22 Condizioni GENERALI di vendita I prezzi indicati nel listino di vendita potranno subire variazioni, che verranno comunicate. I prodotti potranno essere soggetti, a ns. insindacabile giudizio, alle modifiche di carattere migliorativo ritenute necessarie. Non si garantisce pertanto che il materiale fornito corrisponde esattamente alla foto del catalogo. Nel caso di ordini di completamento non viene garantita la fornitura dell esatta tonalità del materiale consegnato in precedenza. E facoltà dell Azienda, accettare o non accettare in tutto o in parte gli ordini effettuati dai clienti. La merce viaggia a rischio e pericolo dell acquirente; evenutali reclami del materiale, dovranno essere comunicati per iscritto alla Stil-Lux illuminazione s.r.l. entro otto giorni dal ricevimento. I termini di consegna non sono mai impegnativi. L Azienda non si assume la responsabilità per eventuali ritardi nella consegna dei materiali per cause dipendenti dalla propria volontà. Il ns. imballo standard in cartoni è gratuito; il costo relativo a imballi speciali, sarà addebitato in fattura. Per nessun motivo il destinatario può rifiutare lo svincolo della merce; in caso di eventuale rifiuto, le spese di sosta ed ogni danno derivabile saranno a Suo completo carico. A carico del cliente, saranno anche eventuali spese di giacenza dovuta all impossibilità del corriere ad effettuare la consegna nei normali orari di apertura dei negozi. Per i pagamenti effettuati oltre i termini stabiliti, si applicheranno gli interessi moratori senza necessità di costituzione di mora e ciò ai sensi dell art.1219 n.3 del C.C. e verrà applicato sull importo del credito un interesse di tre punti superiore al tasso ufficiale di sconto a norma dell art.1284 del C.C. ultimo comma. Se l inadempimento consiste nel mancato pagamento parziale o totale del prezzo della merce, al ricevimento della comunicazione inviata dalla Stil-Lux illuminazione s.r.l., con cui quest ultima dichiarerà di avvalersi della relativa facoltà, si verificherà ipso iure, la risoluzione parziale o totale del presente contratto, e la proprietà di tutta la merce giacente passerà in capo alla scrivente con la conseguenza che qualunque atto di disposizione della stessa, sarà considerato, da quel momento, come appropriazione indebita. Per qualsiasi controversia il foro competente è il Tribunale di Empoli o Firenze. Il presente listino prezzi sostituisce e annulla tutte le precedenti edizioni. GENERAL CONDITIONS OF SALES Prices indicate in this price list will be able to endure variations, that they will be communicated. The products could be subjected, under our judgement, to necessary modifications in order to improve quality and design. It is not guaranteed therefore that the supplied material corresponds exactly to the catalogue photo. In the event of completion orders we cannot grant the exact tonality of the material delivered previously. The goods travels to risk and danger of the purchaser; any claims concerning the goods, have to be communicated to Stil-Lux illuminazione s.r.l. within eight days from the reception by fax or Terms of delivery are never engaging. Our standard packing in cartons is free of charge; the related costs for special packing, will be debited into invoice. To customer costs will be also eventual expenses of lying due to the impossibility of the courier to carry out the delivery in the normal hours of opening of the stores. Payments carried out beyond the agreed terms will be applied of money interests without necessity of constitution of mora according to art.1219 n.3 of C.C and will be applied to the amount of the credit a money interest for three points superior to the official bank rate in compliance with art.1284 of C.C, last codicil.
