4 1. Introduction This document sets out the audit and inspection programme of DG Health and Consumers for 2009 with a detailed inspection programme for January to December. There is always a degree of uncertainty attached to any SANCO inspection plan. Of necessity, it must remain flexible to enable it to respond to emergencies, other urgent issues and unforeseen circumstances. As in previous years, adjustments to the plan will be required as the year progresses. Inspections in response to emergencies can only be made by cancelling or postponing planned missions. Also, the carrying out of certain inspections will depend on the timely availability of resources. An update of the programme will therefore, as usual, be presented in June The programme is also published at the DG Health and Consumers website: 2. Number and distribution of audits and inspections As shown in table 1, a total of 255 audits and inspections are planned for the 2009 programme. This figure includes the specific audits which supplement the general audits planned in 9 Member States in 2009 (see Chapter 3. Audits and inspections in Member States). As usual, audits and inspections in the food safety area make up the main part of the programme (68%). However, in line with the "farm to fork" approach, a large number of food safety inspections naturally also cover animal health and welfare elements. 12 and 5% of inspections, respectively, will specifically focus on controls in the animal health and welfare areas, and 7% of inspections are targeted at phytosanitary controls. General reviews - inspections to develop and/or update country profiles and to review overall progress on follow-up to FVO report recommendations make up a further 8% of the planned audits and inspections. 5 Table 2 provides an overview on the geographical breakdown of audits and inspections in % of the audits and inspections will take place in the European Union. In EFTA countries, 4 inspections are planned, while 4% of inspections will take place in candidate countries, and 38% in other third countries. Taking into account that one sixth of the audits and inspections in the EU deal with Member States' import control systems, overall, controls with respect to third countries' export of feed, food, plants and animals amount to more than 50% of the programme. Table 2: Geographical breakdown of audits and inspections: COUNTRY No. of audits and inspections % EU EFTA countries 4 2 Candidate countries 11 4 Other third countries Total Audits and inspections in Member States As outlined above, the FVO will carry out nine general audits in the framework of the Official Feed and Food Controls Regulation 1 in 2009, namely in Belgium, Cyprus, Finland, Greece, Latvia, Lithuania, Portugal, Slovenia and the United Kingdom. Following a pilot phase in 2007 and 6 general audits in 2008, 2009 will be the second year of the introduction of a 3-year audit cycle to all Member States. Following the integrative approach introduced by the Regulation, the main purpose of the general audits, in accordance with Article 45, is to verify that, overall, official controls take place in Member States in accordance with the multi-annual national control plans referred to in Article 41 of the Regulation and in compliance with Community law. The general audits will be supplemented by specific audits across all main control systems; the list for each of the 9 Member States is determined by combining the regular prioritisation process with a desk analysis of the multi-annual national control plans and additional information such as Member States' own audit reports. In the remaining 18 Member States, inspections will mainly focus on follow-up to issues identified in previous audits and inspections, and to prepare for the audits in Table 3 gives an overview on all inspections and specific audits planned in Member States: 1 Regulation (EC) No. 882/2204 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules. 4

Inspections in EFTA Countries Inspections in EFTA countries will be done in the framework of the agreement on the European Economic Area (EEA agreement) and agreements between the European Union and Switzerland. The inspection to Iceland will be a joint mission between the EFTA Surveillance Authority (ESA) and the FVO. While the main part of these inspections is targeted at a review of existing approvals of major trade partners and follow-up to previous missions, there are also a number of new requests for approval which will need to be evaluated. The readiness of application files (such as, for example, timely replies by competent authorities to pre-mission questionnaires), but also certain specific regional circumstances (e.g. security considerations), are major conditions for the completion of the inspection programme. Therefore, a number of third country inspections can only be programmed provisionally at this stage.
