1 TOWNSHIP OF CRANFORD CRANFORD, NEW JERSEY ORDINANCE NO AN ORDINANCE AMENDING AND SUPPLEMENTING CERTAIN SECTIONS OF THE LAND DEVELOPMENT ORDINANCE OF THE TOWNSHIP OF CRANFORD COUNTY OF UNION, STATE OF NEW JERSEY CHAPTER 136 LAND DEVELOPMENT BE IT ORDAINED by the Township Committee of the Township of Cranford, New Jersey: SECTION 1: Chapter 136, Article IV Development Requirements and Standards, Section of the Township Code, is hereby amended as follows: A Design standards; specific Driveway standards (3)(a)[4] (new code G(3)(a)) Driveways for one and two family homes must be located a minimum of three feet from any side or rear lot line. B (6) (new code G(6)) (6) Off-street parking in non-residential zones C (11) (new section G(11)) delete D (new code J). Signs (1)(e) Directional signs approved by the Boards and having areas of less than two square feet are exempt from area and location regulations, except that they shall be located a minimum of five feet from any property line, and further provided they do not constitute a hazard to the traveling public shall comply with all applicable county, state and federal sign regulations (1)(f) delete (2) (b) Signs which project more than six inches from the wall to which they are attached other than projecting signs that are permitted as per Subsection 4(g) below (4) (a)[2] delete SECTION 2: Chapter 136, Article V. Zoning, Section Supplementary zone district regulations of the Township Code, is hereby amended as follows: Supplementary zone district regulations D (new code D) Yard regulations (4) Room air-conditioning equipment, ground-mounted generators barbeques or patios may be located only within any side or rear yard, so long as the furthest extending side is not less than five feet from any property line. Outside central air-conditioning equipment may be located only in any side or rear yard, provided that the closest face of the unit is not less than five feet from the property line. SECTION 3: Chapter 136, Article V. Zoning, Section B. (1) of the Township Code, is hereby amended and replaced by the following so as to read in their entirety as follows:

Zoning, Section B. of the Township Code, is hereby amended as follows: (new code ) Conditional Uses B. Specific conditions for conditional uses (2) Appliance and electronic service supply and repair shops (a) Shall be permitted on the first floor in existing space measuring 1,000 square feet or less. (b) Shall be permitted on the second floor or above without limit as to size. (c) The space shall be measured from the interior wall surface of the walls encompassing the use. (d) First-floor uses shall be required to provide on-site parking. (3) Automobile dealers - deleted (11) Dwellings- deleted (17) New and used vehicle sales dealers. (a) The minimum lot area shall be 40,000 square feet. (b) They shall be located on primary or secondary arterial streets. (c) All sales and repair activities shall take place within a principal structure. (18) Offices, professional, business, administrative uses (a) Offices shall be permitted on the second floor or above without any limit as to size. (b) Offices (not accessory to any other permitted use) shall only be permitted on the first floor in existing space measuring less than 1,000 square feet or in an existing office-style building that does not have storefront-type windows on the first floor. (c) Space shall be measured from the interior wall surface of the walls encompassing the office. (d) First-floor offices shall be required to provide off-street parking. (e) No first-floor space for a single occupant may be divided to create an occupant space of less than 1,000 square feet. (22) Residential uses (a) Each apartment shall have its own entrance to a hallway, staircase or to the exterior. (b)the ground floor entrance to the apartment unit or units shall be separate from the entrance to the ground floor use. (c)an applicant or developer shall provide credible evidence to the satisfaction of the reviewing board that sufficient parking spaces are available and/or reserved in either public or private off-street
6 parking lots for the overnight parking of vehicles of the prospective tenants of the apartment or apartments. (d) Such apartments shall be a minimum of 700 square feet for one-room studio or efficiency apartments and 150 square feet for each additional bedroom, but in no case contain more than two bedrooms. (e) No boarders shall be permitted to occupy such apartments, nor shall any portion of the space within the apartment be sublet or rented out for any period of time. (f) A minimum lot size of 5,000 square feet is required. (g) The gross density shall not exceed 20 units per acre. (h) A principal non-residential use must be located on the ground floor of the building. (23) Retail services in the D-b Zone -delete (24) Retail services on upper floors - delete (29) Vending machines- delete SECTION 6: Chapter 136, Article V. Zoning, Section of the Township Code, is hereby amended as follows: (A) (new code ) Off Street Parking (A) Off-street parking. In all zones off-street parking shall be provided for all uses in accordance with the following schedule. All ground floor nonresidential principal permitted uses in the D-C and D-T zones, except offices, shall not be required to provide off-street parking spaces. These are Central Business District blocks for which public parking shall be provided by the Township. SECTION 7: Chapter 136, Article V, Section d of the Township Code, is hereby amended and replaced by the following so as to read in their entirety as follows: d (new code D(5)) General Parking Requirements d (3) All new one and two family homes are required to provide a garage for at least one on-site parking space. All existing one and two family homes constructed without a driveway may construct a driveway on-site without erecting a garage. SECTION 8. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. SECTION 9. If any portion of this ordinance shall be determined to be invalid, such determination shall not affect the validity of the remaining portions of said ordinance. SECTION 10. This ordinance shall take effect upon final passage and publication in accordance with law. NOTICE OF PENDING ORDINANCE The foregoing ordinance was introduced and approved on first reading at a meeting of the Township Committee of the Township of Cranford, New Jersey on Tuesday, August 16, 2016 and will be further considered for final passage after public hearing to be held at the Municipal Building, 8 Springfield Avenue, Cranford, New Jersey on Tuesday, September 27, 2016 at 8:00 PM or as soon thereafter as this matter can be reached.
