1 THE MINISTRY OF AGRICULTURE, FISHERIES AND RURAL DEVELOPMENT 2252 Pursuant to Article 38, paragraph 5 of the Veterinary Act (Official Gazette 41/07), the Minister of Agriculture, Fisheries and Rural Development hereby issues the ORDINANCE ON INTERNET-BASED INFORMATION PAGE TO MAKE INFORMATION ON AQUACULTURE PRODUCTION BUSINESSES AND AUTHORISED PROCESSING ESTABLISHMENTS AVAILABLE BY ELECTRONIC MEANS [1] SCOPE Article 1 1.) This Ordinance lays down the requirements for the establishment of Internet-based information page (herein: Register) to make information on aquaculture production business and authorised processing establishments available by electronic means in accordance with Article 59 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals (Official Gazette 42/08 and 36/10)[2]. 2.) The Ordinance shall apply mutatis mutandis to installations, put and take fisheries where organised fish-stocking is carried out for the purpose of recreational fishing (herein: put and take fisheries) and aquaculture production business which, without prejudice to the provisions of Article 4, paragraph 1 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquaculture animals, have been registered by the competent authority in accordance with Article 4, paragraph 4 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquaculture animals subject to the first indent of Article 3, paragraph 1 of this Ordinance. DEFINITIONS Article 2 The competent authority responsible for implementation of this Ordinance is the Ministry of Agriculture, Fisheries and Rural Development.
2 1) The competent authority: INTERNET-BASED INFORMATION PAGE Article 3 shall establish the Register to make available information on farms or mollusc farming areas of aquaculture production business and authorised processing establishments which are authorised in accordance with Article 4 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquaculture animals, shall decide on case-to-case basis which installations, put and take fisheries and aquaculture production businesses referred to in Article 1, paragraph 2 of this Ordinance must be entered into the Register, taking into account the risk of the spread of aquatic animals diseases resulting from the operations of such installations, fisheries and businesses, based on their nature, characteristics and locations. 2.) The IRegister shall be established in conformity with the following Annexes to this Ordinance: a) ANNEX I for aquaculture production business keeping fish; b) ANNEX II for aquaculture production business keeping molluscs; c) ANNEX III for aquaculture production business keeping crustaceans; d) ANNEX IV for authorised processing establishments slaughtering aquaculture animals for disease control purposes, in accordance with Article 4, paragraph 2 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquaculture animals. 3.) The competent authority shall keep the Register updated so that it corresponds with the information included in the Register kept pursuant to Article 6 of the Ordinance on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquaculture animals. Changes in health status shall be introduced into the Register as soon as the health status recorded has changed. 4.) The competent authority shall communicate the Internet address of the Register to the European Commission. Article 4 Annexes I to IV are printed along with this Ordinance and form an integral part thereof.
