1 Constitution of the College Democrats at Florida Atlantic University Updated: Wednesday, April 23 rd, 2014 Preamble In order to promote a better University, a better Florida, a better United States of America and a better world, with equality, opportunity and freedom for all, we dedicate ourselves to promoting the causes of the Democratic Party. We call for action based on principles and values, and principles and values backed by action. As citizens and leaders tomorrow Democratic vision of the future where the advantaged care for the disadvantaged, where the minority is given, we share a the same rights as the majority and where government sits with the people and not above it. We will strive for a government that ensures every citizen the right to a quality education, a clean environment and the unimpeded opportunity to pursue his or her dreams regardless of race, religion, gender, gender identity, veteran status, age, disability, or sexual orientation. Under these principles and to further these goals of the Democratic Party, we hereby form the College Democrats at Florida Atlantic University. Article I Name of Student Organization The official name of this organization shall be the College Democrats of Florida Atlantic University and shall be referred to, in this constitution, as the College Democrats or the organization. Florida Atlantic University shall be referred to as FAU or the University. Article II -Statement of Purpose Section I -Guiding Principles A. The purpose of the College Democrats will be to enlighten the University and its surrounding communities about the Democratic Party, its political affiliates, constituencies and the ideas to which they adhere. Section II -Objectives A. The objectives of the College Democrats is to strengthen the ties between students & politics, familiarize the university community with the Democratic Party, foster relationships with other organizations on and off campus and to serve as a political and social outlet for our members. Article III -Responsibility The College Democrats shall comply with all FAU policies and procedures as detailed in the Student Rights and Responsibilities, the Student Organization Handbook:, as well as all local, state and federal laws. Article IV -Membership Section 1 -General Membership A. Membership in the College Democrats shall be open to all FAU students who have paid their Student Activity Fee. The College Democrats shall not discriminate on the basis of race, color, sex, handicap, age, sexual orientation or religious practices.

2 B. Associate membership may be extended to interested faculty, administrators, staff members and alumni of the University. Associate members cannot vote or hold office. C. Active members, with voting privileges, of the College Democrats shall be defined as those full or part-time FAU students who have attended at least three (3) general meetings during the entire academic year and who openly unite to promote the purpose and objectives of this organization. D. College Democrats shall be in full compliance with all Federal and State nondiscrimination and equal opportunity laws, orders and regulations. College Democrats shall not discriminate against a Student Officer, member or prospective member on any basis identified in FAU Regulation 5.010, except if specifically exempted by law. College Democrats shall be open to all currently enrolled FAU Students, except if specifically exempted by law. Article V Regulations Section 1 College Democrats will abide by all Federal, State and Local Laws and FAU Regulations and policies, including but not limited to the Student Code of Conduct, Code of Academic Integrity, Regulation 4.006, Alcohol and Drug Policy, and all requirements as outlined in the Student Organization Manual. Section 2 College Democrats agrees to abide by the Florida Anti-Hazing Law in the Student Code of Conduct and the Student Organization Manual. Article VI - Officers Section 1 -Executive Board A. Eligibility Requirements: i. In order to be eligible for officer, candidates must be in compliance with specific requirements a. Maintain a 2.5 cumulative GPA and be registered for 6 credits if an undergraduate, or a 3.0 GPA and 3 credit hours if a Graduate student. b. Officers must be in good academic standing and not on probation. c. Student serving as President must have earned at least 12 college credits d. A student may serve in the same position of office for a maximum of two terms during his/her academic career at FAU, which includes undergraduate, graduate and professional course work. e. Officers must also be compliance with any and all requirements referenced in the Club and Organization Manual, Participation in Campus Activities by Students and Minimum Qualifications for Student Leaders. ii. All Executive Board members shall be elected into their respected offices via the procedures outlined in Article V of this Constitution. B. Positions & Responsibilities: i. President: a. Preside over all general meetings of the organization, all Executive Board meetings, all Central Committee meetings and all special meetings of the organization. b. Confirm all financial transactions with the organization Advisor and Treasurer. c. Protect the welfare of the organization.

3 d. Act as a liaison between the organization and the entities of the FAU and all other organizations independent of the College Democrats. e. Prepare the agenda and business to be conducted at each meeting of the organization. f. Head coordination of all organization meetings and events. g. Delegate authority and responsibilities to the officers and members of the organization, not already defined, as he/she sees necessary. h. Keep the College Democrats website or social media page up to date. ii. Vice President: a. Fulfill all the responsibilities of the President in the event of his/her absence. b. Coordinate and serve as an ex-officio, non-voting member for any and all established committees. c. Assume the Presidency in the event of a vacancy. iii. Treasurer: a. Keep record of the organization's finances. b. Administer the organization's funds upon approval of the President and Advisor. c. Render regular financial reports on request of the President. d. Prepare the annual COSO budget packet request for the following academic year. e. Prepare all banner requisition forms and any other necessary forms needed when ordering and using allotted funds from COSO. f. Keep track of funds in COSO account and in private bank account, if one exists. g. Become fiscally certified by COSO by attending training and passing online test. iv. Secretary: a. Handle all administrative communications and correspondences of the organization. b. Keep the College Democrats website or social media page up to date. c. Keep record of all organization meetings and provide meeting minutes upon request of the President. d. Handle registration of all new members and keep a roster of all active members. e. Send s to members about upcoming meetings and post to social media. f. Prepare flyers for marketing upcoming organization events, weekly meetings and guest speakers. Submit flyers online via OWLlink to COSO office for approval for posting on campus. Also to bring flyers to COSO Clubhouse to have copies made, up to our allotted total for the semester. Keep track of number of copies used. Section 3 - Central Committee A. Eligibility Requirements: i.. The Central Committee shall consist of the four (4) members of the Executive Board and the appointed positions described below. ii.. All Central Committee members shall be active organization members in good standing with FAU. iii.. All appointed Central Committee members shall be appointed by a three-fourths (3/4) vote of the Executive Board. B. Positions and Responsibilities: i. Chief of Staff: a. Assist the President and the Executive Board.

4 b. Co-coordinate all organization meetings and events with the President. c. Serve as ex-officio, non-voting member of the Executive Board. d. Serve as a liaison between the Executive Board and the appointed members of the Central Committee. ii. Outreach Coordinator: a. Serve as chairperson of iii. Public Relations Coordinator: a. Serve as chairperson of the organization's Publicity Committee. b. Fulfill responsibilities of the Publicity Committee, as described in Article VII, Section 2 of this constitution. the organization's Outreach Committee. c. Fulfill responsibilities of the Outreach Committee, as described in Article VII, Section 1 of this constitution. d. Provide committee action report upon request of the Vice- President. r. Provide committee action report upon request of the Vice-President. iv. Sergeant-at-Arms: a. Assist the President and Chief of Staff in preparing meeting and event areas for use. b. Assist the President in presiding over all organization general, special and Central Committee meetings. v. Historian: a. Chronicle the events and activities of the College Democrats b. Keep the organization scrapbook up to date. c. Assist the Secretary in updating the College Democrats website. C. Special Positions: i. The President and Executive Board reserve the right to create any special Central Committee position they deem necessary and appoint an active organization member, in good standing with FAU, to the position. Article VII -Voting, Elections & Appointments Section 1 -Organization Voting Procedures A. Motions and Executive Board Orders: i. Motions: a. Motions must be approved by a majority of the active members present at any general or special meeting. b. Motions may be approved, temporarily, by a majority vote of the Central Committee, pending approval by a majority of active members at the next general or special meeting. ii. Executive Board Orders: a. Executive Board Orders may be enacted by a three-fourths (3/4) vote of the Executive Board and be put into effect for a period no greater than three (3) weeks unless a two thirds (2/3) vote of the Central Committee or a majority of the active members present at any general or special meeting approves the order as a motion.

5 Section 2 - Elections A. Timeline: i.. Nominations for elections will be held at a date set by the current Executive Board, one to two (1-2) weeks prior to the date of the election. Nominations will take place during one of the organizations general meetings. ii.. Elections will be held at a date, set by the current Executive Board, no later than two (2) weeks before the end of each spring semester. Elections will take place during one of the organizations general meetings. B. Procedures: i.. A current member of the Executive Board who is not up for re-election will facilitate the nominations and elections. This member will only vote in the case of a tie. If no such member exists, the elections shall be facilitated by the Advisor. ii.. Only active members of the College Democrats who are in good standing with the Florida Atlantic University may run for election. iii. Nominations will be taken for each position from the general assembly present and will require a second by another active member. iv. Each nominated candidate will be required to make a short speech on the day of the election. v. Voting shall take place by secret ballot on the day of the election. Only active members of the organization in good standing with College Democrats may have vote. All offices shall be determined by a majority vote of the active members present. In the event no one candidate receives a majority, a run-off shall be held between the two candidates with the most votes. C. Terms of Offices: i. Terms of Offices for all Executive Board and Central Committee members shall be one year from their date of installation. ii. Installation shall occur at the last general meeting of the Spring semester. iii. No member shall serve in the same office for more than two terms. iv. Officers can run for re-election for a second term through the normal nomination and election process, but they can only serve two terms. v. No member can hold more than one E-Board positions. No E-Board member can hold an additional appointed position. However members can hold more than one appointed positions if approved by the E-Board. D. Vacancies/Succession: i. If a vacancy occurs in the position of the President, the Vice-President shall assume the position of President, with the Treasurer assuming the position of the Vice President. ii. Vacancies in any other elected office shall be decided by a special election. iii. The Executive Board may appoint an interim officer to vacant elected offices and vote to postpone the special election until the end of the year. All interim officers will serve the remainder of the term or until the E-Board decides to call a special election.

6 Article VIII Advisor Section 1- The advisor of the College Democrats shall be a full-time faculty, administrator, or staff member of the FAU and must be approved by a three fourths (3/4) vote of the Executive Board. Section 2- The advisor will assist and advice the College Democrats in all aspects of the organization and in working with the University while also signing off on paperwork for event registration, annual budgets and club registration. Section 3 - At least one advisor MUST be a full-time faculty, AMP or SP staff member at FAU. Article IX -Meetings Section 1- Regular meetings shall be held weekly on a date to be determined by the Executive Board in accordance with SIL and Student Union reservation policies and procedures. Section 2- Special meetings may be called by the President or by a majority vote of the Executive Board. Section 3 A quorum for any regular meeting or special meeting will consist of a majority vote of the members (50% plus 1) Section 4 Meetings will be informal and facilitated by the Executive Board, however for elections and special meetings involving business, Robert s Rules of Order will be used. Article X -Impeachment Section 1 -Procedures A. Two-thirds (2/3) of active members must sign a petition of impeachment in order for proceedings to begin. B. All active members and the organization Advisor as well as the member undergoing the impeachment proceedings must be notified at least two (2) weeks prior to the impeachment hearing. C. Any impeachment hearing must take place during the academic year. Section 2 -Hearings A. The President shall preside over the impeachment hearing. B. The member undergoing impeachment proceedings may not preside over the hearing. Article XI -Amendments Section 1- Any two members of College Democrats can submit amendments to this club constitution, through a written submission to the Executive Board. Section 2- The Executive Board will then put the amendment on a regular meeting agenda to be discussed and voted on. A two thirds vote is required for the passage of any constitutional amendment. The amendment process will be facilitated by the President and will run using Robert s Rules of Order. Article XII Travel Section 1- In the event that College Democrats participates in any out of state or in state travel, the chapter will comply with all policies regarding travel Section 2- College Democrats will have each member complete the following forms as a condition of membership: 1) Release of Liability Agreement, 2) Student Travel Code of Conduct. These forms must be completed annually by every member. Section 3- Prior to any domestic or international trip, College Democrats, in consultation with the appropriate Student Affairs office or academic department, Office of International Programs (if travelling internationally), and student organization advisor, must host a pre-departure orientation meeting for all travelers.
