INTRODUCTION The Children Act (1989) states : The Child s Welfare is Paramount: National Guidance (Laming 2003) requires all organisations to adopt and implement a written Child Safeguarding Policy which relates to the management of any child protection concern. In response to Laming (2003) further guidance issued Every Child Matters (HM Government 2003) outlines a framework of five outcomes that all children should achieve: Stay Safe Be Healthy Enjoy and Achieve Make a Positive Contribution Achieve Economic Wellbeing Safeguarding and promoting the welfare of children is the broad term that includes child protection and for the purposes of this policy as: Protecting children from maltreatment Preventing impairment of children s health and development Ensuring that children are growing up in circumstances consistent with the provision of safe and effective care Taking action to enable all children to have the best life chances (HM Government 2015:92) 2. SCOPE This policy is relevant to all MSA licence holders whether they are paid or unpaid including volunteers. The policy applies to the management of any child safeguarding concern, at an MSA permitted event, whether arising from that event or not. 3. GEOGRAPHICAL VARIATION The MSA Child Safeguarding Policy is written as an umbrella policy for universal application across the United Kingdom and British Isles. MSA recognises that there is different legislation and guidance across the British Nations. Adoption of the MSA Child Safeguarding Policy is a minimum requirement for individual Motor Sport organisations and should be implemented alongside the regional variations (Appendix 1). Individual Motor Sport organisations are required to review and comply with their national variations in legislation and requirements Page 3 of 28

4 across the UK Nations. This is imperative for those clubs and organisations that may operate across Nation boundaries, eg England and Scotland, England and Wales etc. 4. DEFINITIONS Safeguarding Children is a broader term than Child Protection which includes prevention activities see above. Child is anyone who has not yet reached their 18 th birthday. The fact that a child has reached 16 years of age, is living independently or is in further education, is a member of the armed forces, is in hospital or in custody in the secure estate does not change his/her status or entitlements to services or protection. (Children Act 1989 & 2004; HM Government 2015:92). Therefore the generic term child refers to children and young people throughout. Child Protection - is the specific aspect of safeguarding that protects children from harm, or abuse or risk of harm or abuse. Motor Sport Event an MSA permitted motor sport event which includes all competitive, and non-competitive meetings, and therefore includes club meetings, management meetings, and social activities undertaken by MSA club members. Children s Social Care This is a generic term for Local Authorities services provided to support children and families, and undertake child protection investigations. Other terms for the same department include: Children s services, Social services, social care, children and young people s services. 5. ROLES AND RESPONSIBILITIES MSA The MSA will ensure that Child Safeguarding and Child Protection are regularly discussed on Senior Management Team, Regional Committee, Motor Sports Council and MSA Board agendas. The MSA will provide support and access to MSA Clubs /Organisations through the MSA Child Safeguarding Coordinator. The MSA will provide initial and refresher training for MSA Club Child Safeguarding Officers. The MSA will provide access to the MSA Child Safeguarding Policy and documentation via MSA website. The MSA will cooperate with all requests from Local Authorities, Local Page 4 of 28

5 Safeguarding Children s Boards (LSCB s) or their equivalent, Local Area Designated Officers (LADO) and the Police in relation to all child safeguarding issues including serious case reviews and child death reviews and notifiable incidents (HM Government 2015) MSA Child Safeguarding Co-ordinator The MSA Child Safeguarding Co-ordinator will ensure that child welfare issues are reported at MSA Senior Management Team Meetings and that safeguarding children and Child Protection is a standing item at MSA Senior Management Team Meetings. The MSA Child Safeguarding Co-ordinator will provide support to MSA Club Child Safeguarding Officers in their role. This will include providing access to training for motor sport officials, and club officials, support and advice to MSA Club Child Safeguarding Officers, and liaison with statutory agencies in individual cases. Motor Sport Clubs All Motor Sport Clubs are required to have a child safeguarding policy in place. MSA Clubs shall use the MSA Child Safeguarding Policy and procedures or adapt the policy and procedures to be their own. In addition MSA Clubs are required to: Appoint one or more MSA Club Child Safeguarding Officer(s), (this is a named role and may be shared with another local MSA Club or Clubs). Inform the MSA Child Safeguarding Co-ordinator of the MSA Club Child Safeguarding Officer nomination and maintain current personal contact details. Include child safeguarding matters at their management committees as a standing item and keep records of all discussions. Support the MSA Club Child Safeguarding Officer. MSA Club Child Safeguarding Officers All MSA Club Child Safeguarding Officers have the responsibility to ensure that they: Comply with the MSA Club Child Safeguarding Officer Job Description. (Appendix 2). Attend initial and refresher training opportunities. Page 5 of 28

6 Club members Ensure that child safeguarding is a standing agenda item for the club management committee. Raise the profile of child welfare within their club. Cooperate with the MSA Child Safeguarding Co-ordinator / Event Clerk of the Course / MSA Steward. Ensure every MSA club permitted event or MSA club activity has access to an MSA Club Child Safeguarding Officer and these details are published at each event (Appendix 3). Manage child safeguarding incidents at MSA permitted events and activities. (Appendix 4). Complete child safeguarding documentation for each child safeguarding concern and store according to MSA / club requirements. All adults within the MSA Clubs have a responsibility to recognise actual and potential child abuse, and safeguarding concerns and report this to the MSA Club Child Safeguarding Officer, or MSA Child Safeguarding Co-Ordinator. 6. INDIVIDUAL CASES All concerns must be reported by telephone or in person to the MSA Club Child Safeguarding Officer on duty for the event or activity. Concerns can be reported by any individual; adults and children alike. All the concerns will be acted upon by the MSA Club Child Safeguarding Officer. All concerns will be recorded using the MSA Child Safeguarding Incident Reporting Form (Appendix 5) and when required the MSA Continuation Sheet (Appendix 6). On completion the original will be forwarded to the MSA Child Safeguarding Coordinator at the MSA for storage. MSA Club Child Safeguarding Officers should keep a copy of their completed incident form and store securely within their MSA club for a period of 12 months from the last entry for the individual child. After this period the MSA Club Child Safeguarding Officer should destroy their copy of the documentation. During an MSA event all child safeguarding concerns raised to the MSA Club Child Safeguarding Officer must be notified to the Event Clerk of the Course and/or MSA Steward. All child safeguarding concerns must be recorded in the event report and managed according to MSA procedures (Appendix 7). This flow chart is for use by all MSA Officials except the MSA Club Child Safeguarding Officer. Page 6 of 28

7 Following the event the MSA Steward report will contain a record of the incident, but the detail of the incident would be contained in the MSA Club Child Safeguarding Officers records. Where there are concerns that a child or young person is in immediate danger, the MSA Club Child Safeguarding Officer or in their absence the Event Clerk of the Course or MSA Steward must contact the police for immediate protection. Where concerns are raised and recorded but the child is not in immediate danger the case will be referred to the children s social care for the child s home location as well as the children s social care for the venue location. Concerns relating to adults at events must have factual evidence to support the actions to be taken. Concerns about adults at events must be reported to the MSA Child Safeguarding Co-ordinator and recorded on the Child Safeguarding Incident Reporting Form (Appendix 5). All continuous case management will be recorded by the individuals undertaking the actions on the Child Safeguarding Continuation Sheet (Appendix 6). A copy of all completed documentation is to be forwarded to the MSA Child Safeguarding Coordinator for storage. At all times the child must be the focus of the case management and be protected from further harm. MSA Club Child Safeguarding Officers and individuals witnessing incidents will cooperate with the MSA Child Safeguarding Co-ordinator, statutory agencies (Police and Children s Social Care) and Local Safeguarding Children s Boards (or equivalent) at all times as necessary. 7. CASE REVIEW FRAMEWORK FOR LEARNING AND DEVELOPMENT National Guidance (HM Government 2015:72-73) requires LSCB s to maintain a local learning and development framework which applies to all local organisations. The National Guidance identifies a broader range of reviews that will be undertaken by LSCB s. The MSA recognises that a range of reviews may be undertaken. The MSA and MSA clubs and organisations will cooperate with all requests for participation and contribute to LSCB learning and development frameworks. The MSA will comply with the national guidance (HM Government 2015:73), and provide an individual who is independent of the case to complete an agency report where required. Page 7 of 28

8 These reviews include but are not limited to Serious Case Reviews, Child Death Reviews and Notifiable incidents, and the criteria for each type of review is provided below: a) Serious Case Reviews The purpose of Serious Case Reviews are to identify improvements to practice across the multi-agency child safeguarding system. A Serious Case Review is undertaken for every case where abuse or neglect is known or suspected and either: when a child dies; or is seriously harmed and there are concerns about how agencies or professionals worked together to safeguard the child. b) Child Death Reviews The MSA Child Safeguarding Co-ordinator on behalf of the MSA, will notify the appropriate Local Authority Child Death Review Panel of any fatal incident involving a child at an MSA related activity. c) Other Types of Reviews Review or audit of practice in once or more agencies. Review of a child protection incident which falls below the threshold for an SCR The MSA Child Safeguarding Co-ordinator will liaise with the Local authority and agree whether the Local authority or MSA will report the child death to Ofsted. d) Notifiable Incidents HM Government (2015:74-75) identifies notifiable incidents involving the care of a child which meets any of the following criteria: A child has died (including cases of suspected suicide) and abuse or neglect is known or suspected A child has been seriously harmed and abuse of neglect is known or suspected A looked after child has died (including cases where abuse or neglect is not suspected or known) A child in a regulated setting or services has died (including cases where abuse or neglect is not known or suspected) The reviews outlined above are taken from (HM Government 2015:72-73) Page 8 of 28

9 8. RECRUITMENT AND SELECTION When MSA club committees nominate individuals to the role of MSA Club Child Safeguarding officer, evidence of nomination and seconding must be recorded within the minutes of those club committee meetings. 9. DISCLOSURE AND BARRING SERVICE Disclosure and Barring Service (DBS) checks are required for those who are working with children as defined in (Children and Families Act 2014). This includes those operating in a child safeguarding role, and those undertaking regulated activities. MSA has authority to undertake DBS checks for example: MSA staff, licenced officials, MSA Club Child Safeguarding Officers, ARKS club examiners and MSA schools social instructors, rescue crews. A list of identified roles is included (Appendix 8) and MSA reserves the right to assess individual roles and add these to the DBS requirement list. MSA is compliant with the DBS code of practice, and Data Protection Act for the management of personal information relating to DBS checks. Where MSA clubs or individuals remain unsure of the requirement for DBS check this is to be discussed with the MSA Child Safeguarding Co-ordinator. 10. PHOTOGRAPHY MSA recognises that Motor Sport events are a popular photographic opportunity where a range of individuals will be involved, and encourages responsible use of photography at all times. Motor Sport events must operate an open and transparent environment and organisers should publish specific information particularly concerning professional photographic/video filming. Individuals must not engage in photographic activities when they are on duty ie officiating at an event. The only exception is where the officiating duties require photographic evidence to be collected e.g. serious incident investigation. Any individual that has concerns regarding photography and child safeguarding during MSA activities must contact: Event MSA Club Child Safeguarding Officer. Event Clerk of the Course. MSA Steward. MSA supports event organisers to take appropriate action where concerns are raised about individuals at events, including requests for individuals to leave events. Page 9 of 28

10 11. MANAGING ALLEGATIONS OF CHILD ABUSE FOR ADULTS WITHIN MOTOR SPORT Where an allegation about child abuse is made about an adult or licence holder within motor sport which places a child/young person at risk of harm the process for managing allegations of abuse procedures will be initiated. This includes allegations relating to: An adult or young person that has behaved in a way that has harmed a child, or may have harmed a child. An adult or young person that has possibly committed a criminal offence against or related to a child. An adult or young person that has behaved towards a child or children in a way that indicates that they are unsuitable to work with children. An adult or young person that has failed to take action, which has resulted in a child/young person being placed at risk of harm. Concerns should initially be reported to the MSA Club Child Safeguarding Officer (see Appendix 2 for Job Description and section 13 below for training requirements), who will subsequently report to the MSA Child Safeguarding Co-ordinator and confirm with the completed documentation. On receiving the completed child safeguarding documentation about the allegation the MSA will appoint a named senior officer and a named senior manager for the investigation and management of the allegation. MSA treats all allegations of child abuse seriously and will appropriately and proportionally investigate all allegations made. Matters reported may include incidents within an adult s personal life or be motor sport related. MSA will undertake immediate action to ensure the protection and safety of a child, or children which may involve contacting the police and or children s social care immediately, and then assist in any investigation into the nature of the allegation, including liaising with the Local Area Designated Officer (LADO). All allegations must be reported to the MSA Child Safeguarding Co-ordinator or the MSA Chief Executive Officer. All allegations will be investigated using a systematic and consistent approach, evidencing decision making at all stages, which is recorded and stored at MSA head office. MSA recognises there is potential for malicious or unsubstantiated allegations to be made. The MSA recognises that more than one investigation may be initiated and these may run concurrently. 11 Any concerns that a child/young person may be at risk of immediate harm must be reported to the police or social services at once. 12. TRAINING AND DEVELOPMENT MSA provides support and initial training for MSA Club Child Safeguarding Officers. MSA Club Child Safeguarding Officers are required to update their knowledge and skills every 3 years as minimum. Update training is compulsory for continuation in the MSA Club Child Safeguarding Officer role. MSA recognises that MSA Club Child Safeguarding Officers may receive child protection training in their professional capacity or within other voluntary roles. Updating knowledge and competence can be demonstrated through a range of learning and development activities. Training and development activities are accepted from external opportunities providing MSA Club Child Safeguarding Officers can supply the MSA with evidence of continuing training and updating, e.g. certificate of attendance including learning outcomes. MSA Club Child Safeguarding Officers must report details of their training and updating to the MSA at the point of annual renewal as part of relicensing process. Important changes to legislation and practice within child safeguarding will be disseminated by the MSA using appropriate media. 13. SUPERVISION MSA are developing a supervision framework to support MSA Club Child Safeguarding Officers with their role in managing child safeguarding case work, in accordance with Working Together To Safeguard Children (2013). Supervision can be provided individually or to groups and must be recorded and stored in accordance with MSA data protection policy. Supervision is accessed via the MSA Child Safeguarding Co-ordinator. 14. SUPPORT The MSA recognises that those who are involved in child safeguarding work require support when managing child safeguarding case work. This applies equally to those who are involved regularly in child safeguarding work and those who are only occasionally involved in child safeguarding cases. Page 11 of 28

12 The MSA provides support to all individuals involved in child safeguarding issues, regardless of the complexity of the situation. This is available from the MSA Child Safeguarding Co-ordinator. 15. GOVERNANCE This Policy will be regularly reviewed and updated at intervals not less than 3 years as minimum. A review may be initiated earlier due to legislative or national guidance changes. This Policy and any applicable Guidelines are seen as live documents, capable of being reviewed and amended by the MSA according to need on an ongoing basis. The MSA welcomes any written comments or suggestions regarding the Policy and any applicable Guidelines, and their application, at any time. Page 12 of 28

16 Appendix 2 MSA Club Child Safeguarding Officer Job Description JOB PURPOSE AND SCOPE The role of the MSA Club Child Safeguarding Officer is to be the first point of contact for all child safeguarding enquiries within their club and to ensure that children s welfare is considered in all aspects of the club Activities. Assist and liaise with the MSA to implement the MSA Child Safeguarding Policy. Promotes the MSA Child Safeguarding Policy. Ensure the club or association adopts the MSA policy statement on child safeguarding within its constitution. Ensure the club or association develops its own MSA Child Safeguarding Policy to align with that of MSA. Be the first point of contact for club enquiries and approaches from other officials, parents, guardians, carers, and young people themselves where issues of concern regarding children s welfare, poor practice or child abuse are identified. Promote and ensure that confidentiality is maintained. Be a member of the club management committee (where possible). Provide basic advice and support to club members and children and young people. Provide information about local and national resources relating to child safeguarding. Maintain a child focused approach at all times. Maintain accurate records of child safeguarding incidents and store these in accordance with data protection legislation.
