1 METHODOLOGY FOR ELECTIONS IN THE STRUCTURES AND POSITIONS OF ACADEMIC LEADERSHIP IN CONSTANTA MARITIME UNIVERSITY

2 I. General Principles Art 1. This methodology establishes the rules by which elections are organized and conducted for the structures and functions of academic leadership in Constanta Maritime University, hereinafter refered to as CMU and are prepared in accordance with Art. 209 and Art. 364 para. (2) of Law no. 1/2011, the University Charter, the results of the referendum on the election of the Rector held in CMU and MECTS notes no / and 389/ on elections. Art 2. The organization and conduct of the elections and the leading academic structures shall respect university autonomy, transparency, the principles of legality, accountability, responsibility, efficiency and financial management, rights and freedoms of students and academic staff and professional ethics rules. Art 3. The governing structures in CMU are: the Senate, the Administrative Board, the Faculty Councils, the Council for doctoral studies and the Departments Councils. departments. Art 4. (1) The University Senate is composed of 75% teaching and research staff and 25% student representatives. The number of members of the university senate is maximum 28, 3 representatives from each department of the university and 7 students. (2) Representatives of teachers in the Senate are elected by universal, direct and secret vote of permanent CMU teaching staff. (3) Representatives of the student in the Senate are elected by universal, direct and secret vote of all students enrolled in CMU programs of study according to the Rules of Elections LSUMC. Art 5. (1) The Faculty Council is the faculty deliberative and decision body. (2) The Council shall consist of four faculty members of departments subordinated to the respective faculty, 75% teaching and research staff and 25% students. (3) Representatives of teaching and research staff from departments and doctoral schools affiliated to the faculty are elected by universal, direct, secret and equal vote of all tenure teachers and research staff of the faculty. (4). Student representatives are elected by universal, direct, secret and equal vote of all faculty students under the Rules of elections of LSUMC. Art 6. Members of the department are elected by universal, direct and secret vote of all tenure teaching and research staff in the department. The number of board members of each department is 3 and includes the head of the department. Article 7. CMU management is represented by the rector, vice-rector, general administration, dean, vice-dean and head of the department. Article 8. CMU Rector is appointed by universal, direct and secret ballot of all tenure teachers and research staff of the university and student representatives in the senate and faculty councils. Article 9. The head of department is elected by universal suffrage, direct and secret vote of all tenure teaching and research staff in the department.

3 II. The election commissions Article 10. (1) The organization, conduct and communication of election results is provided by the Electoral Commission. (2) The election commissions is constituted for each faculty and the Central Election Commission (of CMU) will be approved by the Faculty Board and the Senate respectively. (3) Members of electoral commissions must be teachers and non-teaching staff of CMU with proper ethics and moral behavior. Chairmen of election commissions should not be part of the current faculty councils or Senate. (4) Each Election Commission will have a president, a number of two tenure members and one alternate member who may replace a member become inconsistent or unavailable. (5) The election commissions of faculties shall be determined by vote of the faculty Faculty Councils, the commissions operating at the Dean s Office of each faculty. The electoral commissions hold elections at the level of faculty departments for the position of: head of department, members of the department Council and members of the Faculty Council. (6) The Central Election Commission is established by vote of the Senate and shall consist of a President, 3 Members (including 1 student) and two alternate members, at least half of its members are outside the Senate. The Commission operates on the premises of the Rector s Office. The Central Election Commission holds elections for members of the University Senate and the Rector. III. Applications Article 11 (1). Elections for leadership positions (heads of departments and rector) as well as for management structures (department Council, Faculty Council and Senate) are based on applications submitted to the Electoral Commission, within the time limits set on the elections calendar. (2) Applications for the positions of Head of Department, Member of the Department Council and member of the Faculty Council shall be filed with the election commissions of the faculties, the candidates for membership in the Senate or Rector shall be submitted to the Central Election Commission. (3) Applications for the position of Rector shall be submitted, accompanied by a curriculum vitae and Managerial Program (printed and electronic), the Central Election Commission and will be published on the site at the end of applications. Applications for Head of Department, Member of Department Council, member of the Faculty Council, member of the Senate shall be submitted accompanied by Curriculum Vitae and will be published on the University website. Article 12 The election commissions shall accept only applications that meet the following conditions: (1). The candidate is a tenure teacher of CMU and has not reached the statutory retirement age at the time of elections. (2) The candidate meets the professional and scientific qualities required for the position for which he/she is a candidate; is a personality recognized because of the teaching, research and professional activity, has managerial skills and good knowledge of the laws in force in education in Romania and the EU. (3). The candidate meets the moral qualities required for the position for which he/she is a candidate and has not received throughout his teaching career any legal, administrative or academic sanction.

4 (4). The candidates must not be involved in other activities that lead to conflict of interest and incompatibilities. The same management structure can not stand husband-wife or I-III degree relatives as candidates. (5) The persons who at the time of application are in leadership positions of political parties, shall not be candidates for the position of rector. (6) The candidate for the position of Rector is no third successive application for this position. (7) He/she was not a member of CMU Senate for three consecutive mandates. Article 13 Denied applications are communicated in writing to the applicant together with the reasons for rejection. They can lodge complaints to the ascribed Election Commission within 48 hours of the notice, and disputes will be resolved within 24 hours of submission and communicated to the complainant within 24 hours. Resolving disputes lies with the Election Commission. The answer to the appeal becomes final and irrevocable. Article 14 Accepted applications for all positions, including curriculum vitae of the candidates, candidates managerial programs for Rector and denied applications including reasons for rejection, are to be displayed on CMU site before the election. Article 15 The members of the Commission can not apply for structures and management positions. Article 16 The candidates elected as Heads of the department, members of the Council department, member of the faculty Council or a member of the Senate, may apply for the position of Rector. If the rector is voted and confirmed by MECI, the elections are re-run only for the position of Head of the Department, member in the University Senate or the Faculty Council who is not in the state of incompatibility with the position of rector. IV. Election of student representatives Article 17. (1). Election of student representatives in the council and senate are organized by students, respecting CMU Charter and the legislation in force according to the Regulation on elections of LSUMC. Art.18 The elected student representatives must have very good results in professional training and proper conduct. V. Election of Heads of Departments and members of the Department Board Art.19 (1) The election of heads of departments and members of the Department Board shall be done based on application of candidates, for the departments of each faculty. A member of the Board of the department can be any tenure teacher or researcher of a department, who does not have a suspended employment contract. (2) The election is serviced by the Faculty Election Commission, together with a representative of the Central Electoral Commission. (3) The Electoral Commission will carry: the Alphabetical Table of all teachers in the department, pens with black ink, a number of ballots equal to the number of teachers in the department plus a reserve of 10% for any voting error, (handed out and signed by the President of the Faculty Election Commission) and a cardboard urn inscribed with the number and name of the department, the ballots are already printed in different columns and in alphabetical order for the candidates for the positions of Head of the department and members of the Department Board.

5 (4) (a) First, the Head of Department is elected. Each voter is distributed a ballot paper containing the nominal alphabetical list of candidates for the position of Head of department. Voters vote secretly. Voting consists of selecting a single candidate for the position of Head of Department and crossing out the list of other candidates present. The bulletin is valid if it does not contain erasures, and if a candidate is scored once. (5) If a voter makes a mistake completing this card you can return it and request a new one; the returned bulletin must be struck in red, it is marked ANNULED and signed by the Chairman of the faculty election commission and by the individual. The voter shall sign the attendance table, then get the bulletin stamped on the back with the commission stamp and place in the urn. (6) After the last voter has placed in the bulletin in the ballot box or ballot time has run out, in the presence of the members of the faculty election commission, a representative of the Central Electoral Commission and of prospective desirous voters, the ballot box is opened, the ballot is counted, which must match the number of signatures on the voters tables. After manual verification of invalid ballots which are canceled with a red line, marked annuled and signed by the Chairman of the Faculty Electoral Commission. (7) Members of the Electoral Commission complete the protocol, according to the default model, which they submit in the first 24 hours to the Central Election Commission, together with the computerized, printed result, the valid ballots, the ballots canceled, unused ballots and voter signatures table. Article 20 The election result (1) The winner of the election for the position of Head of department is declared the candidate who cumulatively ranks first. (2) The winners of the elections for members of the Department Board are declared the candidates who are in descending order of cumulative voters choices in that department. (3) For equal scores, for any position, another election round shall be organized in the same day until a head of department shall be appointed and two members of the department board. VI. Election of members of Faculty Council, Senate and the position of Rector Article 21 (1) The election of Teaching Staff Council, the University Senate and the Rector is conducted on the basis of applications. (2) The Rector is appointed by universal, direct and secret ballot of all tenure teachers and research staff of the university and student representatives in the senate and faculty councils. (3) Teachers members of the Senate shall be determined by universal, direct and secret vote of of all tenure teachers and researchers of CMU and CMU students' representatives in the Senate will be elected by universal, direct and secret vote of university students according to LSUMC Regulation. (4) All members of Teaching Staff Councils shall be determined by universal, direct and secret vote of all tenure teachers and researchers of the respective faculty and student representatives are elected by universal, direct and secret vote by faculty students. (5) Voting is serviced by members of the Central Electoral Commission

6 Article 22 Election of members of Faculty Councils (1) The voters in a faculty are handed black pens and voting cards, signed by the President of the Central Electoral Commission. (2) The ballot papers are printed in a number equal to the number of voters on the list, plus 10% reserve for errors. (3) The voting cards contain, printed on different columns, depending on the number of departments, a list in alphabetical order of the candidates in that unit for the teaching staff council. (4) Voters vote secretly in the voting booth. Voting consists in selecting the four candidates from each department on the list, in the voter s preference order and crossing out the list of other candidates present. The bulletin is valid if it does not contain erasures and if each candidate is marked once (option for a single candidate position). (5) In the event that the voter makes a mistake completing the bulletin, the bulletin will be barred wrong with red pen and marked CANCELLED signed by the President of the election commission and the voter is served with a different voting card. (6) The voting card after voting is stamped and placed in the ballot box of that Faculty Council. (7) After the last voter has voted or after depletion of the alloted voting time in the presence of the Central Election Commission and of prospective desirous voters, the boxes are opened, the ballots are counted and are supposed to match the number of signatures on the voters lists. After manually checking the votes, the valid ballots are recorded and the invalid ones are cancelled with a red line, marking them annuled and signed by the President of the Central Electoral Commission. (8) The members of the Electoral Commission according to the default model, complete and submit the minutes within 24 hours at the Central Electoral Commission, the list of results printed and computerized, the valid ballots, canceled and unused ballots on the voter signatures table. (9) The winners of memberships in the Teaching Staff Board are declared candidates in each department in descending order of cumulative voters, for the allocated places. (10) For equal scores, for any position, another election round shall be organized in 3 days until the appointment of all members of the teaching staff councils. Article 23 Elections of Senate Members (1) Voters from the university are provided with black pens and voting cards, under signature of the President of the Central Electoral Commission. (2) The voting cards are printed in a number equal to the number of voters on the list, plus 10% reserve for errors. (3) The voting cards contain printed on different columns, depending on the number of departments, a list in alphabetical order of the candidates for the Senate. (4) Voters vote secretly in the voting booth. Voting consists in selecting the three candidates from each department on the list, in the order of the voter s preference and crossing out the list of other candidates present. The bulletin is valid if it does not contain erasures and if each candidate is marked once (one option for a single candidate position). (5) In the event that the voter makes a mistake completing the bulletin, the bulletin will be barred wrong with a red pen and marked CANCELLED signed by the President and the election commission and the voter person shall be served with a different voting card. (6) After voting, the voting card is introduced in the ballot box of CMU Senate. (7) After the last voter has voted or after depletion of the affected voting time in the presence of the Central Election Commission and of prospective desirous voters, the boxes are opened, and the votes should be equal to the number of signatures on the voters lists. After manually checking the

7 votes, the valid ballots are recorded and the invalid ones are cancelled with a red line, marked cancelled and signed by the President of the Central Electoral Commission. (8) Members of the Electoral Commission shall fill the minutes according to the default model and submit it within 24 hours at the Central Electoral Commission Minutes, the list of results printed computerized, the valid votes, canceled and unused ones and the table with the voters signatures. (9) The winners of the election for the position of members of CMU Senate are declared the candidates of each department in descending order of cumulative choices of university electors for the assigned seats. (10) For equal scores, for any position, there shall be another election round in 3 days until the appointment of all members of CMU Senate. Article 24 Election of the Rector (1) Voters from the university are provided with black pens and voting cards, under signature of the President of the Central Electoral Commission. (2) The voting cards are printed in a number equal to the number of voters on the list, plus 10% reserve for errors. (3) The voting cards contain printed on different columns, depending on the number of departments, a list in alphabetical order of the candidates for the position of Rector. (4) Voters vote secretly in the voting booth. Voting consists in selecting the three candidates from each department on the list, in the order of the voter s preference and crossing out the list of other candidates present. Validation of election Article 25 Validation of student representatives elected in the Councils and the Senate is made by the operating Faculty Council. Article 26. (1) Elections for the positions of Head of the department and members of the Faculty Council or the Department Councils for each faculty are validated by the current Councils. In the meeting of the Council, the Chairman of the faculty electoral commission presents the election results of the departments (Head of Department Director, the new Faculty Council and the new Department Council) and the acting Council validates by open vote the election results. (2) The new Council is validated by the acting Senate.

8 Article 27 The componence of the new Senate is validated by the incumbent Senate, the President of the Central Election Commission presents the results from the electoral units and the election results are validated by open vote by the Senate. Article 28 The acting Rector shall convene the first meeting of the new Senate and elections for the position of President of the Senate are held. VIII. Final Provisions Article 29 In cases there is a vacancy in the structures and managing positions, during the term, for any reason, new elections are held according to the methodology of this Regulation. Article 30 The documents relating to elections at all levels: minutes, lists and ballot results (valid and canceled) are filed by the Central Election Commission, and shall be sealed and kept at CMU Rector s Office, throughout the mandate. Article 31 Any dispute shall be resolved by the Senate within 48 hours of submission and the result communicated to the complainant within 24 hours. Article 32 This Regulation is annexed to CMU Charter Article 33 Any amendment to this Regulation shall be approved by the Senate, and only as a consequence of any changes in legislation and the Charter with implications on the election procedure.
