1 IDAHO CONCEALED WEAPONS PERMIT APPLICATION INFORMATION Jerome County Sheriff's Office- Driver s License Office 300 North Lincoln Jerome, ID (208) Applicants please read all instructions prior to filling out your Concealed Weapon Permit (CWP) application. DO NOT ABBREVIATE any of your personal information on your application. Use your full legal name. List your physical residence, not your mailing address. FIRST TIME APPLICANTS NEED TO PROVIDE PROOF OF 'FAMILIARITY WITH FIREARMS' TRAINING. See Idaho Code (13)(a-g) for acceptable proofs. Listed below are some examples: Hunter s education or hunter s safety course approved by the Department of Fish and Game, or a similar agency of another state. Completion of any firearms safety or training course, utilizing instructors certified by the National Rifle Association or the Idaho State Police. Completion of any law enforcement firearms safety or training course or subdivision of a law enforcement agency. Presents evidence or equivalent experience with a firearm through military service. 1. FIRST TIME APPLICANTS: All first time applicants will need to complete and submit their application and supporting documents to the Jerome County Sheriff s Office. Be sure to read all the information provided and fill out required information. When you submit your application and supporting documents you will be fingerprinted. A fee of $55.00 will be collected at the time the fingerprints are completed. You may pay with cash, by personal check or credit/debit card (a fee off $1 + 3% will be required) only. Should you be rejected for your CWP, there will be no refunds. New applicants will be contacted within 90 days after the date the application was submitted via U.S. mail. Applicants will be advised of their application status and of any actions that need to be taken. 2. RENEWAL APPLICANTS: Concealed Weapon Permit (CWP) applicants must appear in person and can be submitted at the driver s license department for renewal within 90 days before or after the expiration date listed on the CWP A fee of $45.00 will be collected when you submit your renewal application. Should you be rejected for your CWP, there will be no refunds. Any CWP expired 91 days or more will pay a late fee of $ The applicant will be contacted within 90 days and advised on the status of their application. CARRYING YOUR CONCEALED WEAPON LICENSE You are required to have your CWP in possession when carrying a concealed weapon. If your CWP is lost or stolen, please contact the Jerome County Sheriff s Office at KEEPING YOUR WEAPON CONCEALED It is suggested that you keep your weapon concealed. If you accidentally or intentionally display your weapon to others, you should expect that a police officer will contact you. NAME CHANGE OR ADDRESS CHANGE If your legal name changes or you move and your address is changed please contact the Jerome County Sheriff s Office. CARRYING IN OTHER STATES It is the responsibility of the Licensee to seek other States' rules and regulation regarding Idaho's Concealed Weapons Licenses. DO NOT ASSUME it will be honored in other states. Contact each individual State's Attorney General's Office for more information. If you are prohibited by federal law from possessing a weapon or a firearm, you may be prosecuted in federal court. A state permit is not a defense to a federal prosecution. Have you ever been adjudicated guilty in any court of a crime punishable by imprisonment for a term exceeding one (1) year? Are you a fugitive from justice? Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant or narcotic drugs, or any other controlled substance as defined in 21 U.S.C. 802? Are you currently suffering from any of the following conditions or have you been adjudicated as follows, based on substantial evidence: (1) lacking mental capacity as defined in Section , Idaho Code; (2) mentally ill as defined in Section (m), Idaho Code; (3) gravely disabled as defined in Section (n), Idaho Code; or (4) an incapacitated person as defined in Section (a), Idaho Code? Have you been discharged from the armed forces under dishonorable conditions? Have you been adjudicated guilty of or received a withheld judgment or suspended sentence for one (1) or more crimes of violence constituting a misdemeanor in the last three (3) years? Have you ever had an entry of a withheld judgment for a criminal offense which would disqualify you from obtaining a concealed weapon license? Are you an alien illegally in the United States? Have you, having been a citizen of the United States, renounced your citizenship? Are you under twenty-one (21) years of age? Are you free on bond or personal recognizance pending trial, appeal or sentencing for a crime which disqualifies you from obtaining a concealed weapon license? Are you a respondent to a civil protection or no contact order? Have you ever been convicted in any court of a misdemeanor crime of domestic violence? 4 Verification of Compliance With THE LAUTENBERG AMENDMENT [18 USC 922(d)(9)] The Lautenberg Amendment to the Gun Control Act of 1968 makes it a felony for anyone convicted of a misdemeanor crime of domestic violence to ship, transport, possess, or receive firearms or ammunition. A person has a conviction of a misdemeanor crime of domestic violence if: the person was convicted of a misdemeanor crime; the offense had as an element to use or attempted use of physical force, or threatened use of a deadly weapon; and the convicted offender was at the time of the offense: o a current or former spouse, parent, or guardian of the victim; or o a person with whom the victim shared a child in common; or o a person who was cohabitating with or has cohabitated with the victim as a spouse, parent or guardian; or o a person who was similarly situated to a spouse, parent, or guardian of the victim; and the convicted offender was represented by counsel, or knowingly and intelligently waived the right to counsel; and if entitled to have the case tried by jury, the case was actually tried by jury or the person knowingly and intelligently waived the right to have the case tried by a jury; and the conviction has not been expunged or set aside, or the convicted offender has not been pardoned for the offense or had civil rights restored, unless the pardon, expungement, or restoration of civil rights provides that the person may not ship, transport, possess, or receive firearms. 5 Idaho State Police Bureau of Criminal Identification NONCRIMINAL JUSTICE APPLICANT PRIVACY STATEMENT As an applicant who is the subject of a national fingerprint-based criminal history record check for a non-criminal justice purpose you have certain rights which are discussed below. This serves as notification from the Jerome County Sheriff that your fingerprints will be used to check the criminal history records of the State of Idaho and the FBI and that those records will be used solely for the purpose requested and may not be disseminated outside the receiving department, related agency or other authorized entity. The collection of applicant fingerprints in Idaho is authorized by Idaho Code If you have a criminal history record, the officials making a determination of your suitability for the job, license, or other benefit must provide you the opportunity to complete or challenge the accuracy of the information in the record. Procedures for obtaining a change, correction, or updating of your criminal history record are set forth at Title 28, Code of Federal Regulations (CFR), Section If you have a criminal history record, you should be afforded a reasonable amount of time to correct or complete the record, or decline to do so, before being denied the job, license, or other benefit based on information in the criminal history record. Disclosure of your Social Security number is voluntary and is solicited pursuant to the Federal Privacy Act and Idaho Code to aid the processing of an interstate background check request for noncriminal justice purposes allowed by federal statute, federal executive order or a state statute that has been approved by the attorney general. The fingerprints and information reported from this request may be disclosed pursuant to your consent, and may also be disclosed by the FBI without your consent as permitted by the Federal Privacy Act of 1974 (5 USC 552a(h)). Routine uses include, but are not limited to, disclosures to appropriate governmental authorities responsible for civil or criminal law enforcement, counterintelligence, national security or public safety matters to which the information may be relevant; to State and local governmental agencies and nongovernmental entities or application processing as authorized by Federal and State legislation, executive order, or regulation, including employment, security, licensing, and adoption checks. Depending on the nature of your application, other authorities may include numerous Federal or State statutes pursuant to Public Law or other authorized authorities. According to Idaho state law and if agency policy permits, you may be provided a copy of your FBI criminal history record for review and possible challenge upon submission of a written request. If agency policy does not permit it to provide you a copy of the record, you may obtain a copy of the record by submitting fingerprints and a fee to the FBI. Information regarding this process may be obtained at If you decide to challenge the accuracy or completeness of your FBI criminal history record, you should send your challenge to the agency that contributed the questioned information to the FBI. Alternatively, you may send your challenge directly to the FBI at the same website address as provided above. The FBI will then forward your challenge to the agency that contributed the questioned information and request the agency to verify or correct the challenged entry. Upon receipt of an official communication from that agency, the FBI will make any necessary changes/corrections to your record in accordance with the information supplied by that agency. (See 28 CFR ) If a change, correction or update needs to be made to an Idaho criminal history record, that process information is available on the Idaho State Police website.
