1 TFO ASKS THE CRTC FOR MUST-OFFER STATUS Educational Content for All Summary
2 1. Groupe Média TFO manages all of the regulated and non-regulated platforms of the Ontario French-Language Educational Communications Authority. Apart from TFO, its educational television channel, Groupe Média TFO operates on 10 YouTube channels, 14 social media platforms, more than 200 websites and is present on some 30 applications and games for mobile devices. 2. Groupe Média TFO has become a premium destination for award-winning, educational and innovative French-language content, and a leader in digital learning. APPLICATIONS PRESENTED TO THE CRTC 3. On January 16, 2015, Groupe Média TFO filed two (2) applications to the CRTC: The first one is for the license renewal of the TFO educational television channel, which expires August 31, AND, A second application requesting, from the CRTC, must-offer status to make its television service a mandatory offering by cable and satellite broadcasting distribution systems. 4. The CRTC has the power to order mandatory distribution of a television service by cable or satellite operators or can grant must-offer status. In the former, all subscribers get the service, whether they want it or not. In the latter, distributors offer the service, but consumers choose whether to subscribe or not. This last option is what TFO is seeking. 2
3 WHY THIS APPLICATION FOR A MANDATORY ORDER IS NECESSARY 5. The objective of the application is to ensure that Francophones living in all regions of Canada can have access to TFO s French-language educational programming, without being obligated to subscribe to it. 6. Over the years, the issue of distributing TFO s television service outside of Ontario has come up several times. The CRTC had already expressed an opinion on that matter when it allowed TFO to be distributed through Fundy Cable s basic service in New Brunswick in The Commission noted, in that decision, that it had always encouraged TFO to distribute its service outside of Ontario. 7. The issue has resurfaced many times since, including during the CRTC s 2009 public process which focused on broadcasting services available to linguistic minorities. This exercise led to the Report to the Governor in Council on English- and French-language broadcasting services in English and French linguistic minority communities in Canada in March The CRTC then noted, like the interveners, that French-language minority community access to television services is not optimal. 8. Several parties, including the Fédération culturelle canadienne-française (FCCF), the Fédération des communautés francophones et acadiennes du Canada (FCFA) and the Commissioner of Official Languages agreed on the lack of variety of services offered to Francophones in a minority situation. They had identified TFO, at the time, as being of particular interest for Francophones. Certain parties had then suggested that those services be given, by the CRTC, a mandatory distribution order through cable and satellite distribution systems. 9. The CRTC has recognized the necessity to increase availability of services to Francophones in a minority situation. In 2013, it extended mandatory distribution to TV5 and must-offer status to ARTV through cable companies in English markets. Certain specialized television services were also added to that offer, on a discretionary basis. However, TFO s educational television is still not being offered by distributors in several western provinces. TFO S REACH IN CANADA: HOW TO WIDEN IT? 10. TFO currently reaches 700,000 households outside of Ontario. TFO is available in the Atlantic provinces, in Quebec, in Manitoba and elsewhere in Canada through the Bell Satellite service. However, TFO is facing important hurdles to the extension of its reach, particularly in the western provinces where its service is not offered through large distributors like Shaw Cablesystems, Shaw Direct and TELUS OPTIK TV. 11. According to the 2011 Census, there are close to 10,000,000 people in Canada who can speak French, including almost 700,000 in the western provinces. Some 200,000 of them speak French at home. 12. Groupe Média TFO feels that, like many stakeholders who have expressed an opinion on the question, it would be in the best interest of those communities to gain access to TFO s educational television service, which offers a unique contribution to Canada s broadcasting system The current broadcasting system is very much concentrated in the hands of a few vertically-integrated distributors/programmers who are in a dominant position. TFO does not, considering its size, have the necessary tools to effectively negotiate with these large companies. This is why TFO is asking the CRTC to help establish a fair and balanced relationship in its negotiations with large cable and satellite distributors, in the interest of Francophone communities, especially in minority situations. 3
4 TFO DESERVES THE CRTC S SUPPORT FOR THE SAKE OF THE FRANCOPHONIE 14. The TFO channel makes an important contribution to Canada s broadcasting system: TFO plays a unique educational role in the Francophone market. TFO encourages the development of Canadian means of expression. TFO contributes to linguistic duality, including improving services offered to official-language communities in minority situations. TFO contributes to cultural diversity. A Unique Educational Role 15. Groupe Média TFO is a premium destination for people of all ages seeking educational and innovative content in French. It provides stimulating experiences and award-winning products on the cutting-edge of digital learning. 16. The TFO channel occupies a unique place in Canada s broadcasting system. More than 70% of its schedule is devoted to educational French-language programming aimed at children, mainly 2- to -12-year olds, with the MiniTFO franchise. 17. TFO s educational role is not limited to youth, but also finds an echo in the channel s family programming. The TFO Evening, from 7 pm to 9 pm, combines entertainment, culture, quizzes and shows that reflect Francophone communities and teach them about their history. 18. This key role in the field of education is confirmed through the far-reaching scope of 5,000 multimedia educational tools offered to Ontario s 12 French-language school boards, to the province s 60 English-language school boards, and to 62 school boards and schools outside of Ontario. In total, some 21,000 teachers and 2 million students benefit from our content in Canada. Encourages Canadian Expression 19. Groupe Média TFO is a premium destination for children and Ontarian and Canadian audiences seeking educational and innovative content in French, and it has achieved that status mainly through using local content. 20. Within the terms of the current license, the TFO channel has exceeded Canadian content requirements each year with levels varying from 62% to 70% per broadcast day. 21. The youth contents broadcast between 6 am and 7 pm account for more than 70% of the programming schedule. The winter 2015 youth schedule is 75 % Canadian. 22. The Family-TFO Evening time-slot between 7 pm and 9 pm is mostly made up of Canadian shows aimed at families. 4
5 TFO Contributes to Improving Services Offered to Official-Language Communities in Minority Situations 23. Showcasing Francophone communities is at the very heart of TFO s programming strategy, and an absolute necessity in order for TFO to build on its community identity. The TFO channel is committed to offering shows like 24.7, Carte de visite and ONfr that reflect Francophone communities in a minority setting and show them in a positive light. 24. TFO wishes to be a fitting representative of Francophone communities in a minority situations. It is crucial that they know they can count on us to give them the attention they deserve, and that they will not be able to find anywhere else under the same conditions. Appendix A provides more information on the expectations and aspirations of Francophones, particularly in a minority situation. TFO Contributes to Cultural Diversity 25. Cultural diversity is at the very heart of Groupe Média TFO s values when it comes to its programming choices and policies. It is important to us to reflect the environment in which we operate and the audiences we serve. The new face of Ontario and Canada must be found on the air at TFO and on our digital platforms. 26. Our approach in terms of cultural diversity is based on our desire to communicate an educational message in all of our content, as well as to share wider-encompassing values with our youth and family audiences. That is one of the basic tenets of Groupe Média TFO s approach to selecting and broadcasting content on its multiple platforms. CONCLUSION 27. The TFO channel makes a unique contribution to the Canadian broadcasting system through its educational and cultural programming that reflects Francophone communities. 28. Extending TFO s reach is in the public interest, particularly that of Francophone communities in minority situations, and meets an oft-expressed need of the Francophone community. 29. The granting, by the CRTC, of a mandatory order that gives TFO a must-offer status on cable and satellite systems, pursuant to paragraph 9 (1) (h) of the Broadcasting Act, will allow these communities to access the TFO educational service while respecting consumers freedom of choice. 5
6 Appendix A The results of focus groups organized by Substance stratégies on behalf of TV5 in March of 2012, with Francophones living outside of Quebec in western and eastern Canada, enlighten us on the perceptions and expectations of Francophones living in a minority setting and support TFO s approach. 1. Francophones perceive the French language as an integral part of their cultural DNA, as an essential component that they try to hand down to their children. However, the passing on the French language through the generations does not seem assured and interest in Francophone culture remains limited. French-language television is perceived as a means of contributing to the intergenerational passing on of the French language. (our emphasis) 2. The results of the focus groups are also telling when it comes to unfulfilled needs in terms of children s programming: There is a real need for children s programming for children, particularly in western Canada (where offerings in French are fewer or, at the very least, harder to gain access to), and particularly for Francophone Canadians born outside of Quebec. These Francophones bemoan the nearly non-existent offerings of children s shows in the morning, considering the fact that they grew up with leading youth programming (such as Bobino, Passe-Partout, etc.) The issue of children s television content is generally intertwined with that of assimilation to the Anglophone culture. In the opinion of several participants, a language must be learnt at a young age in order for it to be fully acquired. In many cases, French-language television is perceived as providing some protection from assimilation and is a useful tool for gallicizing children. In this regard, participants, apart from Ontarians, indicate that it is difficult for them to find good shows for their children to watch. (our emphasis). 3.
