2 CENTRAL HIGHLANDS COUNCIL REFERENCE NO. 01/15 SUPPLY OF CRUSHED RED GRAVEL SPECIFICATION 1. GENERAL REQUIREMENTS 1.1 CONTRACT The Contract is a Schedule of Rates Contract for the supply of aggregate for general use within the boundaries of the Central Highlands Municipality in accordance with this specification. 1.2 CONTRACT DOCUMENTS The Contract Documents shall comprise of the following: Letter of Acceptance; Instrument of Agreement; This Specification; and All correspondence and/or drawings accompanying the tender or subsequent to the tender. 1.3 DURATION OF THE CONTRACT The Contract shall be for a period from 1 st August, 2015 to 1 st August, 2016 with an option of a further one (1) year extension by mutual agreement. The Principal shall determine the period of the Contract in its absolute discretion and will notify the successful Tender before 24 th July GOODS & SERVICES TAX (GST) All prices for materials, equipment and labour which are supplied under the Contract are to include GST. All tax invoices submitted for payment shall detail in full the amount of GST applicable for each category of payment due. Contractors shall have a current ABN number. CHC Tender No.01/15 2

3 1.5 SUPPLY OF MATERIALS Delivery The Supplier shall supply materials to the Stockpile nominated by the Purchaser: Into stockpile at Hamilton Quarry in Hamilton, and Bowden s Quarry in Bothwell, or other stockpiles as nominated by the Purchaser. All quarry operations are to be carried out under Council supervision to ensure compliance with Council s requirements. All works are to comply with the current Quarry Code of Practice. Prices relate to the winning, screening, crushing and stockpiling required. They do not include stripping of overburden. Material should be won at time of crushing. Unless otherwise agreed, quarry operations shall be carried out during normal Central Highlands Council working hours, Monday to Friday 7:30 am to 4:30 pm Failure to Supply In the event of the Supplier being unable to supply the full quantity of the correct grading and quantity of aggregate required at any time, the Purchaser may, at his discretion obtain the balance from the nearest source producing such material acceptable and available to it, and recover any additional costs from the Supplier. If the balance cannot be supplied by other sources, liquidated damages of $ per day will be incurred by the Supplier for every day s delay in construction or reconstruction Consignment Crushed gravel is to be provided on consignment (i.e. Council will only pay for gravel taken from the Quarry). 1.6 ORDERING OF QUANTITIES REQUIRED The Supplier shall be given an estimate of the quantity and sizes of aggregate required. 4 1.7 MEASUREMENT All measurement shall be per tonne or measured cubic metre by agreement with the Purchaser. 1.8 PAYMENT Payment shall be made monthly on a per tonne basis or cubic metres basis at the rates set out in the schedule taking into consideration the period of the Contract as nominated by the Principal. Payments are to be made 30 days after receipt of invoice. 1.9 RISE AND FALL The tendered rates shall be deemed to be based on the cost of labour and materials existing at the date of closing of tenders. If the Supplier agrees to the 1 year extension of contract adjustments to the tendered amount to compensate for variations in labour and materials costs during the term may be calculated by a formula stated in the Tender document. If a Supplier does not state in the tender that the rates shall be subject to adjustments to the rise and fall in costs the tender shall be deemed to be for fixed rates for the term of the contract. Should any material be rejected by the Purchaser as unsatisfactory, no price variation shall be applicable to such material after the date of notice of unsound work QUANTITY Central Highlands Council s annual requirements are for a total of approximately tonnes of 14mm minus, 30,000 tonnes of 20mm minus, 4,000 tonnes of 60mm minus and 1,800 tonnes of Run of Mine. No guarantee is given that this quantity will be purchased. 5 2. QUALITY OF MATERIALS 2.1 SCOPE This section covers the quality and the blending as required by Central Highlands Council of the gravel. 2.2 AGGREGATE All gravel shall be crushed and stockpiled and be free from all organic matter and conform to the gradings as specified for the particular gravel size listed in the schedule. Rock produced shall be crushed from a jaw and cone crusher or impact crusher. Material to be consistently blended. Sizing to comply with DIER Specification R41. CHC Tender No.01/15 5

8 AUSTRALIAN STANDARD GENERAL CONDITIONS OF TENDERING AND FORM OF TENDER 1. The documents, upon which the tenderer is to tender are: Notice to Tenderers; General Conditions of Tendering; Form of Tender; Schedule of Rates; The Specification and Annexure A (They should be listed in each case. No general description suffices.) 2. Tenderers must complete the Tender Form provided and lodge it with any accompanying schedules or information in a sealed envelope endorsed with the Contract number at the Central Highlands Council Office, 6 Tarleton Street, Hamilton by 4.00 pm on Friday 10 th July, Late tenders will not be considered. 3. The Principal is not bound to accept the lowest or any tender. 4. No conditions or qualifications pertaining to any tender shall be considered unless stated in the body of a letter accompanying the tender. Printed conditions on the reverse side of a tender letter shall be specifically excluded. 5. The successful tenderer shall execute a Formal Instrument of Agreement as provided in Clause 6 of the General Conditions of Contract. 6. Any tender will be rejected which does not comply with the requirements of or contains any provision not required or allowed by the tender documents. Alternative tenders will only be considered when submitted with a conforming tender. 7. Tenderers shall comply with the requirements of Central Highlands Council s Code for Tenders and Contracts. 8. Tenderers shall have documented safe working procedures. 9. The Principal may select the period of the Contract as described in Clause 1.3 of the specification. 10. Tenders by facsimile or electronic mail will not be accepted. 11. Evaluation of Tenders will have consideration to the following information, which shall be supplied as part of the tender submission: (i) the resources of the Tenderer including technical, managerial, physical and financial resources; (ii) price; (iii) Tenderer s past experience and performance history; and (iv) any other criteria specified in the Tender package. Failure to provide such information will result in diminished tender assessment. 12. Opening of tenders will not be public. 13. 13 ANNEXURE PART B REQUIREMENTS WHILE WORKING IN THE QUARRY 1. The Contractor is required to abide by all Workplace Safety Tasmania requirements while working in the quarry. 2. The quarry must be left clean and tidy at the end of each working day. 3. All gates to be closed and locked at the end of each working day. 4. All wind blown material is to be collected at the end of each day (i.e. paper, plastic etc) and removed. 5. Any fuel or oil spills to be reported to Council s Works and Services Manager immediately (Jason Branch ). Contractor is required to have appropriate oil spill kits available on site. 6. Should a fuel or oil spill occur, all costs associated with the clean up is to be at the contractor s expense. 7. No materials to be removed from quarry without consent from Council s Works and Services Manager. 8. Material rejected from the crusher shall not exceed 200 cubic metres before it is returned to the crusher. 9. Council reserves the right to sample stockpiles as it sees fit. 10. The cost of all subsequent tests required to verify the correction of substandard material is to be at the contractor s expense. 11. Council does not accept responsibility for damage to Contractor s plant or equipment while working in the quarry. 12. The Contractor is to ensure that no damage to the quarry road, surrounding property, stock or wildlife is allowed. Costs of repairs will be the responsibility of the contractor. 13. All raised gravel is to be quarried by dozer and to Council s Works and Services Manager s requirements. CHC Tender No.01/15 13
