2 Codes I-94 Codes Refugee = Stamp showing admitted as Refugee under Section 207 of the INA, or RE1, RE2, RE3, RE4, or RE5 Asylee = Stamp showing admitted as Asylee under Section 208 of the INA, or AS1, AS2, or AS3. Order from an Immigration Judge granting Asylum under Section 208. Asylum Approval Letter from an INS Asylum Office stating asylum approved pursuant to Section 208. Amerasian = AM1, AM2, or AM3 Cuban/Haitian Entrant = Stamp showing parole at any time as Cuban/Haitian Entrant (Status Pending), stamp showing parole into the U.S. on or after April 21, 1980 or 212(d)(5) on or after April Afghan/Iraqi Special Immigrant (treated as refugees for eligibility) = Immigrant Visa SQ1, SQ2, SQ3, SI1, SI2, or SI3 Paroled for 1 year or more = Stamp showing 212(d)(5). May say humanitarian or PIP (public interest parolee). Must be granted for 1 year or more. Withholding of Removal/Deportation = Order from an immigration judge/uscis granting withholding of deportation or removal. September

6 Sample Asylum Approval Letter Note: This is only the first page of the letter. The date granted asylum is located in the 2 nd paragraph in bold. It may be typed or handwritten. Alien # or A# Dear Mr. XXXXX: This letter refers to your request for asylum in the United States filed on Form I-589. This office Previously issued you a letter to notify you that your request for asylum had been recommended for approval, pending the results of the mandatory, confidential investigation of your identity and background. It has been determined that you are eligible for asylum in the United States. Attached please find a completed I-94, Arrival Departure Record, indicating that you have been granted asylum status in the Unites States pursuant to section 208(a) of the Immigration and Nationality Act (INA) as of June 17, You have been granted asylum in the United States for an indefinite period; however, asylum status does not give you the right to remain permanently in the United States. Asylum status may be terminated if you no longer have a well-founded fear of persecution because of a fundamental change in circumstances, you have obtained protection from another country, or you have committed certain crimes or engaged in other activity that makes you ineligible to retain asylum status in the United States. See INA section 209 (c)(2). September
