2 1. Background: The American University of Afghanistan (AUAF) is Afghanistan's only private, notfor-profit, institution of higher education, offering internationally-supported degree programs. 2. Project Summary: AUAF is seeking qualified construction companies for the Construction of Design built Containerized Dormitory at AUAF International Campus. The facilities consist of Bedrooms with bunk beds (each 40 feet container should have the capacity of 4 bunk beds for 8 students), gang toilets and shower room, shared kitchen and dining areas, Laundry facilities for Students. Also the construction of one community recreational facility, Study room facility, residence hall coordinator rooms, chain link fence with green screen around the facility with 4 meter height with razor wire on top with access gate, and guard room, and sidewalks is included in this RFP. Project is based on the attached concept drawings and specifications to this RFP. The scope of the work is, but not limited to the following: Site work. Site Lighting. Utility Work. o Water. o Sewer. o Site Electrical. HVAC Electrical Plumbing All work to be performed based on the following documents attached herewith: o Project Technical specifications included in drawings. o International Building Code. o AUAF Architectural standards. o Concept Design with site plan. o Special Condition: In case of conflict among different specs the most stringent specification shall govern. All interested bidders who have similar experience are invited to bid. 3. Government Withholding Tax Pursuant to Article 72 in the Afghanistan Tax Law effective March 21, 2009, AUAF is required to withhold "contractor" taxes from the gross amounts payable to all Afghan/International for-profit subcontractors/vendors. In accordance with this requirement, AUAF shall withhold two percent (2%) tax from all gross invoices to Afghan subcontractors/vendors under this Agreement with active AISA or Ministry of Page 2 of 7

3 Commerce license. For subcontractors/vendors without active AISA or Ministry of Commerce license, AUAF shall withhold seven percent (7%) "Contractor" taxes per current Afghanistan Tax Law. Before the signing of this Agreement, the subcontractor/vendor will provide a copy of the organization's AISA or Ministry of Commerce license and TIN (Tax Identification Number). Amounts deducted from the invoices will be forwarded to the Ministry of Finance (MOF) Tax Division credited to the firm's TIN. Records of payments to the MOF shall be maintained on file with AUAF. 4. Penalty Charges If the Vendor fails to supply the specified Goods/Services within the date stipulated, AUAF shall, without prejudice to its other remedies under the Purchase Order/Contract price, as liquidated damages, deduct a sum equivalent to five percent (5%) of the delivered price of the delayed Goods/Services for each week of the delay until actual delivery, up to a maximum deduction of Ten Percent (10%) of the Purchase Order/Contract/Contract value. 5. Source, Origin and Nationality The vendor may not supply any goods or services manufactured in or shipped from the following countries: Cuba, Iraq, Iran, Laos, Libya, North Korea, or Syria. 6. Inspection AUAF shall have reasonable time, after delivery, to inspect the service and goods, and to reject acceptance in not conforming to the specifications of this Purchase Order and offer. Recovery of the rejected item (s) shall be the sole responsibility of the construction company. 7. Statement of Work/Specification: See the attached annexes for detailed. Construction Company must comply and have the following: Experience and capability for construction of similar projects with International Institutions only. Construction Company must have been in existence for a minimum of 5 years Experienced and qualified technical staff for this type of projects. Page 3 of 7

4 Adequate needed machinery, tools, and equipment. Ability to work in hard situations. To have sufficient permanent skilled workers. To have certificates of successfully completed similar projects with international organizations. Provide list of similar projects in scope and cost completed by the firm. Provide contact information for reference of other similar projects completed. Have the capability and capacity to complete the project within 60 Calendar days from the date of award. Registration certificate with AISA. 9. Evaluation Process: The proposals will be evaluated in terms of fairness, cost-consciousness, and best value to the AUAF considering both technical and cost factors. AUAF may reject all of the proposals submitted for good cause. AUAF may negotiate price or service provided in terms with one or more of the bidders if it feels that negotiations would improve the chances that AUAF receives a better quotation. 1. Proposal demonstrates the firm s ability to implement Safety Plan, Implementation Plan, Quality Control and Quality Assurance plan. Evaluated Points of 25 Possible Points 2. Proposal identifies key personnel who possess the technical background, language skills, and prior professional work experience that will enable them to perform the services with a high probability of success. Proposal Submission guidelines: Cover Letter shall be included in proposals and signed by the person or persons authorized to sign on behalf of the bidder. All proposals must include the following information: Work Plan. Proposals must contain a description of how the Statement of Work (Attachment 1) would be carried out. Special consideration will be given to proposals that provide the greatest detail for the provision for a smooth and seamless transition of services from the current contractor. Page 5 of 7

6 Project Personnel. Identification of all key personnel who will take an active part in the provision of services outlined in this proposal is required. Resumes that include past employment, education, training, and references must be included in the proposal. Institutional Capacity. A full and complete description of experience in performing similar services, including the capacity to perform the services described in the Statement of Work, must be included in the proposal. Performance References. All proposals must include a references list with the names of three organizations for which the contractor performed similar services as outlined in the Statement of Work. The list must contain the name and address of the organization, and current telephone and address of the person who oversaw the contract. AUAF will use this information to discuss the offer or s past performance. Failure to provide all of the information requested will result in rejection of the proposal. Cost of the Proposal. A budget for the services outlined in this RFP must include sufficient detail to allow a complete analysis of the proposal. Indirect costs, if any, must be included along with a justification. If indirect costs are included they should be supported by a copy of the offeror s negotiated indirect cost rate agreement with the U.S. Government or comparable supporting documentation. Security Plan on coordination with AUAF Security for obtaining access inside AUAF campuses, escorting workers, identification of trucks while delivery of material, and any other security coordination required by AUAF Security. Proposals must be submitted in two (2) Sealed pockets, TECHNICAL PROPOSAL and FINANCIAL PROPOSAL by hard copy to the following address by no later than January 5, :00pm. Electronic bids are not permitted. Proposals received after the due date will not be considered further. Only successful offer will be notified. 7 11. Site visit/pre-bid Meeting: All interested contractor must attend the site visit/pre-bid meeting on December 27, 2016 at 10:00am. Also, all questions should be raised during the site visit to the technical team. Note: Please clearly write down on the envelops separately Technical Proposal and Financial Proposal so that we can easily identify what envelope contains what!! Bids will be accepted only from vendors who attend the site visit before the closing date of this RFP. Late registration of your representatives than the aforementioned deadline will result no access to site visit. 12. Others: AUAF as a not-for-profit educational institution expects to be charged no more than standard humanitarian agency rates.
