3 Planning Information Phase 1 - Land at Woodlands Way, Westfield Detailed Planning Consent has been granted by the Rother District Council under reference number RR/2010/2187/P (Phase 1) for the erection of some 45 houses/apartments subject to a Section 106 Agreement and various conditions. There are no affordable housing requirements or commuted sums payable on this site, but it is subject to an overage payment that can be found within the Section 106 Agreement. PLEASE NOTE: the site plan and house type schedule notate affordable housing units but these are now all open market units following renegotiations of the Section 106 Agreement. The owners have discharged a number of the planning conditions and are currently applying for those outstanding to be satisfied. A material start has been made on site to ensure the current consent remains extant. Phase 2 - Land to Rear 440 The Ridge, Westfield Detailed Planning Consent has been granted by the Rother District Council under reference number RR/2012/1576/P dated 6th February 2014 (Phase 2) for the erection of some 15 dwellings and associated access road. (PLEASE NOTE THAT THIS CONSENT IS FOR 14 DETACHED HOUSES PLUS AN AMENDMENT TO PLOT 15 UNDER THE PHASE 1 APPLICATION TO ENABLE THE NEW ACCESS ROAD TO BE CONSTRUCTED). The Consent is subject to a Section 106 Agreement and various conditions. There are no affordable housing requirements or contributions but the site is subject to an overage provision which can be found in the Section 106 Agreement. There has been no application to satisfy the conditions on this Phase. Phase 3 - The Michael Tyler Factory Site, Westfield The adjoining site known as the Michael Tyler Factory currently manufacturing upholstered furniture was refused planning consent by Rother District Council under reference number RR/2009/1378/P dated 27th July 2009 for change of use from commercial and the erection of some 41 residential dwellings. An appeal was subsequently dismissed. The owners are now preparing a new application for residential consent and would be prepared to offer an Option to the purchasers of Phases 1 & 2 to purchase subject to such consent being received. Alternatively the owners may consider a sale of the factory site on a subject to contract basis only leaving any prospective purchasers to obtain their own consent.
