1 Warranty Policy Policy for LED Lamps This document sets out the warranty policy for LEDvolution branded products sold by LEDvolution sales partners, such as but not limited to distributors, retailers, resellers or installers from which you (hereinafter referred to as Purchaser ) purchase your LED lamps. This policy is applicable only to LEDvolution branded LED lamps (hereinafter referred to as Products ) and for Products purchased and installed in the member states of the European Union (hereinafter referred to as EU ) from June 2015 onwards. LEDvolution indoor and outdoor professional luminaires are excluded from this warranty policy. This warranty policy is subject to the provisions set out below and to the attached terms and conditions ( Warranty Terms and Conditions ). This warranty is given by item international Handel GmbH (hereinafter referred to as LEDvolution ), Hollabererstrasse 4, 4020 Linz, Austria, who is first distributor of the Products in the EU. This warranty policy applies only if it is agreed and referred to in the purchase agreement between the LEDvolution sales partner and the Purchaser. A. Warranty Period Subject to the provisions as set out in the Warranty Terms and Conditions, Purchaser receives the warranty for each named product family for the applicable period, as described in table 1 of this document. 2 B. Special Conditions 1. The warranty period starts on the date of invoice. 2. The warranty period is based on a burning behaviour (working time) of max hours / year for LED tubes and max hours / year for all other LED lamps. In case of a burning behaviour (working time) of more than hours / year or hours / year (depending on the product family), the warranty period will be adjusted pro-rata. 3. The warranty period is only valid when Products are operated below the maximum ambient temperature (Ta) stated in the product specification sheet, on the packaging or the installation guide. 4. This warranty policy is only valid when Products are properly installed and operated in application conditions as specified in the product datasheet. 5. Relative humidity in the installation never exceeds 80% RH or never exceeds the IP rating of the Product, if any. 6. The Product has to be operated in an open luminaire and with a minimum 10 mm gap between luminaire and Product. Using the Product in a closed fixture might exceed the recommended maximum ambient temperature (Ta) as stated in the product specification sheet, on the packaging or the installation guide and which subsequently renders the warranty void. 7. The electrical installation in which the Product operates is not subjected to voltage fluctuations exceeding +/- 10% of 230 volts. 8. Purchaser receives this standard warranty by default. LEDvolution may upon request agree in writing on an extended warranty or customised project warranty after evaluation of the specific application conditions. 9. Purchaser shall not rely on any other information or documentation. 10. Labour costs for (de)-installation and (re)-installation of the Products are not covered under this warranty. 11. LEDvolution reserves the right to decide by oneself whether the case is covered by the warranty or not. C. Additional Conditions (non-exhaustive) Purchaser can only make a claim on the warranty if Purchaser complies with the following terms and conditions: 1. This warranty is only applicable to Products sold and installed in the EU. In other regions this warranty is not applicable and there can be no claims made according to this warranty. 2. The Products have been purchased directly from a LEDvolution sales partner based in the EU. 3. Proof of purchase for the Products is available for inspection by LEDvolution. 4. The Products have been properly installed and operated in accordance with the manufacturer s instructions. 5. The Products have to be professionally maintained. For instance the Products have to be properly cleaned regularly to avoid dust accumulation. For the necessary cleaning cycles of your Product please check with the LEDvolution sales partner. 6. Adequate records of operating history are kept and available for inspection by LEDvolution. 7. A LEDvolution representative will have access to the defective Products. If the Products or other parts become suspect, the representative shall have the right to invite other manufacturers representatives to evaluate the lighting systems. version 07/2015, page 2 of 5

3 Warranty Policy This warranty is given by item international Handel GmbH, Hollabererstrasse 4, 4020 Linz, Austria, as first distributor of LEDvolution branded products. Terms and Conditions 1. Limited Warranty a. This warranty shall only apply to LEDvolution branded lighting products (hereinafter referred to as Product ) sold by LEDvolution sales partners, such as but not limited to distributors, resellers, retailers or installers in the member states of the European Union (hereinafter referred to as EU ). The warranty is only applicable to the party (hereinafter referred to as Purchaser ) purchasing the Products directly from a LEDvolution sales partner. b. LEDvolution warrants that each Product will be free from defects in material and workmanship. The foregoing warranty shall be valid for the period mentioned in the applicable warranty policy for the Products referred to in your sales agreement. If a Product fails on grounds of defects in material or workmanship to operate in accordance with this warranty, LEDvolution will provide a free replacement of the failed Product subject to the applicable warranty policy and the limited warranty terms and conditions set out below. 2. Terms and Conditions a. LEDvolution s warranty flows only to Purchaser. If any Product covered by this warranty is returned by Purchaser in accordance with section 3 and within the applicable warranty period set out in the warranty policy and on examination LEDvolution determines to its satisfaction that such Product failed to satisfy this warranty, LEDvolution will, at its option, repair or replace the Product or the defective part thereof, or the LEDvolution sales partner will reimburse Purchaser the purchase price. For purposes of clarity, repair or replace the Product or the defective part thereof does not include any removal or reinstallation activities, costs or expenses, including without limitation, labour costs or expenses. b. The warranty periods specified in the foregoing warranty policy are applicable once only. By repair or replacement of a Product under warranty, the warranty period is not renewed or extended. c. If LEDvolution chooses to replace the Product and is not able to do so because it has been discontinued or is not available, the LEDvolution sales partner may refund the Purchaser or LEDvolution may replace the product with a comparable product (that can show deviations in design, product specifications and lighting facts). d. No LEDvolution sales partner is authorized to change, modify or extend the terms of the warranty on behalf of LEDvolution without official written approval from LEDvolution. e. This warranty only applies when the Product has been properly wired and installed and operated within the electrical values, operating range and environmental conditions provided in the specifications, the recommended or specified PSU (Power Supply Unit), application guidelines, IEC standards or any other version 07/2015, page 3 of 5

4 document accompanying the Products. If a Product is found to be defective, or not performing in accordance with the product specifications, the Purchaser must notify the LEDvolution sales partner in writing. f. This warranty does not apply to damage or failure to perform arising as a result of any Acts of God or from any abuse, misuse, abnormal use or use in violation of any applicable standard, code or instructions for use, including without limitation, those contained in the latest safety, industry and / or electrical standards for the relevant region(s). g. This warranty shall be void in the event any repairs or alterations, not duly authorized by LEDvolution in writing, are made to the Product by any person. The manufacturing date of the Product has to be clearly readable. LEDvolution reserves the right to make the final decision on the validity of any warranty claim. 3. Warranty Claims a. All warranty periods mentioned are subjected to LEDvolution sales partners or LEDvolution representatives having access to the Product or system for verification of non-compliance. Warranty claims have to be reported in writing and returned to the LEDvolution sales partner within 30 days after discovery, specifying at least the following information (additional information may be required on request): - Details of the failed Products; and for system warranties also details of other components used; - Installation date and invoice date; - Detailed problem description and number of affected Products; - Application, hours burned (working time) and number of switching cycles; b. Where a warranty claim is justified, the LEDvolution sales partner will pay for freight expenses. The LEDvolution sales partner may charge the Purchaser for returned Products that are not found to be defective or non-conforming together with the freight, testing and handling costs associated therewith. 4. No Implied or Other Warranties a. The warranty and remedies contained in this warranty are the only warranties given by LEDvolution with respect to the Products and are given in lieu of all other warranties, whether expressed or implied, including without limitation warranties of merchantability or fitness for a particular purpose, which warranties are hereby disclaimed. b. These terms and conditions state LEDvolution s entire liability and obligation to Purchaser and Purchaser s sole and exclusive remedy in connection with defective or non-conforming Products supplied by LEDvolution to the Purchaser, whether or not such damages are based on any warranty not explicitly mentioned in these terms and conditions, tort, contract or any other legal theory, even if LEDvolution has been advised or is aware of such defects. 5. Limitations and Conditions a. This warranty is not applicable for Products bought second-hand. b. This warranty is only valid for Products installed in the EU. c. Transport damage to the Product will effectively void this warranty. d. Please contact the LEDvolution sales partner for the RMA procedure. Products being returned must be 100% complete and must be packaged in original packaging. If the original packaging is no longer version 07/2015, page 4 of 5

5 available, the Product must be sufficiently packed for transport. e. The Product s manual and / or installation guide and accessories must be included in the return shipment. All Purchaser s labels, adhesives and markings on the return products must be removed and erased before being sent back. If the label adhesives cover any information on the product, or the labels cause any physical destruction on the product when removed, we will consider that as physical damage and not covered in warranty. f. Discolouration and embrittlement of plastics used in the Product s body and in optical components, such as but not limited to polycarbonate, PMMA or ABS are a result of the natural ageing process and are thus not covered by this warranty. g. No part of the Product may get in contact with substances harmful to the used materials. This explicitly excludes damage caused by inappropriate cleaning agents. h. The colour shift of LED modules is not included in this warranty. In a new LED module, light flux and performance are subject to a tolerance of +/- 10%. All relevant technical data are defined in the product and application specifications (data sheet, product leaflet, etc.). Due to technical progress and to the change in the luminous flux and light colour of products that is caused by their use, subsequent deliveries of LED modules may have light properties deviating from those of the original products. i. This is a limited warranty and excludes, among other items, installation, providing access to products (scaffolding, lifts, etc.), and special, incidental and consequential damages (such as loss of revenue / profits, damage to property or other miscellaneous costs not previously mentioned), and is further defined by the limitations and conditions set forth in the respective warranty policy and these terms and conditions. j. Upon request, LEDvolution representatives shall be allowed access to the defective Product, system or application for verification of non-compliance. k. LEDvolution cannot be held liable for electrical supply conditions, including supply spikes, over-voltage / under-voltage and ripple current control systems that are beyond the specified limits of the products and those defined by relevant supply standards (e.g. EN norms). l. This warranty is covered by the laws of Austria. The rules of conflict are excluded and not applicable. Further application of the UN Convention on Contracts for the International Sale of Goods is expressly excluded. The competent courts of 4020 Linz (Austria) shall solely have jurisdiction for all disputes arising from this warranty. version 07/2015, page 5 of 5
