The contract was originally awarded to MK CIL, on behalf of the Disability Information, Advice and Support Partnership (DIASP) following competitive tender. The contract commenced on 1 November 2011 and is due to expire on 31 October An extension to 31 October 2016 is requested to enable the Council to work on a sustainable social care and health support system. This will then inform any future commissioning and delivery of the services contained within the current contract. 1. Recommendation 1.1 That the contract for the Advice and Support Service, provided by the Milton Keynes Centre for Integrated Living (on behalf of the Disability Information, Advice and Support Partnership), be extended to 31 October Context 2.1 DIASP is a partnership of five local charitable organisations. MK CIL is the lead organisation for the contracted services. The contract provides a range of social care information, advice and support services, to the whole population of Milton Keynes, as well as being the lead for the Milton Keynes User Led Organisation Network. These services include: Employment Advice and Support Service The Employment Advice and Support Service provide support for service users who employ personal assistants with their personal budgets. This includes assistance with job descriptions, recruitment and interviews, payroll and ongoing P&C ITEM 5 7 APRIL 2015 PAGE 1

2 support. Consultations are also given to service users to explain what is involved in employing personal assistants in order for them to make informed decisions. This service is for children and young people, as well as adults. Peer Support Planning and Information Service Peer Support Planning provides support, with the involvement of peers, to service users who are developing their care plans to help them approach the use of their personal budget in a person centred way. The information service underpins this service by providing information on choices regarding adult social care services, and the options available to people potentially eligible for social care. User Led Organisations Network CIL lead on maintaining and developing a network of user led organisations and help organisations develop the skills and competencies to become user led. Through this network, CIL organise events for service users and groups, helping people to help themselves, live independently and maximise control over their life. The contracted services are accessible to all citizens of Milton Keynes based on their individual need, regardless of the person s age; gender; ethnic origin; religion; or particular physical or mental impairment. 2.2 All the services within the current contract are formally monitored and reviewed by the Joint Commissioning Team. All services are performing well, with positive outcomes being expressed by those users questioned about their experiences. The contract provides good value for money to the Council and meets key social value considerations. 3. Background 3.1 In March 2014, the Cabinet Procurement Committee approved a one year extension to the Advice and Support contract to enable the Council to undertake a broader review of personalisation services. This review has highlighted the importance for vulnerable people and their families to receive appropriate information, advice and support in order to enable them to live as independently as possible; and to have and retain the increased choice and control that direct payments facilitate. During 2014 there have been several significant legislative changes and mandates affecting the Council and its health partners. Specifically: The Care Act 2014; The National Health Service (Direct Payments) Regulations 2013, as amended by the National Health Service (Direct Payments) (Amendment) Regulations 2013; and P&C ITEM 5 7 APRIL 2015 PAGE 2

3 The Childrens and Families Act All of these introduce key changes to the rights of people using the Advice and Support contract s services. The Council has commenced a number of pieces of work seeking to confirm the most appropriate way to meet the challenges raised by this new legislation. Of these, a pilot to offer direct payments to residents within residential care homes; and a trial to determine the impact of partnership working with the Milton Keynes Clinical Commissioning Group in relation to Personal Health Budgets are currently underway. The advice and support needs of people under the 2014 Special Education Needs and Disability guidance (SEND) are covered within the scope of the contract. Additionally, the Council and its local health partners face unprecedented budgetary pressures, making it more critical than ever that medium term commissioning and service delivery models and plans are as effective, efficient and economical as possible. Innovative new solutions to service provision are being explored with the help of other Local Authorities. 3.2 The Advice and Support contract was awarded on the basis that it can be extended for a further two years by agreement of both parties. It is requested that the contract is extended for a second year, until 31 October 2016, to enable the Council to work on a sustainable social care and health support system that adequately meets all citizens varied needs; complies with all new legislative requirements; and does this in the most cost effective way possible. 3.3 The Council s Constitution requires all extensions to contract in excess of 100,000 to be approved. The Advice and Support contract price for year 5 is 255,550: Joint Commissioning 243,550 Children & Families 12, The alternative options are to: Not extend the contract and re-tender information, advice and support services for a new contract to start on 1 November This option would not give the Council sufficient time to: Adequately assess the impact of the above legislative and NHS policy changes; Evaluate the results of current pilots and trials; and Determine the most appropriate service provision model available. 4 This option is therefore not recommended Not extend the contract and not re-tender for the contract. This option would leave vulnerable people without essential services that they need to retain their independence; and cause the Council to be non-compliant with its statutory responsibilities. This option is therefore not recommended. 3.5 The Contract Management arrangements are: The Senior Client Officer for this contract is the Senior Joint Commissioner. The contract adheres to the Council s standard terms and conditions as maintained by the Council s Legal Services team The key monitoring processes for the Advice and Support contract include: 4. Develop and maintain strong local partnerships to improve outcomes for children and young people The procurement of this contract has complied with Contract Procedure Rules, Financial Regulations and applicable European Procurement Regulations. Following a successful pilot of a Holding Account offering to people who experience difficulties administering a direct payment, the extension would include the Holding Account Service at no additional cost to the Council. Satisfactory performance of the contract against this funding is assured by the governance arrangements detailed in paragraph 3.5 above. 4.3 Carbon and Energy Management: Not relevant 4.4 Legal: The Contract commenced on 1 November The terms and conditions of the Contract provide for an initial term of three years with the possibility to extend for upto two years. The extension of the Contract is compliant with Council s Contract Procedure Rules. The Contract is being provided to meet Milton Keynes Council s responsibilities, both statutorily and non-statutorily to support individuals and groups to contribute fully to meeting their needs and for the wider benefit of the community. 4.5 Other Implications - if you say Y then make sure this is addressed in the main body of the report.
