1 AIMS & OBJECTIVES 1. Accepting that every employee has the right to work without fear of injury or illhealth from any conditions within Council s control, the Council is committed to ensuring freedom of every employee from work related injury or work related illhealth. 2. The basis objective of this policy is the secure, progressive improvement in health and safety standards, therefore this policy:- provides a statement of the roles and responsibilities of all persons within the work environment; records the commitment of the Port Augusta City Council as the employer, to its legal and moral obligations in the field of health and safety; endorses the need for genuine consultation over health and safety; is the foundation for the ongoing development and implementation of procedures designed to create a safe and healthy working environment. RESPONSIBILITIES Council To ensure, so far as is reasonably practicable, that all persons involved in the work environment are safe from injury and risks to health while at work. This includes :- 1. Providing a safe working environment and safe systems at work. 2. Providing safety policies, procedures and systems in accordance with Acts and Regulations governing Occupational Health, Safety & Welfare and Compensation and Rehabilitation Act. 3. Providing and maintaining safe plant, machinery, equipment, substances and materials. 4. Engaging and maintaining a competent and committed management. 5. Consulting with employees and union and associations on Health, Safety & Welfare matters. 6. Providing appropriate personal safety equipment. City Manager 1. To acknowledge Council s obligations in relation to the Occupational Health, Safety & Welfare of its workforce and to provide adequate management systems to meet Council s responsibilities as :-

2 a) the employer; b) the Responsible Officer under Section 61 of the Occupational Health, Safety & Welfare Act. 2. To provide effective Injury Management and equitable claims management in accordance with the Workers Rehabilitation & Compensation Act 1986, and Regulations, to assist work-injured employees with an early return to work, and to achieve the best practical levels of physical and mental recovery (see supporting Injury Management procedures). 3. To participate, where necessary, in the formulation of safety policies, rules and regulations. 4. To provide for the development, enforcement and review of safe working procedures and systems. 5. To become involved, where required, in the promotion of a safe working environment. 6. To provide for information, training and supervision in an endeavour to ensure each employee is safe from injury and risk to health. 7. To provide for the implementation of Council s Health and Safety Policies and Programs. 8. To ensure that appropriate personal protective equipment is available for employees use and that adequate structure is in place to facilitate appropriate training regarding usage and maintenance and that measures are developed to ensure its proper use and maintenance. 9. To provide for the keeping of records of work related injuries. 10. To provide for the investigation of all work related incidents, and the implementation of remedial actions. 11. To provide for maintenance programs, to be developed for all plant, machinery and equipment to ensure safe conditions and use. 12. To promote adequate consultation with employees regarding Health and Safety issues and the important role status of health and safety within the organisation. Human Resource Manager 1. To provide advice to management regarding program objectives and strategies. 2. To provide administrative assistance in the implementation and monitoring of OHS&W programs. 3. To distribute OHS&W information to all levels of management. 4. To liaise with the LGA Workers Compensation Scheme Regional Rish Co-ordinator for assistance and advice on OHS&W issues. 5. To monitor Council s consultative procedures to ensure compliance with all legislative requirements.

3 6. To co-ordinate and arrange for OHS&W training and development. 7. To assist the elected OHS&W representatives as required; and 8. To advise management on the progress of the OHS&W program implementation. Directors/Managers/Supervisors 1. To enforce Council s safety policies, rules and regulations. 2. To constantly review working procedures and practices. 3. To develop a safe work environment by controlling, directing and monitoring work practices by :- a) carrying out job safety analysis; b) informing, instructing and training all subordinates in the safe use of all plant, machinery, equipment, substances and materials; c) investigating and controlling hazards; d) carrying out regular, well-planned inspections; e) taking remedial action to control identified hazards and recommending control strategies to executive management where hazard control requires resources beyond the Delegated Authority; f) ensuring issue and proper use and maintenance of personal protective equipment; g) ensuring all plant machinery and equipment is well maintained; h) ensuring good housekeeping; i) promoting safety awareness by setting a good example; j) ensuring all employees work in a safe manner; k) ensuring workers are not, by the consumption of alcohol or a drug, in such a state to endanger their own safety at work or the safety of others under their control. 4. To inform, instruct and train all volunteers and work experience persons in the safe use of all plant, machinery, equipment, substances and materials. 5. To assist in the rehabilitation of employees who are, or have been, absent from work due to illness or injury, by working in conjunction with the Internal Rehabilitation Co-ordinator. 6. To respond to potential hazards which may affect the OHS&W of employees. 7. To respond to proposed changes to the work place if such changes may affect the OHS&W of employees. 8. To respond to proposed changes to OHS&W practices, procedures and policies that are to be followed at the work place.

4 9. To respond immediately on receiving notification of a work related injury or illness to an employee or occurrence of a dangerous or hazardous situation. 10. To ensure that access and egress from the work place are safe. 11. To consult with OHS&W representatives and Committee on any proposed changes to the work place, plant, substances used etc. Employees 1. To take reasonable care of their own safety and that of others at work. 2. To accept the responsibilities in the course of performing their work to :- a) use safety devices and protective equipment correctly and in accordance with health and safety procedures; b) obey all instructions from their supervisors issued to protect their own personal health and safety and that of others; c) report any safety hazards to supervisors in regard to working conditions or methods and not to perform any procedure or task unless they have received appropriate training and instruction; d) report any accident or injury which arises in the course of their work; e) keep work areas in a safe condition; f) ensure that you are not, by the consumption of alcohol or a drug, in such a state to endanger their safety or that of others; g) not interfere with, remove or displace any safety guards, safety devices or protective equipment unless it is part of an approved maintenance or repair procedure. 3. To elect OHS&W representatives. 4. To serve on OHS&W Committee or as a OHS&W representative if elected. 5. To exercise their right to participate in OHS&W matters. 6. To support and use appropriate consultative structure. 7. To take such action as is within their competence and responsibility to report or make such recommendation to a higher level as they deem necessary to avoid, eliminate or minimise hazards of which they are aware in regard to working conditions or methods. Safety Representatives To represent the interests of the employees within their designated work group. Under the OHS&W Act, representatives have the following rights and responsibilities :- a) to inspect the work place either immediately, if there is an accident or direct risk to the health, Safety & Welfare of any person, or at any time after giving reasonable notice to the direct supervisor or departmental superintendent;

5 b) to accompany an inspector during an inspection of the work place; c) to investigate complaints relating to health, Safety & Welfare made by employees in the designated work group; d) to be present at an interview between management and an employee concerning Occupational Health, Safety & Welfare if the employee requires it. The employee must be advised that he/she can request the attendance of the Occupational Health, Safety & Welfare representative; e) to make representation to management on any matter related to Occupational Health, Safety & Welfare; f) to issue notices requiring unsafe situations to be corrected by a certain date; g) to direct work to cease if an immediate threat to health, Safety & Welfare is present; h) to have access to any information on risks that arise or may arise at the work place. OHS&W Committee There are some specific functions of the Occupational Health, Safety & Welfare Working Committee when it operates as part of a health and safety system. They include the following :- a) to help to formulate and disseminate policies, practices and procedures that promote health and safety in the work place; b) to consult with the employer on any proposed or actual changes in health and safety policies, practices and procedures at the work place; c) to assist management in the planning of action on Occupational Health and Safety. This will include helping to set priorities on controlling hazards; d) to act as a problem solving group to help with the identification and control of hazards; e) to help resolve Occupational Health, Safety & Welfare issues in the work place. Contractors Contractors are responsible for :- a) ensuring, in their capacity as responsible employers, that they and their employees, comply with the provisions of the Occupational Health, Safety & Welfare Act, 1986 and associated Regulations; b) notifying both the Council and the Department for Administrative & Information Services of accidents, incidents, and/or dangerous occurrences as defined by Regulation 6(6) Occupational Health, Safety & Welfare Act (Notification of workrelated Injuries, Accidents and Dangerous Occurrence) Regulations, 1987 involving contractors or their employees; c) ensuring compliance with the advice and/or directions issued by the Council and its agents;

6 d) abiding by the terms of the contract, including compliance with these OHS&W responsibilities; e) providing for themselves and their employees, all necessary protective equipment and enforcing the correct usage and maintenance of any such equipment; f) exercising due skill, care and expertise in the performance of the contract. Outside Advisory Staff 1. To provide competent, professional advice and assistance on legislative requirements, preventative strategies, accident investigation and follow-up, and hazard specific issues. 2. To provide professional auditing and training services. Visitors 1. To abide by all Council s safety rules. 2. To comply with health and safety instructions, advice and directives issued by Council staff. Volunteers & Work Experience People 1. Same as EMPLOYEES, paragraph 1 and 2. Use of Policy 1. It is intended that this Policy will act as a guide to all employees in regard to OHS&W matters, and should be read in conjunction with Council s OHS&W & Injury Management Policy statement. 2. It should be stressed that the importance of this document should be regarded as legal and binding, and should be used as a guidance document for all staff. The intent of this document should be translated as an effective way of achieving action with regard to OHS&W, and that all persons will refer to this document in all matters relating to OHS&W.
