2 Review on: Bali Declaration on Technical Cooperation for Consumer Protection in Southeast Asia 5-7 Nov 2006 in Bali The results are the establishment of three entities: 1. The ASEAN Coordinating Committee on Consumer Protection (ACCCP) 2. The Southeast Asian Consumer Protection Agencies Network (SEA-CPAN) 3. The Southeast Asian Consumer Council (SEA-CC)

3 Review on: Indonesian Proposal Related to the Establishment of the Southeast Asian Consumer Protection Agency Network 1. Indonesia supporting ASEAN Coordinating Committee on Consumer Protection (ACCCP). 2. Indonesia proposed the establishment of the Southeast Asian Consumer Protection Agencies Network (SEA- CPAN) and will host the secretariat while a waiting the establishment of ACCCP. 3. Two important projects for SEA-CPAN are a Rapid Alert System for Unsafe Products and a Cross Border Consumer Redress Mechanism.

4 Objectives of SEA-CPAN 1. Having informed consumers with a proper redress mechanism at their disposal 2. Ensuring that only safe products are placed into the market 3. Stopping rogue traders and unfair commercial practices

5 Closing Speech by ASEAN Secretariat (Mr. Azmi Mat Akhir on behalf of Mr. Ong Keng Yong) 1. The consumer protection policy will inherently improve quality of life. 2. ASEAN needs to consider a formal or non formal dispute settlement institution 3. Conveying all recommendations and proposals of the Conference to SEOM.

6 What We Have Done Consumer Protection Issues in the ASEAN Charter In the SEOM meeting in Cebu, Philippines, the consumer protection issues have been included in the (draft) of the ASEAN Charter: To promote economic growth and financial stability in the region through measures such as the harmonization of economic policies and regulations; introduction of company laws and corporate governance; enhanced domestic financial sector regulations, intellectual property law, elimination of tax obstacles and developing regional competition policies; and, ensuring a high level of consumer protection.

7 Roadmap to SEA-CPAN In order to establish a rapid information alert system on unsafe products and a cross border redress mechanism, the following roadmap has been agreed: 1. Establishing a secretariat. Indonesian become the secretariat. 2. Technical Meetings for Consumer Protection Agencies, which Indonesia will host. 3. Listing down all consumer protection agencies and authorities 4. Compiling an inventory of existing redress mechanisms and agencies responsible for product safety. 5. Identifying each country s legal framework. 6. Assisting other member countries to develop a consumer protection framework. 7. Accepting the Malaysian proposal to conduct a training program on consumer protection every year.

8 The Ongoing Process of Indonesia s Proposal: SEA-CPAN TECHNICAL MEETING The objectives of SEA-CPAN Technical Meeting are below: Implementing the relevant provisions of the Bali Declaration on Technical Cooperation on Consumer Protection 2006 and KL Plan of Action on Consumer Protection Supporting the establishment of the ASEAN Coordinating Committee on Consumer Protection (ACCCP). Discussing proposals for regional cooperation on Cross Border Consumer Redress and Rapid Alert System for Unsafe Consumer Products in Southeast Asian Consumer Protection Agencies Network (SEA-CPAN). Forming the working group on Cross Border Consumer Redress and the working group on Rapid Alert System for Unsafe Consumer Products. Planning roadmaps for the implementation of mechanisms for Cross Border Consumer Redress and Rapid Alert System for Unsafe Consumer Products in Southeast Asian Consumer Protection Agencies Network (SEA-CPAN).

9 Basis of SEA CPAN Projects: For supporting the operationalisation of two important projects : SEA- RAPEX and SEA CBCR. The SEA-CPAN secretariat has been established and started working in May SEA RAPEX and SEA CBCR are consumer protection networks and are entirely voluntary to participate within for ASEAN member countries. The Working Group on SEA RAPEX and SEA CBCR and will be absorbed as Sub-Committees of ACCCP once ACCCP is established within the ASEAN secretariat. We invite all ASEAN member countries to participate actively and provide their technical inputs to make these two projects a success. It is critical that staff who are technically competent in product safety and consumer redress issues attend the SEA CPAN Technical Meeting and become members of the relevant working group

10 SEA CPAN is a consumer protection network and will be dissolved once the ACCCP is established within the ASEAN secretariat. We need to demonstrate our commitment to the ASEAN secretariat that we are serious about regional consumer protection. We welcome your active participation in launching SEA RAPEX and SEA CBCR after (in) the second technical meeting by the end of this year,(if it is completed).

11 The Latest Information : To postpone the technical meeting from July to 30 31July Intensive discussion among Indonesia s related parties including local experts and foreign advisors on Consumer Protection. To inform Thailand, Vietnam, Lao PDR, Cambodia project of SEA-CPAN in Korea. Following up SEA-CPAN roadmap ( from Bali Declaration ) by SEA-CPAN secretariat, including : list of contact persons in 10 ASEAN countries, legal framework, dispute settlement mechanism, etc. SEA-CPAN secretariat has been established and started (working) in May 2007.
