7 Legislation The national regulator for the VET sector is the Australian Skills Quality Authority (ASQA), an independent statutory agency. It is comprised of a Chief Commissioner and two other Commissioners, who are appointed by the Governor-General for up to five years. ASQA staff are employed under the Public Service Act 1999.

10 National VET Regulator Act 2011 Clear statement of requirements An NVR registered training organisation must comply with the Standards for NVR Registered Training Organisations. An NVR registered training organisation must satisfy the Fit and Proper Person Requirements An NVR registered training organisation must satisfy the Financial Viability Risk Assessment Requirements An NVR registered training organisation must comply with the Data Provision Requirements An NVR registered training organisation must comply with the Australian Qualifications Framework.
11 National VET Regulator Act 2011 Clear statement of sanctions ASQA may do one or more of these: a) written direction requiring the organisation to rectify a breach of a condition on the organisation s registration b) written direction requiring the organisation to notify its VET students, in writing, of a matter as set out in ASQA s direction c) shorten the period of an RTO s registration d) amend an RTO s scope of registration e) suspend all or part of an RTO s scope of registration f) cancel an RTO s registration
12 National VET Regulator Act 2011 Clear definition contained in the Act VET Quality Framework means the following: a) the Standards for NVR Registered Training Organisations b) the Fit and Proper Person Requirements c) the Financial Viability Risk Assessment Requirements d) the Data Provision Requirements e) the Australian Qualifications Framework

17 Standards for NVR RTOs Part 1 Preliminary SNR 1 Name of Standards These Standards are the Standards for NVR Registered Training Organisations. SNR 3 Definitions About 40 definitions: Client, Continuous improvement Record, Operations 3.3 These standards may be referred to by the abbreviation SNR. For example this is SNR 3.3. Part 2: Essential standards for initial registration Organisations applying for initial registration are audited against this part.
18 Standards for NVR RTOs Part 3: Essential standards for continuing registration SNR 15 The NVR registered training organisation provides quality training and assessment across all of its operations. SNR 16 The NVR registered training organisation adheres to principles of access and equity and maximises outcome for its clients. SNR 17 Management systems are responsive to the needs of clients, staff and stakeholders, and the environment in which the NVR registered training organisation operates.

22 Fit and Proper Persons Requirements Purpose Every executive officer, high managerial agent and person or entity which exercises a degree of control or influence over the management or direction of the RTO is assessed against the Fit and Proper Person Requirements. The purpose is to decide on their suitability to be associated with the organisation. There is a Fit and Proper Person Requirements Declaration form on the ASQA website that must be signed by each person who fits the definition.
23 Fit and Proper Persons Requirements Definition: Executive Officer A person, by whatever name called and whether or not a director of the organisation, who is concerned in, or takes part in, the management of the organisation, or if the organisation is a body corporate: a person who, at any time during a period for which the organisation is registered, owns 15% or more of dividends paid by the organisation, or a person who, at any time during a period for which the organisation is registered, is entitled to receive 15% or more of dividends paid by the organisation.
24 Fit and Proper Persons Requirements Definition: Executive Officer (con t) An administrator, receiver or manager, or liquidator of the organisation (other than a receiver and manager, or liquidator, appointed by the court), or if the organisation is a body corporate - the administrator of a deed of company arrangement executed by an organisation, or if the organisation is a body corporate - a trustee or other person administering a compromise or arrangement made between the organisation and another person or other persons.
25 Fit and Proper Persons Requirements Definition: High managerial agent An employee or agent of the organisation with duties of such responsibility that his or her conduct may fairly be assumed to represent the organisation in relation to the business of providing courses (where courses mean courses of vocational education and training).
26 Financial Viability Risk Assessment Purpose An NVR registered training organisation must be able to demonstrate financial viability at any point in time, upon request. The assessment evaluates the likelihood of business continuity, and its capacity to achieve quality outcomes.
27 Financial Viability Risk Assessment Purpose The intention of the assessment is to determine whether the organisation has the financial resources necessary to: acquire assets and physical resources to deliver all qualifications on its scope employ sufficient qualified staff for the courses for which it takes enrolments provide appropriate levels of student services to students remain in business to ensure that each student can achieve completion meet the above requirements, even in an unsure environment.
28 Financial Viability Risk Assessment Definitions Financially viable means the ability of an organisation to generate sufficient income to meet operating payments, debt commitments and, where applicable, to allow growth while delivering quality training and assessment services and outcomes. Financial viability risk is the assessed financial performance, operations, and capacity of an organisation as an ongoing concern to deliver quality training and assessment services and outcomes for the duration of its registration, and the potential of its losing this capacity.
29 Financial Viability Risk Assessment Process If requested, financial data and information must be submitted to a qualified independent financial auditor nominated by the NVR. Common indicators of financial performance and position may include, but are not limited to: Liquidity including current ratio and cash flow assessments Solvency including debt to assets assessment, debt to equity assessment Economic dependency for example, reliance upon government funded training, or reliance on a particular cohort of students (e.g. overseas students) Revenue, profit and cash flow Commercial risk and contingencies Compliance with statutory obligations/accounting standards Audit opinion
30 Data Provision Requirements Purpose This instrument outlines the requirements for RTOs to capture and provide data to ASQA that relates to registration and performance information.
31 Data Provision Requirements AVETMISS compliant data Australian Vocational Education and Training Management Information Statistical Standard (AVETMISS) for VET providers is a national data standard that ensures accurate capture of information about students, their courses, units of activity and qualifications completed. NVR registered training organisations must have a student records management system that has the capacity to provide the National VET Regulator with AVETMISS compliant data. A records management system is AVETMISS compliant if it can export data in the file format required by the government (these files are known as NAT files).
32 Data Provision Requirements Quality Indicator Data This instrument also requires that the NVR registered training organisation collect data on the quality indicators and provide an annual summary report to ASQA. The annual summary report is due on 30 June each year and relates to the previous calendar year s activities.
33 Data Provision Requirements Registration data There is also a list of other documentation/information that must be provided to ASQA if requested. Most items are covered in other legislation but are included here because they constitute data, so there is no room for misinterpretation.
