproof condition. Metal garage doors and windows within the doors do not provide sufficient insulation during the winter months. These conditions are in contravention of Section 2(b)(i) of the Minimum Housing and Health Standards, which states: All windows and exterior doors shall be; maintained in good repair, free of cracks and weatherproof. c. Areas of the floors, walls, and ceilings throughout the premises are missing, damaged, or in a state of disrepair. Bedroom walls are constructed of various materials that are not finished to make them easy to clean. Unit is missing or has damaged baseboards and window frames. Washroom vanity is damaged and no longer in good repair. Washroom is not supplied with a door. These conditions are in contravention of Section 5 of the

2 Page 2 of 5 Minimum Housing and Health Standards, which states: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. d. Bedroom walls do not appear to be structurally sound. This condition is in contravention of Section 1(a) of the Minimum Housing and Health Standards, which states: The housing premises shall be structurally sound. e. Bedroom door is not openable from the inside. This condition is in contravention of Section 5(2) of the Housing Regulation AR 173/99, which states: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. f. Building materials in washrooms are unfinished and not suitable to sustain moist environments or capable of withstanding regular wet washings and sanitizing. Washrooms are not equipped with water tight seals and/or are in disrepair. Space above shower surround is open to the remainder of the unit. These conditions are in contravention of Section 5(a) of the Minimum Housing and Health Standards, which states: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, non-absorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. g. Plumbing system components throughout the converted garage unit are in disrepair and not connected to the sanitary sewer. These conditions are in contravention of Section 6(a) of the Minimum Housing and Health Standards, which states: Every housing premises shall be connected to the public sewage system, or to an approved private sewage disposal system. The plumbing system and the sanitary drainage system or private sewage disposal system, as the case may be, including drains, fixtures, traps, vents, stacks, waste disposal facilities, pumpout sewage holding tanks, septic tanks and the disposal system shall be maintained in a proper operating condition. And Section 6(c) of the Minimum Housing and Health Standards, which states: All plumbing fixtures shall be serviceable, free from leaks, trapped and vented to the outside. h. Washroom is not supplied with mechanical or natural ventilation. This condition is in contravention of Section 7(c) of the Minimum Housing and Health Standards, which states: All rooms containing a flush toilet and/or bathtub or shower shall be provided with natural or mechanical ventilation. i. Electrical outlet within 3 feet of water source that does not appear to be properly protected through a ground fault circuit interrupter (GFCI) device. This condition is in contravention of Section 11 of the Minimum Housing and Health Standards, which states: Every housing premises shall be supplied with electrical service. Outlets, switches and fixtures shall be properly installed and shall be maintained in a good and safe working condition. j. Food preparation contact surface areas are not smooth and easy to clean. This condition is in contravention of Section 14(a)(iii) of the Minimum Housing and Health Standards, which states: Every housing premises shall be provided with a food preparation area, which includes: a counter or table used for food preparation which shall be of sound construction and furnished with surfaces that are easily cleaned. k. Duct tape has been installed between the South wall and floor to prevent entry of ants into the unit. This condition is in contravention of Section 16(a) of the Minimum Housing

3 Page 3 of 5 and Health Standards, which states: The owner shall ensure that the housing premises are free of insect and rodent infestations. l. Windows throughout the unit are not equipped with effective insect screens. This condition is in contravention of Section 2(b)(iii) of the Minimum Housing and Health Standards, which states: During the portion of the year when there is a need for protection against flies and other flying insects, every window or other device intended for ventilation shall be supplied with effective screens. AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to be Closed for Tenant Accommodation Purposes. NOW THEREFORE, I hereby ORDER and DIRECT: 1. That the occupants vacate the above noted premises on or before October 31, That the Owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely: a. Install working smoke alarm in the proper location(s) throughout the premises. b. Replace or repair exterior door so that is in good repair and maintained in weatherproof condition. c. Ensure premises is constructed and maintained in a weatherproof condition and adequately insulated to allow sufficient thermal barrier during the winter months. d. Repair or replace all damaged areas of walls, ceilings, floors and floor coverings to ensure that they are in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders them easy to clean. e. Ensure unit is supplied with baseboards and window trim that are in good repair. f. Replace washroom vanity so that it is in good repair. g. Repair or replace interior doors so that they are in good repair and in operable condition. h. Ensure walls are constructed in accordance with the Alberta Building Code and are structurally sound. i. Ensure the washroom is provided with walls, floor and ceiling that are smooth, non-absorbent to moisture, easy to clean, and walls form watertight joints with each other at the floor and ceiling. Ensure sealant around shower and sink is maintained in good repair. j. Repair plumbing system so that fixtures are in good working condition, properly vented, free of leaks, and drain to the sanitary sewer. k. Install mechanical exhaust fan in washrooms that vents directly to the outside and ensure it is maintained in good working condition. l. Ensure all electrical outlets, switches and wires are in safe working condition and are provided with appropriate covers. m. Ensure food contact and preparation surfaces are constructed of material that is smooth, easy to clean, and impervious to moisture. Food contact surfaces must be maintained in good repair. n. Ensure premises are constructed to prevent the entry and harborage of pests. o. Ensure all openable windows are equipped with effective insect screens.

Provide a report prepared by a Safety Codes Officer confirming that the premises are constructed and maintained in compliance with the Alberta Building Code with particular details on the corrective repair work required in this Order. 3. That until such time as the work referred to above is completed to the satisfaction of an Executive Officer of Alberta Health Services; the above noted premises shall remain closed for tenant accommodation purposes. The above conditions were noted at the time of inspection and may not necessarily reflect all deficiencies. You are advised that further work may be required to ensure full compliance with the Public Health Act and regulations, or to prevent a public health nuisance.
