3 Itroductio The Motor Idustry Code of Practice for Service ad Repair ( the Code ) defies the promises made by subscribig garages ( subscribers ) i the provisio of service ad repair work to cosumers. The Code sets out stadards that subscribers will comply with regardig: Advertisig The Bookig Process Carryig out the Work Billig Staff Complaits Hadlig Dispute Resolutio ad Discipliary Actio Subscribers are obliged to accept the Code i its etirety ad esure that their staff are aware of their legal resposibilities as well as their resposibilities uder this Code. A cosumer who feels dissatisfied with the service they receive uder ay item covered by this Code is able to submit their grievace to the Cosumer Advice Lie ad Cociliatio Service. A detailed procedure explaiig how to do this appears i the Appedix as do the terms of referece for dispute resolutio ad discipliary actio. The priciples set out i this Code are ot iteded to iterpret, qualify or supplemet the law, ad are ot iteded to be applied to o-cosumer trasactios. This Code has bee developed by the motor idustry to provide a self regulatory regime by which idividual garages ca demostrate their itetio to operate as resposible busiesses ad have i place a cost effective ad speedy dispute resolutio service that cosumers ca readily access i the evet of a disagreemet. 4 Defiitios Throughout the Code: The term subscriber describes a idividual garage that has subscribed to this Code. The term vehicle is take to iclude passeger cars, light ad medium commercial vehicles (where such vehicles are ot used i the course of the cosumer s trade, busiess or professio) ad their derivatives. The term cosumer describes the ower of ay vehicle ad icludes ay vulerable cosumer; for which subscribers will have i place satisfactory provisio for attedig to their eeds. The term vulerable cosumer describes ay cosumer whose circumstaces put them at risk of makig a icorrect or iappropriate decisio, or receive iferior goods or services. The term ew vehicle warraty is take to iclude the maufacturers warraty ad ay extesio provided free with a ew vehicle. The term exteded warraty is take to iclude ay warraty provided with a vehicle that is ot a ew vehicle warraty or ay warraty purchased after the ew vehicle warraty has expired. The term warraty provider describes the admiistrator of the warraty. The term guaratee describes the method(s) of esurig quality of parts ad work. The term estimate is take to mea a approximate cost to complete the work required. The term quotatio is take to mea a statemet of the cost for which the work will be completed. The term subcotracted work describes ay work completed by additioal people to those employed by the subscriber. The term diagostic or exploratory work describes the work carried out i determiig the cause of a problem. The term ivoice meas a ivoice that lists separately with costs agaist each item, the work carried out, parts used, labour, additioal work agreed, evirometal disposal charges ad VAT. The term competet describes demostrated proficiecy i the required skills ad abilities of the job holder. 4
5 Advertisig Our commuicatios will hoestly promote our services What our promise meas to you 1.1 Our advertisemets, promotios or ay other publicatios, whether i writig or otherwise, will ot cotai ay items which are likely to mislead you or be misuderstood. 1.2 Our advertisemets (icludig comparative advertisemets), promotios or ay other publicatios will comply with the requiremets of the relevat legislatio alog with the codes, regulatios ad ruligs of the appropriate orgaisatios or associatios. 1.3 Ay price quoted should be iclusive of VAT where applicable (ad cosumers iformed where ot), ad cover ay additioal charges such as waste disposal ad evirometal chargig. 1.4 The words guaratee or warraty withi ay of our advertisemets will ot be used uless the full terms of that guaratee or warraty are set out clearly withi the advertisemet or are available before you commit to ay work or trasactio. 6 Bookig Our price will be all-iclusive for the work that we agree to udertake What our promise meas to you 2.1 We will provide you with flexibility ad choice regardig dates ad times for bookig ad completio, alog with accurate iformatio ad advice to eable you to choose the work required, which you will be asked to authorise by sigature. 2.2 We will cofirm whether ay additioal or special requiremets you may have are icluded or require additioal work, time ad/or cost prior to agreemet of a completio date ad time. 2.3 We will fully explai ad give you clear practical advice to help you uderstad the work required ad beig offered i order to complete the agreed work, which will be cofirmed i writig if requested. 2.4 The terms uder which we will be chargig for ay diagostic or exploratory work will be cofirmed ad agreed durig the bookig process, as will our cacellatio policy, which will allow you to cacel the repair ad/or service at aytime, subject to your legal liability for ay work doe so far, icludig reasoable labour ad parts costs geerated, which will be kept to a miimum. 2.5 Replaced parts will be made available for you to view ad examie util collectio of the vehicle uless otherwise agreed. You should oly ever remove these from the premises if you have the ability to dispose of them i a evirometally resposible maer. 2.6 Accepted methods of paymet will be cofirmed prior to work commecig. 2.7 All terms ad coditios of busiess will be writte i clear ad itelligible Eglish, promietly displayed withi the premises ad be available upo request. 2.8 Where a estimate is give, this will be supplied as a breakdow of costs to be provided i writig, as a geeral guide to the cost of the work required (which could go up or dow) ad be iclusive of all parts, labour ad VAT where appropriate. If this is ot possible we will cotact you prior to the date of your bookig to re-arrage, i which case you may also exercise your right to cacel the bookig. 3.2 If durig the performace of the agreed work, it becomes apparet that additioal time, labour or parts will be ecessary to address cosequetial/additioal eeds ot previously recogised, we will cotact you to agree prior to commecemet of this additioal work, givig you the opportuity to accept ad agree a ew completio time/date, or declie ad exercise your right to cacel the bookig. 3.3 If your vehicle is dismatled, we will ot compel you to agree to the completio of additioal work. We will always offer a optio of re-assembly withi the origial price, where possible. We will also make you aware of ay operatig ad/or safety implicatios of ot havig this work carried out. 3.4 We udertake to guaratee all service ad repair work agaist failure. We will iform you where parts are provided with a maufacturer s warraty. We will tell you about the duratio of ay warraty or guaratee ad how to exercise it. 3.5 Ay guaratees or warraties provided with parts or labour are i additio to your existig cosumer rights. 3.6 Replaced parts will be made available for you to view ad examie util collectio of the vehicle uless otherwise agreed. If the work is likely to take loger we will cotact you, as stated i We will obtai permissio from the warraty provider prior to startig ay repairs covered by ay warraty, as log as we have bee made aware that the vehicle is covered by a warraty We will promptly ad effectively respod to ay questios you have regardig the completed work ad swiftly ivestigate ay issues with the work. Where possible we will rectify ay issues at o extra cost. 8
9 We would advise you to Clearly otify the subscriber where a vehicle maufacturers warraty period applies, as the vehicle maufacturer will have set certai specific criteria to be observed by the subscriber to maitai the beefit of the warraty. Decide whether or ot to have your vehicle serviced accordig to the vehicle maufacturer s requiremets, i full kowledge of the cosequeces which the subscriber will have explaied to you. Uderstad that you will ot ivalidate a ew vehicle warraty by havig origial spare parts or parts of matchig quality fitted to your vehicle, but that these compoets or cosequetial damage caused by their failure will ot be covered by the ew vehicle warraty. Uderstad that failure to have your vehicle serviced accordig to the maufacturer s servicig schedule may ivalidate ay warraty ad could cause the premature failure of parts. Uderstad that the warraty for origial spare parts or parts of matchig quality other tha those provided by the vehicle maufacturer will be with the parts maufacturer. Be aware that elemets of work required will sometimes be outsourced for aother specialist outlet to perform. The satisfactory coclusio of these tasks will remai our resposibility. 10 Billig Our ivoice will match the bookig price What our promise meas to you 4.1 Our prices will be clear ad iclusive of parts, labour, VAT ad ay other additioal charges, to iclude the cost of disposal ad ay evirometal disposal charges. 4.2 Where a estimate is give, this will be provided as a geeral guide to the cost of the work required ad clearly stated at the time of bookig (see 2.8). 4.3 Where a quotatio is give this will be as a firm, agreed price to complete the agreed work ad will be clearly stated at the time of bookig (see 2.9). 4.4 If durig the performace of the agreed work, it becomes apparet that additioal time, labour or parts will be ecessary to address cosequetial or additioal eeds ot previously recogised, we will cotact you to agree prior to commecemet of the proposed additioal work. 4.5 Uless a fixed price arragemet has bee agreed i advace (e.g. fixed price servicig), fial ivoices will clearly list the work that has bee carried out, idetifyig ay additioal work agreed ad detailig parts used, labour, evirometal disposal charges ad VAT separately. 4.6 All elemets of the service provided, work carried out ad the prices charged will be explaied to you durig the hadover procedure upo completio of the agreed work, at which poit paymet will be due. We would advise you to Check that the ivoice details the work as agreed to be carried out ad that the price meets with that agreed at the time of bookig. If additioal work has bee agreed, esure this is clearly detailed o the fial ivoice. Retai your detailed ivoice to form part of your service history. Proof of servicig will be required i the evet of a warraty claim. 14 Appedix Guidace o Hadlig Complaits The iformatio below ad the flowchart opposite set out the Code s complaits escalatio procedure. Iitial Complait A cosumer, or itermediary who has a complait about a subscriber should, i the first istace, refer the matter verbally to the subscriber s Customer Relatios Represetative. Cosumer Advice Lie The Cosumer Advice Lie will hadle iitial cotacts ito the Code Advisory ad Cociliatio Service ad will provide cosumers with appropriate advice ad assistace. If the vehicle is still with the subscriber or the Cosumer Advice Lie cosiders that a complait is oe that may be resolved quickly by the Fast Track, the Cosumer Advice Lie ca cotact the subscriber i order to discuss the cosumer s complait ad egotiate a resolutio. If the complait caot be resolved via the Fast Track, or the case is ot suitable for referral to the Fast Track, the complait ca be referred to the Cociliatio Service. Cosumers may be asked to provide further iformatio by post or i order for the case to progress. Cociliatio The Cociliatio Service will ivestigate potetial breaches of the Code ad aim to quickly review ad resolve ay dispute with as little disruptio to the cosumer as possible. I certai complex cases it is ot always possible to resolve a dispute quickly, as it ca take some time to gather all the iformatio ecessary to reach a decisio ad a satisfactory outcome. Cosumers will be kept iformed of the progress ad outcome of their cociliatio or arbitratio case ad ay cosequetial discipliary actio take agaist the subscriber. Arbitratio If a case remais uresolved or there is a differece of opiio that caot be satisfactorily addressed through cociliatio, the case ca be referred to idepedet arbitratio. Arbitratio is provided by IDRS Ltd, a experieced dispute resolutio service operator, ad is idepedet of the Code Advisory ad Cociliatio Service or subscribers. The decisio of the Arbitrator is legally bidig upo both parties ad cocludes the complait. There are oly limited circumstaces where a case already cosidered uder the terms of the Arbitratio Act ca the proceed to court. Arbitratio outcomes will be assessed to determie whether ay Code compliace issues have bee raised ad if ay amedmets to the Code are required to address ay specific issues raised by the case. 16 Dispute Resolutio ad Discipliary Actio Complaits, Cosumer Advice, Cociliatio ad Arbitratio Ay verbal complaits will be dealt with immediately by a subscriber s Customer Relatios Represetative. If the complait is ot dealt with immediately, the Customer Relatios Represetative must respod to the complait withi 72 hours. A cosumer who seds a subscriber a letter of complait will receive a iitial reply from the subscriber withi 10 workig days of receipt. Subscribers are obliged to give every assistace to the Code Advisory ad Cociliatio Service ad upo receipt of a complait are required to esure that they take effective ad immediate actio to resolve the complait. If attempts to reach a satisfactory solutio fail, or a verbal complait remais uresolved withi 72 hours, or if ay writte complait to a subscriber remais uresolved after 15 workig days, the complait should be referred to the Code Advisory ad Cociliatio Service. I the first istace cosumers should call the free phoe Cosumer Advice Lie o Or submit their equiry or complait via the Motor Idustry Codes website If the Cosumer Advice Lie advise that a complait will be referred to cociliatio the cosumer may be required to submit further iformatio i writig via the website. All equiries referred to the Code Advisory ad Cociliatio Service withi a reasoable time of the cause for complait arisig will be cosidered. If cociliatio does ot resolve the complait to the satisfactio of the cosumer, subscribers will agree to idepedet arbitratio if the cosumer so wishes. The parties will be required to sig a applicatio for arbitratio ad pay the registratio fee. The Code Advisory ad Cociliatio Service will submit to the Arbitrator all documetary evidece as required. The Arbitrator will advise the parties to submit ay further evidece which it cosiders ecessary. As the arbitratio service is desiged to be low cost to allow it to be accessible, ay hearig will ormally rely o documets oly. Noe of the parties to the dispute may be preset or be represeted by aother perso, uless the Arbitrator decides to coduct a oral arbitratio, i which case parties may atted to preset their evidece. Legal represetatio may oly be employed if the Arbitrator so directs. The Arbitrator has the power to direct ay party to provide ay additioal documet or iformatio cosidered relevat. The award of the Arbitrator will be published i writig to all parties ivolved i the dispute ad is eforceable i the Courts by ay party. 16
17 Discipliary Actio The Idepedet Compliace Assessmet Pael (ICAP), is a idepedet pael which moitors the operatio of the Code ad subscriber compliace. ICAP will also meet to review cases of persistet or serious breaches of the Code by subscribers. ICAP is idepedet of the sector. Its authority over subscribers reflects the serious ature with which o compliace is viewed. It is the resposibility of the Code Admiistrator to ackowledge whe a subscriber has breached the Code i a maer that requires actio beyod cociliatio or arbitratio. ICAP has the authority to istigate a idepedet ivestigatio, with which the subscriber is required to assist fully. Depedig o the outcome of ay ivestigatio, the pael ca impose a varied selectio of sactios o a subscriber, ragig from educatio ad cotiued moitorig, through to writte warigs ad expulsio from the Code scheme. It must be remembered that discipliary actio i this respect is differet to ay idividual case that may be accepted through the cociliatio service. However a umber of similar cociliatio cases regardig the same subscriber could istigate discipliary actio. The outcome of ay ICAP ivestigatio will be published i the Motor Idustry Codes Aual Review, which will be supplied to the Office of Fair Tradig for moitorig purposes. Idividual cosumers will be made aware of the outcome of discipliary actio, istigated as a direct result of their complait.
