Officer's Report - Updated Reason for deferral. This application was deferred at the Planning Committee meeting on 8 October, to allow councillors to undertake a site visit. This site visit took place on 27 October. RECOMMENDATION The recommendation is as set out in appendix of this report. Appendix This application has been referred to the Planning Committee as it is directly linked to planning application /P/00026 which has attracted more than 0 letters of objection contrary to the officer's recommendation. Site description. Richmond House (30 Millbrook) comprises a mid 20th century two storey house of no particular architectural merit. A full site description, including the relationship to surrounding features, is contained in the report on the related planning application /P/00026 elsewhere on this agenda. Proposal. Conservation Area Consent for demolition of Richmond House, existing garage, outbuildings and rear extension on Old River Cottage. Relevant planning history. Please see related planning application report (/P/00026). Consultations. Holy Trinity Amenity Group: HTAG has made some direct comments on this Conservation

4 Area Consent application. Draw attention to guidance which states that approval should not be given unless a related and acceptable redevelopment scheme has been granted. Conservation Area Consent should not be given unless such a situation exists. Third party comments: None received on this application. National Guidance PPS 5 - Planning for the Historic Environment Guildford Borough Local Plan 2003 (as saved by CLG Direction 24 September 2007): HE9 Demolition in Conservation Areas Planning considerations. The main planning considerations in this case is: The impact on the character and appearance of this site with its listed building within the conservation area Relevant guidance is set out in policy HE9 of the Local Plan, which states that development which involves demolition of a building in a conservation area will only be permitted where:-. The existing buildings make little or no contribution to the character or appearance of the area, or 2. Its potential for repair, retention and beneficial use is limited; and 3. Approval has been granted for a replacement scheme with an agreed timetable. In this case the related planning application for redevelopment is set out elsewhere on this agenda (application /P/0026). In consideration of criteria of policy HE9 no objection is seen to the loss of this house of no particular merit, although it sits fairly unobtrusively within its setting. The significance of the property is that it is a designated heritage asset by virtue of being within the Town Centre Conservation Area, as well as in the setting of the River Wey Navigation Conservation Area, and the setting of the grade II listed Old River Cottage. As reported elsewhere on this agenda, the related planning application for redevelopment is being recommended for approval. Subject to the imposition of a condition on this Conservation Area Consent to meet criteria 3 in terms of implementation timescale, no objection is seen to this proposal. The small outbuildings are also of little merit and their removal is acceptable. RECOMMENDATION: 2

5 Approve subject to the following condition(s) and reason(s) :-. The development for which Conservation Area Consent is hereby granted shall be begun before the expiration of three years from the date of this consent. Reason: In pursuance of Section 8 of the Planning (Listed Building and Conservation Areas) Act The demolition hereby permitted shall not be undertaken before planning permission has been granted for the redevelopment and a contract for the carrying out of the works of redevelopment of the site has been made. Reason: To ensure that premature demolition does not take place before development works start in order that the visual amenities of the area are safeguarded. In accordance with the following policy number(s), HE9 of the Guildford Borough Local Plan 2003 (as saved by CLG Direction on 24/09/07). 3. Works related to the demolition activities hereby permitted shall not take place other than between the hours of 8 am and 6 pm Monday to Friday and 8 am to.30 pm Saturdays and at no time on Sundays or Bank or National Holidays. Reason: To protect the neighbours from noise and disturbance outside the permitted hours during the construction period. In accordance with the following policy number(s), policy G(3) of the Guildford Borough Local Plan 2003 (as saved by CLG Direction on 24/09/07). 4. This decision relates expressly to the drawings and additional information received on 20/0/20. Reason: To ensure that the development is carried out in accordance with the approved plans, and in accordance with policy G of the Guildford Borough Local Plan 2003 (as saved by CLG Direction dated 24/09/07). Reason for decision: The development hereby approved has been assessed against the Guildford Borough Local Plan 2003 (as saved by CLG Direction on 24/09/07) and it has been found by the Planning Committee that it is in compliance with its policies, in particular, the existing buildings of are no particular merit and this proposal complies with the criteria attached to local plan policy HE9. Other material considerations, including all third party representations, have been considered. It has been concluded that this Conservation Area Consent application, subject to the conditions imposed, would accord with the development plan and there are no other material considerations to justify a reason for refusal. 3
