1 GIPPSLAND PORTS POSITION DESCRIPTION 1. POSITION DETAILS Position: Risk and Compliance Manager Reports To: Direct reports: Starting location: Classification: Finance & Business Manager Nil The operating base for this position is Bairnsdale Office. Administration Level A Gippsland Ports Enterprise Agreement 2014 Salary Range: $104,511 - $115,821 Time Fraction: Full-time, ongoing Preparation date: January 2016 Approved by: Chief Executive Officer Finance & Business Manager 2. POSITION IN CONTEXT Gippsland Ports is a Committee of Management with responsibilities delegated from the Victorian Government s Department of Economic Development, Jobs, Transport and Resources to deliver services and manage assets and infrastructure. Services include management of port and waterway safety and environmental values, provision and management of berths and moorings, Aids to Navigation, hydrographic survey and information, publication of information to mariners, maritime security management, dredging and channel management, property management and on-water fuel retailing, vessel repair and maintenance services through two boatyards, marine pollution response, a range of unspecified community service obligations, marine events oversight, together with the governance and administrative functions associated with a regional business with 55+ employees and annual turnover in excess of $10m. Assets under GP management include 800+ Aids to Navigation,100+ wharves and jetties, 900+ berths and moorings, marine plant and equipment, property, seawalls and boardwalks. Gippsland Ports operates from 4 sites, Bairnsdale, Lakes Entrance, Paynesville and Port Welshpool and has responsibility for 5 of Victoria s 14 Local Ports and 2 Declared Waterways that comprise 1400m2 of waterways located along the Victorian coast from Inverloch to Mallacoota. Principal activities within and from the Ports and Waterways under Gippsland Ports management include recreational boating, Victoria s largest commercial fishing fleet, oil and gas industry services and coastal commercial shipping. The Role This is a redefined role reporting to the Manager, Corporate Services. The primary purpose of this position is to contribute to effective corporate governance, risk management and statutory compliance across all Gippsland Ports functions. The position is required to provide leadership and direction in the further development and refinement of Gippsland Ports holistic risk management framework and strategies from a managerial perspective as well as hands on operational work in implementing risk management actions, monitoring and reporting on compliance and in coaching and supporting other positions within Gippsland Ports toward December 2015

2 the realisation of objectives. risk management, statutory compliance and environment, health and safety The position will have proven managerial experience combined with a strong background and broad understanding of risk and compliance and a demonstrable history of practical application in a service and infrastructure management organisation. 3. DELEGATIONS Delegated authority level up to $5, SPECIAL CONDITIONS The position will be required travel between Gippsland Ports facilities throughout its region and to other locations, including Melbourne that may include overnight or work outside of normal business hours. KEY ROLES AND RESPONSIBILITIES Key Roles Responsibilities Risk Management Unveil a risk, compliance and governance framework throughout the business Manage the risk management framework, the corporate and subordinate risk registers and risk management plans throughout the organization, to meet best practice standards set by relevant authorities and Australian Standard for Risk Management. Develop and maintain effective relationships with key stakeholders, both internal and external Assist Executive Managers in the development of department plans to reflect risk based priorities Ensure Gippsland Ports meets corporate risk, legal and regulatory obligations Identify and rank all business risks based on best practice assessment techniques for review by the Management Team. Develop and continually review the organisation s Risk Register for consideration by the Management Team, the Audit and Risk Committee (A&RC) and the Board. Develop, refine and implement risk management policies and procedures, including implementation of tools, SOPs and SMS to identify, assess, measure, manage, monitor and report risks. Review relevant legislation and best practice with the view to continually improve procedures, work practices, systems and performance. Promote an organisational culture that allows all risk issues to be openly reported, discussed and addressed. Develop and/or implement specific Gippsland Ports deliverables, including, but not limited to: Safety and Environment Management Plans (SEMPs); Maritime Security Plan Compliance Management Develop and maintain GP s Statutory and Regulatory Compliance Register. Provide Statutory and Regulatory compliance register reports to the quarterly A&RC. Investigate and report legislative compliance management changes likely to affect GP s risk management policies and procedures. Investigate compliance management breaches and document agreed/proposed remedial actions. Ensure EHS auditing and incident investigation procedures are effective and are compliant with relevant legislation. Ensure regular corrective and preventive action reporting, systems compliance and opportunities for improvement to Management Team and the Board. Internal Audit Act as the day-to-day primary contact for the outsourced internal auditors. Develop and review the internal audit scope for adoption by the (A&RC). Develop the draft internal audit plan in conjunction with the A&RC, CEO, Executive Mgr Corporate Services and internal auditors for consideration by the Board. Facilitate internal audit reviews, including organising meetings with relevant staff. January 2016 Page 3 of 6

4 Key Roles Responsibilities Encourage and reinforce a culture of safety awareness and environmental awareness Lead the further development and promotion of a culture within Gippsland Ports which is consistent with Board policy and facilitates the achievement of organizational objectives Provide leadership, advice and technical support to portfolio managers and site managers on OHS matters. Develop and/or implement strategies to reduce workplace injuries and ensure workplace health and safety. Provide OHS coaching and facilitation at management and site level to equip portfolio and site managers to effectively fulfil OHS responsibilities. Other Ensure knowledge is current in the EHS field including legislation, regulations, guidelines and best practice, and that any proposed changes are planned to minimise any effect on GP s operations. In conjunction with the Human Resource Coordinator, manage GP s injury rehabilitation and return to work processes. Monitor activities to ensure compliance with appropriate legislative requirements and conformance with internal policies and procedures. Coordinate and facilitate EHS consultative committee meetings, including preparation and distribution of agenda as well as the recording and processing of minutes. Identify organisational EHS training needs. Monitor and review the effectiveness of GP s Safety induction program. Represent GP on external committees and specialist technical groups within portfolio area as required. Liaise with and build strong working relationship with DEDJTR, TSV, AMSA, WorkSafe and other regulatory agencies. Build strong relationships with all staff, their managers and the Board to ensure their risk management competence and knowledge is up-to-date. Assist the FBM with the annual budget process in the Risk and Compliance management operational area. Ensure budget expenditure/income for which the position is responsible falls within agreed budget parameters and is in accordance with Gippsland Ports policies. This position can be expected to be allocated duties not specifically mentioned in this document but within the capacity, qualifications and experience normally expected from a person at this level within Gippsland Ports. COMPETENCIES RELEVANT TO THE POSITION: Qualification/s Capabilities & Behaviours Knowledge & Experience Tertiary qualification in environmental management, occupational health and safety, risk management or other relevant discipline. Certificate IV in Training and Assessment, or similar current qualification. Current car drivers licence Proven ability to work collaboratively with CEO, senior managers, site managers and other staff to establish and maintain healthy working relations. Excellent organisational and time management skills and experience working under pressure and organising work priorities to meet strict deadlines, often with short turnaround times. Highly developed communication and interpersonal skills and ability to deal with complex internal and external stakeholder enquiries and training staff in standards and processes. The incumbent will act as a role model to other staff. Ability to work both independently and as part of a team in a busy, demanding but rewarding environment. Ability to research, evaluate and analyse new techniques, methods, policies and procedures and adapt to GP use High degree of initiative, analytical and problem solving skills with a proactive approach to staff and managers to quickly identify problems and implement improvements. Demonstrated knowledge and experience in risk management and the management of, safety and/or environment systems and plans. Experience in dealing with others successfully, both individually and in groups, in order to facilitate and build strong working relationships. Highly developed knowledge of OHS, marine safety, port management, environmental and other relevant legislation, Australian Standards, codes and guidance information. Demonstrated advanced computer skills including word processing, spreadsheet, databases, outlook and internet, and ability to maintain and analyse information and maintain manual and computerised record management systems. Knowledge and understanding of Gippsland Ports work practices. 8. KEY SELECTION CRITERIA i. Demonstrated performance at managerial level in a similar role in a service organization. ii. iii. iv. Highly developed understanding of applicable legislative and regulatory regimes in workplace health and safety, marine safety, port management and environmental management. Demonstrated competence in development, maintenance and auditing of risk management systems, including but not limited to safety, environment and emergency management. Strong research, analytical and problem solving skills and the ability to influence and negotiate effective outcomes. v. A tertiary qualification in a relevant discipline (eg; Corporate governance, occupational health & safety, risk management, environmental science/management). 9. ENVIRONMENT HEALTH & SAFETY REQUIREMENTS All employees are required to implement and maintain the Gippsland Ports EHS Management Strategies in areas under their control ensuring compliance with legislative requirements and the established standards. 6 All employees will assist the Manager of their work unit to create and maintain a safe and healthy work environment by working safely, adhering to instructions and using the equipment provided in accordance with safe operating procedures. Where appropriate, employees will participate in and contribute to EHS, Designated Work Group and Toolbox meetings; develop safe work/operating procedures; and, provide appropriate information, instruction, training and supervision. Employees will also inform their Manager or the Health and Safety Representative of their work unit of any unsafe working practices or hazardous working conditions. 10. GIPPSLAND PORTS EXPECTATIONS All employees are expected to: Contribute to the efficient and effective functioning of their team or work unit in order to meet Gippsland Ports objectives. This includes demonstrating appropriate and professional workplace behaviours in accordance with the Code of Conduct, providing assistance to team members if required and undertaking other key responsibilities or activities as directed by their manager/supervisor; Perform their responsibilities in a manner which reflects and responds to continuous improvement; and Read, understand and comply with all Gippsland Ports policies and procedures.
