Summary of why application proposals are acceptable: The proposed advertisements would not have a negative effect on local amenity or public safety. Furthermore, the signage would not have a detrimental impact on the character and appearance of the surrounding commercial area. 1.0 BACKGROUND 1.1 Site and Surroundings: 1.2 The application site consists of three single storey commercial units on the eastern side of High Street Sutton. 1.3 The northernmost unit is the Melo café which lies adjacent to Sutton Station, with The Magical Haircut barbers to the south and Flowerscents florist and the southern end of this terrace. 1.4 These units are positioned at the southern end of the High Street. The character of the area is mainly commercial and forms an entry point to Sutton for users of the nearby station. 1.5 Site Specific Designation: 1.6 The properties fall within the Sutton Town Centre Crossroads Conservation Area, an Area of Tall Building Potential, the Sutton Limit for Sustainable Residential Development and a Secondary Shopping Frontage. 1.7 Relevant Planning History: 1.8 The following is the most recent and relevant planning history for each site. 1.9 Unit 2 Sutton Station /53592/FUL. Use of the premises for purposes falling within Class A3 (food and drink) of the town and country (use classes) order 1987 (as amended). Granted March 2005.

Installation of two shop fronts for units fronting High Street and three air conditioning/refrigeration units. Granted October /59376/ADV. Display of two illuminated hanging signs and three non-illuminated blank fascia panels. Granted May /65018/FUL. Use of unit as a taxi cab ordering office. Refused January Unit 3 Railway Bridge 1.18 No planning history. 2.0 APPLICATION PROPOSALS 2.1 Details of Proposal: 2.2 Advertisement Consent is sought for the removal of all existing signs to be replaced with three new fascia signs. One would be externally illuminated, one internally illuminated and one non-illuminated. Two non-illuminated projecting signs are also proposed. 2.3 The fascia sign to Melo café would be 2.7m wide, 0.5m high and 0.1m deep. Lettering would be 0.27m in height in green with a white background. This sign would be externally illuminated with neon lettering and finished in powder-coated aluminium. 2.4 The fascia sign to The Magical Haircut would be 3m wide, 0.5m high and 0.1m deep. Lettering would be 0.15m in height in white and amber with a black background. This sign would be internally illuminated and finished in powder-coated aluminium with acrylic lettering. 2.5 The fascia sign to Flowerescents would be 3.8m wide, 0.25m high and 0.05m deep. It would not be illuminated and would consist of lettering only pinned to the existing fascia. Lettering would be 0.25m in height in gold with a maroon background. This sign would be finished in powder-coated steel. 2.6 The projecting sign to Melo café would be 0.5m in height, 0.1m in width and 0.6m in depth projecting from the fascia. It would be positioned at a height of 2.7m from the ground featuring lettering 0.1m high in green on a white background. The finishing material would be powder-coated steel. 2.7 A barber s pole projecting sign to The Magical Haircut would also be installed to 0.75m in height, 0.1m in width and 0.3m in depth projecting from the fascia. It would be positioned at a height of 1.6m and finished in powder-coated steel with white and gold stripes. 2.8 This signs would replace existing signage of similar dimensions and appearance in a similar location. 2.9 Significant amendments to application since submitted:

(2) The Local Development Framework (LDF), which comprises two main documents (additional ones for specific areas such as Sutton Town Centre will also be produced): -(a) The Core Planning Strategy Development Plan Document (December 2009) sets out the Council s long term vision, spatial strategy and core policies for shaping the future development in the Borough and managing change over the next 15 years in line with the principles of sustainable development. -(b) The Site Development Policies Development Plan Document (March 2012) which identifies sites for future development (outside Sutton Town Centre) and sets out detailed development management policies to be used to help decide planning applications. In the event that there are discrepancies between the adopted CPSDPD, SDPDPD and the London Plan, legal guidance indicates that the latest adopted document prevails. 4.1 National Planning Guidance: National Planning Policy Framework (NPPF) National Planning Practice Guidance (NPPG) 4.2 Core Planning Strategy DPD: BP12 Good Urban Design and Heritage 4.3 Site Development Policies DPD: DM1 Character and Design DM3 Enhancing the Street Scene and Public Realm DM4 Historic Environments 4.4 Supplementary Planning Guidance/Documents: SPD14 Creating Locally Distinctive Places 5.0 PLANNING CONSIDERATIONS
4 Agenda Item 10 Page The principal considerations (including whether any material planning objections have been reasonably addressed) in relation to this application are: Use Amenity/Design Quality Impact on Public Safety Traffic 5.2 Use: 5.3 The national statutory requirements, as set out in the 2007 Advertisement Regulations state that when considering and determining a planning application the power of LPAs to control advertisements is restricted to the interests of amenity and public safety. Furthermore, para 67 of the NPPF states that poorly placed advertisements can have a negative impact on the appearance of the built environment and also that only adverts which would clearly have an appreciable impact on a building or on their surroundings should be subject to the detailed assessment of the LPA. As such, control over outdoor advertisements should be efficient, effective and simple in concept and operation. 5.4 Therefore, the proposed advertisements are considered to be acceptable in principle providing they do not conflict with the policies outlined below. 5.5 Amenity/Design Quality: 5.6 Policy BP12 of the Core Planning Strategy DPD states that proposals for new development should incorporate the basic elements of good design. Policy DM3 of the Site Development Policies DPD states that advertisements will only receive consent if they are not detrimental to the visual quality of the Borough and do not meet public safety requirements, whilst DM4 states that development within Conservation Areas should preserve and enhance that area s character. In addition, SPD14 recommends that the scale, materials, siting and detailing of signage should have regard to the character of the site and its surroundings. 5.7 All proposed signage would replace existing fascia and projecting signs of similar height and width dimensions which are also similar in terms of their colouring and detailed design. The signs would provide an uplift in the visual quality of the materials and external detailing of the signs. The revised signage would not be overly prominent when viewed from the street compared to the existing signs. 5.8 It is of relevance to note that signage for both the café and barbers have illuminations proposed, but these would reflect the similar illuminations already in place. 5.9 As such, it is considered that the proposed signage would not have a negative impact on the appearance of the building or the character of the distinct surrounding area. Therefore, the proposal is considered acceptable in terms of its visual appearance Impact on Public Safety: 5.11 The lettering of both signs at the café (externally) and barbers (internally) would be illuminated. Both illuminations would be static in nature The neon external at the café would be up to a level of 1200cd/m2. The internal illumination at the barbers would be up to 600cd/m2. Neither of these forms of lighting is considered to be excessive in the circumstances as they meet the requirements of
5 Page 115 Agenda Item 10 SPD14 in terms of their level of illumination for signs of the dimensions indicated within a Town Centre location Therefore, it is considered that the proposed adverts would not have an impact on the amenity of adjoining residents, road users or general public safety Traffic: 5.15 The Senior Engineer has not objected to the illuminated signage and, as such, it is considered the signage would not have a negative effect on traffic on High Street or Mulgrave Road. 6.0 CONCLUSION AND RECOMMENDATION 6.1 The proposed advertisements would not have a negative effect on local amenity or public safety. Furthermore, the signage would not have a detrimental impact on the character and appearance of the surrounding commercial area. 6.2 Therefore, this application for Advertisement Consent is considered to be acceptable. SECOND SCHEDULE (1) No advertisement is to be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission. Reason: This is a standard condition required by Regulation 14(1)(a) of the Town and Country Planning (Control of Advertisements) Regulations (2) No advertisement shall be sited or displayed so as to (a) endanger persons using any highway, railway, waterway, dock, harbour or aerodrome (civil or military); (b) obscure, or hinder the ready interpretation of, any traffic sign, railway signal or aid to navigation by water or air: (c) hinder the operation of any device used for the purpose of security or surveillance or for the measuring of the speed of any vehicle.. (3) Any advertisements displayed, and any site used for the display of advertisements, shall be maintained in a condition that does not impair the visual amenity of the site.
7 Page 117 Agenda Item 10 (4) Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a condition that does not endanger the public. (5) Where an advertisement is required under these Regulations to be removed, the site shall be left in a condition that does not endanger the public or impair visual amenity. (6) The level of illuminance of the external lighting hereby permitted shall not exceed 1200 cd/m2. Reason: To safeguard the visual amenity of the area. (7) The luminance of the internally illuminated advertisement(s) hereby permitted shall not exceed 600 cd/m2. Reason: To safeguard conditions of highway safety. (8) The display of this advertisement(s) is valid for a period of 5 years from the date of this consent. (9) The development hereby permitted shall be carried out in accordance with the following approved plans: 061GA110 Rev. C, 061GA010 Rev. B, 061GA006, 061AD110 Rev. C, 061AD111 Rev. C, 061AD112 Rev. C, 061AD010 Rev. B, 061AD011 Rev. B and 061AD012 Rev. B. Reason: For the avoidance of doubt and in the interests of proper planning. INFORMATIVES.
