1 MUNICIAL DIVISION SUMMARY REORTING FORM INSTRUCTIONS Complete a report each month, even if there was no court activity during the reporting period. SUBMITTING THE MONTHLY REORTING FORM 1. Make a copy of the completed reporting form for your files. 2. Return the completed form to the Missouri Office of State Courts Administrator (OSCA) no later than the 15 th day of the month following the reporting month by: a. fax to ; b. mail to Statistics, OSCA, 2112 Industrial Drive,.O. Box , Jefferson City, MO 65110; or c. to MunicipalDivision.Reports@courts.mo.gov. If you have any questions or concerns, contact the OSCA Help Desk at I. COURT INFORMATION If the address and other contact information have not changed, check the box next to Contact information same as last report. Municipality Enter the name of the municipality. Reporting eriod Enter the month and year for the data entered on the form. This is the full month (1 st through 31 st ) for which you are reporting, not docket date to docket date. Mailing Address Enter the mailing address for the municipal division. Software Vendor Enter the vendor or the court management software used by the municipal division. If no software/software vendor is used, enter Manual. hysical Address Enter the physical, or street, address of the municipal division. County Enter the county in which the municipality is located. Circuit Enter the judicial circuit in which the municipality is located. Telephone Number Enter the main telephone number for the municipal division. Fax Number Enter the primary fax number for the municipal division. repared by Enter the name and title of the individual who prepared the reporting form. Address Enter the primary account for the municipal division, the inotes address, or an officially approved/established by the City address. This should be the account that the individual(s) who administers the court uses to conduct most of his/her correspondence. It should not be a personal or business address. inotes Indicate if the foregoing address is an inotes account administered by OSCA. Contact OSCA with any terminations and/or changes to inotes. Categories and charge codes can be found in the Municipal Clerk Manual, Appendix J, Ordinance Violations or on the Judicial Website at on the Office of State Courts Administrator page under ublications. Cases (Citations/Informations) ending: Enter the number of municipal citations and informations filed in your court in previous months that have not been disposed through one of the manners of disposition listed under item C. 3 Include all active and inactive cases. For example, include cases continued generally and cases with outstanding warrants issued prior to case disposition. DO NOT include cases on probation or cases with outstanding warrants where the warrant was issued after the case was disposed. Note: Your pending cases may include reopened cases resulting from set aside judgments. DO NOT count them again as filed or disposed. lease make a note of this on the reporting form or contact the OSCA Statistics Unit to provide clarification. B. Cases (Citations/Informations) Filed: Enter the number of municipal citations and informations filed in your court by the prosecutor for the reporting month. A citation is defined as the actual ticket (Uniform Citation) law enforcement uses to file charges with the prosecutor. An information is defined as the document filed with the court by the prosecutor charging a defendant with a crime(s). The information is used by prosecutors in place of filing the citation with the court. Note: A Case is defined as either a uniform citation or an information filed by the prosecutor. If there are multiple counts/violations contained in a single information with a single defendant, count as one case. If there are multiple violations contained on a single citation, i.e. speeding and seatbelt, count as one case. However, if multiple citations on a single defendant are filed with the court, count each citation as a separate case. C. Cases (Citations/Informations) Disposed: Enter the total number of dispositions for each category for the reporting month. Note: For the purposes of monthly reporting, court/bench trial - GUILTY and plea of GUILTY in court dispositions are those cases that have had a guilty finding or sentence (including a suspended sentence) entered in the court record, even though there may still be outstanding fines/fees which could result in post-disposition activities. A case is considered disposed only when all counts have been disposed. (For example, count the case as disposed when you submit the moving traffic violation to the Department of Revenue.) If a case was disposed under a different category than it was filed, report the disposition under the ORIGINAL category. For example: A case was filed as a BAC (Alcohol and Drug Related Traffic), but reduced to Careless & Imprudent Driving (Other Traffic). The case should have been reported as filed under the Alcohol and Drug Related Traffic category and should also be reported as disposed under this same category. If two or more charges or counts were filed on a case (citation/information), and they were disposed by different manners of disposition, report the highest ranking (as numbered below) manner of disposition as the disposition for the case. 1. jury trial (Springfield, Jefferson County, and St. Louis County only) 2. court / bench trial - GUILTY 3. court / bench trial - NOT GUILTY 4. plea of GUILTY in court 5. Violations Bureau Citations and bond forfeitures by court order 6. dismissed by court 7. nolle prosequi 8. certified for jury trial (not heard in the Municipal Division) Office of State Courts Administrator 3 October 2015
4 Examples: Case A - If one charge in the information was disposed by court/bench trial - NOT GUITLY and one was disposed by court/bench trial - GUILTY, the disposition for the case would be reported as court/bench trial - GUILTY because that manner of disposition has the higher rank. Case B - If one charge in the information was dismissed and the defendant plead guilty before a judge to the second charge, the disposition of the case would be plea of GUILTY in court because that manner of disposition has the higher rank. 1. jury trial: This field will only be used by those municipal divisions that are allowed to try a case before a jury in court, on the record. 2. court/bench trial - GUILTY: Enter the number of cases in which the judge heard evidence and found the defendant guilty. Include all suspended imposition of sentence (SIS) and suspended execution of sentence (SES) dispositions. Count a case as disposed court/bench trial - GUILTY if the defendant plead guilty after the trial began. Count the disposition at the time of the finding of guilty. DO NOT count again when probation is complete. 3. court/bench trial - NOT GUILTY: Enter the number of cases in which the judge heard evidence and found the defendant not guilty. Count a case as disposed court/bench trial - NOT GUITLY if the case was dismissed after the trial began. Cases where the defendant was found not guilty due to mental disease or not competent to proceed would also be included in this category. 4. plea of GUILTY in court: Enter the number of cases in which the defendant pleads guilty in court. Include all suspended imposition of sentence (SIS) and suspended execution of sentence (SES) dispositions. Count a case as disposed plea of GUILTY in court if a plea bargain is arranged by the prosecuting attorney and approved by the judge or an Alford lea was entered. Count the disposition at the time the plea is received. DO NOT count again when probation is complete. 5. Violations Bureau Citations (i.e., written plea of guilty) and bond forfeitures by court order (as payment of fines/costs): Indicate the number of citations paid through a violations bureau with a written plea of guilty. In addition, enter the number of cases in which the court ordered the forfeiture of a cash bond to pay court costs and fines as the final disposition on the case. This would not include bond forfeitures that are not applied to costs and fines. 6. dismissed by court: Enter the number of cases that were dismissed prior to evidence being heard by the judge. Cases that were dismissed by the court on the courts own initiative, e.g. for failure to prosecute or death of the defendant. 7. nolle prosequi: Enter the number of cases in which the charges were nolle prossed (dismissed) by the prosecutor after filing of the case. 8. certified for jury trial (not heard in the Municipal Division): Enter the number of cases that were forwarded to the residing Judge for assignment to be heard under the circuit court procedures. 9. Total Case Dispositions: Enter the total number of cases disposed or leaving your jurisdiction through one of the dispositions listed under C. Cases (citations/informations) pending at end of month: For each of the three columns, add the numbers entered in the Cases (citations/informations) pending at start of month and Cases (citations/informations) filed rows, then subtract the number in the TOTAL CASE DISOSITIONS row (i.e., Item A + Item B Item C9). E. Trial de Novo and/or appeal applications filed: Enter the number of cases in which a trial de novo or appeal application was filed. III. WARRANT INFORMATION 1. Enter the total number of warrants issued during the reporting period. 2. Enter the total number of warrants served or withdrawn during the reporting period. 3. Enter the total number of warrants that have ever been issued and are still outstanding at the end of the reporting period. IV. ARKING TICKETS If the court processes parking tickets, enter the number of tickets issued for the reporting month. If the court does not process parking tickets, check the box indicating the court does not process parking tickets and do not enter information in the issued box or revenue received for parking tickets box (V. NET DISBURSEMENTS). Note: If an actual case is being filed as a result of a parking ticket and costs are being assessed, do not enter this in Section IV. This should be identified in Section II under MONTHLY CASELOAD INFORMATION under Other Traffic. V. DISBURSEMENTS Report all money disbursed by the municipal division for the reporting month by fines, clerk fee, surcharges, restitution, bond forfeitures, refunds, and any other charges specified by local ordinance. Note: With regard to bond monies, DO NOT report bond money currently being held. If the court orders that the bond money be applied to the fines/costs, include this in the appropriate categories at the time it is disbursed. Excess Revenue (minor traffic, subject to the excess revenue percentage limitation) Fines - Excess Revenue Enter the amount of money disbursed by the municipal division for fines collected from traffic subject to the excess revenue percentage limitation Clerk Fee - Excess Revenue Enter the amount of clerk/court fees (costs) disbursed by the municipal division for cases subject to the excess revenue percentage limitation (i.e., $12.00 per case less the $1.00 retained for JEF if applicable). Crime Victims Compensation (CVC) Fund surcharge aid to City/Excess Revenue Enter the total amount of CVC Excess Revenue disbursed by the municipal division to the city. Bond forfeitures (paid to city) Excess Revenue Enter the total amount paid to the municipality during the reporting month as a result of bond forfeitures subject to the excess revenue percentage limitation. Bond forfeitures are when the bond amount is defaulted and turned over to the municipality but is not intended to satisfy fines and/or costs. Office of State Courts Administrator 5 October 2015
6 Total Excess Revenue (minor traffic violations subject to the excess revenue percentage limitation) Enter the total of all surcharges and/or fees disbursed by the court listed as an Excess Revenue (minor traffic, subject to the excess revenue limitation). Other Revenue (non-minor traffic and ordinance violations, not subject to the excess revenue percentage limitation) Fines - Other Enter the amount of money disbursed by the municipal division for fines collected from alcohol- and drug-related traffic, other traffic not subject to the excess revenue percentage limitation, and non-traffic ordinance cases. Clerk Fee (costs) - Other Enter the amount of clerk/court fees (costs) disbursed by the municipal division not subject to the excess revenue percentage limitation (i.e., $12.00 per case less the $1.00 retained for JEF if applicable). Judicial Education Fund (JEF) Enter the amount retained (if applicable) from the Clerk/Court Fee (costs) for the Judicial Education Fund (JEF). ursuant to Section RSMo, each municipal division may establish a judicial education fund in an account under the control of the municipal division to retain one dollar of the fees collected on each case to use for CLE certification for judges, judicial education, and training for court administrators and clerks. If your court does not retain the $1.00 per case, please indicate this by marking the check box, Court does not retain funds for JEF. eace Officer Standards and Training (OST) Commission surcharge Enter the amount of OST disbursed by the municipal division. Crime Victims Compensation (CVC) Fund surcharge aid to State Enter the total amount of CVC Excess Revenue disbursed by the municipal division to the state. This is the total of the state portion of CVC collected for minor traffic violations, non-minor traffic violations and other ordinance violations. Law Enforcement Training (LET) Fund surcharge Enter the amount of LET disbursed, if authorized by the municipal division. Domestic Violence Shelter surcharge Enter the amount disbursed for the Domestic Violence Shelter surcharge, if applicable. Inmate risoner Detainee Security Fund surcharge Enter the amount disbursed for the Inmate Security Fund surcharge, if applicable. Sheriffs Retirement Fund (SRF) surcharge Enter the total of Sheriff s Retirement Fund surcharge amount disbursed to the Missouri Sheriffs Retirement System. This would be $3 per case. Restitution Enter the amount of restitution disbursed. arking ticket revenue Enter the amount disbursed for parking ticket violations and related late fees. This is revenue from parking tickets. No case filed and no court costs assessed. Bond forfeitures (paid to city) - Other Enter the total amount paid to the municipality during the reporting month as a result of bond forfeitures not subject to the excess revenue percentage limitation. 7 Total Other Revenue Enter the total of all surcharges and/or fees disbursed by the court listed as an Other Revenue (non-minor traffic and ordinance violations, not subject to the excess revenue limitation). Other Disbursements Enter the total of each other surcharges and/or fees disbursed by the court not included in the above categories. Itemize each specific surcharge/fee and indicate if it is subject to the excess revenue percentage limitation. (Examples include, but are not be limited to, arrest costs, witness fees, and board bill/jail costs.) Total Other Disbursements Enter the total of all surcharges and/or fees disbursed by the court listed as an Other Disbursement. Total Disbursements of Costs, Fees, Surcharges and Bonds Forfeited Enter the sum of total excess revenue, total other revenue, and total other disbursements. Bond refunds Enter the total amount of bonds refunded by the court for the month. Total Disbursements Enter the sum of total disbursements of costs, fees, surcharges and bonds forfeited plus bond refunds. Enter this amount as the total disbursed for the month.
