2 WHAT DOES OWH DO? The Office of Wage-Hour serves employers and employees in the District of Columbia by: Performing intake interviews for claimants in office Investigating claims Conducting compliance audits Working to recover back wages Communicating with employees and employers

3 LAWS ENFORCED BY OWH I. DC Wage Payment and Collection Law II. Minimum Wage Amendment Act of 2013 III. Accrued Sick and Safe Leave of 2008 (ASSLA) IV. Living Wage Act of 2006 V. Wage Theft Prevention Amendment Act of 2014 (WTPAA) VI. Commuter Benefits Law

4 DC Wage Payment and Collection Law This law requires that all employers pay their employees: At least twice monthly On designated paydays, Pay all earned and promised wages, and Pay wages timely upon termination of employment.

5 Minimum Wage Amendment Act of 2013 This Act amends the Minimum Wage Act Revision Act of 1992 to increase the minimum wage in the District of Columbia to $11.50 an hour in three (3) steps: Beginning July 1, 2016, the minimum wage will increase from $10.50 per hour to $11.50 per hour for all workers, regardless of size of employer Every employer subject to the provisions of the Act must post the Minimum Wage Poster in or about the premises at which any employee covered is employed. Employers of Tipped Employees must provide a Quarterly Wage Certification that all tipped employees are paid the proper minimum wage.

6 Accrued Sick and Safe Leave Act of 2008 (ASSLA) The Accrued Sick and Safe Leave Act of 2008 requires employers in the District of Columbia to provide paid leave to employees: For illnesses or medical appointments, and For absences associated with domestic violence or sexual abuse. Sick leave conditions can be related to the employee or a family member in the home of the employee.

7 Living Wage Act of 2006 The Living Wage Act of 2006 requires employers in the District of Columbia who are recipients of contracts or government assistance in the amount of $100,000 or more to pay their affiliated employees no less than the living wage rate 2013 Rate = $ Rate = $ Rate = $ Rate = $13.85 (effective January 1, 2016)

8 The Wage Theft Prevention Amendment Act of 2014 The Wage Theft Prevention Amendment Act of 2014 (WTPAA) went into effect February 26, The purposes of the WTPAA: To amend the following existing D.C. wage laws: Wage Payment and Wage Collection Law Minimum Wage Revision Act (Current rate: $10.50 per hour) Accrued Sick and Safe Leave Act (All employees must be able to access paid leave) Living Wage Act (Upholds previous 2013 amendment. Current rate: $13.85 per hour) To require the employer to provide written notices to employees of their employment status To clarify administrative procedures for enforcement of D.C. wage laws To enhance applicable remedies, fines, and administrative penalties

13 DC Commuter Benefits Law Sustainable DC Act of 2014 Reduce traffic and pollution by encouraging transit use Make commuting more affordable As of January 1, 2016, employers with 20 or more employees in DC must offer access to one or more transit benefit options: 1) Employee-paid pretax benefit (most popular) 2) Employer-paid direct benefit 3) Employer-provided transit

17 BSG Program Analyst: Department of Employment Services BSG Program Analyst Identify and promote employment opportunities by establishing partnerships with business stakeholders in the District of Columbia. Integrate employer recruitment with American Job Center Employment Opportunity Specialist Team. Promote DC Networks registration with employers and job seekers for recruitment hiring activities. Introduce DOES employer support services at strategic planning sessions. Conduct Competency Based pre-screening assessments for qualified job seekers. Offer employers local and federally funded tax incentives, bond insurance and preemployment training programs.

18 Employer Incentives Disabled Access Tax Incentives Tax Credit o Business revenues of $1 million or less o 30 or fewer full-time workers o Maximum credit amount $5,000 o No tax credit for first $250 of expenditures o Architectural adaptations, equipment acquisitions, and services Tax Deduction o Maximum of $15K/Year for items capitalized (depreciated) o Deduction for expenses associated with the removal of architectural or transportation barriers in compliance with applicable accessibility standards Federal Bonding Program Work Opportunity Tax Credit (WOTC)

19 Employer Incentives Empowerment Zone Employment Credit o Wage Credit up to $3,000 per eligible employee both full-time & part-time o Total credit amount is 20% of the first $15,000 of wages paid to the employee o o Credit is renewable each year as long as employee lives in Empowerment Zone and works at least 90 days during the year in which the credit is claimed. Empowerment Zone Employment Credit is claimed on company s federal tax return (Form 8844)

20 Work Opportunity Tax Credit (WOTC) Federal tax credit available to employers hiring individuals from eligible target groups. Who is Eligible? Veterans TANF Recipients SNAP (food stamp) Recipients Designated Community Residents Vocational Rehabilitation Referral Ex-Felons Supplemental Security (SSI) Recipients Summer Youth Employees

21 Work Opportunity Tax Credit (WOTC) Employer Benefits: Reduces cost of doing business Reduces federal income tax liability between $1,200 and $9,600 per employee No limit of new hires to claim the tax credit Requirements: Employees must work a minimum of 120 hours first year of employment Complete IRS Form 8850 by the day job offer is made Complete ETA Form 9061 or 9062 if employee has been conditionally certified by State Workforce Agency, Vocational Rehabilitation Agency or participating agency Forms must be submitted within 28 calendar days of employee s start date Information: WOTC web-site, IRS web-site,
