4 RUNDLE-SPENCE/Trip 2015 Promotion GENERAL RULES, DETAILS & CONDITIONS Trip value is expressed in terms of points, with each point having a value of 1 dollar. Points are usable only toward this incentive trip and have no cash value. Trip price is on the basis of double occupancy. There will be a surcharge for single accommodations. EXAMPLE: $1,000 TRIP COST = 1,000 POINTS 1 DOLLAR PER POINT EARNED FROM QUALIFIED PROGRAM PURCHASES OR POINTS = COST x %. (Points and trip costs are subject to escalation due to currency fluctuations) Account must be in good standing according to current agreed upon terms or trip will be forfeited without reimbursement. Any unpaid balance on the trip(s) will appear on your statement the month end prior to the trip date. Any unpaid balance on the trip(s) must be paid by the 10th of the month prior to trip date before you can receive your trip. Qualifying promotional purchase period: through All trips earned from qualifying promotional purchases that are not paid in full by will be deducted and billed to your account. Promotional points earned above and beyond trip value can not be carried over to any future promotion. Extra promotional points earned after trip is paid have no real monetary value and can not be used for any other promotion and can not be turned in for cash value or credit on account. Points earned must be used in this trip program and will not accumulate toward any other program. $150 deposit is required per person and will be charged to the customer s account at sign up and held until the end of the program. Deposits can be earned, but are non-refundable. Room upgrade requests are limited to customer principals only, and are subject to availability. Any income tax liability is the responsibility of the individual recipient. A 1099 will be issued by Rundle-Spence to customer participating in trip. Cancellations or transfers are subject to penalties, including the full cost of the trip. Warranty replacement heaters do not qualify for promotional points. No meals, drinks or entertainment, gratuities or taxes are included in this promotion unless otherwise expressed. You are responsible for travel to and from the Milwaukee airport and any parking cost if incurred. Transportation to and from the airport to and from the resort is included. Passports are required and trips will not be reimbursed for not having your passport. If you do not have one, we recommend allowing at least eight weeks lead prior to the trip to get your passport. ADDITIONAL RULES & CONDITIONS Points earned must be used in this trip program and will not accumulate toward any other program. Buy-in amounts are due no later than January 31, 2015 regardless of actual trip dates. Any cancellations must be made prior to November 30, 2014 and will be subject to penalties. No employee of Rundle-Spence Mfg. Co. may go on any trip unless selected by Rundle-Spence management to participate as part of the hosting group. Sign-up must be received by April 30, 2014 to be eligible for the 2015 program. All dining, entertainment and travel except those that expressly named on this document are the responsibility of the participant and are not the responsibility of Rundle-Spence, or any Vendor participant or of Olson Travel and its representatives. Any problems with delays or lost luggage are the sole responsibility of the airlines. Any problems with rooms or service are the sole responsibility of the hotel. Limit of points per company/account. Any purchases returned for credit in the subsequent three months after the end of the promotional period that are in excess of the purchases for that period will be deducted from earned points for the trip and will be billed to your account if you are short of full reimbursement. 5 LIABILITY WAIVER AND RELEASE Rundle-Spence Mfg. Co Punta Cana Trip I/we enter into this Liability Waiver and Release in consideration of being included on an excursion to Punta Cana, (the "Excursion") which is being sponsored by Rundle-Spence Mfg. Co. Travel arrangements for the Excursion are being made by a travel agency (Olson Travel). The Excursion includes travel and recreational activities. The Excursion begins once I/we begin traveling to Punta Cana (for example, when we get into the taxi to leave for the airport), and ends when we return to our place of residence in Wisconsin. As with all travel and recreational activities, there will be risks (the "Risks"). Specific examples of Risks are: risks related to travel mishaps, risks related to recreational activities that are engaged in during the Excursion, risks associated with loss of luggage, risks related to fatigue, risks related to being a victim of criminal activity, risks related to medical care, risks from driving an unfamiliar rented automobile in an unfamiliar location, risks related to gambling, risk related to drinking alcohol, and risks related to greater physical and emotional stress than one is normally accustomed to. Another risk is that one or more of the Released Parties (defined below) may be negligent (whether in their actions or failure to act, including in attempts to rescue or provide assistance). The Risks described above are examples only, and are not a complete list of Risks that might arise during the Excursion. Consequences of the Risks could including any one or more of the following types of serious injury or damage: permanent disability, death, illness, disease, severe social and economic loss, loss of companionship, consequences resulting from deficiencies in medical care or rescue, damage to property, loss of property, accidents, as well as other injury or damage that is not reasonably foreseeable at this time (collectively, "Consequences of Risks"). I/WE UNDERSTAND THAT THE EXCURSION INVOLVES RISKS AND THAT I/WE MAY SUFFER CONSEQUENCES OF RISKS. I/WE VOLUNTARILY ASSUME AND ACCEPT ALL RISKS AND CONSEQUENCES OF RISKS, EXCEPT THOSE ARISING FROM THE WILLFUL OR RECKLESS ACTS OF RELEASED PARTIES. I/WE RELEASE, DISCHARGE, AGREE NOT TO SUE, AND WAIVE THE LIABILITY OF ALL RELEASED PARTIES FROM THE CONSEQUENCES OF RISKS THAT I/WE MAY SUFFER DURING THE EXCURSION, INCLUDING THOSE ARISING FROM NEGLIGENT OMISSIONS AND NEGLIGENT ACTIONS OF RELEASED PARTIES, BUT NOT INCLUDING THOSE ARISING FROM THE WILLFUL OR RECKLESS ACTS OF RELEASED PARTIES. "Released Parties" means each of the following: Rundle-Spence Mfg. Co. and Olson Travel, any companies affiliated with either of them (whether under common ownership, or parent or subsidiary companies), and each of their respective shareholders, members, directors, officers, agents and employees. I/WE ACKNOWLEDGE THAT I/WE HAVE HAD THE OPPORTUNITY TO BARGAIN THE TERMS AND CONDITIONS OF THIS LIABILITY WAIVER AND RELEASE. THIS MEANS THAT I/WE UNDERSTAND THAT THE TERMS AND CONDITIONS OF THIS LIABILITY WAIVER AND RELEASE ARE NEGOTIABLE. WE UNDERSTAND THAT BY NEGOTIATING, WE COULD OBTAIN A LESS BURDENSOME LIABILITY WAIVER AND RELEASE (or perhaps even avoid this Liability Waiver and Release altogether) in exchange for payment of a larger amount of money for the Excursion. This Liability Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the State of Wisconsin. In the event that any provision is held to be invalid under Wisconsin law, it is agreed that such provision shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or the remaining provisions of this Liability Waiver and Release. I/we intend this Liability Waiver and Release to be binding on my/our heirs and assigns. I/we are not relying on other statements or promises in entering into this Liability Waiver and release. My/our signature below indicates that I/we have had sufficient opportunity to read this entire document, that I/we have read it, and that I/we understand it. In particular, I/we understand that I/we are giving up substantial legal rights by signing this Liability Waiver and Release. I/We understand that if I/we suffer Consequences of Risks, I will be precluded from bringing a negligence claim against any of the Released Parties.
6 PARENT S OR GUARDIAN S ADDITIONAL LIABILITY WAIVER AND RELEASE (Must be completed for participants under the age of 18) In consideration of (print minor s name) being permitted by Rundle-Spence Mfg. Co. and Olson Travel to participate in the Excursion, I/we acknowledge the presence of the Risks and Consequences of Risks described in the Liability Waiver and Release that will arise in connection with the Excursion. I/we agree that by signing below, I/we make each acknowledgement, release, agreement, assumption and acceptance contained in the above Liability Waiver and Release with respect to any Consequences of Risks that may be suffered by the minor, as well as by myself/ourselves. If completed, this Parent's or Guardian's Additional Liability Waiver and Release shall be part of the Liability Waiver and Release. Capitalized terms not otherwise defined in this Agreement have the meanings given to them in the Release. This Agreement and the Release are provided by the undersigned as in consideration for being permitted to come on the Excursion. I/WE AGREE TO HOLD HARMLESS AND INDEMNIFY THE RELEASED PARTIES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS OR RIGHTS OF ACTION, WHICH ARE RELATED TO, ARISE OUT OF, OR ARE IN ANY WAY CONNECTED WITH MY/OUR PARTICIPATION, OR PARTICIPATION BY ANY OF MY/OUR FAMILY MEMBERS, IN THE EXCURTION, INCLUDING WITHOUT LIMITATION ALL CONSEQUENCES OF RISKS FOR WHICH I/WE HAVE RELEASED THE RELEASED PARTIES IN THE RELEASE. Should any Released Parties incur attorney s fees and costs to enforce this Agreement or the Release, I/we agree to indemnify and reimburse them for such fees and costs. I/we understand that Indemnified Parties are not responsible for changes in carrier schedules, classification of service or accommodations, or costs arising from cancellation of individual activities or the entire excursion, due to causes outside their control, and I/we agree not to bring any claims against Indemnified Parties related to such matters.
