YOU WILL BE REQUIRED TO VIEW A VIDEO BEFORE THE JUDGE COMES INTO THE COURTROOM. What is a Small Claims Action? A claim up to $5,000 (not including costs, interest and attorney s fees) can be filed with the Clerk of Courts as a Small Claims Action according to Rule of the Florida Rules of Court. When can you file a Small Claims Action? Before you consider a Small Claims Action, you should first try to communicate to the other party exactly what is in dispute. It is a good idea to send a letter which clearly states your complaint. You may be able to resolve the problem without going to court. A law suit should be your last resort in solving a civil dispute. Where can a Small Claims Action be filed? Actions may be brought only in the county: a) where the defendant resides, b) where the cause of action occurred, or c) where the property involved is located. Landlord/Tenant disputes must be heard in the county where the property is located. ONCE YOU HAVE DECIDED TO FILE Your lawsuit cannot proceed until the defendant has been served. (The law requires that a defendant be notified of a claim and be given an opportunity to defend against it) PLAINTIFF: Please print or type your name, address and telephone number including area code. (This may also be a company, business or corporation; however, you must list the name as registered with the Division of Corporations in Tallahassee.) DEFENDANT: Print or type the name and address, telephone number including Area Code of the person or persons you wish to sue. This may be an individual, a company, business or corporation (see above). If you are suing a business, you must find out whether or not it is incorporated. 1

2 If you are suing a corporation, you must have the full name under which the business is incorporated and the name and address of either a corporate officer or the registered agent of the business. This information can be obtained from the State of Florida Corporate Information Department at (850) If the business you are suing is not incorporated, you will need the correct company name and the full name and address of the owner. You can obtain this information by calling the Occupational License Bureau. The company you are suing may use a name other than the owner s name, referred to as a fictitious name. That information along with the name and address of the person who owns the company must be registered with the Florida Secretary of State and may be obtained by contacting them at (850) STATEMENT OF CLAIM FORM EXPLANATION: In the space provided fill in your reasons and explanation for the suit. AMOUNT OF CLAIM: PRE-JUDGMENT INTEREST: Fill in the amount you are suing for. Calculation of interest due if entitled. If you are requesting pre-judgment interest, you must provide an Affidavit of Interest Calculation form calculating interest through the date of your assigned pretrial conference. COURT COSTS: TOTAL AMOUNT DUE: The filing fee (see fee schedule), issuance of summons, plus your choice of service constitutes court costs Add all of the above. The costs for filing a Small Claims action include the filing fee, based on the amount of your claim, as well as a service fee for summoning each party to court (see fee schedule). If a Final Judgment is entered in your favor as a result of your lawsuit, these costs may be added to the total amount of your Judgment. WHEN YOU GO TO FILE Bring all the information and papers concerning your claim with you to Room 105 of the Courthouse. If the claim is based on a written document, a copy must be attached to your formal Statement of Claim. You will be required to fill out a Statement of Claim with details of your claim. THE FORMS MUST BE SIGNED IN FRONT OF A DEPUTY CLERK ($3.50 fee) OR NOTARY PUBLIC. If the claim is based on a written document, you must provide copies of contracts, bills and any other supporting documents to substantiate your claim. You must provide one copy for the court file and copies for each defendant you are suing. IF YOU FAIL TO DO SO, THE CLERK CHARGES $1.00 PER PAGE.. 2

3 AFTER YOUR CLAIM HAS BEEN FILED Once the deputy clerk has processed your suit and filing fee (see fee schedule) you will receive a pre-trial hearing date either at the time of filing or later by mail. The clerk will issue a summons along with any supporting documents you might have with it to the defendant. PLEASE INDICATE HOW YOU WISH SERVICE TO BE MADE. We also accept cash. For out-of-county service, you will need to contact the Sheriff s Office in the county where you want service to be perfected. SEE ATTACHED SHEET FOR PHONE NUMBERS. You will need to make funds payable to the sheriff of the county where the defendant resides. You will forward the paperwork and the fee to the appropriate county sheriff for service. There are two methods which you may use to summon the other party or parties to court: 1. The sheriff or a certified process server will serve the summons and a copy of your lawsuit on a defendant within Highlands County for a fee (see schedule). A list of process servers is provided in this packet. For service outside of Highlands County, you must make arrangements to have a process server or the sheriff of the county where the defendant lives to serve the papers. 2. You may attempt service of a summons on individuals (not businesses) within the State of Florida by certified mail, return receipt requested. A deputy clerk will prepare the certified mail form. There is a fee for the actual cost of mailing (see fee schedule). 3

5 PRE-TRIAL HEARING When you go to your pre-trial hearing: 1) DO NOT BRING WITNESSES 2) BRING ALL PAPERWORK, INCLUDING A COPY OF THE STATEMENT OF CLAIM, AND ALL DOCUMENTS WHICH WILL ASSIST YOU IN PROVING YOUR CASE. This is your opportunity to appear with the defendant(s) before the judge and attempt to settle your case without a trial. If all parties appear at the pre-trial hearing and no agreement is reached at that time, your case will be referred to mediation. The County Court of Highlands County requires mediation before setting a formal trial. Mediation brings both parties together out of court where trained mediators will impartially assist you in reaching an agreement or settlement. Mediation allows you and the other party to decide the outcome of your case in a relaxed atmosphere away from a crowded courtroom. In court there is usually a winner and a loser; with mediation you are fully involved in shaping the outcome of your case. Experience shows that the parties are more satisfied with a mediated settlement. Mediation can save you time and money. Successful mediation means no further court appearances; therefore, no further loss of time from work. If an agreement is reached, the mediator will prepare a written agreement. All parties will sign the agreement indicating that they will be bound by it. The agreement will then be given to the presiding judge for approval. If mediation is not successful, a trial will be scheduled to be heard within 90 days or sooner. In order for the judge to decide how much time is needed for the trial, you will need to inform the court of how many witnesses you plan to have. If you do not appear at your pre-trial hearing, your case will be dismissed, unless just cause can be given as to why you did not appear. If the defendant does not appear, the judge may enter a default. If a default is entered, the Judge can either award a Default Final Judgment or require a court appearance to prove the claim. If and when the judge feels that you have proven your case, the Court will prepare and you will be mailed a copy of your Default Final Judgment. If you are representing a corporation or partnership, you must attach a copy of your authority to file signed by a corporate officer or general partner. Any agent appearing at a court proceeding must have written authority to appear and must have full settlement authority. Individual litigants, including husbands and wives, must appear in person or through an attorney. Spouses cannot represent each other. After you have been given a trial date, it is your responsibility to subpoena any witnesses you want to call to prove your case. To do this, you must go to Room 105 of the Courthouse. A deputy clerk will can either prepare witness subpoenas or sign and seal. (See additional service fees) At the trial, the judge will hear both sides of the case and listen to any witnesses whom you and the defendant(s) have called. The judge may also ask questions as part of the hearing. If the judge makes a decision in your favor, you will receive a Final Judgment. A Final Judgment is a legal document stating that one party is entitled to recover damages in a specified amount from another party. Interest will be added on the amount awarded until the Final Judgment is satisfied. At any time during this process, the defendant may pay you and settle the claim. However, obtaining a judgment against a party is NOT the same thing as collecting that judgment. Post-judgment legal procedures are often required prior to any collection. You may find it necessary to retain an attorney to assist you in postjudgment procedures. 5

6 AFTER THE FINAL JUDGMENT Motions for a new trial may be filed not later than 10 days after a judgment. If no new trial has been requested and if you have not received payment even though there was a final judgment in your favor, you have the right to begin post-judgment procedures as listed below. If you want to have your final judgment entered as a lien against real property owned by the defendant(s), you must obtain a certified copy at the location where your case was heard and then have it recorded by the Clerk of the County in which the property is located. (See fee schedule). The recorded Final Judgment will serve as a lien for up to 20 years from the date the Judgment was signed, but must be re-recorded every ten years to stay in effect. If you know the name and address of the employer or the bank of the defendant(s), you may want to use the process of Garnishment. This is an order signed by the Judge, directing a Deputy Clerk to issue a writ directing a third party, usually an employer or a bank, to hold funds until a hearing is held and a judge decides if such funds should be awarded to you. (See fee schedule). A Writ of Execution, which commands the Sheriff s Office to make demand for the amount of your Final Judgment from the defendant(s), may be issued by a deputy clerk upon request. You must then complete and file an Instruction for Levy form with the Sheriff s Office identifying specific property or real property to levy upon. You must first record your judgment with the Clerk of Courts (real property) or Judgment Lien Database (personal property) in Tallahassee to establish your judgment lien. Florida Chapters 55 and 56 cover judgments and final process. The Sheriff s Office will also require you to complete and file a Creditor s Affidavit. There are fees and costs payable to the Sheriff before the Sheriff can proceed. If you do not know the employer(s) or bank(s) of the defendant(s) which would be subject to a Writ of Garnishment, and/or if you do not know the location of any property which might be subject to a Writ of Execution, you may file a motion with the Clerk s Office for a Hearing in Aid of Execution. The judge will then enter an order for the hearing and the defendant(s) will be served with the order and a Fact Information Sheet. At the hearing, the defendant(s) will be required to reveal assets, employment and sources of income to the judge. 6

7 AFFIDAVIT OF INTEREST CALCULATION INSTRUCTIONS THIS SAMPLE COMPUTATION SHEET IS DESIGNED TO HELP YOU COMPLETE THE AFFIDAVIT OF INTEREST FORM WHEN YOU ARE ASKING FOR PRE-JUDGMENT INTEREST ON THE AMOUNT OF MONEY YOU ARE CLAIMING. $2000 PRINCIPAL BALANCE AT TIME OF DEFAULT x 4.75% INTEREST RATE OF 4.75% (UNLESS OTHERWISE 95 PROVIDED FOR IN CONTRACT). 95 -:- 365 = $.26.. PER DIEM (PER DAY) 45 days.. (# OF DAYS FROM DATE OF DEFAULT TO DATE OF JUDGMENT) x.26 x PER DIEM $11.70 INTEREST NOTE: ANY UNACCRUED PRE-CHARGED INTEREST HAS TO BE ADDED BACK WHEN ARRIVING AT BALANCE DUE. EXAMPLE: $500 BORROWED AT 4.75% FOR ONE YEAR. PLAINTIFF SHOWS $540 BEGINNING BALANCE. DEFENDANT DEFAULTS AFTER 6 MONTHS. AT THE TIME OF DEFAULT PLAINTIFF ONLY ENTITLED TO INTEREST FOR 6 MONTHS WHEN COMPUTING PRINCIPAL BALANCE. WHEN COMPUTING SIMPLE INTEREST 1. DETERMINE ORIGINAL PRINCIPAL. 2.
