Background This for enforcement at road works is aimed at ensuring that Highways Agency (HA) personnel, their contractors, and the enforcement authorities are aware of their responsibilities in enabling the selection, placement, maintenance and correct recording of appropriate speed limits where applicable at road works sites. It will inform Project Sponsors of the enforcement process and arrangements established depending on the type of road works and project. Issue B Page 4 of 29

Introduction On highways where the maximum speed limit is set at 70 mph a mandatory reduced maximum speed limit of 50mph or less may be imposed at road works sites, but compliance with the limit is far from universal. In order to provide safety for workers and road users it is essential that motorists comply with the speed requirements for road works site. Without enforcement, it is likely that some motorists will not comply with the speed limits. There is a link between the level of enforcement and the level of compliance so it is necessary to enforce at a level which will result in the majority of motorists obeying the speed limits. The deterrent provided by enforcement is key to achieving the compliance needed on a road works site. The provision of speed cameras has proven an effective tool for reducing speed at road works. Other measures for gaining compliance are discussed at Section 4.6 in this guidance document. The use of temporary speed cameras should be seriously considered at road work sites on the strategic road network. It is important that this guidance is followed to achieve consistency and the maximum safety benefit for road workers and road users. The key stakeholders involved in the enforcement at road works process include: HA Project Sponsors Enforcing Authority Managing Agent Contractors (MAC) Designer (Normally a Consultant) Figure 2a below shows how this Guidance fits in with other policy documents that are to be referenced throughout this document. This Guidance sits alongside the Safety Camera Partnership Guidance 2006/07 which seeks to support the involvement with SCPs of any HA staff along with those of managing agents and their contractors and also achieve a consistent approach across the strategic road network. 6 It should be noted that from April 2007 the current arrangements for cost recovery will cease to exist. The HA will receive a grant to allow the provision of continued support to the partnerships but this is unlikely to include Road Works. Revised guidance explaining funding mechanisms to facilitate HA partnerships will be published prior to April Issue B Page 6 of 29

7 3. Procedures This section will consider the roles and responsibilities of each organisation. It is necessary to ensure that each organisation is aware of what they are responsible for and at what stage they should be involved in the process. This will ensure that the introduction of enforcement at road works will be well planned with each organisation being fully aware of what activities need to be carried out. A summary of key Highways Agency activities is shown at Appendix A. 3.1 Enforcement Process Figure 3a below identifies 5 key stages of a scheme where the introduction of enforcement at road works needs careful consideration. 9 3.2 Summary of Key Activities, Deliverables and Responsibilities Stage 1 - Pre-Design This stage addresses the initial planning of the project and every effort should be made to mitigate the risk to the travelling public and workers before enforcement is considered. All of the activities in this stage should be carried out prior to the start of the project. An Early Contractor Involvement (ECI) project will require early liaison with the Designer. The following points should be considered by the HA Project Sponsor: Points to Consider: Is a reduced speed limit required? If so, taking into account the nature of the works; worker protection; whether there are concrete barriers or cones and also the topography of the site, HA should consider what the speed limit should be taking into account these issues. Chapter 8 of the Traffic Signs Manual (Operations document Section 3.5) provides guidance on the recommended speed limit that should be adopted. The Interim Advice Note (IAN 57/04) The Use of Temporary Speed Limits at Road Works on High Speed Roads provides guidance to traffic management designers on the application of temporary speed limits. Does the reduced speed limit require camera enforcement or are there suitable alternatives available? If camera enforcement is required, include TASCAR (Temporary Automatic Speed Camera at Road works see section 4.1 for further information) in contract. If camera enforcement is required, liaison with the Enforcement Authority should commence as soon as possible. Any final decision on speed limits must be agreed with the Enforcement Authority. 10 Stage 2 - Design and Proposals This stage addresses the start of the project. If enforcement has been agreed all relevant parties and personnel should be made aware of the planned works and proposals. Joint agreement will be reached on the most appropriate and pragmatic speed limit based on the expert opinions of the HA, its agents, contractors and Enforcement Authority. It is essential that all parties know what they need to do to ensure that enforcement at road works can begin as planned. 11 Stage 3 Implementation This stage addresses the implementation of road works and equipment to enable enforcement to commence. Liaison with all parties is critical to ensuring that all aspects are covered. Once the checking of signage and equipment has been undertaken enforcement should commence. Policy 4.1 TASCAR (Temporary Automatic Speed Camera at Road works) TASCAR is included as a clause/appendix in contract specifications for some of our Managing Agents Contractors (MAC) and addresses the requirements for the provision of temporary automatic speed cameras at road works. It lays out both general and specific technical requirements where safety cameras are to be deployed within road works in an attempt to standardise the implementation of such systems. TASCAR should be incorporated into all contracts for major works and should be considered by all stakeholders at the earliest opportunity. For internal HA staff TASCAR can be found on the HA Portal. External staff should approach their HA representative. A diagram giving guidance on the use of TASCAR is at Appendix B. 4.2 Site Selection All road works sites should be seriously considered for enforcement. This is necessary to ensure the safety of workers and road users. When the decision is made that enforcement is required it will be necessary to liaise with all relevant parties and agree the method and type of enforcement. The Safety Camera Partnership Guidance 2006/07 (the reader should obtain the latest available issue) provides information on the type of equipment that could be considered and the appropriate Enforcement Authority will be able to advise on their preferred method. The Association of Chief Police Officers (ACPO) Code of Practice for Operational Use of Road Policing Enforcement provides the operational standards for the Police Service use of road policing enforcement equipment. This is available on the ACPO web-site under Publications. 4.3 Regulations All enforcement installations relating to the Safety Camera Programme have to meet strict rules, the following should also be taken into account when considering enforcement at road works sites. Rules and guidance relating to the national safety programme are detailed in the Handbook of Rules and Guidance for the National Safety Camera Programme for England and Wales 2006/07. Chapter 8 of the Traffic Signs Manual, which is the Department s standard for all aspects of signing and management of traffic at static and mobile road works on the network carried out by MAC. Full details including minimum site lengths and minimum signing requirements can be found in Chapter 8 of the Traffic Signs Manual. The requirements of Chapter 8 must be taken into account for all works on live motorways and all-purpose trunk roads. If a situation arises which, is not covered by Chapter 8 those planning the works must give consideration to ensuring safety, minimising traffic delay and Issue B Page 13 of 29

14 producing the most cost-effective solution when selecting which methods to use. If a departure from the HA requirements is needed approval must be obtained from the Regional Office and authorisation obtained for the use of any non-prescribed signs. All signs at road work sites should comply with Chapter 8 and TSRGD If a scheme is being introduced and in a special circumstance a sign is not prescribed within TSRGD they must be authorised by the HA Traffic Signs Team. The HA Traffic Signs Team should be approached as soon as possible so that the necessary authorisation can be obtained. The HA and County Surveyors Society Guidance for Safer Temporary Traffic Management (2002) complements Chapter 8 and must be taken into account during the planning, execution and removal of traffic management. The Interim Advice Note (IAN 64/05) Driver Information Signs at Road Works (unless superseded by Chapter 8) sets out the HA policy relating to driver information signs at road works that require the closure of a lane or hard shoulder. Temporary Traffic Regulation Orders (TTRO) are made under Section 14 of the Road Traffic Regulation Act (RTRA) MAC must submit requests for TTRO on Form TR514 and allow a minimum of 8 weeks for the preparation and publication of the necessary orders. Correctness of the TTRO is the responsibility of the HA Project Sponsor. The enforcement authority can only enforce speed limits where the speed limit signs conform to the requirements of the TSRGD and the TTRO. Details of signing including the co-location of speed limit and camera signs for safety cameras are found in TSRGD and the DfT rules and guidance handbook. All enforcement equipment used needs to have Home Office Type Approval to ensure devices are accurate, reliable and robust and provide accurate evidence leading to safe convictions. Details can be found within the ACPO Code of Practice for Operational Use of Road Policing Enforcement. The Design Document in Chapter 8 states that temporary speed limit signs on high-speed roads and other roads should comply with Table 4a below. Issue B Page 14 of 29

16 4.4 Communication The communication between organisations is crucial to the process for introducing enforcement at road works. It is necessary to ensure that all organisations involved in the process are approached at the earliest opportunity. The Enforcement Authority should be advised a year in advance that road works are planned. If road works are planned within a year then the Enforcement Authority should be made aware at the earliest opportunity so that funding can be available and arrangements made. It is considered that there should be a single point of contact in each organisation. This will mean that there will be no confusion with regard to responsibilities over which organisation will do what. It is considered that the point of contact for the HA who should be responsible for liaising with the Enforcement Authority should be the HA Safety Camera Partnership (SCP) Liaison Officer or a delegated representative. 4.5 Recording of Evidence It is necessary to ensure that there is appropriate and correct signing when enforcement is to be introduced. The signing and cameras put in place should be properly checked to ensure conformance to regulations and Chapter 8. This is necessary as should a case go to court then it can be proven that the signs in place had been checked and conformed to the regulations. Consideration should be given to positioning equipment and signs on fixed poles to prevent any cases being challenged due to signs being on temporary frames. A pack of evidence is shown at Appendix C and a pack should include the following documentation: Temporary Traffic Regulation Order this should be sought at the start of the road works scheme and must be validated as robust by the HA project Sponsor. A Traffic Regulation Order on All Purpose Trunk Roads should refer to distances from fixed landmarks such as bridges or junctions rather than marker posts. Witness Statement by Traffic Control Safety Officer or designated officer this will need to be recorded daily to ensure that the site has been checked thoroughly and that no signs or markings have been covered. It should be made clear to the witness that they should be available to attend court should they be required to do so. It may be that police forces may want to develop a generic statement covering specific road work operations. Daily Check Sheet The daily check sheet should be signed every two hours after checks have been completed. Schematic Chapter 8 Signing Schedule The signed diagram will show the signing layout of the road works site and that it complies with Chapter 8. The diagram must be the most up to date drawings of the road works showing the sign layouts. The documents listed above should be provided as a minimum for enforcement at road works. The evidence pack can be supplemented by video taken by police vehicles and with other documentation such as a Temporary Traffic Management Shift Maintenance and Operations Briefing Record Sheet. This sheet could reflect all activity undertaken including the cleaning, Issue B Page 16 of 29

17 checking and maintenance of road signs along with any other duties. The evidence pack should be agreed with the Enforcement Authority at the first meeting. 4.6 Other measures to gain compliance The challenge is to find a level of enforcement which influences driver behaviour and gains the compliance necessary to ensure the safety of workers and road users. Factors that can assist compliance include signing, road layout, and presence of traffic management personnel (such as a mobile SCP vehicle), as well as the sophistication of technology deployed. Education, engineering and encouragement will all help to gain compliance through a road works site. Education and publicising the benefits of the scheme will have a positive effect. The engineering of the scheme and the adoption of good habits as a result of the publicising of enforcement will go some way to gaining compliance. Other measures through encouragement such as the use of Vehicle Activated Signs (VAS) should also be considered in order to address the problem of inappropriate speed where conventional signing has not been effective. TA Leaflet 1/03 Vehicle Activated Signs states that VAS appears to be very effective in reducing speed, particularly those of the faster motorists who contribute disproportionately to the accident risk. VAS should be considered at road works sites as when used correctly it should provide benefit and encourage those speeding motorists to comply with the speed limit set. Where the VAS is to be used, the HA should agree an acceptable threshold with the Enforcing Authority. As a last resort, motorists should be aware that if they do not comply with the regulation then there are consequences through enforcement activities. Issue B Page 17 of 29

19 Appendix A - Summary of Key Highways Agency Activities and Enforcement Matrix In summary the HA should undertake the following: HA must seek approval on behalf of the Chief Constable of Police. The police are always the enforcing authority but may be represented through a Safety Camera Partnership. The decision to enforce the speed limit is made by the Chief Constable and the Safety Camera Partnership will carry out the enforcement on behalf of the Chief Constable. Ensure a Temporary Traffic Regulation Order is in place and is validated by the HA. This may take approximately 8 weeks but should be sought as early in the project as possible. In view of the fact this formal process (which includes publicity) must take place that ensures the speed limits applied are mandatory in law, there is no need necessarily to publicise the fact that limits will be enforced. NB The order may be required in court many months after the road works have ceased. Ensure signing for enforcement is installed and maintained in accordance with TSRGD, Chapter 8 of the Traffic Signs manual and the relevant rules within the DfT Safety Camera Programme Handbook. A useful addition is to ensure that speed limit and camera repeater signs are co-located and if possible lie within the enforcement zone. This adds weight to any challenged prosecution. It is recommended that enforcement equipment and signs be positioned on fixed poles. Recording a video while driving through the works can also confirm all equipment was originally in place. Particular attention must be given to ensuring that any movements are logged and that enforcement only takes place when the prosecuting authority (likely to be the Crown Prosecution Service, Secretary of State or the Local Authority) authorise that the site meets the requirement as set out in the Traffic Regulation Order. Ensure a log is maintained confirming all signs in place in accordance with TSRGD, certified as agreed and updated a minimum of every 2 hours. Under the HA Project Sponsors instruction, it is the MAC responsibility to ensure this is done. The logs must be retained securely at the end of the works and then the originals signed over to the police for retention and court use. In the event of a contested case, all material logs, videos etc are fully disclosable. Persons maintaining these logs could be required to attend court and produce such articles. Ensure a log of works suspension is maintained. Where road works are suspended, it is recommended that the speed limits should remain in place throughout the road works unless the road is operating completely as normal. During works suspension, it is recommended that cameras be bagged, but even if this is not possible, maintenance of this log will facilitate police decisions not to enforce within suspension periods. Inform the Enforcement Authority through SCP Liaison Officer of planned road works requiring enforcement as early as possible. Roles and responsibilities of all parties should be clarified at the earliest opportunity including which is the most appropriate party (SCP or HA alone) to fund camera equipment. For short notice works it may be more appropriate that the HA fund equipment without recovering costs. Particular attention should be given to the potential increase in offence processing that may result from the temporary Issue B Page 19 of 29

20 camera system. This possible restriction can often be overcome as long as sufficient notice is given. HA propose speed limits to be enforced. Joint agreement will be reached on the appropriate and most pragmatic speed limit based on the expert opinions of the HA, its agents, contractors and Enforcement Authority. The HA will make a request to the Enforcement Authority that enforcement at a signed speed limit takes place. Agree the most appropriate type of enforcement technology with the Enforcement Authority before designing a solution. All options including spot speed and time over distance solutions for enforcement should be considered and discussed with the enforcement authority. Consideration should be given to the extra risks introduced by the presence of mobile enforcement staff. Existing roadside monitoring locations may not always be suitable when traffic flow has been altered for the benefit of road works. Additional barriers may be required. Decisions may also be influenced by availability of interfaces to back office systems and the cost of ongoing maintenance. Ensure timely removal of the camera system upon completion of the road works. Secondary road markings should also be removed unless required for future. Figure A1 below lists the stages and shows which agency is involved in each activity. Each organisation should be aware of how they fit into the enforcement process and also who they need to be liaising with to ensure that all activities are covered to ensure that there are no delays to the introduction of road works. 23 Appendix C - Evidence Pack When a scheme is being designed it is necessary to provide the following information in an evidence pack. Temporary Traffic Regulation Order. Daily Check Sheet - A template is shown on page 24. Schematic Chapter 8 Signing Schedule. An example diagram is given on page 25 and shows a lane change zone for a lane closure. Project Sponsors should ensure that a diagram reflecting their scheme is prepared and authorised by appropriate personnel. Witness Statement by Traffic Control Safety Officer or designated officer. A template is shown on page 27. Guidance points regarding the information that should be included on the Witness Statement are as follows: - What is your background? - What are your qualifications? - What is your current role? - What speed limit is on the scheme?
