4 TERMS OF REFERENCE FOR THE RECRUITMENT OF CONSULTANT TO SUPPORT PILLAR 1 OF THE BANK S GENDER STRATEGY WOMEN S LEGAL STATUS AND PROPERTY RIGHTS 1. BACKGROUND 1.1. The African Union Commission declared the African Women s Decade with the aim of promoting gender equality through the accelerated implementation of global and regional commitments on gender equality and women s empowerment. To this effect, the AUC declared 2015 as the Year of Women s Economic Empowerment and Development towards Africa s Agenda Moreover, African states commitment to gender equality was recently reaffirmed by the African Union Resolution 262 (African Commission on Human and People s Rights), which expressed deep concern that women are disproportionately affected by key development challenges facing Africa and emphasized the primary responsibility of State Parties to ensure women s right to land and property in Africa 1.2. The African Development Bank Group (AfDB) identified gender equality as a core aspect of inclusive growth and transition to green growth in its Ten Year Strategy ( ). Broadening economic opportunities for women is important in its own right and as a driver of economic competitiveness, as economies that harness the energy and talent of women will outperform those that do not. Studies show that a level playing field for women can boost productivity, particularly in agriculture. Increasing the capabilities and opportunities of women and girls can boost the productivity and participation of half Africa s population. Providing basic services will ease the burden of women and free their time for more productive activities. Focus on knowledge, skills development and legal and property rights is the precursor to empowering women s enterprise. Women and girls bear significantly more than half of the continent s burdens, but they also carry disproportionately high potential as generators of income. Giving women more voice is also associated with better outcomes In January 2014, the Bank launched its "Gender Strategy ( ): Investing in Gender Equality for Africa s Transformation". The Gender Strategy is based on the reality that gender equality is integral to Africa s economic and social development and thus is a central part of the Bank s ambitious vision for Africa. The Bank recognizes the need to reduce gender inequalities by strengthening women s legal and property rights, promoting women s economic empowerment, and enhancing knowledge management and capacity building on gender equality. These priority areas, defined and agreed in broad consultations with African countries, form the pillars of the Bank s Gender Strategy Subsequently, the Gender Strategy describes how the Bank will address women s legal and property rights in priority areas in each of the Ten Years Strategy (TYS) pillars: infrastructure, regional integration, private sector, governance, skills, and knowledge. Moreover, the Bank has adopted the High5s: Power and Light-up Africa, Feed Africa, Integrate Africa, Industrialize Africa, Improve the Quality of Life of Africans. This is an opportunity to systematically address women s legal status and property rights, not just in the TYS pillars but also the High5s Promoting women s legal status and property rights (Pillar I of the Gender Strategy) addresses the biggest challenge that women face on the African continent the lack of personal rights and rights to own property, especially land, that are open to women. Land rights are one of the major drivers of gender inequality in Africa, and at the same time secure land tenure constitutes an important means to achieve women s economic empowerment. Opening the possibility for African women farmers to enjoy secure

5 land tenure and land rights will have a multiplier effect on food security, increasing yields and promoting women farmers move from subsistence to commercial agriculture. The Bank will address women s legal and property rights through its work in the strategic priority areas The purpose of improving women's land rights is to contribute to their wider social, political and economic equality. However, the quest to improve women's land rights is hampered by many challenges which include: a) discriminatory customary land tenure systems; b) various policy gaps that lead to the failure of the promotion of women s land rights; c) the lack of rigorous and effective implementation of progressive provisions; and d) the general lack of awareness by most women of statutory provisions that can strengthen their land rights The African Development Bank is seeking the services of an experienced professional with expertise on women s legal status and property rights to support the Bank in assisting Regional Member Countries (RMCs) undertake legal, policy and institutional reforms through policy dialogue, advocacy, and partnerships. 1.7 Interested consultant shall provide information on their qualification and experience demonstrating their ability to provide services (documentation, references for similar services, experience in comparable assignment and qualification ect). The duty station of the Consultant will be at the Bank s Headquarters in Abidjan, Cote d Ivoire. 1.8 The eligibility criteria, the establishment of a short list and the selection procedure shall be in conformity with the Bank s Rules and Procedure for the Use of Consultants. Please, note that interest expressed by a Consultant does not imply any obligation on the part of the Bank to include it in the shortlist. 2. OBJECTIVE OF THE ASSIGNMENT 2.1. The consultant will support the work of the Office of the Special Envoy on Gender (SEOG) to implement Pillar 1 of the Gender Strategy: Women s Legal Status and Property Rights in Regional Member Countries (RMCs). This Pillar cuts across different Bank departments mandates, therefore, the consultant will be within SEOG team, and provide support to the other departments to implement the Ten Year Strategy as well as the Bank s High 5s priority agenda. The consultant is expected to develop a comprehensive approach, which identify areas of focus, stakeholders, and implementation / institutional arrangements to proceed with the work The Bank as a knowledge broker is playing an advisory role in RMCs. For instance, the African Natural Resource Centre (ANRC) within the Bank provides advisory services in the areas of land reform, land policy, and land commissions. One of the mandate of the Agriculture department is to provide technical support to RMCs for improving agriculture outputs, for reducing food insecurity and improve the livelihood, while the Governance department supports economic governance reforms, budgeting, and public financial management. The financial sector department on the other hand focuses among other areas on creating a conducive financial regulatory environment. The land issues and gender mainstreaming have been addressed in an ad hoc manner. The roles of the aforementioned departments and beyond could be strengthened to systematically address the barriers to women s legal status and property rights The consultant will contribute towards strengthening the Bank s approach to support women s legal status and property rights (Pillar I of the Gender Strategy) through internal and external partnerships with relevant stakeholders. 1

6 2.4. In particular, the consultant is expected to address the following: a) Review projects and retrofit with women s legal status and property rights and provide guidance and Key Performance Indicators on legal status and property rights to be included in Results Measurement Framework. b) Support the Bank s work on Pillar 1, and its progress in implementing the Gender Strategy through research and development of knowledge products and collection of disaggregated data; c) Contribute to the development of programs on Pillar 1 by operations department; d) Contribute towards mainstreaming gender within the Bank s current work on policy reforms; e) Provide support in building strategic partnerships internally and externally. f) Conduct analytical work on increased reforms on land ownership for women in African countries 3. MAIN ACTIVITIES AND DELIVARABLES Under the overall guidance of the SEOG, and under direct supervision of identified team leads at both HQ and the Southern Africa Resource Centre, the consultant s duties and responsibilities will include: 3.1 Knowledge Generation: a) Build a desktop review on the legal status and property rights of women in African countries that include social and customary practices related to women land rights, building on work done by the Bank; 3.2 Strategies and Framework a) In consultation with different Bank departments and with Internal and external stakeholders, develop a framework for the Bank s engagement in addressing women s legal status and property rights; 3.3Training and Sensitization (Internal) a) Increase awareness among Bank staff members on women s legal status and property rights; b) Identify operations in each complex to show-case methods of integrating women s legal status and priory rights; c) Support management with their external engagement (related to gender rights), including preparation of briefs, speeches and presentations, particularly in RMCs. 3.4 Outreach and Campaigns: a) Orchestrate campaigns to influence policymakers, including the legislators, planning and gender ministries, to recognize the value of supporting women s legal status and property rights for economic and social development, and the full attainment of gender equality; b) Support the development of advocacy materials for the Bank to support the strategic goals and programmatic work of AfDB/SEOG work on Pillar 1. c) Support Regional Economic Communities in their mandates to reinforcing the legal status of women, especially in relation to economic and financial regulations. 3.5 Establish links from identified/agreed upon influential advocates, academia, regional and development institutions (including RECs), non-governmental organizations and think tanks in RMCs to inform and advance the AfDB/SEOG s mission on Pillar 1; and Perform other duties as assigned. 2

Deliverables The following deliverables are expected from the Consultant: a) An inception report b) A desk review of key findings of primary research, which should include a mapping study, challenges and gaps, opportunities, and partners to support the implementation of Pillar 1. The desk review should identify the priority area of focus given the comparative advantage of the Bank. c) A Framework for the AfDB s engagement on women s legal status and property rights. d) A communication strategy on women s legal status and property rights for SEOG. e) In consultation with the Gender Policy Consultant, develop clear indicators for the Bank Wide Results Framework. f) At least two seminars / round tables / panel discussions to increase awareness among Bank staff on women s legal status and property rights. g) Develop training material on women s legal status and property rights. h) Advocacy material on promoting women s legal status and property rights. 5. Reports / Progress Activities The consultant will submit a monthly report detailing the activities carried out and the status of each activity. 6. Qualifications Advanced University Degree in the field of the position (e.g. Law, Human Rights, Gender, International Relations/Development, political science, economics) or equivalent experience. Minimum 7 years experience in related positions and in African countries; Substantial experience with research, legal analysis, advocacy campaigns at country, regional and international levels; Sound knowledge and experience of institutional and organizational dynamics, policies and systems in developing country environments, including regional political architecture (e.g African Union, UNECA, RECs) and relationships to regional and global fora and processes; Gender and Development experience an asset. Experience in advocacy, policy positioning, partnerships/resource mobilisation, and in the operational priorities and special focus areas of the Bank Group would be an asset; Proven capacity to deliver output in a timely manner and ability to use relevant computer technology; Client and results-oriented with strong analytical and communication (verbal and written) skills, sense of accuracy and attention to detail; Ability to deal with sensitive issues in a multi-cultural environment and to build effective working relations with colleagues; inter-personal, organizational capacity and communication and writing skills; Fluency in English or French, with working knowledge of other language; Good writing skills; Competent in the use of standard software applications (MS Word, Power Point, Excel); Be a national of one of the member countries of the Bank. 3

8 7. Duration and Location The duration of the consultancy is for a period of twelve (12) months full time, beginning on 1 st May 2016, with possibility of renewal. The Consultant will be based in Abidjan, Cote d Ivoire at the Bank s Head Office. Occasional field missions might be required. 8. Costs The consultant will receive a monthly lump sum. No additional benefits or per diems will be paid. The consultant is responsible for his/ her own health insurance and accommodation costs. The Bank will cover full costs of any required missions and provide per-diem in accordance with rules governing consultant mission travel. 9. Reporting The consultant will work under the direct supervision of the Advisor the Special Envoy on Gender.
